Clause 2 of the agreement calls for the City to submit plan,,; and specifications
and expenditure list to Director F�I-A for written approval prior to disbursement
of funds. Section I of said Clause 2 also require.i evidence be submitted of
City's "reasonable efforts to instire—against future destrucl-ton or damage."
Once we have received the Information and it is approved as set forth in the
agreement, we will make the necessary arrangemeriLs w1th the County Auditor/
Controller for disbursement of the funds.

CITY OF HUNTINGTON BEACH
on motion of Supervisor Wlieder, duly seconded and unanimously
carrie'd, the -Clerk of the Board, on behalf of the Board of Supervisors,
Is authorized to execute the agreement dated November 22, 1983, between
the Orange County Harbors, Beaches and Parks District and the City of
Huntington Beach to provide funding assistance for pier restoration in
the amount of $200,000.
IN RE: AUTHORIZATION TO COIRIENCE LEGAL ACTION REIMBURSEMENT FOR

On motion of Supervisor Wieder, duly seconded and unani"llously
carried, the County Counsel is authorized to initiate 'legal action for
reimbursement of the amount due the County for medical services for

the amount of $2,637.48.

STATEMENt.1'6F'.I'SSUE
.The.County's Harbors, Beaches & Parks Commission is recommending to the
Bbard of su'pervisors that the City receive a grant of $200,000 to assist
in the restoration of the municipal pier which was damaged in storms for
the last three years.
RECOMMENDED ACTION:
Approve the attached agreement between the City and the County for funding
of pier repairs and authorize the Mayor and City Clerk to execute the
agreement.
ANALYSIS:
In 1981, the boat landing ramp on the municipal pier was severely damaged
in a violen4- storm. This boat landing ramp was used in rescue efforts
and also served commercial fishing boats in the past. In 1983, the sea-
ward end of the pier suffered considerable damage in a series of storms.
Because of the extensive repairs necessary and the high costs involved,
the City Council authorized a request to the County for financial assistance
to repziir the pier.
This matter was considered by the County's Harbors, Beaches & Parks Com-
mission at their June, 1983 meeting and they approved a recommendation to
the Board of Supervisors that the City be qranted $75,000 to assist in
repairing the pier. At their August meeting, the Commission approved an
additional grant of $125,000 to rentore the boat landing ramp on the pier.
The attached agreement covers the total $200,000 grant and must be approved
and executed by the City before it is considered and approved by the County
Board of Supervisors.

12 WHEREAS, CITY proposes to repair and improve coastal access pier damaged
13 in recent- severe winter storms (hereinafter referred to as 'PROJECT*); and
14 W-HERF-AS, this Board desires to provide and retain regional recreation
15 Opp-,rtunities for all of Orange County; and
16 WHEPEAS, said coastal access pie.- Is a structure located over and upon
17 navigable waters and provides important regional recreation opportunities fo.- all
18 residents of Orance County and others in the recion; and

WHEREAS, CITY will assume "Lead Agency" status within the context of the
Fnviro=e"ntal Quality Act of 1970, an amended, and will comply with environmental
requirements and filing including General Plan conformity.
WHEREAS, 6ISTRICT's Board has conducted required public hearing pursuant
to State of Ca'lifornia Harbor and Navigation Code and has declared repair and
improvement of piev as an authorized project of the DISTRICT.
NOWt THEREFORE, IT IS AGREED as follows:
1. PROJECT shall include funding assistance for the repair and
improvement of sa'id pie'r, specifically as relates to'damages sustained during the
per . iod January 1981 through Merch 1983. Rep&irs and improvements for V'11.'ch
DISTRICT funds may be spent shall include only such darmages as set fortl- In this
paragraph and such structural improvements recommended or reqnired by a public
agency or other licensed engineer under contract and Intended to strengthen the
basic integrity of the pier. Documentation of said ntruct-azal irprovement
reccmm.endations or require=ents shall be made available to DIRECTOR upon requent.
2. CITY:
a. Shall provide the necessary public agency approvals and permits
and nhall accomplish all permits and contract administration in connection with
PROJECT at no cost to DISTRICT.
b. Shall complete PPOJECT within two (2) yeai:s of date of execution
of this agreement, as evidenced by contract notice of completion executed by the
City Cotincil of CITY, with copy provided to County.
c. Shall cause to be prepared plans and specificatiens for PRDJECT,
an�' shall provide to DIRECTOR MMA a detailed cost breakdown and schedule for expen-
diture of DISTRICT funds as related to said plans and specifications. Schedult
shall provide evidenct, that DISTRIM' funds will only be utilizel for actupl con-

state and local laws.
9. Shall operate and maintain PROJECT or cause PROJECT to be
maintained at'no experise 'to DISILTUCT for 'Che benefit I of CITY and COUIM, residents
and shall not discriminate as to fees, hours of use, or any other PROJECT use or
privileges based upon race, colcr, religion, political persuasion or residence.
h. Shall operate and maintain PROJECT in a safe and clean manner for
a minimum period of twenty-five (25) years co.-rencing with the submittal of the
Notice of Completion to COMMY. Failure o.111 CITY to do so shall obligzte CIT'i to
repay DISTRICT all funds contributed to PROJECT by DISMICT.
The CITY shall te excused frow this provision if Its performance
is made impossible by: Act of God, war, civil Insurrection, fire, flood, storm or
by any law, regulation, or lawful order or action of any federal, state or county
agency, or by any other catine beyond the control of the CITY.
i. CITY shall rake reasonable efforlas to insure said pier against
future destrliction or damage;
1) by obtaining casualty insurance to the extent available in
the marketplace and at costs comparable to similar Insurance
policies, oc
2) iraple-menting such structural irmprovements as may be reco=ended
or required by a public agency or other licensed engineer
under contract, and which will strengthen the basic integrity
of the pier.
