Pier Lifeguard Tower & Restrooms - 1993-07-06
1 REQUE%-.i i FOR CITY COUNQ. ACTION Date July 6, 1993 Submitted to: Honorable Mayor and City Council Submitted by: Michael T. Uberuaga, City Administrato Prepared by: is F. Sandoval, Director of Public Works APPROVED BY CITY COUNCIL Subject: PIER LIFEGUARD TOWER AND RESTROOMS 1923 C CLFRK Consistent with Council Policy? [ ]XYes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source, Alternative Actions,Attachments. IA.-I STATEMENT OF ISSUE: Bids for the construction of the Pier lifeguard tower and the public restrooms have been received. RECOMMENDED ACTION: Reject all bids for the Pier lifeguard tower and restrooms and authorize staff to study modifying the plans and report back to Council. ANALYSIS: Bids were received on June 3, 1993 for the construction of the pier lifeguard tower and restrooms. They are summarized, as follows: 1. Team Construction Management $451,300 2. Irvine Engineering Corp. 524,540 3. CWR Corp. 526,000 4. Sedon Engineer„Contractors, Inc. 590,120 5. AMD Construction Group, Inc. 598,640 6. Elam Woods Construction Co. 660,000 The engineer's estimate for both buildings was $300,000 based upon a one year old estimate of $267,000 provided by Construction Analysts, Inc., a cost estimating firm. Attached is an evaluation of the bids by the Architect, Ron Yeo. He feels that the low bid is a competitive one, and he also states that changing the materials would lessen the aesthetics and low maintenance qualities of the buildings. He, therefore, recommends that the low bid of Team Construction Management be awarded. The costs for the remaining three concession buildings including the restaurant, should be considered if the same materials are used for all the pier buildings. The City has retained Anthony and Langford Architects to prepare the construction drawings for these three remaining buildings. A final cost estimate will be prepared as part of their contract. Based upon the bids received for the tower and restrooms, the preliminary cost estimate for the three remaining buildings would be approximately $1.5 million. The budget, however, for all five buildings is only $1.3 million. It should be noted that the recommended terrazzo wall surfacing alone constituted 27% of the low bid. A representative of Team Construction Management, the low bidder, has indicated that there are various "high—tech" materials available which would be high quality, cost—effective substitutes for terrazzo. PIO 5/85 Pier Lifeguard Tower & Restrooms - RCA July 6, 1993 Page 2 Alternate materials and/or design modifications could be investigated to lower the construction costs. It is recommended that this be accomplished by Anthony and Langford. Upon completion of that quick study, staff will report back to the City Council with recommendations. FUNDING SOURCE: The Pier Fund. ALTERNATIVE ACTION: A. 1. Accept the low bid submitted by Team Construction Management for the construction of the pier lifeguard tower and public restrooms in the amount of $451,000 and authorize the Mayor and City Clerk to execute the contract. This would necessitate the addition of approximately $650,000 to the budget for all five buildings if materials are unchanged. 2. Authorize the Director of Public Works to encumber $5,000 for anticipated supplemental expenses. 3. Authorize the encumbrance of an additional $45,000 for change order allowance. B. investigate a proposal from the low bidder, Team Construction Management, to award a reduced cost contract to them by using "Value Engineering" to introduce cost saving alternate materials. C. Reject all bids and re--design to a determined construction cost and re-bid. D. Reject all bids; combine all buildings in one construction contract; and re-bid. ATTACID ENTS• 1. This estimate of$130,000 for the Lifeguard Tower and $170,000 for the Restroom was based upon the October 1991 cost estimate of$266,871 by Construction Analysts, Inc. (which was based upon conceptual drawings) plus an increase of$33,129. A summary of our architects estimate's:. February, 1990: $191,323 (Tower only) November, 1990: $300,000 (base cost only) +12 000 (+40% for overhead / profit, bonds) $420,000 March, 1992 $351,000 (base cost only, no overhead /profit, bonds) November, 1992 $399,577 (base cost only) +79.923 (20% increase mentioned in memo) $479,500 Please refer to the attached comparison between the City's estimate, Team Construction's bid, and numbers generated by a contractor we have used in the past. JUN 21 '93 03:31 RON YEO,rAIA ARCHITECT P.2 page 2 Since these earlier estimates, a number of things have occurred that would increase the Cost: } 1. 