REEKSTIN, Administrative Services Director SUBJECT: ADOPT RESOLUTION NO .2cOO ` 71' MODIFYING THE HUNTINGTON BEACH FIREFIGHTER'S ASSOCIATION MEMORANDUM OF UNDERSTANDING TO ALLOW RATE ADJUSTMENT FOR LEVEL II ARSON INVESTIGATORS Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s) Statement of Issue: Should the Level II Arson Investigator pay rate be adjusted above Level I Investigators to reflect the Level ll's experience, education, and responsibilities? Funding Source: No increase in Fire Department budget for Fiscal Year 1999/00. The current budget can accommodate the salary adjustment. Ongoing General Fund expenditures to support salary adjustments would be $2747. Recommended Action: MOTION TO Adopt Resolution No.;�040 -7/ , A Resolution Adopting a Side Letter to the MOU between the City of Huntington Beach and the Huntington Beach Firefighter's Association Regarding Pay Rate for Level 11 Arson Investigators, with Side Letter attached to place said rate 22 ranges above the Fire Protection Specialist. Alternative Action(s): Deny a Level II pay adjustment Analysis: The pay rates for both Level I and Level II Investigators were established in 1990. In 1990, the Level I Investigator responsibilities were removed from the duties of the non -suppression Fire Protection Specialist and transferred to fire suppression personnel, establishing a standard hourly salary rate percentage below that of a Level II Investigator. The Level I Investigator was an assigned position, independent of rank and included duties of fire cause and origin, engine company backup, witness interviews, and assisting the more experienced Level II Investigators as required. The Level I Investigator was a specialty position and assignment was made generally after regular duty hours, as the need for fire investigation would arise. REQUEST FOR COUNCIL ACTION MEETING DATE: July 17, 2000 DEPARTMENT ID NUMBER: FD 00-007 Analysis (continued): The Level II Investigator is an assigned position and is also independent of rank. The Level II Investigator requires extensive training, experience, education, and responsibilities above the Level I Investigator in arson investigation including hazardous materials, internal affairs, fire deaths, witness interviews, and criminal and civil expert court appearances After the September 8, 1999, Huntington Beach Firefighter's Association (HBFA) Memorandum of Understanding (MOU) was signed, the Level I Investigator responsibilities became part of the job description for the Fire Protection Specialist and the pay rate for Level I significantly increased above that of the Level II Investigator. The Level II Investigator responsibilities still remain independent of the person's rank responsibilities with no salary rate changes. In effect, signing the September 8, 1999 HBFA MOU resulted in a significant reduction in percent salary rate difference for Level I and Level II Investigators. In situations involving off duty hour callouts, the Level I Investigator would exceed the Level II hourly salary rate by 38%. Staff recommends the pay rate be adjusted to reflect the Level II Investigator education, training, experience, and responsibilities. This proposal, if approved, would use the Fire Protection Specialist 40-hour rate as the base and provide a percent differential between Level I and Level II Investigators. If approved, Level II Investigator salary rate would be adjusted 22 ranges above the Fire Protection Specialist salary rate, when temporarily assigned. Environmental Status: Not applicable. BETWEEN THE CITY OF HUNTINGTON BEACH AND THE HUNTINGTON BEACH FIREFIGHTER'S ASSOCIATION REGARDING PAY RATE FOR LEVEL II ARSON INVESTIGATORS WHEREAS, the Memorandum of Understanding between the City of Huntington Beach and the Huntington Beach Firefighter's Association, dated October 18, 1999, and adopted by Resolution No. 99-92 (the "M.O.U.") continues to remain in effect; and The City Council of the City of Huntington Beach desires to modify the M.O.U., regarding pay rate for Level II Arson Investigators, to place said rate 22 ranges above Fire Protection Sepcialist, NOW, THEREFORE, the City Council of the City of Huntington Beach resolves as follows: 1. The Side Letter dated July 17, 2000, to the M.O.U., a copy of which is attached hereto as Exhibit "A" and incorporated by this referenced as though fully set forth hereirf, is hereby approved and ordered implemented in accordance with the terms and conditions thereof. The Side Letter will remain in effect until the salary adjustment is included in a future Huntington Beach Firefighters Association Memorandum of Understanding (HBFA MOU). Pay Rate Prior to September 8, 1999 HBFA MOU The Level I Investigators were paid at the 56-hour time and one-half rate at Firefighter Paramedic "E" Step. The Level II Investigators were paid at the 56-hour time and one-half rate at Fire Captain "E" Step, or approximately 11 % above the Level I. Current Pay Rate After the September 8, 1999 HBFA MOU was signed, the salary rate for the Level Investigator increased based on the Fire Protection Specialist salary rate on -duty, and time and one-half, off -duty. The Level II Investigator responsibilities still remain independent of the person's rank and the salary rate remained at the 56-hour time and one-half Fire Captain "E" Step on- and off -duty. Proposed Rate Adjustment for Level 11 Investigator Effective January 8, 2000 the HBFA MOU reduced the difference between the Level I and Level II Investigator salary rate significantly. The Level I Investigator responsibilities became part of the job description for the Fire Protection Specialist. The salary rate for level 1 Investigator exceeded that of the Level II. The proposed salary rate adjustment would reflect the Level II's education, experience and responsibilities above that of the Level I Investigator. Additionally, the Level II adjusted salary rate (per hour) would bring the percentage differential back in line with the original salary rates used to attract and maintain personnel to the Level 11 Investigator's position. No. 2000-71 Rick Fee, President Huntington Beach Firefighters Association July 17, 2000 Page 2 Proposed MOU Language If approved, the Level II Investigator's salary rate would be adjusted 11 % resulting in the following assigned salary adjustments: • Fire Protection Specialists assigned to a 56-hour suppression work schedule, regardless of the suppression rank, while on duty and temporarily reassigned to Level I responsibilities would be compensated at the Fire Protection Specialist 56-hour salary rate, for each hour temporarily assigned. ® Fire Personnel assigned to a 40-hour non -suppression work schedule, while on duty and temporarily reassigned as a Level 11 Investigator, would be compensated 22 ranges above a Fire Protection Specialist for each hour temporarily reassigned. ® Fire Suppression personnel, off duty and temporarily assigned as Level II Investigator, would be compensated 22 ranges above Fire Protection Specialist rate at the time and one half rate. ® Fire Suppression personnel, while on duty and temporarily reassigned to level 11 Investigator, would be compensated 22 ranges above Fire Protection Specialist rate at a 56-hour rate for each hour temporarily reassigned.
