of Magnolia fftveet to Magnalia Street, then north on Yagnolia to a
point 500 feet north Gil Hamilton .Avenue in conjunction with the develop-
ment of a school site at the northeast corner of Magnolia Street aiad

WHEREAS, the School. District .s, at its o= coot and expense,

construc;.ing said work all in confo7mi.ty with the plans, specifications �
and provisions as approved by the Director of Public Works-- and

NOW, ISEM'ORE, in convideration of th, premises and the agreements
herein contrix-ed; the parties agree as follows:
1. That upon comrletion of the work, or portioxss thereof herein

from drainage fees collected for service by this facility.
7. If additional users participate in drainage faciliti,.4 in
draitiage area No. 7E and ?H in the future, ;he drainage fees they pay
will be distributed to these individuals or -�ntitips, that have previc)%Iely
coat%ibuted to the cost of the drain, in proportion to the cost borne bir
each such 1ndividua2 or entity.
8. City shall not be :Liable for payment of refund, t,r reason if its
failure to collect or receive from any person, or entity the drainage
fee. However, City agrees from an administrative, legislative or qua-...,.
jukii.cial procedure to protect the ".nterest Jz the Lchool District, either
individuals or antities, who have prei.Lously constructed drainage
facil.a.t7 eti by the collecting of the drainage fees, either prior to or
concurrent with the approval of any final mays within the drainage area
if a developer, who ?a within the drazrage area, is required, as a
condition to the app_oval of a tentative or a V nal mats to construct
drainage fafAlities within the drainage area, City may allow said developer
credit towards the per acreage fee consirtent with this said agreement;
City further agrees to furn1sh a copy of this agreement to the developer
of any properties in the drainage area.

legal pmoceedinge to protect the interest of the School, D.istricfi, but
may do so.
