By my signature hereunder as CONTRACTOR , I certify that I am aware of the provisions of California Labor Code section 3700 which requires every employer to be insured against liability for workers ' compensation or to undertake self-insurance in accord- ance with the provisions of that code , and I will comply with such provisions before commencing the performance of the work of this contract . 2 . The bond or bonds required to be furnished to CITY under this contract covering CONTRACTOR 'S faithful per- formance , the coat of labor and materials expended , and CONTRACTOR 'S one-year warranty must be furnished to and accepted by CITY prior to commencement of any work hereunder. All bonds most be in the amount stated in the special provisions incorporated herein, and in such form as is acceptable to the City Attorney. 7 . Warranty. This part applies to all contractors and subcontractors which hold any Federal• • or.. federally assisted . construction contract in excess of $10, 000. The regulations in this part are applicable to all. of a construction contractor' s or subcontrwctors' s construction contractor' s or subcontractor ' s - construction employees who are engaged in on site construction including those construction employees who work on a non--Federal or non-federally assisted construction site. , This part also establishes procedures which all Federal contracting .officers and all applicants, as applicable, shall follow in soliciting for and awarding Federal or federally assisted construction contracts. Procedures also are established which administer- ing agencies shall follow in making any grant , contract, leaur insurance or guarantee involving Federally assisted construc- tion which is not exempt from the requirements of. Executive Order 11246 , as amended. In addition, this part applies to construction work performed by construction contractors and subcontractors for Federal non -construction contractors and subcontractors if the con- struction work is necessary in whole or in part to the per- fo::mance of a non -construction contract or subcontract. Section 60-4 . 2 Solicitations . (a) All Federal contracting officers and all applicants shall include the notice set forth in paragraph (d) of this section and the Standard Federal Equal Employment Opportunity Construction Contract Specifications set forth in Section 60-4 . 3 this next in all solicitations for offers and bids on all Fed- eral and federally assisted construction contracts or subcon- tracts to be performed in geographical areas designated by the Director pursuant to Section 60-4 . 8 of this part . Admin- istering agencies shall require the inclusion of the notice set forth in paragraph (d) of this section and the specifica- tions set forth in Section 60-4 . 3 of this part as a condition of any grant, contract, subcontract, loan insurance or guaran- tee involving -federally assisted construction covered by this part 50-4 . Notice of Requirement for Affirmative Action .to Ensure Equal Employment Opportunity (Executive Order 11246) I . The afferor' s or bidder ' s attention is called to the Equal Opportunity Clause" and the "Standard Federal Equal Employ- ment Opportunity Construction Contract Specification" set forth herein. The goals and timetables for minority and female participa- tion , expressed to percentage terms for the Contractor' s ag-regate workforce in each trade on all construction work in the covered area are as follows : These goals are applicable to all the Contractor' s con- struction work (whether or not it is Federal or federally assisted) performed in . the covered area . The Contractor' s compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be based on its imple- mentation of the Equal Opportunity Clause , specific affir- mative action obligations required by the specific&tions set forth in 41 CFR 60-4 . 3 (a) and its efforts to meet the goals established for the geographical area where the contract resulting from this solicitation is to be performed . The hours of minoirty and female employment and training must be substantially uniform throughout the length of the con- tract, and in each trade, and the contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minorities or female employees or trainees from Contractor to Contractor or from project to project for the sole purpose of meeting the contractor ' s goals shall be a violation of the contract , the Executive order and the regulations in 41 CFR Part 60-4 . Compliance with the goals will be measured against the total work hours performed . 3. The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs within 10 working days of award of any construction subcontract in excess of $10, 000 at any tier for construction work under the contract resulting from this solicitation , The Notification shall list the name , address and telephone number of the subcontractors employer identification number; estimated dollar amount of the subcontracts estimted starting and completion dates of the sucontractt and the geographical area in which the contract is to be perfox j?,sd . 