Approve and Authorize Execution of Amendment No 1 to Professional Services Contracts Between the City of Huntington Beach and Geosyntec Consultants, Inc and Langan Engineering and Environmental Services, Inc Statement of Issue The Fire and Public Works Departments require professional environmental engineering services on an as -needed basis To provide these services, two contracts were entered into on April 1, 2013 These contracts will expire on April 1, 2016, and contract amendments providing one-year extensions are requested Financial Impact None Recommended Action ,SSE /A) Approve and authorize the Mayor and City Clerk to execute Amendment No 1 to Professional Ste` Services Contract between the City of Huntington Beach and Geosyntec Consultants, Inc, and r-4 LO B) Approve and authorize the Mayor and City Clerk to execute Amendment No 1 to Professional Services Contract between the City of Huntington Beach and Langan Engineering and Environmental Services, Inc Alternative Action(s) Do not authorize one or both of the contract amendments and provide staff with alternative direction Analysis The Fire and Public Works Departments use environmental engineering services for development project related activities, such as review of environmental impacts, investigation of subsurface gas anomalies, etc In such cases, the majority of the cost would be paid by the developer in accordance with the current fee schedule Typical environmental services include Prepare, assist, and review preliminary environmental studies Review and prepare documentation in aspects of water discharge permits from regulatory agencies HB -97- Item 6. - 1 Dept ID FD16 004 Page 2 of 2 Meeting Date 3/21/2016 • Investigate and provide mitigation plans for naturally occurring gas odor control, design of gas collection systems • Process, coordinate, and obtain various regulatory permits for removal and disposal of hazardous waste materials • Analyze hazardous materials onsite • Monitor methane gas emissions at Identified sites • Investigate, review, design, and provide operation and maintenance of hazardous waste/materials management and soil remediation • Review third -party reports and studies, and provide City staff with comments and recommendations On April 1, 2013, the City Council approved contracts with Geosyntec Consultants, Inc and Langan Engineering and Environmental Services, Inc to provide these services These contracts will expire on April 1, 2016, and the agreements allow for two one-year extensions Both of the contracts were approved with an amount not to exceed $1 million per contract and because significant funding capacity exists, an additional allocation for these services is not needed Development activity that the Departments process have increased tremendously Examples of significant current and upcoming projects that require environmental engineering services include, but are not limited to, the Hilton Hotel expansion, Pasea Resort and Spa, Pacific City residential projects, and many large residential projects In order to continue to provide the services required for these and other development projects approval of the attached contract amendments is recommended Environmental Status None Strategic Plan Goal Enhance and maintain public safety Attachments) �1 Amendment No 1 to Professional Services Contract between the city of Huntington Beach and Geosyntec Consultants, Inc for Environmental Consulting Services, and, r4 2 Amendment No 1 to Professional Services Contract between the city of Huntington Beach and Langan Engineering and Environmental Services, Inc for Environmental Consulting Services Item 6. - 2 xB _98_ AMENDMENT NO. 1 TO AGREEMENT BETWEEN THE CITY OF HUNTINGTON BEACH AND LANGAN ENGINEERING & ENVIRONMENTAL SERVICES, INC FOR AS -NEEDED ENVIRONMENTAL ENGINEERING SERVICES This Amendment is made and entered into by and between the City of Huntington Beach, a California municipal corporation, hereinafter referred to as "CITY," and Langan Engineering & Environmental Services, Inc., a New Jersey corporation, hereinafter referred to as "CONSULTANT." Analysis: The approved Capital Improvement Program (CIP) exceeds $23 million in fiscal year 2012/13. The CIP is composed of various projects, the majority in the transportation, water, sewer and park improvements categories. Such on call services are established prior .to their need as not to delay an awarded project. Since 2002, it has been the Public Works Department practice to maintain three to five contracts for both planned projects and emergency response. In addition, the Fire Department also uses these services for development project related activities, such as review of environmental impacts, investigation of subsurface gas anomalies, etc. In such cases, the majority of the cost would be paid by the developer in accordance with the current fee schedule. These four firms will replace recently expired contracts. Typical environmental services include: • Prepare, assist and review preliminary environmental studies • Review and prepare documentation in aspects of water discharge permits from regulatory agencies • Investigate and provide mitigation plans for naturally occurring gas odor control, design of gas collection systems • Process, coordinate and obtain various regulatory permits for removal and disposal of hazardous waste materials • Analyze hazardous materials onsite • Monitor methane gas emissions at identified sites • Investigate, review, design and provide operation and maintenance of hazardous waste/materials management and soil remediation • Review third party reports and studies, and provide City staff with comments and recommendations In compliance with Chapter 3.03 of the Municipal Code, proposals were requested and fifteen (15) firms responded. Representatives from city departments ranked the proposals based on qualifications, experience and references. Upon final review, it was determined that Geosyntec Consultants, Langan Engineering & Environmental Services, Pacific Advanced Civil