STATEMENT OF ISSUE;
The lease with the Huntington Beach Employment and 'Training Administration
for space at 520 Pecan expired January 31, 1979, and has been continued
on a monthly basis
RECOMMENDATION:
Approve the new lease.
ANALYSIS:
The ,Huntington Beach Employment and Training Administration would like to
continue its lease of 1294 square feet at 520 Pecan. The new agreement' is
written on a month to month basis so that if the buildings are to be
demolished for the proposed seniors housing project, the lease may be
cancelled with. 30 days notice.
A31 other terms are the same. This office space is used for landscape
maintenance classes., and, as part of the program, students spend a portion...
of the time working in City parks. The rental rate is se4 at $0.25 per
square �(t)t in cash and $0.06 per square foot as a labor contribution,
totalling $0.31 per square foot as required by resolution.

THIS LEASE is made and entered into this 21st day of -
March, 1979, by and between the CITY'OF HUNTINGTON BEACH, a
munJ.cipal corporation, hereinafter referred to as ItCITY,11
and HUNTINGTON BEACH EMPLOYMENT AND TRAINING ADMINISTRATION,
hereinafter referred to as "LES.SEE.'"
W I T N E S S E T H:
WHEREAS, CITY owns certain improved real property
located in the vicinity of Main and Pecan Streets in the City
of Huntington Beach, said property formerly used for city hall
purposes; and
Said property is not presently needed for CITY purposes
and CITY desires to lease said property;
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
AND PROMISES OF THE PARTIES HERETO, IT IS HEREBY c by and
between them as follows
1. DESCRIPTION OF PREMISES:
CITY hereby leases to LESSEE, on the terms and conditions
set forth herein, a portion of the premises formerly ased for
city hall purposes, specifically described as follows: One
Thousarid Five Hundred Ninety -Seven square feet on the second
floor at 505 Pecan Street, huntington Beach, California, all of

2. TERM:
The term of this lease shall be month -to -month com-
mencing March 21, 1979•
3 RENT
The rent shall be payable on or before the 10th day of
each month, at the rate of $383.28 per month. Rent delinquent
for ten (10) days will be assessed'a 10% penalty.
4 MAINTENANCE:
CITY shall maintain the exterior of the structure, in-
cluding the grounds of the leased premises, and LESSEE sha_i.
maintain the interior of the leased premises. If LESSEE fails
to maintain the interior of the leased premises, CITY may, at
its option, perform necessary maintenance and bill, LESSEE for
the cost of the service rendered. LESSEE shall reimburse CITY
for the cost of the services within ten (10) days after receipt
of billing.
5. INDEivINIFY, DEFEND, SAVE HARMLESS:
During the term of this lease, LESSEE agrees to indemnify
and defend and save CITY harmless From any and all claims aris-
ing from any act, omission or negligence of LESSEE or its con-
tractors, sublessees, licensees, agents, servants, or employees
arising from any :,accident; injury, or damage whatsoever causpd
to any person or property occurring In, on, or about the lensed
premises, and ,from and against all costs, expenses and liabilities
incurred in or in connection with any such claim or proceeding
brought thereon. LESSEE shall'. obtain for the entire term of this

Single Limit Bodily Injury and/or Property Damage including
Products Liability of Three Hundred Thousand Dollars ($300io0o)
Said insurance shall include the City Council, all city--ap--
pointed groups, committees, boards .and 'commissions, and all,
elective and appointive officers, servants or employees of CITY
as named additional Ansureds under such policy. LESSEE shall
provide CITY with a certificate of insurance on P form approved
and provided by CITY. Such insurance shall be primary to any
insurance CITY has an e'fect
6 ALTERATIONS
During the term of this lease, LESSEE shall not make any
alterations to the leased premises without the written consent
of CITY.
7. UTILITIES
CITY agrees to pay all utility bills applicable to the
leasF-d premises during the term of the lease, except telephone
service shall be separately charged to and the sole responsibility
of LESSEE,
8. ASSIGNMENT, RE --ENTRY:
LESSEE shall not assign the lease or sublet the premises
except with the written permission of CITY, and. CITY expressly
reserves the right of re-entry for any violation: of this section,
or other condition of the lease.
9. INSPECTION:
CITY reserves the right to enter and (aspect the premises

10t EXISTING LAWS
LESSEE shall not permit any acts to be done on the leased
premises which are in violation of any laws or ordinances.
11. CONDITION OF PREMISES:
LESSEE hereby accepts the premises in their present con-

12. TAXES:
LESSEE shall pay any taxes assessed on its_per-sonal prop-
erty located in the leased premises, and shall pay, if assessed,
an aliquot portion of any possessory interest taxes on the

