I AGREEMEN'T TH I S AGREEMENT Trade and entered Into this A9 day of 1977 by and between the City of Fountain Valley, a municipal corporation, her/in- after called "FOUNTAIN VALLEY," the City of Huntington Beach, a municipal corpora- tion, hereinafter called "HUNTiNGTON BEACH," the City of Seal Beach, a municipal . corporation, hereinafter called "SEAL BEACH," and the City of Westminster, a muni- cipal corporation, hereinafter called "WESTMINSTER." WITNESSET 'H THAT: WHEREAS, the cities of FOUNTAIN VALLEY, HUNTINGTON BEACH, SEAL BEACH, and WESTMINSTER maintain as part of their muncipal service an organized and equipped fire department, charged with the duty of fire protection, rescue and paramedical services within the corporate limits of each of said cities; and WHEREAS, Investigation has disclosed that It would be to the mutual benefit of each city that the services of each fire department be in some circumstances extended outside of the corporate limits of each city, and into the other cities; and WHEREAS, the parties hereto desire to enter into a mutual response pact, wherein in some circumstances one party will first respond to emergency medical inci- dents within the corporate limits of the other cities and conversely and mutually the other cities will in some circumstances respond first to involvements within the corporate limits of another city; and WHEREAS, the parties hereto desire to set forth their rights, duties and responsibilities with respect to said mutual response obligations, NQW, THEREFORE, for and in consideration of the covenants herein contained, per- formed and to be performed, the parties hereto agree as follows: -1- i r The parties hereto, pursuant to the authority granted by Section 55632 of the California Government Code and subject to Section 55634 of the California Government Code, do hereby contract to respond to medical emergencies outside their corporate geographical limitations, and within the corporate geographical limitations of the others, in accordance with the terms and conditions as shall hereinafter appear. I1 Each of the parties hereto will provide paramedical service to geographical areas of the other cities, accompanied by a minimum of two certified paramedics under the terms and conditions as shall hereinafter appear. Ili Each city respectively shall provide and maintain a suitable liability in- surance policy to protect it from casualty losses by reason of the activities contemplated by this contract, and each city shall provide the other with a certificate making the other cities joint insured under said liability Insurance policy, to the extent of the activities contemplated by this contract. iV Each city hereunder shall maintain suitable workmen's compensation coverage for its own employees without cost to the ether cities, and each city shall pay- roll its own personnel without cost to the other titles, said payroll to include existing employee benefits such as vacation- time, retirement benefits, shift arrangements, health and accident insurance and such other benefits as exist In each city, all without cost to the others. -2- V Each of the parties hereto shall be fully responsible for all repairs, maintenance and upkeep of all equipment in use pursuant to this Agreement, while said equipment is Used outside of its geographical limitations, said repair and maintenance and upkeep to include gas, oil , lubrication, parts replacement and repair of casualty damage. V1 It is further understood and agreed by and between the parties hereto that the paramedical service mutually agreed to be rendered pursuant to this Agree- ment shall Include fire and rescue services. VII It is further understood and agreed by and between the parties hereto that each city warrants and represents that it has sufficient equipment to handle the involvements which shall be assigned to It through the aforementioned agreed response pattern. Vill It is further understood and agreed that each city shall provide the necessary police traffic control personnel within its geographical boundaries, and that traffic light control , if any, shall be the responsibility of each city within its own geographical boundaries. ix It is further understood and agreed by and between the parties hereto that, for the purposes of liaison and the administration of this contract, there is hereby designated the Fire Chiefs of each city who shall ,jointly be responsible for the administration of this contract. It is also Understood and agreed that this responsibility may be delegated to agents or employeees of the respective fire departments of the cities, and that each party shall furnish the others in writing the names and rank of all participating officers. -3- X It is understood and agreed by and between the parties hereto that no money payments Q.111 be made between cities, that no charges will be assessed by any city against the others, and that each city shall be fully responsible for all of its costs in connection with the administration and performance of this contract. XI This Agreement shall remain in full force and effect from and after the date hereof, providing that the same may be terminated by any of the parties after giving notice in writing of its intention to terminate not less than ninety (90) days from and after the date of said notice. Such agreement contained herein shall be reviewed by the involved parties at least annually. XII This Agreement shall supersede that certain agreement dated June 17, 1975, by and