Statement of Issue: Over time, the role of some of the Citizen Commissions, Boards, and
Committees has evolved. This is also true of some of the City Council Committees. This
request amends the respective documents for some of the Commissions, Boards, and
Committees to reflect this evolution.

Recommended Action: Motion to:
1. Approve Resolution 2009-42 , A Resolution of the City Council of the City of
Huntington Beach Dissolving the Board of Appeals.
2. Adopt Ordinance 3839 An Ordinance of the City of Huntington Beach Amending
Chapter 2. -'02, 2.107, and 2.111 of the Huntington Beach Municipal Code relating to
Duties and Powers of the Environmental Board, the Historic Resources Board and the
Public Works Commission.
3. Authorize the Elimination of the Green Committee and transfer responsibility for the
city's Green Initiative to the Environmental Board.

Alternative Action(s):
Do not take some or all of the above recommended actions and direct staff accordingly.
Analysis:
In an effort effort to identify ways we might streamline our system of advisory bodies and
assure that efforts by the City Council, the committee members, and staff are the most
productive use of everyone's time, the Mayor asked the Intergovernmental Relations
Committee to review the citizen and City Council advisory bodies. At its February 23 and
March 23 meetings, the Intergovernmental Relations Committee considered potential
changes to the citizen advisory bodies and the City Council committees. From their review,
as well as input from staff, the Committee developed a list of potential changes.
At the May 18 City Council Study Session, the Council reviewed the recommendation from
the Intergovernmental Relations Committee and took comments from staff and some of the
impacted citizen advisory body members. As a result of this input and a series of straw votes
at the study session, staff was asked to return with the appropriate documents and minute
actions to make the needed changes to the Citizen Commissions, Boards, and Committees
and the City Council Committees.
Based on that input, staff has prepared a number of recommendations for City Council
Consideration. If approved the recommended actions would:
• Formally Eliminate the Board of Appeals
• Eliminate Green Committee and give their responsibilities to the Environmental Board
• Change staff support to the Environmental Board from the Planning Department staff
to the Energy Project Manager
• Change staffing responsibility for the Historic Resources Board from Community
Services to Planning.
• Formally establish the Southeast Area Committee as a standing City Council
Committee
• Eliminate the Water Quality Committee and assign their responsibilities to the Public
Works Commission

An ordinance will be brought to the City Council at a later date to implement the
recommendation to change the make-up of the Design Review Board by eliminating the
voting staff member and assigning a representative of the Historic Resources Board as a
voting member. The ordinance will first be taken to the Planning Commission for their
review.
Please also note that staff will be bringing an action to the City Council in the near future to
revise the Municipal Code to change the name of the Environmental Board to the
Sustainability Board.

RESOLUTION NO. 2009-42
A RESOLUTION OF THE CITY COUNCIL,OF THE
CITY OF HUNTINGTON BEACH DISSOLVING THE BOARD OF APPEALS
WHEREAS, in 1966, the City Council adopted Resolution No. 2331 which created
among other things a Board of Appeals in conjunction with adoption of a Uniform Building
Code; and
The Uniform Building Code adopted in 1966, gave the City Council the right to order a
building or structure demolished in the event the building was determined to be unsafe; and
A Board of Appeals was established to permit building owners an opportunity to contest
the City's decision to demolish,
NOW, THEREFORE,the City Council of the City of Huntington Beach does hereby
resolve as follows:
The Board of Appeals established by Resolution no_ 2331 no longer serves a purpose for
the City and is hereby dissolved.

