Pacific owns Pacific Mobile Home Park located at 80 Huntington Street, Huntington Beach, California, Assessor's Parcel Number: 024-291-16 and, legally :described in Exhibit A attached hereto and made a part hereof (the-Tark"). The western border of the Park is Huntington Street. The City recorded an ,easement for a 60 foot wide public right-of-way m Huntington Stet pursuant to an easement deed, which was ;accepted by the Huntington Beach City Council pursuant to Resolution No. 1125 in 1950 (the "Right of Way"). Attached hereto as Exhibits B and C are copies of the deed and City Council Resolution No. 1125, respectively. Pacific has installed a wooden fence which is located mi the recorded Right of Way.. Behind the fence are mobile homes and related structures, soiree of which are also located in the area of the Right of Way. Pursuant to the Settlement .Agreement and Mutual Release (the "Agreernenf ) between the City and .Pacific., dated February 2013, a copy of which is on file with the City Clerk of the City of Huntington Bead, the City hereby grants Pacific the right to use the Right of Way up to and including the area occupied by the existing wooden fence for the benefit of the Park on the terms and conditions set forth in the Agreement, all the terms and conditions of which are made a part of this Memorandum. of Agreement Regarding Real Property.