between "FOUNTAIN VALLEY", "HUNTINGTON BEACH" and „KIi IMINSTER". AGREEMENT ORIGINAL THIS AGREEMENT made and entered into this 161h day of June 1975 by and between the City of Fountain Valley, a municipal corporation, hereinafter called "FOUNTAIN VALLEY" , the City of Huntington Beach, a municipal corporation, hereinafter called "HUNTINGTON BEACH", and the City of Westminster, a municipal corporation, hereinafter called "WESTMINSTER" . W I T N E S S E T H T H A T : WHEREAS, the cities of FOUNTAIN VALLEY, HUNTINGTON BEACH, and WESTMINSTER maintain as part of their municipal service an organized and equipped fire department, charged with the duty of fire protection, rescue and paramedical services within the corporate limits of each of said cities; and WHEREAS, investigation has disclosed that it would be to the mutual benefit of each city that the services of each fire department be in some circumstances extended outside of the corporate limits of each city, and -into the other cities; and WHEREAS, the parties hereto desire to enter into a mutual response pact, wherein in some circumstances one party will first respond to emergency medical incidents within the corporate limits of the other cities and conversely and mutually the other cities will in some circumstances respond first to involvements within the corporate limits of another city; and 1. WHEREAS, the parties hereto desire to set forth their rights, duties and responsibilities with respect to said mutual response obligations, NOW, THEREFORE, for and in consideration of the covenants herein contained, performed and to be performed, the parties hereto agree as follows: I - The parties hereto, pursuant to the authority granted by Section 55632 of the California Government Code and subject to Section 55634 of the California Government Code, do hereby con- tract to respond to medical emergencies outside their corporate geographical limitations, and within the corporate geographical limitations of the others, in accordance with the terms and conditions as shall hereinafter appear. II Each of the parties hereto will provide paramedical service to geographical areas of the other cities, accompanied by a minimum of two certified paramedics under the terms and conditions as shall hereinafter appear. III Each city respectively shall provide and maintain a suitable liability insurance policy to protect it from casualty losses by reason of the activities contemplated by this contract, and each city shall provide the other with a certificate making the other cities joint insured under said liability insurance policy, to 2. the extent of the activities contemplated by this contract. IV. Each city hereunder shall maintain suitable workmen's com- pensation coverage for its own employees without cost to the other cities, and each city shall payroll its own personnel with-' out cost to the other cities, said payroll to include existing employee benefits such as vacation time, retirement benefits, shift arrangements, health and accident insurance and such other benefits as exist in each city, all without cost to the others. V Each of the parties hereto shall be fully responsible for all repairs, maintenance and upkeep of all equipment in use pursuant to this Agreement, while said equipment is used outside of its geographical limitations, said repair and maintenance and upkeep to include gas, oil, lubrication, parts replacement and repair of casualty damage. VI It is'further understood and agreed 'by and between the parties hereto that the paramedical service mutually agreed to be rendered pursuant to this Agreement shall include fire and rescue services. VII It is further understood and agreed by and between the parties hereto that each city warrants and represents that it has sufficient equipment to handle the involvements which shall be assigned to it through the aforementioned agreed response pattern. 3. r VIII It is further understood and agreed that each city shall provide the necessary police traffic control personnel within its geographical boundaries, and that traffic light control, if any, shall be the responsibility of each city within its own geographical boundaries. IX It is further understood and agreed by and between the parties hereto that, for the purposes of liaison and the admini- stration of this contract, there is hereby designated the Fire Chiefs of each city who shall jointly be responsible for the administration of this contract. It is also understood and agreed that this responsibility may be delegated to agents or employees of the respective fire departments of the cities, and that each party shall furnish the others' in writing the names and rank of all participating officers. X It is understood and agreed by and between the parties hereto that no money payments will be made between cities, that no charges will be assessed by any city against the others, and that each city shall be fully responsible for all of its costs in connection with the administration and performance of this contract. XI This Agreement shall remain in full force and effect from and after the date hereof, providing that the same may be 4 r terminated by any of the parties after giving notice in writing , of its intention to terminate not less than ninety (90) days from and after the date of said notice. Such agreement contained herein shall be reviewed by the involved parties at least annually. IN WITNESS WHEREOF we have hereunto placed our hands and seals on the day and year first above written.