40 4 . As used in this notice, and in the contra resulting from this solicitation, the "covered area" is State of California, County of Orange , City of Huntington Beach. Section 60-4 . 3 Fgual Opportunity Clauses • (a) The equal opportunity clause published at 41 CFTC 604. 4 (a) of this chapter is required to be included in, and is part of all nonexwmpt Federal contract►, including construction contracts and subcontracts. The equal oppor- tunity clause published at 41 CFR 60-1 . 4 (b) is required to be included in and is a part of all nonexempt federally assisted construction contracts and subcontracts . In • addition to the clauses decribed above , all federal con- tracting officers, all applicants and all nonconstruetion contractors, as applicable, shall include the specifica- tions set forth to this section in all federal, and federal- ly assisted construction contracts in excess of $10 , 000 to be performed in geographical areas designated by the Director pursuant to Section 60-4 . 6 of this part and in construction subcontracts in excess of $10 , 000 necessary to whole or in part to the performance of ronconstruction federal contracts and subcontracts covered under the Executive Order. Standard Federal Equal Employment Opportunity Construction Contract Specifications (Executive Order 11246) 1. As used in these specifications : a. "Covered area" ;Weans the geographical area described in the solicitation from which this contract resulted. b. "Director" means Director, Office of Federal Contract Compliance Programs, United States Department of Labor, or any person to whom the Director delegates authority; e. ".Employer identification number" means the Federal Social Security riamber used on the Employer ' s Quarterly Federal Tax Return, U. S. Treasury Department Form 941 . d. "Minority" includes : (1) Black (all persons having origins in any of the Black African racial groups not of Hispanic origin) ; (11) Hispanic (all persons of ;Mexican, Puerto Rican , Cuban , Contral or South American or other Spanish Cul rL, or origin regardless of race) ; (111) Asian and Pacific Islander (all persons having 41 r Y origins in any of the original peoples of the Far Last, Southeast Asia, the Indian Subcontinent or the Pacific Islands) ; and (IV) American Indian or Alaskan Native (all persons having, origins , in any of the original peoples of North American and maintaining identifiable tribak •affiliations through membership and participation or community identifi- cation) . 2. Whenever the contractor of any subcontractor at any tier , subcontracts a potion of the work involving any construc- tion trade, it shall physically include in each subcontract in excess of $10, 000 the provisions of these specifications and the Notice which contains the applicable goals for minority and female participation and which is set forth in the solicitations from which this contract resulted . 3. If the Contractor is participating (pursuant to 41 CFH 60-4 . 5) in a Hometown Plan approved by the U. S . Department of Labor in the covered area wither individually or through an assoc- iation, its affirmative action obligations on all work in the Plan area (including goals and timetables) shall be in accordance with that Plan for those trades which have unions participating in the Plan . Contractor must be able to demo- strate their participation in and compliance with the pro- visions of any such Hometown Plan . Each contractor or sub- contractor participating in an approved Plan is individually required to comply with its obligations under the EEO clause , and to make a good faith effort to achieve the plan goals and timetables. 4 . The contractor shall implement the specific affirmative action standards provided in paragraphs 7a through n of these specifications. TM goals set forth in the solicia- tations from which this contract resulted are expressed as percentages of the total hours of employment and training of minority and female utilization the contractor should rea- sonably be able to achieve in each construction trade in which it has employees in the covered area . The contractor is expected to make substantially uniform progress toward its goals in each craft during the period specified. 5. Neither the provisions of any collective bargaining agree- ment, nor the failure by a union, with whom the contractor has a collective bargaining agreement , to :refer either minorities or women shall excuse the contractor ' s obliga- tions under these specifications . Executive Order 11246 or the regulations promulgated pursuant thereto. 