Wilson, City Manager SUBJECT: Approve and authorize execution of an Agreement with Public Cable Television Authority (PCTA) for reimbursement of video staff costs to produce City Council and Planning Commission meetings Statement of Issue: The City of Huntington Beach has been broadcasting its City Council and Planning Commission meetings since 1983. The City has been paying staff costs to broadcast the meetings. The Public Cable Television Authority (PCTA) is now collecting one percent of the State franchise fee to be used for programming. The PCTA has signed an agreement to reimburse the City for the staffing costs of broadcasting the meetings. Funding Source: The current amount budgeted for part-time video staff is $15,000. Reimbursement from the PCTA will be approximately $10,500 based on a four hour City Council Meetings and three hour Planning Commission Meetings. Recommended Action: Motion to: Approve and authorize the City Manager to execute the "Agreement Between the City of Huntington Beach and Public Cable Television Authority for Reimbursement of Programming Costs." Alternative Action(s): Do not approve the Agreement and direct staff accordingly. HB -41- Item 5. - 1 REQUEST FOR COUNCIL ACTION MEETING DATE: 5/16/2011 DEPARTMENT ID NUMBER: AD 11-015 Analysis: At the September 2010 Public Cable Television Authority meeting (PCTA), the board approved a proposal to cover the staff cost of broadcasting the City Council Meetings and Planning Commission meetings. This includes the cost of the part-time camera operators, videographers, scheduler, and engineer. At the April 20, 2011 meeting the PCTA voted to sign an agreement with the City of Huntington Beach to reimburse the City for the staff costs related to video production of the City Council and Planning Commission meetings. The PCTA will be billed on a monthly basis for costs, which will be based on the number of hours the above referenced meetings run. The same video staff members will continue working for the City. "Agreement Between the City of Huntington Beach and Public Cable Television Authority for Reimbursement of Programming Costs" -2- 5/5/2011 11:02 AM Item 5. - 2 HB - 2- ATTACHMENT # 1 AGREEMENT BETWEEN THE CITY OF HUNTINTON BEACH AND PUBLIC CABLE TELEVISION AUTHORITY FOR REIMBURSEMENT OF PROGRAMMING COSTS This Reimbursement Agreement is made and entered into this day of 2011. by and between the City of Huntington Beach, a municipal corporation of the State of California, hereinafter referred to as "City," and the Public Cable Television Authority, a Joint Powers Authority,hereinafter referred to as "PCTA." RECITALS - A. WHEREAS, the City broadcasts various meetings and functions, including its City Council and Planning Commission meetings, on public.television; and B. WHEREAS, the City uses part-time camera operators, videographers, a scheduler and engineer to do so; and C. WHEREAS, the PCTA has agreed to reimburse the City for production cost of broadcasting the City Council meetings and Planning Commission meetings. NOW? THEREFORE, in consideration of the above recitals and the mutual promises contained herein, PCTA and City hereby agree as follows: AGREEMENT 1. PCTA agrees to reimburse City for its production costs (See Exhibit 1) to broadcast its City Council and Planning Commission meetings. 2. City agrees to submit an invoice for its production cost to PCTA at the end of the -City's fiscal year. 3. This Agreement shall be deemed effective on the date first set forth above (the "Effective Date") and shall continue in effect until terminated as provided herein. 11-2759/57323 Page 1 of 3 4. This Agreement shall remain in effect indefinitely from the Effective Date, provided that City may terminate this Agreement upon thirty (30) business days' prior written notice to PCTA. 5. The persons executing this Agreement on behalf-of each party warrant that he/she is duly authorized to execute and deliver this Agreement on behalf of the respective party for whom they sign, and that by so executing this Agreement, the parties are bound by the provisions of this Agreement. 6. This Agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof, and all prior and contemporaneous agreements, presentations, negotiations and understandings of the parties, whether oral or written, are hereby superseded and merged herein.
