Dear Mr.Carchio:
The Fair Political Practices Commission("FPPC").enforces the provisions of the Political
Reform Act ("Act").' Under separate letter we advised you that we recently received a
complaint against you alleging that you have violated the personal financial effects provisions of
the Act.
A public official has a financial interest in a decision within the meaning of section
87100 if it is reasonably foreseeable that the decision will have a material financial effect,
distinguishable from its effect on the public generally, on the official, or on a member of his or
her immediate family. (Section 87103.) Specifically, regulation 18705.5(a) states a reasonably
foreseeable financial effect on a public official's, or his or her immediate family's personal
finances is material if it is at least$250 in any 12-month period. Furthermore, subdivision(b) of
this regulation goes on to state that the financial effects of a decision which affects only the
salary, per diem, or reimbursement for expenses the public official or a member of his or her
immediate family receives from a federal, state,or local government agency shall not be deemed
material, unless the decision is to (in part) appoint, or hire the public official or his or her
immediate family.
a According to information provided with the complaint, you allegedly violated this
provision when you voted to appoint yourself to the Orange County Sanitation District and the
Orange County Vector Control Board during the December 20, 2010 City Council meeting.
In order to properly evaluate the complaint, any explanations.and/or advice you may have
received from legal counsel regarding your participation in that decision must be sent to my
attention and received by our office postmarked no later than December 30,2011.

The Fair Political Practices Commission ("FPPC")enforces the provisions:of the Political
Reform Act ("Act"),"found in Government Code section.81000, et seq. This letter is in response.
to a sworn,complaint filed against you that alleged you violated the personal finance effects
provision of the Act. We are closing this matter with a warning letter.
The FPPC has completed its investigation of the facts in this case. An official has a
financial interest in a decision within the meaning of section 87100 if it is reasonably
foreseeable that the decision will have a material financial effect,distinguishable from its effect
on the public generally,on the official, or a member of his or her immediate family. Specifically,
the FPPC found that you violated section 87100 when you voted to appoint yourself to outside
boards and/or commissions in which it was reasonably foreseeable that the decision would
affect your personal finances.
For purposes of disqualification under sections 87100 and 87103, an official has an
economic interest in his or her personal finances and those of his or her immediate family. A
governmental decision will have an effect on this economic interest if the decision will result in
the personal expenses, income,assets,or liabilities of the official or his or her immediate family
increasing or decreasing. (Regulation 18703.5.) Furthermore, regulation 18705.5 states a
reasonably foreseeable effect on an official's or his or her immediate family's personal finances
are material if it is at least$250 in any 12-month period. "The financial effects of a decision

significant amount, and the fact that you do not have an enforcement history,we are closing
this matter with a warning letter.
This letter serves as a written warning. The information in this matter will be retained
and may be considered should an enforcement action become necessary based on newly
discovered information or future conduct. Failure to comply with the provisions of the Act in
the future will result in monetary penalties of up to$5,000 for each violation.
A warning letter is an FPPC case resolution without administrative prosecution or fine.
However,the warning letter resolution does not provide you with the opportunity for a
probable cause hearing or hearing before an Administrative Law Judge or the Fair Political
Practices Commission. If you wish to avail yourself of these proceedings by requesting that
your case proceed with prosecution rather than a warning, please notify us within ten (10) days
from the date of this letter. Upon this notification,the FPPC will rescind this warning letter and
proceed with administrative prosecution of this case. if we do not receive such notification,
this warning letter will be posted on the FPPC's website ten (10)days from the date of this
letter.

SUBJECT: Reapprove City Council Appointments to Outside Boards
Statement of Issue: The City of Huntington Beach is in receipt of information regarding an
enhanced requirement for the method of appointments of City Council members to outside
boards that provide a stipend and/or salary. Based upon recent interpretation of conflict of
interest laws by the Fair Political Practices Commission (FPPC), it is prudent to reapprove
existing Council appointments.
Financial Impact: Not applicable.
Recommended Action: Motion to:
A) Reapprove the appointment of Mayor Carchio to the Orange County Sanitation District
(OCSD), the Orange County Vector Control District (OCVCD), the Public Cable Television
Authority (PCTA), and the West Orange County Water Board (WOCWB); and,
B) Reapprove the appointment of Councilmember Harper to the Orange County Sanitation

Analysis: On or about November 7, 2011, the City became aware of an enhanced
requirement for the method of appointments of City Council members to outside boards that
provide a stipend and/or salary. In the past, the City Council has taken a single vote with all
Council participating to approve the appointment of Council Members to serve on various
boards. This practice is common amongst local jurisdictions and has been done without
challenge. Nonetheless, in an effort to comply with a new interpretation of the conflict of
interest laws by the FPPC, the City Council is hereby requested to re-approve appointments
to outside boards that include stipends.
Attached is a list of current members that represent the City on outside boards (an arrow in
the left margin indicates boards for which compensation is provided). Staff recommends that
Items A-D be voted on separately, and that the individual Council Member being considered
for an appointment, as either a representative or alternate, recuse himself by announcing his
economic conflict of interest, and then leave the dais during said vote. In the future, all
appointments which receive a stipend or salary will be placed on the City Council meeting
agenda to be voted on separately for each office and not by unanimous consent.
