"CETA-Financial Report-Invoice" forms must be 14 ! subm-itted on a monthly basis , normally once a month, by the loth 15 business day after the closing day of the month. 16 i8. Additional Administrative Conditions and Provisions i 17 i 1 . Termination of Aid: After notice of COM"ISSION review, this grant, 18 ? hereinafter also defined as contract, may be terminated or fund paymnt 14 ! discontinued by the CO"tMISSION where it finds a substantial failure to 20 f comply with provisions of the contract. 21 ± 2. Inspection and Audit: The CNIU SSION and/or the Department of Labor 22 or any of its duly authorized representatives, shall have access for i 2- } purpose of audit and examinations, to any books , documents , papers and f 24 f� records of the SUBGRANTEE and to relevant books , documents , papers and records of the COMMISSION SUBGRAUTEE' s sub 'rantee or subcontractors 25 1 9 ' as 26 related to this subgrant. 27 3. Accounting: The criteria for recordkeeping detail shall be definitive 28 enough to identify expense by the CETA Title, program activity, cost category, and budget line items as defined in the CETA Audit Guide, 27 1 1 September, 1977. i 2 j 4. Maintenance of Records : All required records shall be maintained until 3 three (3) years after termination or expiration of the grant. Notwith- 4 1 standing this requirement , SUBGRANTEE shall maintain a record of each 5 participant, for a period of five (5) years from the date of enrollment 6 ` into the program. y 5. Utilization of Funds : Funds awarded are to be expended for purposes 8 and activities covered by SUBGRANTEE' s approved grant. Adjustments will) 9 be made to correct previous overpayments or underpayments . SUBGRANTEE IO agrees that any funds spent by SUBGRA14TEE in violation of this agree- 11 ment, along with interest which has been earned upon such funds , shall 12 be returned to COMMISSION within thirty (30) days of demand by t 13 COKI-IISSION, or at option of COMMISSION, shall be debited from succeedin 14 payments due from COht,ISSION under this agreement. 15 6. Allowable Costs : Costs incurred under any grant shall be determined in 16 accordance with Circular A-102 and FMC 74-4 . The cost principles to be i 17 used in determining allowable CETA costs are referenced in 41 CFR 29.70: 18 103 "Cost Principles" , except where modified by CETA regulations . 19 ' 7. Expenses Not Allowable: Grant funds may not be expended for any item 20 not identified as allowable under 20CFR 676.40. SUBGfLANTEE further :1 agrees that the expenditures of any and all funds under this agreement I 22 must be in accordance with the BUDGET SCHEDULE , a copy of which is � 23 i attached hereto. Prior approval shall be sought from the COMMISSION on 24 any questionable expenditures. 25 8, Unexpended Funds: All unexpended balances of grant funds will revert 26 to the COMISSION. 27 9. Grant Interest: SUBGRANTEE shall be accountable fcr interest earned on 28 advances of grant in bid funds, pending their disbursement or actual 28 i 1 j application for program purposes. Such interest income shall be 2 i accountable at the end of a grant period and may revert to the 3 COW-11 SS IONI if not utilized for program purposes. i 4 10. Income for Other Sources: All income from other sources, such as S contributions , donations or funds from other grant programs , must be 6 accounted for separately and not co-mingled with, CETA funds . The 7 } SUBGR.ANTEE certifies that no other federal funds will be received or 8 used for the portions of the project funded by the COMMISSION. 9 11 . Property Procurement Standards : SUBGRANTEE will comply with the 10 property management standards as set forth in OMB Circular A-102 and 11 in 41 CFR 29-70.215. Title to property acquired in whole or in part 12 with grant funds in accordance with approved budget shall vest in the 13 COgMISSIQN, subject to divestment at the option of the COWISSION. 14 ' SUBGRANTEE shall exercise due care in the use , maintenance, protection, 15 ; and preservation of such property durin- the period of project use. 16 SUBGP.ANTEE must obtain authorization from the Orange County Manpower 17 Commission prior to purchase , lease or rental of any equipment with a 18 unit cost in excess of $300 during a fiscal year. 19 1 12. Obligation of Grant Funds: Grant funds shall not, without advance 20 written approval b the COMMISSION be obligated prior to the effect- � PP Y 9 21 iveness or subsequent to the termination date of the grant period. 22 Obligations outstanding as of the termination date shall be liquidated 23 within ninety (90) days. Such obligations must be related to goods or 24 services provided and utilized within the grant period. 