Funding Source: NA Recommended Action: Motion to: Adopt Ordinance No. 3760 an Ordinance of the City of Huntington Beach Amending the Huntington Beach Municipal Code by Amending Chapter 2.106 Relating to the Fourth of July Board. Alternative Action(s): 1. Do not adopt the ordinance to amend HBMC Chapter 2.106, and advise staff accordingly. 2. Approve the ordinance with the exception that the membership of the 4th of July Executive Board be set at eleven members as originally directed by City Council on October 18, 2006. Analysis: At its October 18 meeting, City Council approved a revised structure for the 4th of July Executive Board. This included expanding the number of board members, and modifying the method of board selection. For the past 10 years, each Council member has had an individual appointment on the board, for a total of seven board members. Over the past two years, the board has been in transition, and there has been a problem in recruiting and retaining members. In 2006, only C' — -), 4 REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 12/18/2006 DEPARTMENT ID NUMBER: CS06-026 four of the seven seats were filled by the day of the event. Prior to 1996, the board had consisted of more than seven members, with membership reaching up to 15 members. This allowed for a greater distribution of workload and a larger pool of board members who could assist in training new members. At its October 18 meeting, Council voted to increase the board to eleven members. However, the Council liaisons are recommending that the board membership be a range, from nine to fifteen members to allow for greater flexibility. This recommendation has been included in the proposed ordinance (Attachment 1). The proposed ordinance also redefines the method of board selection from individual Council appointments to recommendations for appointment made by the Council liaisons to the board, with final approval by the entire Council. This is necessary if the board is expanded. Term limits have been eliminated. Advisory boards have eight year term limits. This board is not advisory and the members' years of experience are a real asset in carrying out the mission of conducting the annual 4th of July Celebration. A Chair and Vice Chair would be appointed by the Council liaisons on an annual basis. Recommendations for removal of a board member would also be made by the Council liaisons. As a result of the actions of the Council, and subsequent advertisement of 4th of July Executive Board vacancies, several qualified candidates are being recommended for appointment on the December 18 agenda. That Section 2.106.020 of the Huntington Beach Municipal Code is hereby amended to read as follows: 2.106.020 Composition. The Board shall consist of nine to fifteen members, appointed by Council upon the recommendation of the liaisons to the Board. All members of the Board shall be residents and electors of the City of Huntington Beach. Council liaisons shall possess the power to remove appointees to the Board at any time and without cause, and appoint new Board members subject to the approval of City Council. The Board will establish committees with committee chairs as necessary to implement the Fourth of July activities. SECTION 2. That Section 2.106.070 of the Huntington Beach Municipal Code is hereby amended to read as follows: 2.106.070 Officers. The Officers of the Board shall be a Chair and Vice Chair. City Council shall appoint the Chair and Vice Chair on an annual basis based upon the recommendations of the Council liaisons and the Board. SECTION 3. That Section 2.106.090 of the Huntington Beach Municipal Code is hereby amended to read as follows: 2.106.090 Duties of Executive Board Members. Regular attendance at meetings is required to enable the Board to discharge its duties. Any member absent from three (3) consecutive meetings without securing the consent of the Chair, or the designee of the Chair, shall be deemed to have resigned from the Board. The Chair shall notify the Council liaisons of such resignation and request the Council liaisons to appoint a new member. All members are encouraged to attend regular Board meetings so their knowledge and expertise may be utilized to the fullest and they can keep abreast of the Board's plans and activities. SECTION 5.