CHAPTERS 2.102, 2.107 AND 2.111 OF THE HUNTINGTON BEACH
MUNICIPAL CODE RELATING TO DUTIES AND POWERS OF THE

SECTION 1. Chapter 2.102 of the Huntington Beach Municipal Code is hereby

2.102.010 Established. There is hereby created for the City of Huntington Beach the
Huntington Beach Sustainability Committee hereinafter referred to as the Sustainability
Committee.
2.102.020 Composition. The<Sustainability Committee shall consist of not more than
nine voting members, all app¢inted by the City Council. All members shall be residents
of the City of Huntington Beach, and over one-half of the members shall be registered
voters of the City of Huntington Beach. All members shall serve without compensation,
and none shall hold any office or employment in the city government.
The members shall serve a term of four years. Members shall have a term starting July 1
and expiring June 30,end present members shall continue in office until June 30 of the
year of expiration of�erm. Each member shall serve his term until his successor is
qualified and a.. / ed. If vacancies shall occur otherwise than by expiration of term,
they shall be filled�by appointments for the unexpired portion of the term.

2.102.030 Removal of members. Any member of the Sustainability Committee,
including the chairperson, shall be subject to removal by motion of the City Council
adopted by at ast four affirmative votes. The membership of any member of the
Sustainability Committee shall be vacated if such member absents himself from three
consecutive egular meetings of the Sustainability Committee, unless by permission of
such Sustai ability Committee, or ceases to continue to comply with the requirements of
new mem rs as to residence and/or voter registration.

2.102.040 Advisers and assistants to Sustainability Committee. The Sustainability
Committee may request the city staff to provide information, and subject to approval of
the City Administrator, such assistance as may be helpful and desirable to effectuatethe
purposes of the Sustainability Committee. The Sustainability Committee may have as
many ex-officio members,without the power to vote, as may be appointed by the City
Council. The Sustainability Committee may make investigations and employ persons,
subject to the approval of the City Council, as it may deem necessary to perform its
duties and functions.
2.102.050 Powers and duties generally. The Sustainability Committee shall be
empowered and have the duty to:
(a) Study the environment of the City of Huntington Beach and investigate all actual and
potential threats to a clean environment for the City and its inhabitants; and
(b) Report to the City Council, and to other city boards, commissions, departments and
officers its recommendations for legislation and other action that could or might
curtail or limit those activities which appear to be an actual present threat, or which
may become a potential threat in the future, to the assurance of a clean, healthy,
desirable environment for the City and its inhabitants; and
(c) Advise the City Council and staff on sustainability challenges and opportunities to
enhance the overall sustainability,economic, ecological and social environments of
Huntington Beach; and
(d) Perform such other duties as may from time to time be properly assigned or delegated
to it by the City Council.
2.102.060 Bylaws. The committee may establish bylaws, and amendments thereto,
subject to prior submission to and approval by the City Council.
SECTION 2. Chapter 2.107 (titled Historic Resources Board) of the Huntington Beach
Municipal Code is hereby amended as`to Sections 2.107.050 and 2.107.080 as follows:
2.107.050 Secretary. The Director of Planning, or his designee, shall serve as secretary to the
board without the power to vote, and shall keep permanent minutes of the board meetings.
Newly Revised Roberts' Rules of�Order(current edition) shall govern the procedure of the
meetings of the board unless inconsistent with other provisions of this chapter.
Section 2.107.080 is hereby deleted in its entirety.
SECTION 3. Chapter 2.111 (titled Public Works Commission) of the Huntington Beach
Municipal Code is hereby/amended as to Section 2.111.030 by adding subsection(in) as follows:
2.111.030 Duties. The duties of the Public Works Commission shall be as provided

