Statement of Issue:
There is a need for City Council to approve appointments to the Community Services Commission,
per recommendations by the Ocean View School District.
Financial Impact:
Not applicable.
Recommended Action:
Per the recommendation of the Ocean View School District Board of Trustees, appoint Mark Bixby
as the Ocean View School District Representative for the Community Services Commission to a
term of July 1, 2017 to June 30, 2018.
Alternative Action(s):
Do not approve appointment for the Community Services Commission and direct staff accordingly.
Analysis:
The Huntington Beach Municipal Code, Chapter 2.64.040 states: Each elementary, high school
and public community college district having facilities within the City of Huntington Beach shall have
representatives on the Community Services Commission.
Chapter 2.64.040 states: The City Council shall appoint six members for terms of one year. Each
elementary, high school and public community college district having facilities within the City may
recommend to the Council, on or before the third Monday of June of each year, two or more
persons, residents of the City of Huntington Beach, to represent their district. Once of said persons
shall be appointed by the Council for a one-year term which will terminate on July 1 the following
year. In the event that any district shall not make such recommendations to the Council by the first
day of July, then the Council may appoint some qualified person to a one-year term to represent
such school district on the commission (1113-7/65, 1300-3/67, 2383-7/79, 2389-9/79, 3723-12/05,
3983-1/14)
Staff has received the recommendation from Ocean View School District Board of Trustees to
appoint Mark Bixby.

I'm writing to you today to bring your attention to an appointment that is before you this evening for approval.
As you know, the Ocean View School District Board of Trustees has voted unanimously in favor of sending Mr.
Mark Bixby's name forward as the District's appointee for the Community Services Commission. We anticipate
that the Council will honor our Board's decision by voting to affirm OVSD's recommendation to appoint Mr.
Bixby as we deem him to be the most qualified candidate for the position.
As you are aware, the Community Services Commission (CSC) is primarily a conceptual land use body. The
OVSD Board of Trustees has found that Mr. Bixby is fluent in entitlement level land use matters from his time
served as an HB Planning Commissioner. This gives him a unique perspective to discuss issues that may occur
at the outset of a project/plan before the CSC, which could head off trouble that might occur when brought
before the Planning Commission later.
Mr. Bixby spent the first 23 years of his professional career as a software engineer working for a school district
(Coast CCD) and he has spent the past 10 years of his career working in the private sector developing software
for K-12 school districts. So he is more than qualified in our opinion to advocate for OVSD students and
schools due to his extensive background in education.
All of Mr. Bixby's prior appointments to serve on various boards and/or commissions of the City were voted on
unanimously by the City Council in the affirmative. He has served on the City's Charter Review Commission
(CRC), the Planning Commission (PC), and the Citizens Infrastructure Advisory Board (CIAB). He recently
resigned in July of this year from the CIAB so that he could serve for OVSD on the CSC.
It may be worth noting that Mr. Bixby has served on Planning Commission with 4 out of the current 7 City
Council members (Delgleize, Semeta, Peterson, Posey) and he also served on the Charter Review Commission
with Councilman Brenden.
A majority (5 out of 7) of the current City Council members have direct personal experience with his attention
to detail, always doing required research, and exhibiting responsible decision-making. The OVSD Board of