6. In order for the nonworking training hours of apprentices and trainees to be counted in meeting the goals , such appren- tices and trainees must be employed by the contractor during the training period and the Contractor must have made - �..,.. mitment to employ the apprentices and trainers at the - comple- tion of their training, subject to the avall"ability of employ- . 4j ment. opportunities. Trainees must be trained pursuant to training programs approved by the U.S . Department of Labor. 7. The contractor shall take specific affirmative actions to ensure equal employment opportunity. The evaluation of the contractor ' s compliance with these specifications shall be beeed upon its effort to achieve -,aximum results from its actions. The contractor shall document these efforts fully, and shall inplement affirmative action steps at least as e:ttensive as the following: (a) Ensure and maintain a working environment free of harassment, intimidation, and coercion at all sites and in all facilities at which the contractor ' s employees are as- signed to work. The contractor, where possible, will assign two or more women to each construction project. The Con- tractor shall specifically ensure that all foremen, super- intendents and other on-site supervisory personnel are aware of and carry out a working environment with specific atten- tion to minori�y or female individuals working at such sites or in such facilities . (b) Establish and maintain a current list of minority and female recruitment sources, provide written notification to minority and female recruitment sources and to community organizations when the contractor or its unions have employ- ment opportunities available , and maintain a record of the organizations ' responses. . (c) Maintain a current file of the names , addresses , and telephone numbers of each minority and female off--the-street applicant and minority or female referral from a union, a recruitment source or community organization and of what action was taken with respect to each such individual . If such individual was sent to the union hiring hall for re- ferred back to the contractor by the union or, if referred, not employed by the contractor, this shall be documented in the file with the reason therefore, along with whatever addi- tional actions the contractor may have taken . (d) Provide immediate written notification to the Director when the union or iniona with which the contractor has a collective bargaining agreement has not referred to the contractor ' s minority person or woman sent by the contrac- tors or when the contractor has other information that the union referral process has impeded the contractor' s efforts to meet its obligation. (e) Develop on the job training opportunities and/or parti- cipate in training programs for the area which expressly includes minorities and women, including upgrading programs and apprenticeship and trainee programs relevant to the con- tractor ' s employment needs, especially those programs funded or approved by the Department of Labor. The contractor shall provide notice of t%ese programs to the sources compiled under 7b above. 43 ' (f) Disseminate the contractor ' s EEO policy' by providing notice of the policy..to..,unions ynd training programs .and requesting their cooperation in assisting the contractor in meeting its EEO obligations; by including it in any policy manual and collective bargaining agareements by publici.zing. it in the company newspaper annual report, etc. , by specific review of the policy with d11 management personnel and with all minority and female employe=s at least once a year; and by posting the company EEO policy on bul.leting boards accessible to all employees at each location where construction work is performed . (g) Review at least annually the company ' s EEO policy and affirmative action obligations under these specifica- tions.: with all employees having any responsibility for hiring, assignment, layoff, termination or other employment decisions including specific review of these itmes with onsite super- vi'sory personnel such as superintendents, General Foreman, etc. , prior to the initiation of construction work at any job site . A written record shall be made and maintained Identifying the time and place of these meetings, persons attending, sub- ject matter discussed, and disposition of the subject matter. (h) Disseminate the contractor' s EEO Policy externally by including it in any advertising in the news media , specifi- cally including minority and female news media and providing written notification to and discussing the Contractor' s EEO policy with other contractors and subcontractors with whom the contractor does or anticipate doing business. (1) Direct its recruitment efforts, both oral and written to minority female and community organizations to schools with minority and female students and to minority and female recruitment and training organizations serving the contrac- tors recruitment area and employment needs . Not later than one month prior to the date for the acceptance of applica- tions for apprenticeship of other training by any recruitment source. The contractor shah send written notification to organizations such as the above, describing the openings, screen- ing procedures, and tests to be used in the selection prncess. (j ) Encourage prrBent minority and female employees to re- cruit other minority persons and women and, where reasonable, provide after school, summer and vacation employment to mino- rity and female youth both on the site and in other areas of a contractor's workforce. (k) Validate all tests and other selection requirements where there is an obligation to do so under 41 CFR Part 60-.1. (1) Conduct at least annually, an inventory and evaluation at leant of all minority ane female personnel. for promotion- al opportunities and encourage these employees to seek or to 44 z. M prepare for through appropriate training , etc.. , such opportunities . (m) Ensure that seniority apprentices , job classifica- tions work assignment and other personnel practices , do not have a discriminatory effect by continally monitoring alL personnel and eiployment related activities to ensure that the EEO policy and the contractor ' s obligations under these specifications are being carried out., (n) Ensure that all facilities and company activities are nonsegregated except that separate in single ucer toilet and necessary changing facilities shall be provided to ensure privacy between the sexes. (o) Document and maintain a record of all solicitations of offers for subcontractors from minority and female construc- tion contractors and suppliers, including circulation of solicitations to minority and female contractor associations and other business Associations . (p) Conduct a review, at least annually of all supervisors adherence to and performance under the Contractor ' s EEO policies and affirmative action obliqations. g, Contractors are encouraged to participate in voluntary associations which assist in fulfilling one or more of their affirmative action obligations Pa. through p) . The efforts of a contractor association, joint contractor-union, con- tractor-community, or other similar group of which the con- tractor is a member and participant, may be asserted as fulfilling any one or more of its obligations under %a through r of these specifications provided that the contrac- tor actively participates in the group , makes every effort to assure that the group has a positive impact on the employ- ment of minority and women in the industry, ensures that the conc:tete benefits of the program are rejected in the contractor ' s minority and female workforce participation makes a good faith effort to meet its individual goals and timetables and can provide acess to documentation which r demonstrates the effectiveness of actions taken on behalf of the contractor. The obligation to comply, however, is th N. Contractor ' s and failure of such a group to fulfill an obligation shall not be a defence for the contractor ' s non- compliance . 9. A single goal for minorities and a separate single goal for women have been established . The contractor, however, is required to provide equal employment opportunity and to take affirmative action for all minority groups , . both male and femalo and all women both minority and non-minority . Con- sequently, the contractor may be in violatf.on of the Execu- tive order if a particular group is employed in a substan- tially disparate manner (for example , even though the Con- tractor has achioved its goals for wom n generally, the 45 contractor may in violation of the Executive -order if a specific minority group of women is underutilized. 10 . The contractor shall not use the goals and timetables or affirmative action standards to discriminate against any person because of race , color, religion , sex , or national origin. ' 11 . The contractor sha,11 not .enter into anv subcontract with any person or firm debarrred from Governmer t contracts pursu- ant to Executive Order 11246 .. 12 . The contractor shall carry out such sanctions and penalties for violation of these specifications and of the Equal Oppor- tunity Clause, including suspension termination and cancel- lation of existing subcontracts as may be imposed or ordered pursuant to Executive Order 11246 as amended, and its imple-- mentating regulations , by the Office of Federal Contract Compliance Programs . Any contractor who fails to carry out each sanctions and penalties shall be in violation of these specifications and Executive Order 11246 as amended . 13 . The contractor, in fulfilling its obligations under these specifications , shall implement specific affirmative action steps, at least as extensive as these standards prescribed in paragr&ph 7 of these specifications so as to achieve maximum results from its efforts to ensure equal employment opportunity. If the contractor fails to comply with the requirements of the Executive Order, the implementing re- gulations or these specifications, the Director shall pro- ceed in accordance with 41 CFR 60-•4 . 6 . 14 . The contractor shall designate a responsible official to monitor all employment related activity to ensure that the company EEO policy is being carried out to submit reports relating to the provisions hereof as may be required by the Government and to keei• records . Records shall at least include for each employee the name , address, telephone numbers, construction trade, union af.filation, if any em- ployee identification number when assigned social security number, race, sex, status (e . g. mechanic apprentice, trainee, helper, or laborer) , dates of changes in status , hours worked per week in the indicated trade , rate of pay, and locations at which the work was performed . Records shall be maintained in an easily understandable and retrieveable form; h6wever, to the degree that existing 'records satisfy this; requirement, contractors shall not be equired to maintain separate records . 15. Nothing herein provided shall be construed as a limitation upon the application of other laws which establish different standards of compliance or upon the application of regUi re-- ments for the hiring of local or other area residents - '. • - those under the Public Works Employment Act of 1977 a?ic the Community Developrdent Flock Grant Program) . 46 1, (b) The notice set forth in 41 CPR 60--4 . 2 and the specifi- cations set forth in 41 CFR 60-4 . 3 replace the New Form for Federal Equal employment Opportunity Bid Cond-itions for Federal and Federally Assistance -Construction published at 41. FR 32482 and corunonl.y known as the Model Federal EEO Bio Conditions, and the New Form shall not be used after the regulations in 41 CFR fart 60-4 become eftect.ive. Section 60-4 . 4 Affirmative Action Requirements. (a') To implement the affirmative action requirements of Executive order 11246 in the construction industry, the Office of Federal, Cbntract . Compliance Programs previously has approved affirmative action programs commonly referred to as "Hometown Plans, " has promulgated affirmative action plans referred to as "Imposed Plans" and has approved "Special Bid Conditions" for high impact projects construc- ted in area not covered by a Hometown or an Imposed Plan. All solicitations for construction contracts made after the effective date of the regulations in this part shall include the notice specified in Section 4 . 2 of this part and the specifications in Section 60-4 . 3 of this part in lieu of the Hometown and Imposed Plans including the Philadelphia Plans and Special Bid Conditions . Until the Director has issued an order pursuant to Section 60-4 . 6 of this part establishing goals and timetables for minori- ties in the appropriate geographical areas or for a project covered by Special, Bid Conditions, the goals and timetables for minorities to be inserted in the Notice require by 41 CFR 60-4 . 2 shall be goals and timetables contained in the Hometwon Plan, Imposed Plan or Special Bid Conditions pre- sently covering the respective geographical area or project involved. (b) Signatories to a Hometwon Plan (including heavy highway affirmative action plans) shall have 45 days from the effec- tive date of the regulations in this part to submit under sur;h a Plan (for the Director ' s approval) goals and time- tables for women and to include female representation on the Hometown Plan Administrative Committee. Such goals for female representation shall be at least as high as the goals established for female representation in the Notice issued pursuant to 41 CFR 60-4 . 6 . Failure of the signator- ies, within the 45 day period, to include tecnale representation and -to submit- goals for women or a new plan., ' as appropriate shall result in an automatic termination of. the Office of Federal Contract Compliance Program' s approval of the Hometown Plan. At any time the Office of Federal Cuntract Compliance Programs terminates or withdraws its approval of a Hometown Plan, or when the Plan expires and another flan is not approved, the contractors signatory to the plan shall be covered automati- cally by the specifications set forth in Section 60-4 . 3 of this part and by the goals and timetables established for that geographical area pursuant to Section 60-4 . 6 of this part. 47 Section 60-4 . 