13. TERMINATION NOTICE
Either party may terminate this le&se by giving thirty (3O)
days written notice to the other party.
14. PARKING:
LESSEE shall have the right of reasonable access to off-
street parking included with the leased premises:
15. JANITORIAL SERVICES: CREDIT: REDUCTION OF '7NTS:
The monthly rent for the premises is calculated at $0.31
square feet to be paid as follows: cash rent at .$0.24 square
foot, payment in kind of $0.07 square foot. The in -kind pay-
ment shall be in the foi,m of janitorial suplilies and services
to be furnished to the premises by LESSEE. The cash sum shown
in paragraph 3, "RENT," reflects this adjustment and reduction
of rents and is the cash amount payable to CITY each month

LEASE AGREEMENT

CITY, and HUNTINGTON BEACH EMPLOYMENT & TRAINING ADMINISTRATION,
hereinafter referred to as LESSEE

Huntington Beach, said property formerly used for City Hall pur-
poses; and
Said property is not presently needed for CITY purposes

NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
AND PROMISES OF THE PARTIES HERETO, IT IS HEREBY AGREED by

1. CITY hereby leases to LESSEE, on the terms and con-
ditions set forth herein, a portion of the premises formerly
used for City Hall purposes, specifically described as follows:

520 Pecan Street, all of which said premises are set forth in
the plan marked Exhibit A and attached hereto and incorporated

2. The terms of this lease -shall be month -toy -.month,
commencing on February 1, 1979•
3. The rent shall be calculated at the rate of 31� per
square foot per month, such rate to be comprised of a cash con-
tribution of 25� per square foot and a donation of labor to CITY
valued at 6� per square foot. The rent shall be payable on or
before the loth day of each month at the rate o-P $323.50 per
month. All rer.f, not paid within ten (10) days of due date shall
include ,a 10 percent penalty,
4. CITY shall maintain the exterior of the structure,
including the grounds of the leased premises, and LESSEE shall
maintain the interior of the leased premises. If LESSEE fails
to maintain the interior of the leased premises, CIT.Z may, at
its option, perform necessary maintenance and bill LESSEE fo-!<

the cost of the services within ten (10) days after receipt of
billing.
5. Luring the term of this lease, LESSEE agrees to
indemnify and defend and save CITY harmless from any and all
claims arising from any act, omission or negligence of LESSEE or
its contractors, sublessees, licensees, agents, servants, or em-
ployees arising from any accident, injury, or damage whatsoever

caused to any person or property occurring in, on, or about the
leased premises, and from and against all costs, expenses and

proceeding brought thereon.. LESSEE shall obtain for the entire
term of this lease, minimum insurance liability limits as fol-
lows: combined single limit bodily injury and/or propertV I --=age-

city -appointed groups, committees, boards and commmissions, and
all elective and appointive officers, servants or employees of
CITY as named additional insureds under such policy. LESSEE

6. During the term of this lease, LESSEE shall not

RECOKMENDATION
Approve the attached agreement.
ANALYSIS:
The new agreement is written on_a month to month basis for space at
520 Pecan, so that if the City pursues alternative, developments oii the site
the lease may be cancelled with 3(, days _notice.
Resolution 4535 ret,,.fires a rental rate of $0.31 per square foot, but this
figure was to include the City's costs for janitorial services. I•Iowever,
the Huntington Beach ETA will be providing its own janitorial services.
The agreement, therefore, requires the tenant to pay $0.27 in cash pera
square foot, and payment in kind of $0.04 per square foot by providing
its own janitorial services.
FUNDING SOURCE:
No funds are necessary.

STATEMENT OF ISSUE:
The existing lease with the Huntingto Be/a Em ent and Training
Administration for space at the Old C vic CeD r expired March 20, 19.79.
RECOWBNDATION
Approvr, the attached agreement.
ANALYSIS:
The new agreement is written on a month to month basisforspace at
505 Pecan, so that if the City pursues alternative developments on the
site, the lease may be cancelled with 30 days notice.
Resolution 4535 requires a rental rate of $0.31 per square foot, but
this figure was to include the,City's costs for janitorial services. 'The
City has been unable to provide janitorial service to this building,
however, and the Huntington Beach ETA has been providing its own
janitorial services. The agreement, therefore, requires the tenant to
pay $0,24 in cash per square foot, and payment in kind of $0,07 per square
,foot by providing its own janitorial services,

at 505 Pecan. The lease is for a period of one year but it can be
canceled by either party with thirty days notice. There will,
therefore, be no difficulty in canceling the lease if plans for low
cost senior housing move forward and require eviction of the current
tenants