Engineering, and E2 ManageTech will best meet the needs of the city. Each of the proposed contracts is for a three-year term with an amount not to exceed $1 million per contract. It is not anticipated that there would be a situation where these contracts would actually reach that level in the next 3 years however we are recommending this level because it is possible one may depending on the projects they are awarded. The estimated expenditures for each of the three years of the proposed contracts, and their funding sources, may include: • $325,000 — CIP (Prop 42, Gas Tax, Water Fund, Sewer Fund, General Fund) • $280,000 — Environmental/Water Quality Support Services ($250,000 General Fund) • $120,000 — Development Project Services ($105,000 reimbursable, $15,000 General Fund) Approval of these contracts is recommended pursuant to City Council Resolution No. 2012-65 Section 8, which provides authorization for entering into professional service agreements for the completion of the Capital Improvement Program. FOR AS -NEEDED ENVIRONMENTAL ENGINEERING SERVICES THIS AGREEMENT ("Agreement") is made and entered into by and between the City of Huntington Beach, a municipal corporation of the State of California, hereinafter referred to as "CITY," and Langan Engineering & Environmental Services, Inc., a New Jersey Corporation hereinafter referred to as "CONSULTANT." WHEREAS, CITY desires to engage the services of a consultant to provide as -needed environmental engineering services; and Pursuant to documentation on file in the office of the City Clerk, the provisions of the Huntington Beach Municipal Code, Chapter 3.03, relating to procurement of professional service contracts have been complied with; and CONSULTANT has been selected to perform these services, NOW, THEREFORE, it is agreed by CITY and CONSULTANT as follows: I. SCOPE OF SERVICES CONSULTANT shall provide all services as described in )Exhibit "A," which is attached hereto and incorporated into this Agreement by this reference. These services shall sometimes hereinafter be referred to as the "PROJECT." CONSULTANT hereby designates Dan Eberhart, who shall represent it and be its sole contact and agent in all consultations with CITY during the performance of this Agreement. 2. CITY STAFF ASSISTANCE CITY shall assign a staff coordinator to work directly with CONSULTANT in the performance of this Agreement. agree/ surfnet/professional svcs mayor 1 Of 11 10/12 3. TERM, TIME OF PERFORMANCE Time is of the essence of this Agreement. The services of CONSULTANT are to commence on L , 20/3 (the "Commencement Date"). This Agreement shall automatically terminate three (3) years from the Commencement Date, unless extended or sooner terminated as provided herein. All tasks specified in Exhibit "A" shall be completed no later than three (3) years from the Commencement Date. The time for performance of the tasks identified in Exhibit "A" are generally to be shown in Exhibit "A." This schedule may be amended to benefit the PROJECT if mutually agreed to in writing by CITY and CONSULTANT. In the event the Commencement Date precedes the Effective Date, CONSULTANT shall be bound by all terms and conditions as provided herein. 4. COMPENSATION In consideration of the performance of the services described herein, CITY agrees to pay CONSULTANT on a time and materials basis at the rates specified in Exhibit "B," which is attached hereto and incorporated by reference into this Agreement, a fee, including all costs and expenses, not to exceed one million Dollars ($1,000,000). 5. EXTRA WORK In the event CITY requires additional services not included in Exhibit "A" or changes in the scope of services described in Exhibit "A," CONSULTANT will undertake such work only after receiving written authorization from CITY. Additional compensation for such extra work shall be allowed only if the prior written approval of CITY is obtained. 6. METHOD OF PAYMENT CONSULTANT shall be paid pursuant to the terms of Exhibit "B." agree/ surfnet/professional Svcs mayor 2 of 11 10/12 7. DISPOSITION OF PLANS ESTIMATES AND OTHER DOCUMENTS CONSULTANT agrees that title to all materials prepared hereunder, including, without limitation, all original drawings, designs, reports, both field and office notices, calculations, computer code, language, data or programs, maps, memoranda, letters and other documents, shall belong to CITY, and CONSULTANT shall turn these materials over to CITY upon expiration or termination of this Agreement or upon PROJECT completion, whichever shall occur first. These materials may be used by CITY as it sees fit. 8. HOLD HARMLESS CONSULTANT hereby agrees to protect, defend, indemnify and hold harmless CITY, its officers, elected or appointed officials, employees, agents and volunteers from and against any and all claims, damages, losses, expenses, judgments, demands and defense costs (including, without limitation, costs and fees of litigation of every nature or liability of any kind or nature) arising out of or in connection with CONSULTANT's (or CONSULTANT's subcontractors, if any) negligent (or alleged negligent) performance of this Agreement or its failure to comply with any of its obligations contained in this Agreement by CONSULTANT, its officers, agents or employees except such loss or damage which was caused by the sole negligence or willful misconduct of CITY. CONSULTANT will conduct all defense at its sole cost and expense and CITY shall approve selection of CONSULTANT's counsel. This indemnity shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as limitation upon the amount of indemnification to be provided by CONSULTANT. 