5% inflation/escalation, lumber cost increase: $35,000 2. The project was reduced in size, in which the cost burden 50,000 of supplying utilities (especially electrical) / overhead / supervision / coordination is placed upon two buildings instead of five buildings. (Refer to memo dated March 3, 1992.): 3. Revisions to plans - adding the stairs to the Lifeguard 15,000 'Power; 4. The conceptual cost estimate did not include preparation 1.0,000 of the pier surface at the Restroom Building: 5. The conceptual cost estimate did not include demolition of 51000 the old Lifeguard Tower and removal of the temporary electrical enclosure: j 6. The pier opened, necessitating the contractors to take 15,000 more time and precautions to protect the safety of thousands of pier users (assume 10% minimum): 7. Terrazzo costs have increased: 60,000 Construction Analyst's estimate: $15.50/sq. ft. Architect's estimate: $25.00/sq. ft. ! Actual Cost: $35.00/sq. ft. 8. The construction estimate did not include quality 15,000 materials and details to increase the life span of the buildings to match that of the pier: 9. Cost estimate's allowance for bonds and profit were low: 51000 Additional Costs Subtotal: $210,000 Overhead and Profit at 10%: 21,000 Subtotal- $231,000 Architect's base estimate: 351,000 Bundling Costs: $582,000 i This compares favorably with the bids (removing the high and the to-w): $524,540 526,540 3 590,1.20 I 598,640 Average: $559,600 The architect's memo of November 25, 1992 indicated costs of$399,577 with possibility of an additional 1.0 to 20% for construction complications, equaling $479,500. The low bid is $28,200 under this. IH If Team Construction is awarded the contract: Bid amount: $451,300 _ - 10% reserve for change orders:- 45,130 - Total dial Construction Costs. $496,430 This final construction cost is a savings of$85,570 over value. ` JUN 07 '93 17.0c PON YTO.FAIA ARCHITECT P.? page 3 f Options: 1. Revise quality and re bid (or negotiate cost savings with low bidder). Costs will not be substantially lower if the project is re-bid. What are the ramifications of using a stucco-like finish on the exterior of the buildings and going to a the interior at the restroom, in lieu of terrazzo at these locations? Obviously, money can be saved, but aesthetics, maintenance and longevity will be sacrificed. The savings would be in the neighborhood of$57,300. This won't make or break the bid,but it will be detrimental to the final product. Terrazzo was one of the key materials that was incorporated in presentations to the Pier Committee, Planning Commission, and City Council. You would have to determine whether changing the finish would require going back to these groups for now approvals. Our major concerns with stucco are that it is ordinary, collects dirt, hard to clean, subject to vandalism, doesn't resist the marine environment and would change the buildings from unique beauty to average utilitarianism. 1 Change lath from stainless steel to galvanized -- $7,000 savings. I Delete ceramic the -- $8,000 savings. Change to solid phenolic or plastic toilet partition's -- $1,500 savings. This totals $73,800 in possible deductions from the bid price. Other items may be able to be fine tuned to lower the cost. It would probably to be best to work directly with Team Construction to get the prices for these items. 2. Build one building at this time (the tower), and place the other in the next phase bid set. j 3. Do not build -- use the temporary tower and combine both buildings in the next phase bid set. 4. Award to the lowest bidder. What is our comfort level of the low bid of$451,3W by Team Construction? We have called their three references: each one was pleased with the quality of Team's work and would work with them again, The references indicated that construction problems and delays Vere minimized and that quality craftsmanship was provided. The references were very positive. We have checked with key subcontractors -- terrazzo, tile, glass, and framing. They each assured us that they understood the contract documents, understood the scope of the work., an Could provide the services required for successful completion of the project. JUN 07 '99 17:07 RON YEO,EAIA ARCHITECT P.3 F page 4 Anytime the law bid is $73,000 below the next bidder, there is cause for concern. However, Team Construction is a local Huntington Beach firm with their office on Main Street and they want to do this job as a sign of pride and workmanship. They are probably doing it for cost, with little or no profit. Many of their subcontractors prices are tight and night cause delays or change order requests once they start losing money, Five of their subcontractors are located in Huntington Beach. They do not have a tremendous amount of public works experience, and may tend to have more relaxed procedures than is preferable for government paper work. This may tend to create problems with coordination, but if we can meet early and define procedures, potential problems will be minimized. This will mean more work for all -- to keep track of and stay and on top of the construction. Our recommendation: go for it. This is the best price you will get for a quality project. The buildings won't get less expensive as time passes. The original intent was to create quality buildings with long life spans, and decreasing the quality of materials will actually increase life span costs due to maintenance and shorter material life. f 3 'o iI i i . i 0. uHrr Lii co . rQ ' F fv rsa .w-• ,5.,,r` •!