Trustees is confident that Mr. Bixby will bring all of this wealth of experience to the Community Services
Commission.
You must keep in mind that, per the City Charter, the elected members of the OVSD Board of Trustees, like
other school districts that serve HB's children, is given the discretion to choose whom they would like to
represent their interests with the City. Mr. Bixby is qualified to do this with a long track record of work for
students and schools as well as the residents of Huntington Beach.
I was concerned by calls to my office by Mayor Delgleize that were reported to me by OVSD's executive
assistant. I was informed that the Mayor needed to discuss problems with Mr. Bixby's appointment. Mayor
Delgleize asked to speak with me directly about this matter, was given my phone number, but never called me
to discuss her concerns. I do not know what the mayor's concerns were, but look forward to hearing from her
moving forward.
However,just a few days later I was informed of a coordinated online campaign to the City Council to thwart
Mr. Bixby's appointment. In this discussion were attacks on Mr. Bixby's character, his physical attributes, and
perceived disabilities while focusing on his supposed political affiliation as a"liberal" and a "Democrat".
Several urged readers to write, call, mail, and speak at the Council Meeting tonight in opposition to Mr. Bixby.
Some wrote of revenge that certain City Council Members could take against Mr. Bixby.
I was greatly disturbed and disheartened to read such impudent words and actions directed at Mr. Bixby. I
hoped that those few loud and uncivil voices would not sway a professional City Council such as ours into
discriminating against Mr. Bixby. As you are aware, our job as non-partisan elected officials is to reject outright
partisanship and prejudice toward those who are different from us. We are charged with doing what is best for
the citizenry as a whole, and in this case with this appointment, to do what is in the best interest of our children
and schools.
The seat on the Community Services Commission is not about Mr. Bixby. Since he will be representing
OVSD's interests rather than his own, you can all rest assured that Mr. Bixby will work on behalf of the
children and schools and at the pleasure of the Board of Trustees.
Mr. Bixby will be given a set of issues to discuss when appropriate, such as OVSD's strong advocacy in
protecting HB's open space from unnecessary development, protecting sensitive receptors like children and
schools by keeping our parks and public land free of harmful pesticides and herbicides, and advocating for our
interests as they relate to our pocket parks owned by OVSD, but leased by the City of HB. We have faith in his
ability to perform necessary duties as laid out by the City and we have nominated him unanimously.

Thank you for your consideration concerning this very important matter. As I will be out of the country this
evening and unable to be present at the City Council Meeting, I ask that, if possible, this letter be read aloud in
the Council Chambers during the meeting by the City Clerk and made available to the public at the meeting as it
is a public document per the Brown Act now that all Council Members together have received it and its contents
may be used during deliberations.

Dear Council Members,
I'm extremely concerned with the prospect of Mark Bixby being appointed to the position of
Community Services Commissioner representing the OakView School District. He is a loose
canon, extremely left wing and I have personally witnessed the lengths this man will go to to
undermine his enemies.
Last year months prior to the elections I was part of a secret FB forum that was to
'allegedly' support Gina Clayton-Tarvin but it became a hate fest demeaning her retractors.
Mark personally researched and retrieved personal information of The Chuck Johnson Family
(house was going into foreclosure) and Craig Frampton (past criminal activity) and Chris
Epting (lost his home and some jobs). While I'm not a huge fan of these people or some of the
comments they make on forums but I'm more mortified by Mark Bixby's actions. I have no doubt
that he has also researched me (no criminal activity, lost my home in 2008, painful divorce
and subsequent lawsuit, health issues) as I stated what he was doing months ago on the
Citizens for a Better DT forum and was promptly blocked by him.
I've also heard, but haven't confirmed that Dr. Hansen appointed him as head of the measure R
committee.
Please, please, please reconsider this appointment for the sake of the residents of HB and
OakView.

this evening of our Ocean View School District Board of Trustee's unanimous selection of resident Mark Bixby
for our Community Services Commission.
As a 55-year resident within the OVSD, I fully support Mr. Bixby as our appointee due to his extensive
knowledge and experience in land-use issues. Even though Mr. Bixby and. I do not agree on a variety of issues. I
believe it's imperative to choose the greatest minds over the loudest voices. In relation to Mr. Bixby's
"`watchdog" tendencies (or anyone of us for that matter), please keep in mind that when leaning in your favor,
there are celebrations in the. streets. Thanks to each of you for your dedication to our town. It's appreciated, very
much.

Description: Please vote No on the Bixby appointment. He has spent a lot of time and energy in negative campaigning. It appears
his targets are personal In nature and not ideological. In my opinion he is self centered and has an agenda not
qy supportive of the city or the council. Please don't support this nomination.
