Hi Dave - Joan and I were reviewing council agenda items that have been held in a pending status.
In the past I had kept in touch with Luann regarding this project and she requested that it be kept in
the pending status. Have you had any update at all from the county regarding this project? Given the
current budget issues, do you think we should continue to hold it as a pending item? If not, with your
permission, we would file it on the shelf with the regular files as a incomplete file. Thanks for your
help and advice on this item!

The agreement is still active, yet unsigned by the County. It is really not a budget issue. If and when the County signs the

Hi Patty — wish I had new news to share, but the status remains the same. We three OCRP cities have all signed,
and it is being held up at the OC Board of Supervisors level. I hope later this year when some Prop 84 money
becomes available, it will help in our efforts; however, I have had no indication that is the case. As of this time,
we three cities (HB, NB, Costa Mesa) are all in the same boat and waiting... and waiting... As soon as I get some
more definite info, I will let you know. Thanks for checking, Luann

Hi Patty, Yes, I know this has not yet been signed by the County, although the three cities (HB, Newport Beach
and Costa Mesa) have all executed it. The hold up is with the OC Board of Supervisors, and the Orange Coast
River Park committee has been working to try to resolve their issues. As of our last meeting, there has been no
resolve. We meet again next week, and if there is any information as to when we may expect their signing of the
document, I will let you know.

Statement of Issue: There is a need to approve a Memorandum of Agreement outlining
the city's participation in the creation of the Orange Coast River Park.
Funding Source: None. The Memorandum of Agreement does not obligate the city to
contribute funds.
Recommended Action: Motion to:
Approve the Memorandum of Agreement between the cities of Huntington Beach, Costa
Mesa, Newport Beach, and the County of Orange establishing a cooperative effort for the
planning and development of the Orange Coast River Park.
Alternative Action(s): Do not approve the Memorandum of Agreement for the Orange
Coast River Park.
REQUEST FOR CITY COUNCIL ACTION

Analysis:
Through the Friends of Harbors, Beaches and Parks, the Orange Coast River Park (OCRP)
steering committee was established with the mission of creating a 1,000-acre park along the
areas of the Santa Ana River. The OCRP would be a unified park, linked by trails, several
existing parks, and nature reserves along the Santa Ana River. Portions of the OCRP would
lie in the county of Orange and the cities of Huntington Beach, Costa Mesa and Newport
Beach. The areas in Huntington Beach include the west side of the Santa Ana River and
along Pacific Coast Highway from the mouth of the river to Beach Boulevard.
Due to multiple landowners, both public and private, development of the OCRP will be a
long-term challenge and will require a cooperative effort between the local governments and
the Friends of Harbors, Beaches and Parks. Toward this end, a Memorandum of Agreement
has been prepared identifying each agency's commitment to participate in the creation of the
park through cooperative planning by sharing information, seeking grant funding and
establishing consistent policies and stewardship protocols for the OCRP.
Each agency retains control over its property. As indicated in the Memorandum of
Agreement, all agencies involved will have the option to withdraw upon 30 days written notice
and any amendments or modifications to the agreement must be achieved through
consensus in writing of all involved agencies.
The Community Services Commission has reviewed the agreement and at its November 8,
2006, meeting. The agreement was unanimously recommended for submittal to and
approval by the City Council. Approval and signatures have been completed by both Costa
Mesa and Newport Beach. Approval of this Memorandum of Agreement by Huntington Beach
City Council would be necessary at the December 18 meeting in order for approval by the
County Board of Supervisors in 2006.
Environmental Status:
All necessary environmental reviews will be completed as improvements to the OCRP
development progress.

Whereas, it is within the public interest that local governments communicate effectively
on matters of mutual interests; and
Whereas, Orange Coast River Park ("OCRP") is a proposed future park involving
component areas from four jurisdictions, which are the cities of Newport Beach,
Huntington Beach, Costa Mesa; and the County of Orange; and
Whereas, it is within the mission and purpose of those jurisdictions within the proposed
area of the OCRP to cooperate in order to plan connective trails, and develop consistent
policies and stewardship protocols in the area, and
Whereas, it is believed the public will be better served by cooperative planning, and
shared goals and objectives, including but not limited to funding opportunities such as
with future applications for grant funding; and
Whereas, the OCRP Steering Committee has been established in partnership with.
Friends of Harbors, Beaches and Parks with staff representation from all four
jurisdictions, the Huntington Beach Wetlands Conservancy and others,
NOW, THEREFORE, BE IT RESOLVED that the undersigned agree to the following:
All undersigned will provide one another copies of any new park plans or modifications in
those parks within and adjacent to OCRP and will provide the OCRP Steering
Committee an opportunity to review and comment prior to approval; and
All undersigned will be given equal opportunity by OCRP to participate in the application
process for park improvements for any part of the OCRP; and
All undersigned will make use of opportunities to promote .the concept and name
"Orange Coast River Park and the associated logo whenever and wherever appropriate
and practicable; and
All the undersigned will continue to appoint a staff representative to the OCRP Steering
Committee; and
Any undersigned may withdraw from this agreement with written 30 day notice to all
other undersigned parties and any modifications or additional signatories will be
achieved through consensus in writing.