5 Hometown Plans (a) A contractor participating, either individually or through an association, in an approved Hometown Ytan (in- cluding heavy highway affirmative action plans) shall comply with its affirmative action obligations under Ex- acutive. Order 11246 by complying with its obligations tinder the plan: . Provided,. that each contractor or subcon- tractor participating .in an approved plan is 'indivsadually required to comply with the =.:4ual opportunity clause, set forth -in 41 CFR 60-1.4 ; , to make a good faith effort to ac�►ieve the goals for each trade participating in the plan in which It has employees; and that the overall. good performance by other. contractors or subcontractors toward a goal in an approved plan does not excuse any covered contractors or subcontractors failure to take good faith efforts to achieve the plants goals and time- tables . If a contractor is not participating in an approved Hometown Plan it shall comply with the specifi- cations set . forth in Section 4-3 of this part and with the goals and timetables for the appropriate area as listed in the notice required by 41 CFR 60-4 . 2 with regard to that trade. For the purposes of this part 60--4 , a contractor is nW participating in a Hometown Plan for a particular trade if it: 1. Ceases to be signatory to a Hometown Plan covering that trade; 2 . Is signatory to a Hometown Plan for that trade but is not party to a collective bargaining agreement for that trade; 3. Is signatory to a Hometown Plan for that trade but is party to a collective bargaining agreement with labor or- ganizations which are not or cease to be signatories to the same Hometown Plan for that trade; 4 . Is signatory to a Hometown Plan for that trade and is party to a collective bargaining agreement with a labor organization for that trade but the two have not jointly executed a specific commitment to minority and female goals and timetables and incorporated the commitment in the Hometown plan for that trade; 5. ' is participating in a Hometown Plan for 'that trade which is no longer acceptable to the office of Federal. Contract Compliance Programs; 6. Is signatory to a Hometown Plan for that trade but is party to a collective bargaining agreement with a labor organization and the contractor have failed to make a good faith effort to comply with their obligations under the Hometwon Plan for that trade.. Section 60-4 . 8 Show Cause Notice If an investigation or compliance review reveals that a construction contractor or subcontractor has violated the i Executive Order, any contract clause, specifications or the regulations in this chapter and if administrative en- forcement in contemplated, the Director shall issue: to s the contractor or subcontractor a notice to show cause, r° which shall contain the items specified in (i) (iv) of 41 ' CFR 60--2 . 2 Cc) (1) . if the contractor does not show good cause within 30' days, or in the alternative, fails ; to enter an acceptable conciliation agreement which in- cludes where appropriate, make up goals and timetables back pay and seniority relief for affected class members, ` the compliance agency shall follow the procedure in 41 ' CFR 60-1. 28 . However, F1JJ funds have been to rnporarily "frozen" as a result of Environ- mental Protection Agency (EPA) sanctions in California. Rondation: 1. Ap-pr67e the appropriation of gas tax or H.C.D. funds for the installation of a traffic si.c nal using salvaged equi.pmcint. The cost estimate is $45,000.00. 2. Authorize the Director of Public Works to proceed with the acquisition of sufficient~ right-of-way on the north side of Warner Ave. to enable the installation of left-turn pockets. 3. Determi.ne that the purchase and installation of the material and equipment for this project is of urgent necessity for the preservation of the health and welfare of the travelling public, and that the nonral bid procedures are waived for the purpose of completing the project in the rmst expedient manner possible. Analysis: A traffic signal for Warner and Nichols was originally listed as a gas tax project in the 1978/79 fiscal year budget. Flowever, because of the shortage of gas tax funds, the traffic signal and intersection widening was included in the Warner Ave. FAU project. However, the EP.X has imposed funding sanctions in California over the issue of mandatory vehicle .inspection stations. The issue is in the process of being resolved and sc - obiigat:ional release of funds is t.,cpected in Augudt, 1.981.. The warner Ave. FAU project =ild be obligated at that time if it is approved on the priority list. Othm,iise, October 1981 is the next date for obligationaA release of funds. If the property corners are willing to dedicate or sell the necessary right--of--way to the City, widening for left-turn pockets would be includW in this project. if the City and property owners cannot quickly agree on right-of-way negotiations, a signal would be constructed without left-turn pockets since we feel time is of the essence. Do no i at this tug and continue to keep this project as part of the rAU project. 2. Leyva Traf.& Engineer JNTRObUCTION: This report was generated by requests from citizens and from the school facility on the northeast corner of the intersection. To ascertain the existing conditions , the following steps were taken: 1 . Manual and machine traffic volume counts were made . 