25 13. Bond-ling: Every officer, director, agent or employee of SUBGRANTEE who 26 is authorized to act on behalf of SUBGRANTEE for the purpose of 27 receiving or depositing funds into program accounts or issuing finAncia 28 ; documents, checks, or other instruments of payment for program costs , 29 i shall be banded to provide protection against loss. The amount of 2 coveragE shall be the lower of the following: 3 ! a} S100,000; or a b) The highest advance received through check or draw down during I 5 the preceding grant year, or for new recipients ,the highest I 6 advance through check or draw down planned for the present 7 grant year. I 8 14. Insurance: The SUBGRANTEE must provide evidence of adequate personal 9 liability and property damage insurance prior to funds being disbursed, 10 + The COMMISSION may at its sole discretion waive the above requirement. 11 15. Public Service Employment Positions: Public Service Employment 12 positions created and/or filed subsequent to April 1 , 1979, will be 13 limited to entry level positions , with the exception of project 1 14 ; positions under Title YI . Within 90 days of the effective date of the 15 contract agreement, the COMMISSION will verify whether the entry level 16 ; requirement has been met . If the COHMISSION finds that the position 17 in question is not an entry level position , the COMMISSION will notify I 18 SUBGRANTEE of the modifications needed to conform the position with i 19 + the entry level requirement. If the SUBGRANTEE fails to comply with 20 the COfT- ISSION' s request within 15 days , the COMIISSIOh will remove 21 the position from the SUBGRANTEE' s allotment. 22 16. Release Time Trainina: SUBGRANTEE may permit Public Service Employ- 23 ment participants hired under this subgrant agreement to participate s 24 in manpower services and activities as set forth in 20 CFR 667-678 25 , -- including, but not limited to, assessment and employability plan 26 I development, classroom training and job search assistance. 27 I 17. General : The administration of grants shall be subject to such .28 further rules , regulations and policies concerning accounts and 30 r I records , payments of funds , cost allowability, submissions of financial 2 f records , etc. , as may be prescribed by the COMU-01ISSION. 3 C. Cancellations or Modifications 4 1. All parties to this grant agree that program funds are contingent upon g funds received , or obligated from the Department of Labor under CETA of { 6 1978. If such funds are not forthcoming, or otherwise limited, the 7 j COhI'1I5SION will notify the SUBGRANTEE of any such notice or provisions i g and order them to cease , limit , or otherwise curtail their operations in 9 accordance with the following provisions : 10 In the event the Department of Labor terminates in whole or in part its contract with the prime contractor before 11 ! the expiration date, and by so doing makes necessary the termination by the prime contractor of this subcontract, 12 ! the Program Agent will provide prompt notice of termina- tion to the subcontractor. Upon receipt of such notice, 13 the subcontractor agrees to cease such operations as are 1 necessary to conform with the Department of Labor- termina- 14 tion of the prime contract within 20 days , and to negotiate necessary fair and reasonable final settlement and close- ts i out costs . (Sec. 106 , 107 and 106 CETA of 1978 and 20 CFR 676.90) 16 i 17 i 2. If the SUBGRANTEE should fail to meet the commitment of this grant either 1B because of failure to perform; changes in the program operating environ- 19 ment; or other factors that are a product of program operations or 20 changes in circumstances or situations , then the LOMMISSION may at its 21 discretion, withhold further funds , and unilaterally terminate the grant. 22 This subgrant may be terminated by either party, at its sole discretion, 23 upon 30 days written notice to the other party. There may be a mutually 24 agreed upon reallocation of the balance of funds with a change in goals, 25 objectives and program design. 26 3. All changes tr modifications to the grant shall be Jointly negotiated 27 between the SUBGRANTEE and the COMISSION. In all cases, changes and 28 modifications shall be made in compliance with rules, regulations , 31 p1 1 p:,licies and procedures presently in existence or provided in the 2 future by the COMMISSION. ' 3 D. Reports 4 R 1. The SUBGRANTEE shall submit , at such times and in such form as may be 5 j prescribed, such reports as the COMMISSION may reasonably require. The b COMMISSION shall notify the SUBGRANTEE from time to time as necessary o 7 any changes in the SUBGRANTEE' s reporting requirements. 8 1E. Monitoring and Evaluation 9 1 1. Monitoring and/or evaluation will be scheduled in accordance with the 10 overall COMV-IISSION Management requirements and will require access on 11 the part of the C01-11•SISSION to all records , data , and other document- 12 ' ation , as well as access to observe in a reasonable manner relevant 13 program activities , as related to this subgrant. ' 14 F. Authority to Bind SUBGRANTEE 15 1. SUBS ANTEE shall furnish to the COM".ISSION, in writing, a list of i lb persons authorized to execute, in behalf of the SUBGRANTEE, modifica- 17 tions to the grants , Invoice for CETA Project, or other documents as may I 18 , be required by the COM'ISSION. In the event authority is delegated to a 19 position (e.g. , City Manager, Personnel Director) rather than to an 20 individual , the list of positions so authorized shall be furnished. 21 B. Fair Employment: Practices 22 1 . Statutes , rules, and regulations governing state and federal fair i Z3 employment practices are required to be adhered to by SUBGRANTEE in the 24 conduct of and/or related to the operation of the grant. 25 Complaint and- Hearing Procedures: SUBGRANTEE shall continue to operate or 26 shall establish and maintain for its CETA participants a grievance or com- 27 plaint procedure relating to the terms and conditions of CETA employment, as 28 set forth under Section 106(a) and (b) of the Act. The SUBGRM tEE who does 32 not have a grievance or complaint procedure may use the procedure set forth 2 j under Section 676.83 of the April 3, 1979 Federal Register. Those SUB- 3 GRANTEES who do not utilize the procedures in Section 676.83, shall establis 4 ! or maintain procedures which shall provide at a ninimum: 5 a) Notice , upon enrollment into employment or training of the scope and 6 availability of such procedures. 7 j b) Notice, at the time the complaint is filed, of the procedures under 8 I which the complaint is being processed. 9 c ) Written notification of the disposition of the complaint, and the 10 reasons therefore , which shall be issued within 60 days of the 11 ! filing of the complaint, unless the grievance procedure or .collectiv i 12 ! bargaining agreement specifically provides other limits. i 13 d) Written notification of the right to file a complaint with the Grant 14 Officer of the decision issued, pursuant to Section 676.86 of the 15 CETA regulation as published in the Federal Register of April 3, 197 . 16 The SUBGRANTEE shall submit to COMMISSION a copy of the applicable Complaint 17 and Hearing procedures and shall notify COM11.-IISSION of any amendments or is revisions thereto. 19 I . Hold Harmless Agreement 20 Each party hereto agrees to hold harmless , deferid , and indemnify the other 21 party, its agents and officers, and employees from and against any legal 22 liability arising out of or resulting from the acts or ommissions to act of Z3 the indemnifying party to the extent permissable by law. 24 Equal Employment Opportunities 25 The Operational Compliance Review consists of on-site monitoring of program 26 to assure that unlawful discrimination on the part of the SUBGRANTEE does not 27 affect the abilities of the COMMISSION to fulfill its commitments under the H' 28 Act, 'thereby affecting CO101ISSION's future funding. Specific items which 33 V I may be monitored at least every three (3) months are: 2 it 1. The proportion of minorities and women enrolled, their numbers in the 3 ! various program components, and numbers placed, as compared to the 4 grantee' s plan and percentage of minorities and women in the eligible r 5 ) population. 6 2. Their percentage of minority and female participants and staff personnel 7 at all levels within the SUBGRANTEE' s organization, funded under this I 6 grant and their upward mobility or lateral movement over a period of g time. 10 i 3. Periodic interviews will be conducted with a representative sample of 11 participants and staff personnel funded under this grant. i 12 h 4. No individual shall participate in programs receiving financial assist- 2 5 ance under this Act for longer than a total of 30 months in any 5-year 26 period. For purposes of this paragraph, no period of participation 27 prior to October 1 , 1978, shall be included in the computation of such 28 ; 30 months (Section 121(c) (2) ) . i li 38 r I p. Conditions of employment and training shall be appropriate and reason- 2 able in the light of such factors as the type of work, geographical 3 region, and proficiency of the participant (Section 121(d) ( 1) ) . 4 q. It shall establish and maintain appropriate health , safety and other 5 standards for wort; and training (Section 121 (d)(2)) . 6 r. Household support obligations shall be taken into account, and special consideration shall be given alternative working arrangements such as 8 flexible hours of work, work-sharing arrangements , and part-time jobs , g particularly for parents of young children and for older persons (Sec- 3.0 tion 121(d)(3) )• .1 s. All programs for iii-school youth shall be consistent with applicable 12 State educational standards (Section 121(d) (4)) . 