LEASE AGREEMENT
THIS LEASE is made and entered into this 31st day of
January, 1978,_ by and betweentheCITY OF HUNTINGTON BEACH,
a municipal corporation, hereinafter referred to as "CITY,"
and HUNTINGTON BEACH EMPLUZMENT & TRAINING ADMINISTRATION,
hereinafter referred to as "LESSEE."
W I T N E S S E T H:
WHEREAS, CITY owns certain improved real property located
in the vicinity of Main, and _ Pecan Streets in the city of
Huntington Beach, said property wac formerly used for city hall
purposes; and
Said property is not presently needed for CITY purposes and
CITY desires to lease said property,
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
AND PROMISES OF THE PARTIES HERETO, IT IS HEREBY AGREED by and
between them as follows:
1. CITY hereby leases to LESSEE on the terms and conditions
set forth herein, a portion of the premises formerly used for
city hall purposes, specifically described as follows: 1,294
square feet on the southeast side of the building at 520 Pecan
Street, all of which said premises are set forth in the plan
marked Exhibit "A" attached hereto and incorporated herein by
reference
/ps 1.
2. The terms of this lease shall be for a period ofone
year, commencing on February 1, 1978.
3. The rent shall be calculated at the rate of P0.31 per
square foot per month, such rate to be comprised of a c �h con-
tribution of $0.25 per square foot and a donation of lab r to
CITY valued at ,$0.06 per square foot. Total cash payable to CITY
shall be the sum of $3,882 per year, payable on or before the
loth day of each month at the rate of $323 50 per month. All rent
not paid within ten (10) days of due date shall include a'10 percent
penalty,
4 CITY shall maintain the exterior of the structure, in-
cluding the grounds of the leased premises, and LESSEE shall
maintain the interior of the leased premises. If LESSEE fails
to maintain the interior of the leased premises, CITY may, at
its option, perform necessary maintenance and bill LESSEE for the
cost of the service rendered. LESSEE shall reimburse CITY for
the cost of the services within ten (10) days after receipt of
billing.
5. During the term of this lease, LESSEE agrees to indemnify
and defend and save CITY harmless from any and all claims arising'
from any act, omission or negligence of LESSEE or its contractors,
sublessees, licensees, agents, servants, or employees arising
from any accident, injury, or damage whatsoever caused to any
person or property occurring in, on, or about the leased premises,.
and from and against all costs, expenses and liabilities in-
curred in or in connection with any such claim or proceeding
brought thereon. LESSEE shall obtain for the entire term of this
lease, minimum insurance liability limits as follows: Combined.

Single Limit Bodily Injury and/or Property Damage including Pro-
ducts Liability of Three Hundred Thousand Dollars ($300,000).
Said insuranceshall include the City Council, all City -appointed
groups, committees, boards and commissions, and all elective and
appointive officers, servants or employees of CITY as named addi-
tional insureds under such policy. LESSEE shall provide CITY
with a certificate of insurance on a form approved and provided
by CITY. Such insurance shall be primary to any insurance CITY
has in effect.
6 During the term of this lease, LESSEE shall not make
any alterations to the leased premises without the written con
seit of CITY.
7. CITY agrees to pay all utility bills applicable to the
leased premises- during the term of the lease, except 'telephone
service shall be separately charged.to and the sole responsibility
of LESSEE.
8. LESSEE shall not assign the lease or sublet the premises
except with the written permission of CITY, and CITY expressly
reserves the right of re-entry for any violation of this section,
or other condition of the lease.
9.- CITY reserves the right to enter and inspect the pre-
mises at all reasonable times. ;
10 LESSEE shall not permit any acts to be done on the
leased premises which are in violation of any laws or ordinances.
11. LESSEE hereby accepts the premises in their present
condition and hereby waives any claim against CITY for the pre-
sent condition or the future condition of the leased premises.

12. LESSEE shall pay any taxes assessed on its personal
property located in the based premises, and shall pay, if
assessed, an a? quot portion of any possessory interest taxes
on the premises.
13. Either party may terminate this lease by giving thirty
(30) days, written notice to the other party.
14 LESSEE shall have the right of reasonable access of
off-street parking included with the leased premises.
15. CITY sl-iall provide basic janitorial services during
the term of said lease.
IN WITNESS WHEREOF, the parties hereto have caused this lease

The Huntington Beach Employment and Training Administration wishes
to rent the space it formerly occupied at 20 Pecan to train
landscape maintenance workers. Students in the program will spend
a portion of their timeina formal classroom and the remainder
of their time working in City parks under the supervision of the
parks maintenance crews. The rental rate set by Resolution 4535
is $0.31 per square foot per ..ionth.
RECOMMENDED ACTION
Rent the space to to Huntington Beach Employment and Training
Administration at the rate of $0.31 per square foot, to be paid
for by a cash contribution of $0.25 per square foot and a labor
contribution to be valued at $0.06 per square foot.
ANALYSIS
The Huntington Beach Employment and Training Administration, in
conjunction with Coastline Community College, will be offering
training in landscape maintenance. As part of the program, the
students will spend, a portion of their time working in City parks
Sine we have six new parks coming on line this year and no
additional park maintenance workers, this training program will
Offer a tremendous benefit to the City in terms of ;::uch needed
labor at no additional cost:
