Statement of Issue:
The City of Fountain Valley has requested a modification of the Agreement A
previously approved by the City Council.
Recommendation:
Recommend City Council approve the modified Agreement and order it executed
and returned to the City of Fountain Valley for final action.
Analysis:
The City of Fountain Valley considered the Agreement on November 14, 1978.
The Fountain Valley staff pointed out that previous construction of a
similar signalized intersection at Talbert and Newland was divided differ-
ently than indicated in the Agreement forwarded by Huntington Beach. The
City Council of Fountain Valley adopted the proposed Agreement, but con-
ditioned on making changes in the percentages paid by each city. As noted
in their letter, these percentages apply to both construction costs and
maintenance costs.
The precendent previously set is based on the number of "legs" of the inter-
section lying within the boundaries of each city. Although the city bound-
ary is 12' from the west curb face of Newland Street, the percentages of
the "legs" entering are correct at 25%/75% when the number of "legs" alone
is considered.
The Huntington Beach proposal is to construct the intersection after the
acquisition of right-of-way, as part of an AHFP project. The City's actual
cost will be 37.5% of the construction cost as opposed to 75% of the con-
struction costs if it were done as a Gas Tax project without AHFP parti-
cipation.
Alternatives:
City Council may reject the Fountain Valley conditions and request staff to

renegotiate, or return a revised Agreement with different percentages
designated by Council for Fountain Valley's consideration.
Funding Source:
The funding of the City of Huntington Beach share for this project
($30,000) will be obtained from Gas Tax Funds. See attached Gas Tax
Fund listing.

Statement of Issue:
An agreement needs to be approved for the sharing of construction costs and
maintenance costs for a traffic signal at Slater Ave. and Newland Streets.
Recommendation:
City Council authorize the Mayor to execute the proposed agreement and
forward it to the City of Fountain Valley for their review and approval.
Analysis:
The City of Huntington Beach has an AHFP Project for the installation of
street improvements along Slater Avenue between Gothard Street and Newland
Street. That project includes the installation of a traffic signal at the
intersection of Slater and Newland. The installation is of considerable
concern to local residents who have frequently contacted both cities regard-
ing the status of the project.
Traffic conditions create severe congestion at this four-way stop controlled
intersection during heavy traffic periods in the morning and in the afternoon.
Compounding this problem is the presence of an elementary school on Slater
Avenue, one block west of Newland. It has, therefore, been suggested that
the traffic signal installation be done separately (as Phase I) from the road
improvement project (Phase II). This will provide immediate relief for the
traffic flow and permit some additional safety for school children crossing
at the intersection.
The proposed agreement requires sharing between the two cities the cost of
the $60,000 installation on a 50/50 basis.
Alternative Actions:
1. Take no action; let the proposed AHFP project supply the traffic signal
as planned. Forward the agreement to the City of Fountain Valley as
part of the AHFP funding package.

2. Reject the proposed agreement, direct the Department of Public [corks
to prepare a new agreement with such other figures as the Council may
feel appropriate, and resubmit for Council consideration.
Funding Source:
This project will be funded from the Gas Tax account. City Council would
be requested to modify, by resolution, the budgeted Gas Tax allocations
to include this project. The project costs would be shared as follows:

TRAFFIC SIGNAL AGREEMENT
THIS AGREEMENT, made and entered into this 6th day of February ,1979 ,
by and between the City of Fountain Valley, a municipal corporation of the State
of California, hereinafter called FOUNTAIN VALLEY and the City of Huntington
Beach, a municipal corporation of the State of California, hereinafter called
HUNTINGTON BEACH.
W ITNESSETH:
WHEREAS, the intersection of Newland Street and Slater Avenue lies on a
mutual corporate boundary line of HUNTINGTON BEACH and FOUNTAIN VALLEY,
and
WHEREAS, engineering studies indicate that installation of a traffic signal is
warranted at the above -named intersection for improved traffic safety and
efficiency, and
WHEREAS, it is agreed between HUNTINGTON BEACH and FOUNTAIN
VALLEY that installation of the traffic signal would be mutually beneficial and
improve traffic safety in both cities,
NOW, THEREFORE, in consideration of the covenants and conditions herein
contained, the parties hereto agree as follows:
I. HUNTINGTON BEACH shall prepare plans and specifications for the
installation of a traffic system at the intersection of Newland Street and Slater
Avenue.
2. FOUNTAIN VALLEY
shall have the right to
approve such plans.
3. After approval by
FOUNTAIN VALLEY,
HUNTINGTON BEACH shall
advertise for bids, pursuant to California State law.
4. HUNTINGTON BEACH's Department of Public Works shall supervise the
performance of said work.

5. The cost of the installation of the traffic signal system shall be paid by
the parties hereto as follows:

6. FOUNTAIN VALLEY will pay its proportionate share within thirty (30)
days after notice of completion of the construction contract. Said notice of
completion shall be filed in the County Recorder's office of the County of Orange.
7. HUNTINGTON BEACH will require the contractor who receives the bid to
keep an exact accounting of the expenditures on the project.
8. HUNTINGTON BEACH shall not issue any contract change order without
first having obtained approval from FOUNTAIN VALLEY.
9. Upon completion of the installation of the traffic signal system at the
intersection of Newland Street and Slater Avenue, the maintenance of said system
shall be performed by or under the direction of HUNTINGTON BEACH. The cost
of said maintenance shall be proportioned between the parties hereto as follows:

10. Any controversy or claim arising out of or related to this Agreement or
to the interpretation, breach or enforcement thereof shall be submitted to three (3)
arbitrators, one being the Assistant Director, Development, E.M.A., County of
Orange, or an engineer member of his staff, and the remaining two (2) to be
chosen by FOUNTAIN VALLEY and HUNTINGTON BEACH. Any decision made by
the majority of said arbitrators shall be final, binding and not appealable to courts
of low.