2 3 t. Appropriate worker' s compensation or equivalent protection shall be i 14 provided to all participants (Section 121(d) (5) ) . I 15 ` u. The program shall result in an increase in employment and training 3.6 opportunities over those opportunities which would otherwise be 17 i available (Section 1?1(e)( 1 ) ). 16 v. No currently employed worker shall be displaced by any participant ' i 3.9 (including partial displacement such as a reduction in the hours of 20 yy! non overtime work, wages , or employment benefits) Section 121(e)(2)) . 22 i w. No person shall be trained for an occupation which requires less than 6 2 weeks of pre-employment training unless there are imrediate employ- 7 ment opportunities available in that occupation (Section 121(f) (2)) . 8 aa. It shall not hire a person in an administrative capacity, staff posi- 21 tion, public service employmen!: position or on-the-job training I 22 1 position funded under the Act, if a member of that person' s immediate 23 family is engaged in an administrative capacity for the recipient or 24 program agent from which SU3GRANTEE obtains its funds (Section 123(g) ). t 25 1 uu. It shall comply with applicable Federal , State, and local child labor� 26 laws (20 CFR 676. 67). ' 27 vv. It shall not select, refldct, or promote a participant based on that 28 -Individual ' s political affiliation or beliefs (20 CFR 676.63(a) ) . 43 F �F Y ww. do funds provided under the Act will be used to attempt to influence 2 in any manner a member of Congress , State, or local legislators to f s favor or oppose any legislation or appropriation by such legislators I 4 (Section 123(g) ) . xx. It will comply with the requirement that no funds under the Act shall 6 he used in any way to either promote or oppose unionization. (Section 123(g) ) • g I yy. 1t will comply with the requirement to establish and use internal pro- 9 ' gram management procedures sufficient to prevent fraud and program 10 abuse (20 CFR 676. 75-1( 1 )). 11 18. Additional Assurances Relating- to Eligibility - All Titles 1.2 1 . A person shall be eligible to participate in a program receiving i 13 i financial assistance under the Act only if such person is economically 14 disadvantaged and either unemployed, underemployed or in school as 15 i defined by the Act and as published in the Federal Register for each 16 applicable title/program (Section 213 , and 20 CFR 675 . 5-1 through 9 17 and 675.6) . ! f is 19 20 21 f 22 23 24 25 26 27 28 1 44 MOM I C. Additional Assurances Relatino to Public Service Employment Programs , 2 Title II-p and YI 3 For public service employment activity, the applicant further assures and 4 I certifies that: S 1 . It will comply with the requirement that only persons residing within 6 the area qualifying for assistance shall be employed, and the public 7 i services provided by such jobs , to the extent feasible, shall be de- 1 S } signed to benefit the residents of such area (Section 122(a) ) . 9 2. It will comply with the requirement that transitional public service 10 4 employment for unemployed economically disadvantaged persons shall be: 11 i a) entry level (with exception of Title VI project positions); 12 i b) combined with training and supportive services if such training and 13 services are reasonably available in the area ; 14 c) designed to enable participants to move into unsubsidized employ- ment (Section 232(a ) ) . 16 3. Public service employment under the Act shall be intended for eligible 17 persons who are the most severely disadvantaged in terms of their 18 length of employment and their prospects for finding employment i 19 (Section 122(b) ( 1) (A) ) . 20 4. Special consideration in filling public service jobs shall be given to �I 21 eligible persons who are public assistance recipients or who are 22 ! eligible for public assistance but not receiving such assistance 23 (Section 122(b) (1 ) (A) , (b) ) . .14 5. Special consideration shall be given to eligible disabled and Vietnam- 25 era veterans (with special emphasis on those who served in the Indo- 26 china Theatre on or after August 5, 1964, and on or before May 7, 1975) ` 27 in accordance with procedures established by the Secretary of Labor, 2E and special attention shall be given to the development of jobs which 45 r 1 where feasible, revise qualification requirements , including Civil i 2 Service requirements and practices relating thereto, in accordance i 3 with regulations prescribed by the Secretary, with a view toward re- 4 moving artificial barriers to public employment of those assisted 5 under the Act (Section 122(f) ) . 6 12. It shall maintain and make available to the public, financial records 7 relating to public service employment programs , and records of the 8 names , addresses , positions , and salaries of all persons employed in 9 public service jobs (Section 122(g) ). ! 