SCHOOL DISTRICT
WITNESSETH:
WHEREAS, the School District has agreed to participate in the construction
of the Newland Storm Drain. Pump Station in conjunction with the development
of a school site at the northeast corner of Magnolia Street and Hamilton Avenue
in drainage a ~ea No. 7E and 7111; arid,
WHME' AS, the School District is, at its own cost and expense participating
in the construction of said work all in conformity with the plans, specifica-
tions and provisions as approved b"F the Director of Public Works; and,
WFM?EAS I construction of said work shall be in conformity to an applicable
chapter of the Huntington Beach Ordinance Code; and,
WHEREAS, School District is entitled to reimbursement for the work performed
following the conctructic"a of there works, said reimluursement to be made as
agreed herein..
NOW, THEREFORE, in consideration of the premises and the agreements
herein contained, the parties agree as follows:
I. That upon completion of the -lark, or portions thereof herein described,
to the full eatisZaction of the Director of Public Works and ,on its being

accepted by the City of Hunt=gton Beach, School District shall be envbitled
to reimbursement for drainage fees paid at the time of development of lands
tributar,T to t:is storm dran, more specifically, r:.•t not, limited to drainage
fees bared on Area 7E and 7H at the rate of. $650/acre x 50.08 for the pump

station facilities. (Refer to Exhi,bit "A" attached hereto for area served
and Exhibit "C" attached hereto for determination of acreage fee.)
2. That the facility in which the Scb;,ol District will participate in
the cost of in crainage area No. 7E and 71Y for which refunds are hereby
agreed to be paid is as follows:
Newland Street .Storm Drain Pump Station and 96-inch diameter
pipe fro the pump station to Hamilton Avenue.
3. That the cost to School District to dote for construction of this
facility is estimated to be as follows:
Newland Pump Station crastruction = 56.07 x $250,000 = $98,995.80
4. That the School District at the request of and in the best interest
of the City is to participate in the cost of ,the construction of this facility
sized to City requirements, and for which the City has agrees'. to participate
in the amount of NONE.
5. That the refund to be paid the �.dh.00l District under this agreement
is as follows:

Net Refundable = $66,443.80
6. That refund shall be made by the Clerk of -he City of Huntington
Beams` upon certificationbythe Direc;or of Public Works, to the School District
as the work progresses to the extent that funds are available from drainage
fees collected for service by this facility.
7, if additional users participate to drainage facilities in drainage
area No. 7E and ?H in the future, the drainage fees they pay will be distributed
to these individuals or entities, that have prev.ously contributed to the
cost of the pump station in proportion to the cosh borne by each such individual
or entity.

8i. City shall not be liable for payment ofr`efund by reason if its
failure to collect or receive from any person or entity the drainage fee.
However, City agrees from an, administrative, legislative or quasi judicial
procedure to protect the i.bterest of School District either individuals or
entities, who have previously constructed drainage facilities, by the collect-
ing of the d-^ainage fees, either prior to or coixurrent with the approval of
any final maps within the drainage area, if a developer, who is within the
drainage area, is required, as a condition to the approval of a tentative or
a final map to construct drainage facilities within the draainage area, City
may allow said developer credit towards the per acreage foe consistent with
this said agreement; City further agrees to furnish a copy of this agreement
to the developer of any properties in the drainage area.
9. in the event City must construct additional drainage facilities
withixi this drainage area to allow further development within the area to
proceed, City may use funds available from dratnage fees collected within
Drainage Arp,' No. 7E and T1 for construction of the additional drainage
facilities prior to fvlfiling the herein stated reimbursement.
10. It is understood that the City is not required to institute legal
proceedings to protect the interns- of. the School District, but may do so.
11. It is also understood that .Security Fore Corporation, the copartici
pant in cost of construction of the Newland Pump Station will br reimbursed
for their proportional cost simultaneously with reimbuvsemen.t due the School.
District. %aiu reimbursement to Security Fore wi 11 be, as outlined in
Reimbursement Agreement No. 143.

Gentlemen:
Huntington Beach Union High School District contributed
to the construction of the subject pump station. Fees in
the amount of $14,086.34 have been collected from developers
and said sum is refundable to the developer per the conditions
of thq agreement. The balance remaining on this agreement
will then be $48,992.59.
It is �*equested that sum be reimbursed and the check
be made payable to Huntington Beach Union High School District.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF
MONEY FROM THE DRAINAGE DISTRICT 7E FUND
WHEREAS, the City Council of the City of Huntington Beach
has adopted a budget for the fiscal year 1.972-1973 by Resolution
No 3503 and
Section 5 of said Resolution No. 3503 specifies ti::., pro-
cedure For au�horizing expenditures from the several special.
Funds mentioned in said. Section 5; and
The Directoh of Finanpe and the City Administrator have
recommended an expenditure; and
The City Council iereby apprcves said recommendation,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of huntington Beach that an expenditure in the sum of
Fourteen Thouswznd Eighty-six Dollars and Thirty --four Cents
($1 11, 036i . 34) is' hereby authortzed to bs made fr nm the Drainage
Distrdet 7E fund, ;paid :hum to be made payable to the Huntington