9. PROFESSIONAL LIABILITY INSURANCE CONSULTANT shall obtain and furnish to CITY a professional liability insurance policy covering the work performed by it hereunder. This policy shall provide coverage for CONSULTANT's professional liability in an amount not less than One Million Dollars agree/ surrfnet/professional svcs mayor 3 of 11 10/12 ($1,000,000.00) per occurrence and in the aggregate. The above -mentioned insurance shall not contain a self -insured retention without the express written consent of CITY; however an insurance policy "deductible" of Ten Thousand Dollars ($10,000.00) or less is permitted. A claims -made policy shall be acceptable if the policy further provides that: A. The policy retroactive date coincides with or precedes the initiation of the scope of work (including subsequent policies purchased as renewals or replacements). B. CONSULTANT shall notify CITY of circumstances or incidents that might give rise to future claims. CONSULTANT will make every effort to maintain similar insurance during the required extended period of coverage following PROJECT completion. If insurance is terminated for any reason, CONSULTANT agrees to purchase an extended reporting provision of at least two (2) years to report claims arising from work performed in connection with this Agreement. If CONSULTANT fails or refuses to produce or maintain the insurance required by this section or fails or refuses to furnish the CITY with required proof that insurance has been procured and is in force and paid for, the CITY shall have the right, at the CITY's election, to forthwith terminate this Agreement. Such termination shall not effect Consultant's right to be paid for its time and materials expended prior to notification of termination. CONSULTANT waives the right to receive compensation and agrees to indemnify the CITY for any work performed prior to approval of insurance by the CITY. 10. CERTIFICATE OF INSURANCE Prior to commencing performance of the work hereunder, CONSULTANT shall furnish to CITY a certificate of insurance subject to approval of the City Attorney evidencing the foregoing insurance coverage as required by this Agreement; the certificate shall: agree/ surfneUprofessionalsvesmayor 4 of 11 10/12 A. provide the name and policy number of each carrier and policy; B. state that the policy is currently in force; and C. shall promise that such policy shall not be suspended, voided or canceled by either party, reduced in coverage or in limits except after thirty (30) days' prior written notice; however, ten (10) days' prior written notice in the event of cancellation for nonpayment of premium. CONSULTANT shall maintain the foregoing insurance coverage in force until the work under this Agreement is fully completed and accepted by CITY. The requirement for carrying the foregoing insurance coverage shall not derogate from CONSULTANT's defense, hold harmless and indemnification obligations as set forth in this Agreement. CITY or its representative shall at all times have the right to demand the original or a copy of the policy of insurance. CONSULTANT shall pay, in a prompt and timely manner, the premiums on the insurance hereinabove required. 11. INDEPENDENT CONTRACTOR CONSULTANT is, and shall be, acting at all times in the performance of this Agreement as an independent contractor herein and not as an employee of CITY. CONSULTANT shall secure at its own cost and expense, and be responsible for any and all payment of all taxes, social security, state disability insurance compensation, unemployment compensation and other payroll deductions for CONSULTANT and its officers, agents and employees and all business licenses, if any, in connection with the PROJECT and/or the services to be performed hereunder. 12. TERMINATION OF AGREEMENT All work required hereunder shall be performed in a good and workmanlike manner. CITY may terminate CONSULTANT's services hereunder at any time with or without cause, and whether or not the PROJECT is fully complete. Any termination of this Agreement by CITY shall agree/ surfnedprofessional Svcs mayor 5 of 11 10112 be made in writing, notice of which shall be delivered to CONSULTANT as provided herein. In the event of termination, all finished and unfinished documents, exhibits, report, and evidence shall, at the option of CITY, become its property and shall be promptly delivered to it by CONSULTANT. 13. ASSIGNMENT AND DELEGATION This Agreement is a personal service contract and the work hereunder shall not be assigned, delegated or subcontracted by CONSULTANT to any other person or entity without the prior express written consent of CITY. If an assignment, delegation or subcontract is approved, all approved assignees, delegates and subconsultants must satisfy the insurance requirements as set forth in Sections 9 and 10 hereinabove. 14. COPYRIGHTS/PATENTS CITY shall own all rights to any patent or copyright on any work, item or material produced as a result of this Agreement. 15. CITY EMPLOYEES AND OFFICIALS CONSULTANT shall employ no CITY official nor any regular CITY employee in the work performed pursuant to this Agreement. No officer or employee of CITY shall have any financial interest in this Agreement in violation of the applicable provisions of the California Government Code. 16. NOTICES Any notices, certificates, or other communications hereunder shall be given either by personal delivery to CONSULTANT's agent (as designated in Section 1 hereinabove) or to CITY as the situation shall warrant, or by enclosing the same in a sealed envelope, postage prepaid, and depositing the same in the United States Postal Service, to the addresses specified below. Attn: Dan Eberhart 32 Executive Park, Site 130 Irvine, CA 92614 When CITY's consent/approval is required under this Agreement, its consent/approval for one transaction or event shall not be deemed to be a consent/approval to any subsequent occurrence of the same or any other transaction or event. 18. MODIFICATION No waiver or modification of any language in this Agreement shall be valid unless in writing and duly executed by both parties. 19. SECTION HEADINGS The titles, captions, section, paragraph and subject headings, and descriptive phrases at the beginning of the various sections in this Agreement are merely descriptive and are included solely for convenience of reference only and are not representative of matters included or excluded from such provisions, and do not interpret, define, limit or describe, or construe the intent of the parties or affect the construction or interpretation of any provision of this Agreement. 