2 . Detail analysis of accident history at and near this intersection was made . The following report presents the findings of that investigation and the data pertai: ..ing thereto . SM51ARY OF CONCLUSIONS: In essence, the problem at this :inter- scction is one of insufficient roadway area to accommodate left turn demands at the intersection. There is a secondary problem in the Habit of drivers following too closely to the vehicle in front of them, unprepared to stop, or even to slow, when faced with a vehicle slowing to turr. Left cr traffic stopped waiting for a vehicle to make a left tarn. The following solutions are presented ir. order of their difficulty of accomplishment : A. Prohibit all left turns on both Warner Ave . and Nichols Street from 3 :30 to 6 : 30 P .M. . B. Obtain the necessary right-of-Way on Warner Ave . to provide sufficient street width to install left turn _ pockets on Warner Ave . . Either of these two alternatives will provide an interim solution at this intersection until Warner Ave, is widened to it 's ulti,zate major arterial width. 1 t-�1r}°i n i f' ` "ANALYST + M thrOCT. 30 1976 The accident record' was reviewed aril plotted 'on' a c.ol lis'ion diagram. (See Exhibit 'I) . As `can be 'seen on the collision diagram, fourteen (14) accidents occurred in or immediately " adjacent to the intersection of Warner Ave . and Nichols St . Of. these fourteen (14) accidents , nine (9) accidents involved rear . .end collisions, and of these , six (6) (and perhaps all nine (9) ) were .- proximately caused by a left turn vehicle on Warner . The remainder of the accidents also involved left turni p v6 hicl'es, with the one exception of a right angle collision which occurred in the NE quadrant of the intersection . The predominence of rear end collisions indicates that drivers are following too closely, thereby causing the large number of rear end type collisions . In addition, the hours at which the accidents occur fall largely between the hours of 3 and 6 P .M. . It is therefore evident that a prohibition of this movement during these hours , rigidly enforced, would have the effect of removing the cause from this intersection. It may however, simply relocate the problem to Oak St . (the next street east) generating a condi - tion 'in which. drivers Aould use the residei..tial streets on the south side of Warner between Nichols and Oak to by-pass the Nichols .intersection during this period. Some of * the activity on the accident investigation was noted at• 40 th6 �Chiirc'h and School driveway entrances . However these accidents were few in number and did riot have a predbminent effect 'an the "intersection activities and were therefore not considered a part of this study. TRAFFIC VOLUME DATA ANALYSIS A manual traffic count was taken on the 21st of October, this year. Three two hour periods were counted manually and are shown on Exhibits 2 , 3 , and 4 . Each of these sheets show the two hour period activities , including the 15 minute peak hour activity and the total number of vehicles counted during the 2 hours . Of particular interest is the note on Exhibit f2 which indicates the volume of traffic turning into the school as 160 vehicles for the two hour period . The traffic volume on Warner Ave . varied from a low of 1393 vehicles/hour during the noon hours to a high of 1747 vehicles/ hour for the period from 3 : 45 to 4 :45 in the afternoon . During these same times the totals on Nichols St . were very light . Due to the malfunction of the machine counters , machine data was not useable for this study, however the data collected during the peak hour manual counts indicates that a signal war- rant generated for this intersection would be marginal but would likely meet the "Interruption of Continuous Traffic" warrant and would perhaps meet .the volume warrant. Ab CONCLUSIONS AND RECOMMENDATION -Because of the analysis of the accident activity and due to the obvious difficulty in utilizing the exsiting -right-of-way to accommodate the traffic movements desired at this intersection , the most immediate solution available would be the prohibition of the left turns from Warner Ave . to Nichols during the hours of 3 :30 and 6 : 30 P .M. . This prohibition would then be enforced, thereby eliminating the conflicts during the peak traffic hours , which are indicated to be the times when the majority of accidents are occurring . This prohibition would certainly inconvenience some drivers and require re-routing of trips , however , no other immediate solution is readily available at this time . A far more useful solution, but one that would take far longer to accomplish,would be the aquisition of sufficient right of way adjacent to the intersection to complete the installation of left turn facilities onto Nichols from Warner Ave . . This acqui- sition could be done in conjunction with an improvement project currently being studied by the City between Beach Blvd. and Gothard St. .
