Funding Source: Funds for purchase of the decontamination unit are provided by the Department of Justice, Weapons of Mass Destruction Grant. There is no cost for the use or storage by Huntington Beach Hospital. There are no City funds required for this purchase. Recommended Action: MOTION TO: Approve and authorize the Mayor and City Clerk to execute the attached Agreement between the City of Huntington Beach and Huntington Beach Hospital for the Use and Storage of the City's Portable Decontamination -Unit. Alternative Action(s): Do not approve the Agreement. Analysis: As a part of the Department of Justice Weapons of Mass Destruction (WMD) Grant, which was awarded during FY 2000/01, the City is proposing to purchase a portable decontamination unit. This unit would benefit emergency response personnel and hospital staff by being made available at Huntington Beach Hospital in the event of a weapons of mass destruction incident. This equipment would be operated by City and hospital staff. It would also maximize the City's ability to transport patients to the closest hospital. The decontamination unit consists of portable PVC pipe framing and tent materials and when set up includes three decontamination stalls. It weighs approximately 200 pounds and can be used to decontaminate up to 50 people per hour. Under the terms of the attached agreement the decontamination unit would be stored by Huntington Beach Hospital and be utilized for patients entering the facility during a WMD incident. It would also be used to train hospital staff in decontamination procedures. The tota cost of the unit is $7,500. This purchase is funded by the WMD Grant and was approved by the Department of Justice. This private/public partnership for the use and storage of the decontamination unit is encouraged in the grant process. For these reasons, staff is recommending that the agreement between the City of Huntington Beach and Huntington Beach Hospital for the use and storage of the City's decontamination unit be approved. RECITALS A. CITY desires to provide a portable decontamination unit belonging to CITY to HOSPITAL for use and storage by HOSPITAL personnel so as to maximize CITY's ability to transport patients to the closest hospital in the event of an emergency and prevent needless shutdown of HOSPITAL should a contaminated patient enter the facility; B. HOSPITAL desires to use the decontamination unit of CITY to treat and segregate contaminated patients. AGREEMENT TERM The term of this contract and of this Agreement shall be for one (1) year and shall commence upon the execution of the Agreement. Unless CITY notifies HOSPITAL at least ninety (90) days before this Agreement expires, this Agreement shall automatically renew for another one (1) year period and continue for like period each year until canceled by either party. 2. COVERED SERVICES CITY agrees to provide one "Sure Clean VI" decontaminator unit to HOSPITAL free of charge. HOSPITAL shall store and maintain the unit in clean, workable condition and shall properly train its employees in its use. Further, HOSPITAL shall employ the unit for patient 03 agreelhospitall1 /9103 0 0 decontamination in accordance with any relevant manufacturer's instructions on the use on an as needed basis or upon request from CITY. These services shall be provided at no cost to CITY. HOSPITAL agrees to accept and provide for the secure custody, care, and safekeeping of CITY's decontamination unit in accordance with state and local law, standards, policies, procedures, and orders applicable to the operation of the. unit. CITY shall notify HOSPITAL and HOSPITAL shall notify CITY as soon as possible of all emergency medical cases requiring the use of CITY's decontamination unit. INDEMINIFICATION AND HOLD HARMLESS HOSPITAL shall protect, defend, indemnify and hold harmless CITY, its officers, officials, employees and agents from and against any and all liability, loss damage, expenses, costs (including without limitation costs and fees of litigation of every nature) arising out of or in connection with the negligent performance of this Agreement or its failure to comply with any of its obligations contained in this Agreement, except such loss or damage which was caused by the sole negligence or willful misconduct of the CITY. 4. ATTOXNEY'S FEES In the event suit is brought by either party to enforce the terms and provisions of this agreement or to secure the performance hereof, each party shall bear its own attorney's fees. 6.