20. INTERPRETATION OF THIS AGREEMENT The language of all parts of this Agreement shall in all cases be construed as a whole, according to its fair meaning, and not strictly for or against any of the parties. If any agree/ surfnet/professional svcs mayor 7 of 11 10/12 provision of this Agreement is held by an arbitrator or court of competent jurisdiction to be unenforceable, void, illegal or invalid, such holding shall not invalidate or affect the remaining covenants and provisions of this Agreement. No covenant or provision shall be deemed dependent upon any other unless so expressly provided here. As used in this Agreement, the masculine or neuter gender and singular or plural number shall be deemed to include the other whenever the context so indicates or requires. Nothing contained herein shall be construed so as to require the commission of any act contrary to law, and wherever there is any conflict between any provision contained herein and any present or future statute, law, ordinance or regulation contrary to which the parties have no right to contract, then the latter shall prevail, and the provision of this Agreement which is hereby affected shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law. 21. DUPLICATE ORIGINAL The original of this Agreement and one or more copies hereto have been prepared and signed in counterparts as duplicate originals, each of which so executed shall, irrespective of the date of its execution and delivery, be deemed an original. Each duplicate original shall be deemed an original instrument as against any party who has signed it. 22. IMMIGRATION CONSULTANT shall be responsible for full compliance with the immigration and naturalization laws of the United States and shall, in particular, comply with the provisions of the United States Code regarding employment verification. 23. LEGAL SERVICES SUBCONTRACTING PROHIBITED CONSULTANT and CITY agree that CITY is not liable for payment of any subcontractor work involving legal services, and that such legal services are expressly outside the scope of services contemplated hereunder. CONSULTANT understands that pursuant to agree/ surfnet/professional svcs mayor 8 of 11 10/12 CITY; and CITY shall not be liable for payment of any legal services expenses incurred by CONSULTANT. 24. ATTORNEY' S FEES In the event suit is brought by either party to construe, interpret and/or enforce the terms and/or provisions of this Agreement or to secure the performance hereof, each party shall bear its own attorney's fees, such that the prevailing party shall not be entitled to recover its attorney's fees from the nonprevailing party. 25. SURVIVAL Terms and conditions of this Agreement, which by their sense and context survive the expiration or termination of this Agreement, shall so survive. 26. GOVERNING LAW This Agreement shall be governed and construed in accordance with the laws of the State of California. 27. SIGNATORIES Each undersigned represents and warrants that its signature hereinbelow has the power, authority and right to bind their respective parties to each of the terms of this Agreement, and shall indemnify CITY fully for any injuries or damages to CITY in the event that such authority or power is not, in fact, held by the signatory or is withdrawn. 28. ENTIRETY The parties acknowledge and agree that they are entering into this Agreement freely and voluntarily following extensive arm's length negotiation, and that each has had the opportunity to consult with legal counsel prior to executing this Agreement. The parties also acknowledge and agree that no representations, inducements, promises, agreements or warranties, oral or otherwise, have been made by that party or anyone acting on that party's behalf, which are not embodied in this agree/surfnet/professional svcs mayor 9 of 11 10/12 Agreement, and that that party has not executed this Agreement in reliance on any representation, inducement, promise, agreement, warranty, fact or circumstance not expressly set forth in this Agreement. This Agreement, and the attached exhibits, contain the entire agreement between the parties respecting the subject matter of this Agreement, and supersede all prior understandings and agreements whether oral or in writing between the parties respecting the subject matter hereof. 29. EFFECTIVE DATE This Agreement shall be effective on the date of its approval by the City Council. This Agreement shall expire when terminated as provided herein. STATEMENT OF WORK: (Narrative of work to be performed) CONSULTANT shall provide consulting services on an "as -needed" basis for general engineering, landfill and gas, hazardous waste material and water quality projects to be determined during the term of this agreement. During the term of this agreement, CITY may elect to solicit proposals from CONSULTANT. City shall issue task orders for each project based upon the scope of serices, work schedule, and fee proposal submitted to CITY for its review and approval. B. CONSULTANT'S DUTIES AND RESPONSIBILITIES: CONSULTANT's duties and responsibilities shall follow provisions specified in the City of Huntington Beach As -Needed Environmental Engineering Serivices Scope of Work shown in Exhibit A.1. Detailed services shall include but is not limited to the following scope of work shown in Exhibit A.2. Upon award and during the contract period, if CONSULTANT chooses to assign different personnel to the project, CONSULTANT must submit the names and qualificaitons of those staff to CITY for approval before commencing work. C. CITY'S DUTIES AND RESPONSIBILITIES: t. Furnish scope of work request for each project assigned. 