We have reviewed your offer and choose not to accept. This letter shall serve as a lease termination notice and a thirty (30) days notice to vacate. As you are aware the provision of your current lease agreement, dated September 13, 1977, Article 4, Termination, states "The obligations under this agreement are to be from month to month, commencing upon execution of this lease, and continuing until one of the parties gives the other thirty (30) days' written notice terminating the tenancy. " The City requests that you follow all terms concerning termination and deliver possession of the premises in entirety on or before April 20, 2013. The City plans to fence the property on April 22, 2013 or soon thereafter, and any remaining items will be removed at the tenant's expense. Based upon a quick field visit, it seems evident that Shorecliffs stillretains use of the City -owned land for the storage of recreational vehicles. I do not, at this time, know whether they have been paying the City on the lease or not. I recommend that you retain this file in the active status until such time as the Real Estate Division completes the following action steps' • Request from and receive a survey from Public Works indicating the amount of land in use by Shorecliffs. • Request a financial record from Accounts Receivable of the payment history. • Communicate with Shorecliffs and inquire whether it is their desire to enter into a new lease with the City that will conform to our current requirements for such uses. If Shorecliffs no longer desires such a lease, than a mutual termination and site restoration would be required' prior to committing this information to inactive status. Real Estate will further solidify the City's disposition on this Agreement in the next few months. Thank you for being this issue to our attention. Is this Lease Agreement an active agreement? If so, the City Clerk's Office needs an up to date insurance certificate. Also, Page No. 2 of the Lease Agreement is missing. Do you have a copy of Page No. 2 or should I write to Huntington Shorecliffs and request a copy of the page? The Lease Agreement stipulates a-$5 per month nominal fee for lease of the property. Is that fee being collected and up to date? RECOMMENDED ACTION; It is recommended thatthe City Council approve the lease agreement prepared by the City Attorney and 'authorize the Mayor to execute it on behalf of the City. ANALYSIS:` Some months ago Mr, Ed Heathf manager of the Huntington Shored.Uffks: Mobile Home Park contacted the City Engineer as to the procedure involvedin leasing a triangular shaped parcel of City -owned land located northerly of and adjacent to the Mobile Home Park. Following numerous field trips and meetings with Mr. Heathf a lease agreement was prepared, This agreement has been executed by the Huntington Shorecliff's Adult Mobile Home Park. The land proposed for lease is triangular -in shape( 12f400 square feet in area and is located immediately adjacent to Frankfort Ave, at the southwest `.corner of the intersection of Beach Blvd. with Frankfort Avenue.. During recent years the City has expended'funds. removing weeds from this land. If this lease is approved the main- tenance will become the responsibility: of Huntington Shoredl ff ks,. This parcel of land might be of some use to the City when and if major modifications are made to the existing intersection of Beach Blvd. at Indianapolis Avenue and FrankfortStreet, ALTERNATIVES: If the Council chooses not to lease this City owned landf .it will simply remain "as is" in our annual weed maintenance program FUNDING SOURCE: There is no expenditure of funds involved in this transaction, The City will receive a nominal rent :of $500 ;per month from the lessee., through the term of the lease.
