WHEREAS, Company has filed written application with { the Water Department of the City of Huntington Bench f or the i ".xtension of a water main and connection to certaproporty owned by Company , and has constructad the said water main facility, at its own cost and expense, all in conformity with ' the plans and specifications and proviso. ons as approved by the City Engineer and the Water Superintendent of City, and ` WHEREAS, upon completion of said construction and upon acceptance by the City Engineer as being in full conform- ity loith the plans and specifications approved by said Ci-'y Engin©sr and Water Superintendent, shall be dedicated by Co-,.pany to the City of Huntington Beach-, and � r 14MMEAS, under Chapter 35 of zho Huntington Beach Or- dinance Coda, Company shall be sntitled, after such construct- 1. NODE THERk7ORF, in consideration of the premises and agreements herein contained, the parties agree as follows: 1. That upon completion of the construction of the facility hereinafter diiscribed, by the Company, to the full satisfsr.,tion of the City Engineer, and its dedication to the City of Huntington Beach, Cornpany shall be entitled to a re- fund from connection fees received by the City or Huntington Beach for connections made by ethers to said hereinafter de- scribed facility, in accordance with the provisions of Chapter 35 of the Huntington beach Ordinanr:s Code. `Y 2. That the cost to the Company for the construct- ion of said facility, less non --reimbursable e%Denses of in- stallation, is the sum of $10,516.31. z 4. The Grant Deed did not contain an exception as to all oil, gas, minerals, asphaltiun, hrea, and other hydrocarbon substances in and under said land but without the right of entry thereon for exploration or prodnet_1_on thereof. This exception is con- tained in the Grant Dped throLlgh which this Company orig- inally purchased the property. This letter will serve as notice to the City of :Huntington Beach that such an exception exists. If you so desire, we will he happy, to send you a new Grant Deed containing ' the exception.