-'::1:. CONTRACTOR shall, within fifteen (15) days from the beginning of any such delay (unless the DPW shall grant a further period of time prior to the date of final settlement of the Agreement) , notify the DPW in writing of the cause of the delay and CITY shall extend the time for completing the work if, in its r judgment, the findings of fact thereon justify the delay; and the decision of the DPW shall be conclusive on the parties hereto. Should CONTRACTOR be delayed in the prosecution or - . completion of the work by the act, neglect or default of CITY, or should CONTRACTOR be delayed waiting for materials required by this Agreement to be furnished by CITY, or by damage caused by fire or other casualty at the job site for which CONTRACTOR is not responsible, or by the combined action of the workers, in nowise caused by or resulting from default or collusion on the part of 11/16/92 : sg -8- SAMPLE ONLY CONTRACTOR, or in the event of a lockout by CITY, then the time herein fixed for the completion of the work shall be extended by the number of days the CONTRACTOR has thus been delayed, but no allowance or extension shall be made unless a claim therefor is presented in writing to CITY within fifteen (15) days of the commencement of such delay. No claims for additional compensation or damages for delays, irrespective of the cause thereof, and including without limitation the furnishing of material by CITY or delays by other contractors or subcontractors, will be allowed and said extension of time for completion shall be the sole remedy of CONTRACTOR. 12. DIFFERING SITE CONDITIONS (1) Notice: The CONTRACTOR shall promptly, and before such conditions are disturbed, notify the DPW in writing of : (a) Subsurface or latent physical conditions at the job site differing materially from those indicated in this Agreement or the Contract Documents; or, (b) Unknown physical conditions at the job site, of an unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent to work of the character to be performed under this Agreement . The DPW shall promptly investigate the conditions and if it finds that such conditions do materially so differ and cause an increase or decrease in the time required for performance of any part of the work under this Agreement, whether or not changed as a result of such conditions, an equitable adjustment shall be made and the Agreement modified in writing accordingly; 11/16/92 : sg -9- SAMPLE ONLY (2) Time Extension: No claim of the CONTRACTOR under this Section shall be allowed unless the CONTRACTOR has given the notice required hereunder, provided, however, the time prescribed therefor may be extended by CITY. 13 . Payment to the CONTRACTOR will be made only for the actual quantities of contract items used in construction of the PROJECT, in accordance with the plans and specifications . Upon completion of the PROJECT, if the actual quantities used are either more than or less than the quantities listed in the bid schedule, the bid price shall prevail subject to the provisions of this Section. The DPW may, at its sole discretion, when warranted by the facts and circumstances, order an equitable adjustment, upwards or downwards, in payment to the CONTRACTOR where the actual quantities used in construction of the PROJECT are in variation to the quantities listed in the bid schedule. No claim by CONTRACTOR for an equitable adjustment in price or time for r completion shall be allowed if asserted after final payment under this Agreement . If the quantity variation is such as to cause an increase in the time necessary for completion, the DPW shall ascertain the facts and circumstances and make such adjustment for extending the completion date as in its judgment the findings warrant. 14 . PROGRESS PAYMENTS Each month the DPW will make an estimate in writing of the work performed by CONTRACTOR and the value thereof . From each 11/16/92 : sg -10- SAMPLE ONLY progress estimate, ten percent (10%) will be deducted and retained by CITY and the remainder, less the amount of all previous payments since commencement of the work, will be paid to CONTRACTOR. The final payment, if unencumbered, or any part thereof unencumbered, shall be made thirty-five (35) days after the acceptance of the work and the filing of a Notice of Completion by CITY. Payments shall be made on demands drawn in the manner required by law, each payment to be accompanied by a certificate signed by the DPW, affirming that the work for which payment is f demanded has been performed in accordance with the terms of the Agreement and that the amount stated in the certificate is due under the terms of the Agreement .