(3) Traffic control device permits issued by Public Works staff. T AX E N
(c) Recommend to the City Council capital improvement projects which exceed;
$50,000.00 and may review capital project repairs exceeding $50,000.00. ,
(d) Review and recommend to the City Council all capital improvements project
construction change orders exceeding the authorized change order limit for the
project.
(e) Receive regular reports of the active capital improvement projects.
(f) Conduct an annual review and performance audit of the Sewer Service Fund.
(g) Recommend to the City Council on an annual basis any,:fees, rates and/or charges
proposed to be modified or added to the sewer service user charge.
(h) Have the power and be required to hear for final decision appeals following sewer
service user charge adjustment and/or exemption decisions made by the Director of
Public Works.
(i) Acting in the capacity of the Citizens Infrastructure Advisory Board,conduct an
annual review and performance audit of the.Infrastructure Fund and report its findings
to the City Council prior to the City Council's adoption of the ensuing fiscal year
budget.
Q) Pursuant to California Vehicle Code §,21950.5, or its successor statute,the Public
Works Commission shall conduct public meetings as necessary to consider the
removal of a marked crosswalk or crosswalks on public streets; and based upon the
results of such meetings, direct City staff, by motion, to either retain the marked
crosswalk(s) or take any necessary steps for removal of the marked crosswalk(s).
Any person who disagrees with,the decision of the Public Works Commission may,in
writing,no later than 10 days after the date of such decision, appeal the decision to
the City Council. Such appeal shall be filed with the City Clerk. If a timely appeal is
filed, the City Clerk shall cause the matter to be set for hearing before the City
Council within 30 days. The City Clerk shall give the appellant at least 10 days'
written notice of the time and place of the City Council hearing. After hearing the
appeal, the City Counci.I may affirm, overrule or modify the decision of the Public
Works Commission. The decision of the City Council shall be final. If the Public
Works Commission's decision is to direct City staff to take the necessary steps to
remove a marked crosswalk(s), and, further, if a timely appeal is filed, the decision of
the Public Works Commission shall be stayed until the City Council has decided the
appeal. If the decision of the City Council directs removal of a marked crosswalk(s),
such removal shall not occur until at least 30 days after the City Council's decision.
(k) Have the power and be required to hear for final decision, appeals following street
work construction permit decisions made by the Director of Public Works.
(1) Have the,power and be required to consider application of a fee adjustment of the Fair
Share `traffic Impact Fee if the development project does not have a discretionary

development permit. The Commission shall consider the application within sixty(60)
days after the fee application is deemed complete by the Director of Public Works.
(m)Work to protect water quality in the channels of Huntington Harbour.
SECTION. 4. All other provisions of Chapters 2.102, 2.107 and 2.111 not amended
hereby remain in full force and effect.
SECTION 5. This ordinance shall become effective 30 days after its adoption.

2.111.010 Commission established. There is hereby established a Public Works Commission
in and for the City of Huntington Beach which shall be known as the Public Works Commission
of the City of Huntington Beach. The authority to create a Public Works Commission is derived

2.111.020 Non-interference. Except as otherwise provided in this Chapter as may be amended

2.111.060 Appointment and composition. All members shall serve without compensation,may
hold no other office or employment in City Government, and no other employment which is
incompatible with Commission Service. Each City Council member shall appoint one member
of the Commission to serve the same term as the City Council member. The term shall coincide
with the term of the\City Council member making the appointment. The first two terms expiring
shall be appointed by\the two first term City Council members. Thereafter, selection shall be
made upon expiration of terms, and shall be by lot drawn among the remaining Council

The City Council of the City of Huntington Beach does hereby qrd'ain as follows:
SECTION 1. Chapter 2.102 (titled Environmental Board) of"the Huntington Beach
Municipal Code is hereby amended by adding a new subsection to&ction 2.102.050, as follows:
2.102.050 Powers and duties generally. The Environmental:Aoard shall be empowered
and have the duty to:

(a) Study the environment of the City of Huntington Beaq.h and investigate all actual and
potential threats to a clean environment for the City and its inhabitants, and (2385-7/79,

(b) Report to the City Council, and to other city board`s, commissions, departments and
officers its recommendations for legislation androther action that could or might
curtail or limit those activities which appear tAe an actual present threat, or which
may become a potential threat in the future,to the assurance of a clean, healthy,

SECTION 2. Chapter 2.1 7 (titled Historic Resources Board)of the Huntington Beach
Municipal Code is hereby amended as to Sections 2.107.050 and 2.107.080 as follows:
2.107.050 Secretary. The Director of Planning, or his designee, shall serve as secretary to the
board without the power to vote, and shall keep permanent minutes of the board meetings.
Newly Revised Roberts' Roles of Order(current edition) shall govern the procedure of the
meetings of the board unliss inconsistent with other provisions of this chapter. (3083-12/90)

2.102.010 Established. There is hereby created for the City/of Huntington Beach the
Huntington Beach Environmental Board hereinafter referred/to as the Environmental Board.