2. Furnish available record drawings and specifications to the CONSULTANT. D. WORK PROGRAMIPROJECT SCHEDULE: A project schedule will be developed for each project assigned by CITY. EXHIBIT A Exhibit A.1 City of Huntington Beach On -Call Environmental Engineering Services Scope of Work In general, the Consultant shall perform environmental engineering services on an "on call or as needed" basis for various projects assigned by the City. The scope of work for any one project may involve all phases of project development and may include but not be limited to the following: Water Quality ♦ Assist in reviewing and preparing documentations in various aspects of water discharge permits from applicable regulatory agencies; m Assist in sampling of dry weather runoff at various storm drain systems that will divert runoff to local sanitation district; ♦ Perform commercial/industrial water quality inspections for compliance with latest NPDES regulations; ♦ Perform water quality testing and sampling; ♦ Assist in reviewing, evaluating, and recommending various storm water pretreatment systems and develop water quality best management practices; ♦ Provide routine wastewater odor control and monitoring; ♦ Manage, monitor, and develop wetland natural treatment systems; ♦ Assist in preparing and/or reviewing watershed action plan. In general, the consultant shall perform environmental engineering services on an "as - needed" basis for various projects assigned by the City. The scope of work for any one project may involve all phases of project development and may include but not be limited to the following: Monitorinq and Inspections ♦ Perform maintenance, monitoring and inspections of City's facilities in accordance to requirements by various applicable regulatory agencies. ♦ Provide testing and sampling of various constituents and media. Studies and Reports ♦ Prepare reports and studies that utilize sound practical environmental engineering analysis and principles. ♦ Prepare documentations that comply with applicable regulatory agency requirements for permitting. ♦ Review 3rd party reports and studies, and provide City staff with comments and recommendations. Grant Applications o Assist in preparing various grant applications to obtain additional sources of funding for various proposed City projects. Preliminary Engineering o Perform site investigation, prepare alternatives by providing recommendations and analyses that describes the advantages of each alternative, and prepare estimates of probable cost for each alternative. o Prepare preliminary plans, cost estimates, engineering details, and support calculations. Construction Documents o Prepare engineering calculations and designs, plans, specifications, cost estimates, and contract bidding documents. Permits o Assist in obtaining approvals from applicable regulatory agencies for environmental, and/or other permits as may be required. Biddinq Stage o Assist the City in answering bidders' questions, attend pre -bid conferences and job walks, prepare addenda, and analyze bids. Construction Stage o Attend pre -construction conference. o Monitor construction schedule, visit construction site as required for progress and quality of work evaluation. o Assist the engineer, contractor, construction manager/contractor administrator, and inspector with interpretation of plans and specifications, analysis of changed conditions, development of corrective action, review of shop drawings and other submittal, and the review and negotiation of change orders. o Prepare "as -built" drawings. Special Requirement: Due to the fact that some of the City projects will be funded by Federal and/or State grants, the selected consulting firm must comply with various requirements including all applicable prevailing wage laws. Exhibit A.2 Section ®: Methodology 1) Implementation Plan (i) Methods and Controls for Managing Projects for this RFP Langan believes that communication and the Project Manager are the keys to successful projects. Our proposed Project Manager, Keith Gilbert, will proactively identify and manage uncertainties during the project. Mr. Gilbert will communicate and meet regularly with the City and project team to identify factors which may change budgets and to efficiently use project resources. He will monitor individual tasks and evaluate variations from the project plan to manage changes as they occur to control project costs. We endeavor to develop flexible plans and transmit data collection results and work product drafts electronically in real time to keep the team up-to-date, allow for redlining of draft deliverables, and facilitate collaboration and agreement. See attached example schedule. Successful projects are achieved by appropriately balancing competing resource demands. To manage these demands, Langan implements project staffing, cost, and schedule control measures. At the start, we will discuss with the City the anticipated schedule for each task through the entire project. Weekly project status summaries are also available to the City. Agreeing on a reasonable schedule and any needs to expedite schedule will be discussed prior to the start of the project in our initial kick-off meeting. Langan's long experience in managing on -call contract projects has given us significant experience managing fluctuating workloads. Successful management of staffing "surges" requires constant monitoring of project requirements, budgetary limits, schedules, and individual calendars. Through this process of "looking -ahead" and maintaining constant project communications between the project team, we can adequately staff all tasks required. Immediately upon weekly timesheet data entry by Langan personnel, our Project Manager can access information on the City project including hours and fees spent to date, percent of project completed, personnel hours charged to the project, and sub consultant and subcontractors invoicing information. He will invoice the City monthly and include a detailed description of our services. Our experience performing these projects has given us the ability to successfully scope and complete these projects within the schedule and budget. Shareholders of the firm are assigned to this project to provide QA/QC review. For this