10 ` 13. A person in public service employment or similar employment shall be 11 paid wages which shall not be less than the highest of (1 ) the minimum- 12 �' wage under Section 6(a)(1 ) of the Fair Labor Standards Act of 1938, 13 1 (2) the minimum wage under the applicable State or local minimum wage 14 law or (3) the prevailing rates of pay for persons employed in similar 15 j occupations by the same employer (Section 124 (b) ) . 16 14. No participant will be paid wages from funds under the Act for public i 17 ! service employment for more than 78 weeks in a 5-year period. For 18 purposes of this paragraph, no more than 2E weeks of public service 19 j employment financed in whole or in part under the Act prior to October i 20 1 , 1978, shall be considered as a part of the 78 weeks (Section 122 21 ( (h)(2) ) • i ! 15. Funds under the Act shall not be used to pay wages to any individual 22 ! 23 I employed in a public service job at a rate in excess of $10,000, 1 24 except where such maximum is adjusted upwards for particular areas 25 served by recipients as determined by the Secretary of Labor (Section 26 122(1 )(1 ) ) . . 27 lb. In order to provide the maximum number of employment and training 28 opportunities under the Act, the applicants shall comply with the I I 4 1 ` annual average federally-supported wage rate per public services job- .". ' holder equivalent to $7,200, as adjusted in accordance with the wage I 3 adjustment index issued by the Secretary of Labor (Section 122(i ) (2) ) .- 4 17. No public service employment participant shall be provided wages for S any public service employment job from sources other than the Act 6 (Section 122( i )(4 )(A) ) . Except that public service employees receivin 7 financial assistance under Title VI of the Act may have their wages I 8 i supplemented by the payment of additional wages for such employment 9 only under the following conditions: 10 a) the total amount of funds which may be used in any fiscal 11 year to provide such supplemental wages shall not exceed a 12 sum equal to 10 percent of such prime sponsor' s allocation 13 I under Title VI for such fiscal year; and 14 b) the supplemental wages for any public service employee under 15 i Title VI may not exceed an amount equal to 10 percent of the I 16 maximum federally-supported wage applicable for such sponsor 17 ' area (Section 609) . 18 18. Notwithstanding the requirements of paragraph 16, any person in public 19 1 service employment on September 30, 1978, receiving wages from sources 20 other than the Act may continue to receive such wages (Section 122(j ) ) 1 21 19. All persons employed in public service jobs shall be provided worker' s 22 " compensation, health insurance, unemployment benefits , and other i 23 benefits and working conditions at the same level and to the same 24 extent as other employees working a similar length of time, doing the 25 same type of work and similarly classified. Any such classification 26 j shall be reasonable and shall include nonfederally financed employees, 27 but within any classification a distinction may be made between public 28 service employees for purposes of determining eligibility in retire- 47 I t ment systems or plans which provide benefits based on age or service 2 or both (Section 122(k) ) . 3 + 20. To the extent feasible, public service jobs shall be provided in 4 ! occupational fields which are most likely to expand within the public S and private sectors , and to the extent compatible with such objectives, 6 shall meet community needs , including, but not limited to, community 7 betterment activities , education, health care, transportation services, 8 crime prevention and control , and environmental quality control i 9 ! (Section 122(m) ) . 10 ; 21 . It shall not hire an individual in a public service employment 11 position, if such individual has , within 6 months voluntarily term- 12 inated , without good cause , his or her last previous full-time 13 employment at a wage rate not less than the federal minimum wage as 14 prescribed under Section 6(a )(1 ) of the Fair Labor Standards Act of 15 ; 1938 (Section 122(n) ) . 16 22. Fifty percent of funds available under Title VI shall be used only fo i 17 ' emplcyr nt in projects (carried out by project applicants) planned to i 1g extend for not more than 18 months from the commencement of the pro- 19 jest (Section 605 (a) ) . 20 ? 23. When filling teaching positions in schools under local education I 21 { agencies under Title V1 , program operator shall not outstation but 22 shall subcon*.:-act with local educational agencies pursuant to Section 23 678. 30 ) of these regulations (Section 603(b) ), (20 CFR 676.25-3 (c) i 24 (5)• 25 24. PSE participants shall not be erployed in building and highway con- 26 struction word, (except that which {s normally performed by the 27 recipiih t or subrecipient) or in any work which primarily benefits a 28 private-for-profit organization (20 CFR 676.25-3(d)). 48