2.102.020 Composition. The Environmental Board shall consist of not more than nine voting
members, all appointed by the City Council. All members shall be residents of the City of
Huntington Beach, and over one-half of the members,shall be registered voters of the City of
Huntington Beach. All members shall serve without7compensation, and none shall hold any office
or employment in the city government. //
The members shall serve a term of four years. Members shall have a term starting July 1 and
expiring June 30, and present members shall continue in office until June 30 of the year of
expiration of term. Each member shall serve-his term until his successor is qualified and
appointed. If vacancies shall occur otherwise than by expiration of term, they shall be filled by

2.102.030 removal of members. Any ember of the Environmental Board, including the
chairperson, shall be subject to remova by motion of the City Council adopted by at least four

Board, unless by permission of such nvironmental Board, or ceases to continue to comply with

2.111.050 Members./The Public Works Commission shall consist of seven(7)members who
shall be residents of the City of Huntington Beach and shall not be officers or employees of the
city and no member of the commission may have any interest in any contract with the city either

Description: As the Chair in 1970 of the first Environmental Council (the Environmental
Board predecessor) I am unhappy seeing your proposal to rename and
downgrade that body. "Environment" is a word that everyone--man, woman and
child-- understands. "Sustainability" is a very new term that many people have
never heard of, nor do they stop to think about what all it implies. It is certainly
important, but is only a part of what the body should be focusing on.
And downgrading from a "Board" to a "Committee" does not seem to me to be
the way to get the attention of the City Council and the community for action to
improve the quality of life in Huntington Beach and beyond. I do hope that there
will still be a Planning Department staff member who will work with the
'Committee' as well as someone in Public Works who can advise on the newer
energy issues as well.
The ordinance (with your 8/17/09 agenda) does not indicate whether the
'Committee' will meet once a year or once a month. There should be some
direction from City Council on that so that there is on-going review and advice
for the very important aspect that has created such a good environment for our
Huntington Beach community.

My name is Joseph D. Santiago and I am currently a Member and Past Chair of the
Historic Resources Board.
I and my fellow Members of the Historic Resources Board have been made aware
that changes are afoot for the Board, but not of the specifics. We have been looking
forward to our transition to the Planning Department for a few months now.
However, few if any of us knew much of the details presented in Draft Ordinance
3839, even from the old versions from'05, '90, and '87. In five years of service,this
weekend was my first look at any version of it(a curious omission from the City's
website), only via a non-Board related associate.
I would like to inquire as to why the section 2.107.080, proposed to be removed
entirely, is on the chopping block. It seems a function we should keep at least in
some form; baby out with the bath water, etc. Voting is tonight Monday 8/17/09 but
I'm sure there must be a mechanism to amend at the last minute.
I also find it curious that the HRB (those in the trenches)wouldn't have some input
before this goes before Council for final adoption.
Please consider the retention of section 2.107.080 in some form or delay passage of
Ordinance 3839 to allow time for review and practical input by the Historic
Resources Board.
I know many of my concerns are also shared by fellow Board Members.

Dear City Administrator, Council Members and City Attorney,
Today I was made aware of some changes being made in the Draft Ordinance
3839. As current Chair of the Historic Resources Board, I am concerned about the
complete elimination of section 2.107.080 dealing with Acceptance of Gifts. In
reading over the Legislative Draft, it seems that the deletion of this section
contradicts 2.107.060(a)that states that part of our job as an advisory Board is the
"studying, interpreting and reporting to City Council on historic issues and
activities appropriate to the City". In speaking for the Historic Resources Board as
its Chair,I feel that it would be inappropriate to completely eliminate section
2.107.080. I especially feel that it is appropriate to retain the sentence stating that
"Historic structures surveys, collection management policies and documentation
on historic artifacts will be reviewed by the Board".
I would strongly recommend that the City Council consider voting for the
retention of some form of section 2.107.080 .