project, Dorinda Shipman will bring her knowledge to the role of Environmental Lead. Our team is made up of individuals and firms that we have experience working with on contaminated properties and are confident in their ability to deliver quality field services, data, and report deliverables on time. All team members check the project data, calculations, and reports before passing work products on for review. Our detail -oriented professional staff members are responsible for Langan having over 80 percent of our work with long-term clients. Many years of experience working with public agencies and organizations enable us to think ahead throughout the project and anticipate issues that can be resolved or managed proactively in real-time. (i) Methodology for Soliciting and Documenting Views of Internal and External Stakeholders A successful public communication program includes frequent project updates, easy access to project information, and productive stakeholder meetings to strengthen relationships, protect human health and the environment, and drive the project to make way for new beneficial land uses. We contribute to these achievements by developing trust, communicating complex information in clear, easy -to -understand formats and providing high quality data interpretations and remedial solutions. We have the experience to work effectively with diverse community groups to reach Agency goals. The Hunters Point Shipyard project have given us unique experience working with communities striving to understand complex environmental contamination and health risk issues as well as the Section D: Methodology general regulatory process these sites must go through to reach the redevelopment end point. We understand their concerns and need to learn new technical terms and ideas. We have described scientific processes such as soil vapor intrusion, groundwater and surface water interaction, contaminant migration, naturally occurring asbestos and metals, liquefaction, etc. We know it is best to be open, listen carefully to questions, use easy to understand examples, and remain calm if individuals are scared or upset to gain trust and communicate effectively with the public. We understand that views of both internal and external stakeholders need to be recognized and documented. We anticipate frequent communication with the City and regulators regarding the project schedule, Phase I, II and III scope development, mitigation plans, landfill management and reporting by email, teleconferences and meetings. Upon approval of the City, Langan will produce deliverables and report documents and distribute them to internal and external stakeholders including agencies, and organizations on a City -approved mailing list. Langan will coordinate with the City regarding the number of hard copies and electronic copies to provide the specific agencies and other Interested stakeholders. Langan can also prepare public notices for the City announcing the availability of project deliverablestdocuments, public hearing dates, and present Fact Sheets to those stakeholders on the mailing list. If necessary, Langan can organize the City's public hearings on the projects. We can reserve a hearing location, provide presentation equipment, and retain a court reporter. The court reporter will prepare an electronic transcript of the public hearing. The draft of the transcript will be provided to the City for review. Any necessary changes requested by the City and others needed to address City comments will be made to the transcript. (ii) Other Project Management or Implementation Strategies or Techniques that Langan intends to Employ in Carrying Out the Work Upon receipt of a task order from the City (e.g., prepare, review or perform environmental assessment, grant application, landfill mitigation plan), the project manager will obtain relevant information including but not limited to, project scope, location, plans, specifications, anticipated duration, and contractors. The relevant information will be reviewed during our internal project scoping meeting, where schedule, budget and staff requirements will be reviewed. The project administrator will identify key staff and alternates, including sub consultants who will be identified for each role, and who will serve their role for the duration of the project, In addition, a schedule of reporting deliverables and timeline will be established as well as budget for the anticipated scope. Schedules can be presented in Gantt or critical path analysis charts. Field task progress will be tracked via daily field reports prepared by our field staff. Our project administrator will submit monthly status reports to the City project manager. The monthly status reports will include a brief summary of technicians utilized, anticipated project requirements for the months ahead, and a highlight of any key outstanding issues or resolutions. Langan and our local sub consultants are committed to providing the labor and resources necessary to meet the City schedules for completion of any services required under the task order. We prepare weekly staffing plans with weekly and monthly "look ahead's" to ensure that the staff resources are available for known work. In addition, we have the ability to draw staff from any office within Langan to supplement required technicians as necessary. 