MEEK CONSTRUCTION Cu. INC., a corporation, hereinafter referred to as "CONTRACTOR." WHEREAS, CITY has solicited bids for a public works project thereinafter referred to as PROJECT) more fully descrit�ed as the repair of the CITY'S municipal pier, CC-663. WHEREAS, CONTRACTOR has been selected and is to perform s3axd work, NOW, THEREFORE, in consideration of the promises and agreements hereinafter mace and exchanyed, the parties; covenant and aqr ee as follows: 1. STATEMENT OF WORK, ACrEPTANCE OF RISK C(JNThACTOR "shall furnish, at his own expanse, all 1tboir, plant, t3ols, equipment supplies, transportation, utilities and all other items and facilities necessary to complete and construct_% in a good and workmanlike manner, P"'EJECT. ACCEPTANCE: OF CONDITIONS OF WORK, SPECIFICATIONS CONTRACTOR acknowledges that he is fully familiar with all the terms, conditions and obligations of the Contract Documents# as hereinafter defined, the location of the jobsite, and the conditions under wh1ch the work is to be performed, and that he enters' into this contract based upon his investigation of all such matters and is ir, no way relying upon any opinions or representations of CKTY. It is further agreed that the Contract Documents are in- corporated in this contract by this reference, with the same force and effect as it the same were set forth at length herein, and that CONTRACTOR and its subcontractors, if any, will be and are bound by any and all of said Contract Llnc:ucnents inso: ar as they relate in any part or in any way, directly or indirectlys to the work covered by this contract. Hid documents including the Notice Inviting Bids, the Special Inso:ructions to Bidders, and the Contractors' Proposals E. The project plans, specifications, spacial provisions and addenda applicable to the PROJECT. Anything ment ionrA in the Specifications and not indicated in the Plans, or indicated in the Flans and not mentioned in the Specifications, shall be of liko effect as if indicated and mentioned in both. In case of dispute or inconsistency between any place or specification, the matter ,shall be immediately submitted to the IXpartment of Public Works av CITY, hereinafter referred to as "DPW", without whose decision said discrepancy shall not be adjusted by CUNTRACTOR, save only at hie own risk and expense. Uhings necessary and incidental to the prosecution of his work in conform- ance with the said progress schedule. He shall coordinate the work covered by this contract with that of all other contractors, subcon- tractors and of the CITY, in a manner that will facilitate the efficient completion of the project and in accordance with Section 3 herein. 'ZITY shall have compl-ite control of the p emisas on which the work is to be performed and shall have the right to decide the time or order in which the various portions of the work shall be installed or the priority of the work of other subcontractors and, in general, all matters representing the r-in.ely and orderly conduct ' at: the work of CONTRACTUR on t-he premises. 5. CHANGES CONTRACTOR hereby agcoes to snake any ;end all changes# fur«v_Leh materials and perform work as directed in writing by the D154 when such changes are within the scope of, work of this agreement. Otherwise, CONTRACTOR shall adhere strictly to, the Plans tend Speci- fications. Under no condition nhall CONTRACTOR make any Changes#.. either. in additions or deductions,. without a written order from the DPW. CITY will not pay any ©xtra charges made by CONTIACVOR unless r ri 1 , `:. UPW, ' such charges ha been agreed, upon in wri'�'ng b the Whon y g p Y directed to change the work, CONTRACTOR shall nubmit immediately to the DPW a written cost proposal in reflecting the- effort of tc,!!:.x. change. Should the DPW not agree to such cost proposal, any disputed work shall be performed as ord�-red in writing by the DPW and the cost, thereof, shall be negotiated by the parti`�s upon cost and pricing data submitted by the CONTRACTOR. CITY will promptly issue a change order to CONTRACTOR and the contract price will be adjasted upward or downward accordingly. b. NOTICE TO PROCEED No work, services, material, or equipment shall be performed or furnished under this agreement unless and until a notice to ,proceed has been given to the CONTRACTOR by CITY. CITY does not warrant that the work site will be available on the date the Notice to Pruce►ad is issued. In event of a delay in conmance- ment due to such unavailability, relief to the CONTFUNCTOR shall bo limited to a time extension equal to the. delay duo to such aval l- abi 1 i ty. 7. ANALYSIS: Gn June 6, 1983 the City Council entered into a contract with John L. Meek for the reconstruction of. the municipal pier. The amount of the contract is $266',700. To this v.-e must now add $25, 000 for the removal of additional debris loft by storms prior to March 1983, and a 201 construction conti.nyency'� o` $53, 300 for any additional work or change orders which :nay be required. This raises the total funding for the project to $345,000. To date, however, only $75,000 of the total funding has been authorized for expenditure by the Council.
