STATEMENT OF ISSUE:
The developer of the shipping center at the northeast corner of Goldenwest
and ;earner has requested a reimbursement agreement for the proposed median
-pnstruction or. Warner Avenue. He is' responsibla .for 50% of the construc-
-ion cost and the City is responsible for the other 50%
RECOMIENDATION:
Execute the reimburs,ment agreement for the median island construction
and. authorize payment to Huntington..Beach Associates of ,California in the
amount of $12,774.55 from the median island construction. fund.. ,
ANALYSTS

WHEREAS, CITY required DEVELOPER as a condition. of . Use
Permit No. 81-46 to , pay 50% of the cost, of construction of

Upor completion of work by DEVELOPER and payment of all
casts of labor and materials, CITY will reimburse DEVELOPER a sum

1. CONSTRUO ON
DEVELOPER will construct improvements at a total cost
of twenty-fine thousand, five hundred forty-nine doll rs am ten
cents ($25,549. 10) on Warner Avenue east of- Goldez.west Street.
Attached hereto and incorporated by reference as Exhibit "All is a
map of,the area on which improvements are to be constructed.
2. IMPROVEMENTS
The improvements to be constructed shall be as, shown on
Use Permit No. 81-46, and the construction shall be done and
performed in accordance with the plans, specifications and
prof i les which have been approved by and are on file with the
Director of Public Works and shall be completed prior to any
reimbursement and accepted by Ube CITY. Construction shall be
performed under a Public Norks contract approved by CITY.
3 DEDICATION
DEVELOPER will dedicate improvements to CITY.
u. REFUND
The maximUm reimbursement to be paid to DEVELOPER under
this agreement is twelve thousand, seven hundred seventy-five
dollars ($12,775.00)
Reimbursement shall not exceed fifty percent (50%) of
construction; costs.
51 COMPLETION 'OF PROJECT
CITY shall not be required to make reimbursement until
completion of all improvements required by Use Perra .t No. 81-46.