2) Detailed Description of Efforts Langan is fully committed to consistently providing quality services to all of our clients. We recognize that our success and our clients' success depend on the dedicated efforts of our employees and the corporate commitment to quality, technical excellence, practical experience and responsiveness. Success in all we do is supported by adhering to the quality assurance principles detailed Section D: Methodology in our corporate Quality Management Plan (QMP). The primary objective of the QMP is to ensure that the services and products provided by Langan to all of our clients meet the requirements of applicable regulations, codes, standards, contracts, and technical specifications, as well as client expectations. The QMP is updated regularly to reflect improvements in quality management procedures, lessons learned in delivering quality, and applicable changes in federal regulations. As demonstrated by our projects presented in Section F, we routinely prepare and peer review Preliminary Environmental Studies, engineering analysis reports, and technical and research studies. We prepare project plans and specifications, perform field investigations and can assist the City in reviewing available Grant and Federal funding applications assist in developing City specifications and local code amendments. We can also prepare and review methane gas mitigation plans, routine methane gas monitoring and provide maintenance and inspection of active gas collection systems. We are experienced at investigating, reviewing providing mitigation plans for naturally occurring bas anamolies/odors control and design passive and active gas collection systems as well as prepare and review Post Closure Maintenance Plans. Langan understands that we will be expected to furnish all personnel, transportation, materials, supplies, and equipment necessary to perform these services and that services shall be provided in accordance with City guidelines and ordinances, OSHA, Construction Industry Standards, California Code of Regulations (CCR), United States Environmental Protection Agency standards, ASTM (including E1527-05), South Coast Air Quality Management District Regulations, the City Building Code, City Fire Department, other applicable standards and local, State and Federal guidelines and codes. We will analyze and evaluate the reviewed available information, subsurface conditions disclosed in the borings, and laboratory test results. We will review existing reports, the Site database, and operations history to identify source areas, data gaps and potential contaminants of concern. We will present the results of our subsurface investigation and laboratory testing in a formal report that complies with regulatory and City standards. Following completion of internal QA/QC reviewer by senior members of our staff, we will issue a draft report to the City. We will meet with the City to review the draft report and will issue a final report upon receipt of City comments. We will assist the City in preparing regulatory agency required documents, based on the City's schedule and risk management concerns. We assume that since underground storage tanks may be present, for some assessments the lead agency may be the City Fire Department or the Certified Unified Program Agency (CUPA) oversight to all work performed in response to this RFP will be conducted per requirements of the City. We anticipate frequent communication with the City and regulators regarding our approach, including email exchange and teleconferences to communicate the Plan rationale and text review. If required, Langan will complete the Phase I ESAs in general compliance with the US Environmental Protection Agency All Appropriate Inquiry (AAI) rule and ASTM Standard 1527-05, The Phase I ESA will review past and present land use practices, site conditions, and neighboring property land uses to evaluate the potential presence of petroleum hydrocarbons and hazardous substances in the site soil and/or groundwater. Results will be presented in a report that includes our opinion regarding the possible presence of petroleum hydrocarbon and/or hazardous materials releases to the site, and recommendations for additional investigations, if necessary. We will submit a draft report for review to you. We will finalize the report based on the comments received. Section ®: Methodology Risk Assessment Analyses (RAAs) will evaluate whether chemicals detected in Site media pose a potential unacceptable risk to future populations and will be conducted in accordance with USEPA and other applicable local, State and Federal risk assessment guidelines and regulations. The RAAs will identify chemicals and exposure pathways that pose an unacceptable potential health risk and the range and types of mitigation measures that might be effective in reducing any unacceptable risks to acceptable levels. The RAA includes: data evaluation, selection of potential chemicals of concern (COCs), exposure and toxicity assessments, characterization of health risks associated with all chemicals in the site media, and determining whether the COCs present an unacceptable risk to human health under projected future land uses. If needed, Site -specific remedial goals will be developed for the COCs for use In identifying the range and types of mitigation and remedial measures that may be effective in reducing the risks to acceptable levels. The RAA results can be presented in a separate report or combined with the Phase II Environmental Assessment. After reviewing the existing information for the City, we will develop the Phase II Sampling and Analysis Plan (SAP). The SAP will be based on past and present uses of the subject properties and nearby properties, including chemicals currently in use at each of the properties. Based on site usage, petroleum hydrocarbons, metals, semi -volatile organic compounds (SVOCs), solvent and paints may be present in subsurface soils and/or groundwater at each of the properties. The SAP will include a brief description of the project, including the property history, problem(s) to be investigated, scope of sampling effort, and types of analyses that will be required at each sampling location. Phase II field investigation will further delineate the lateral and vertical extent of impacts identified in the existing reports and acquire additional information needed to evaluate risks and possible remedial alternatives. Phase 11 SAP will use a "step -out' sampling approach so that data is reviewed in real time to avoid additional mobilizations. We assume that the Phase 11 ESA will be conducted per the HASP and procedures outlined in the IP and that an additional work plan would not be required. The objective of our Phase II Invasive Site Investigation will be to evaluate potential contaminated soil gas, soil and potentially groundwater at the subject properties, if any, by analyzing soil gas, soil and groundwater samples collected at the properties. The field investigation may include: mobilization, soil gas, soil and groundwater grab sampling by direct -push and hollow stem auger drilling methods, soil gas sampling and onsite analysis, monitoring well installation and sampling, GPS and land surveying, and offsite chemical laboratory analysis. Soil will be screened in the field with an organic vapor monitor for organic vapors. Each sample tube will be sealed with Teflon and plastic caps, labeled, and placed on ice in a cooler for delivery to the analytical laboratory under chain of custody procedures. Grab groundwater samples may be collected from some of the soil borings by placing a temporary casing in the borings and collecting water from within the casings. We may obtain soil gas and soil samples from shallow exploratory borings for analytical testing. Grab groundwater samples may also be collected for analytical testing, if warranted. The soil will be analyzed for specific contaminants related to the potential sources such as petroleum hydrocarbons, polycyclic aromatic hydrocarbons, volatile organic compounds and California Assessment Manual (CAM) 17 metals Borings can be installed using direct push technology techniques by Martini Drilling. Hollow stem auger drilling methods can be used In areas where continuous soil cores are needed to fully characterize potential contaminant transport pathways or to install groundwater monitoring wells. Once we receive the laboratory analytical results, we will tabulate and summarize the data for risk screening. Section D: Methodology We will prepare a report describing the Phase II Environmental Site Assessment procedures and results, presenting our opinion regarding the presence of soil that would be characterized as hazardous waste if excavated, outlining soil handling and disposal options for the site to be implemented during soil excavation, potential impacts related to residual chemicals in groundwater and other recommendations. The Phase II report will describe the field investigation activities, field observations, the analytical results, a Conceptual Site Model, risk screening or assessments results, and will include tables, figures, boring logs, well logs, and laboratory reports. We will prepare a draft report describing the environmental site characterization procedures and results, presenting our opinion regarding the presence of soil that would be characterized as hazardous waste if excavated, outlining soil handling and disposal options for the site to be implemented during redevelopment or soil excavation, potential impacts related to residual chemicals in soil vapor or groundwater and health risk management recommendations for City review and comment and will incorporate comments received into a regulatory agency draft report. We pride ourselves on collecting viable and defensible data for our clients. The analytical laboratories with whom we work provide us with Electronic Data Deliverables (EDDs) in addition to standard laboratory reports. EDDs allow for a fully digital workflow between laboratory and database, eliminating the potential errors of hand entry. We employ industry -standard analytical chemistry database software to provide a robust and flexible architecture to store, summarize, and report the data. We also have extensive experience in migrating historical hard copy laboratory data into database form.' Wherever appropriate, software tools are used to automate the entry and checking process. The combination of historical and recent data allows for powerful analysis of trends over time not possible through other means. The analytical laboratories will provide EDDs in addition to standard laboratory reports to allow for fully digital workflow between laboratory and database, eliminating the potential errors of hand entry. One tenth of the Phase II data can be reported in EPA Level IV format and will undergo third -party data validation. Langan will evaluate and tabulate the previous and Phase II data for inclusion on the report. Langan will develop a work plan that would address the recommendations that were presented in the Phase II ESAs. Examples of items that might be recommended could be removal of underground storage tanks and associated piping, removal of sumps/vaults, and contaminated soil and/or groundwater removal and treatment. Results of the ESAs and RAAs will be used to identify remedial action objectives that can be implemented prior to and during site redevelopment. Depending on the results of the ESAs, bench scale or pilot tests may be needed to fully evaluate and choose a preferred alternative for the Site. We will communicate our initial technology screening and comparative analysis to the City via summary tables and will meet with the City to present our draft results and progress on pilot studies. We will prepare a draft Feasibility Study report for City review and comment, and will incorporate comments into the draft final Report. If pilot studies are in progress and depending on the. City's schedule goals, we can prepare a pilot test addendum report. Upon completion of the project, final reports as required will be prepared and submitted to the City and agencies electronically and in hard copy formats as requested. Langan is familiar with the 38-acre Ascon landfill site in Huntington Beach and the DTSC references to odor control measures using suppressants and air monitoring. In addition, Langan has experience with landfill management activities including data collection to determine the level and extent of subsurface methane associated with landfill gas and evaluation of landfill gas migration onto adjacent properties. Reviewing results of previous sampling effort and design of an interim remedial measure to remove and treat the landfill gas.
