Belsito ; DATE: February 16, 1977 5 SUBJECT: TERMINATION OF THE JOiWT POWERS AGREEMENT ESTABLISHING THE SANTA ANA RIV'ER,/SANTIAGO CREEK GREENBELT COMMISSION In January] 1977, the Greenbelt Commission recommended that each member city adopt a resolution to disestablish the Commission. The County of �_�._•.•. Orange has withdrawn from the Commission and from an oPerational and '? fiscal standpoint, continued operation of the 'Greenbelt 'Commission is no longer Oassible. The Greenbelt Commission can be disestablished after i each member c4ty adopts a resolution to terminate the Jcint Powers Agreement which established the Commission. On January 17, 1977, the City Council adopted a resolution to withdraw from the Greenbelt Commission. The City would still be financiall4 obligated through June 30, 1977, however. Therefore , based on the�recom-� mendation of the Greenbelt Commission, City Council resolution to dis- establish the Commission (and therefore terminate the City' s fiscal obligation) is transmitted for adoption. The Greenbelt Commission can then be disestablished on or about March 1, 1a77 , to allow for completion s of all action legally required for such disestablishment. Belsitor City Whinistrator DATE: January 11, 1977 SUBJECT: SANTA ANA RIVER/SANTIAGO CREEK GREENBELT IIMPLEMENTATION PLAN GREENBELT IMPLEMENTATION PLAN In November, 1976, the Santa Ana River/Santiago Creek Greenbelt Implementation Plan was forwarded to the City Council for review. The Planning Department has since reviewed the Implementation Plan and transmitted comments to the Greenbelt Commission. The recommended changes are predominantly technical ones and would not alter the intent of t1ke plan. (A copy of thip trai* '- Aittal is attached. ) The Santa Ana River/Santiago Creek Greenbelt implementation Plant as ccmpiled by the Greenbelt Commission Staff, contains information for the Huntington Beach section of the corridor as previously u'donted by the Council in May, 1976. The Greenbelt Commission has requested that the Council adopt the Implementation Plan for the entire Greenbelt Corridor as soon as possible so that implementation of the provisions by all involved jurisdictions can begin. Copies of the Implementation Plan were transm-tted to the Huntington Beach Citizens Greenbelt Committee in November,, 1976 and comments have been received (see attachment) . In summary, the recommendations of the Citizens Committee are as follows: 1. The City Council should adopt the Implementation Plan. 2 . The priority projects identified in the plan should be completed as soon a-s possible: LHB-010 Upgraded bicycle pathways linking into the River Trail ($400) LHB-011 Signing along bicycle trails linking into the River Trail ($270) LHE-006 Landscaping along the Santa Ana River (OCSD Plant to Garfi=-ld Avenue) (County Expense) All The functibn of the Citizens ; Qreea.v-'-' z Cort—nittee should hq- .assumed by another existing citizens ' advisory body such as the Parks and .1'ecreation Commission. The function of the coordinating ILgency would 'lie to review projects in the area of the Greenbelt and to assure that .... .. the principles and policies of the Greenbelt Implementation Plan are Executed. Page Two The Planning Department concurs with the recommendation ,of the. citize'ns ' committee to adopt the Plan and pu''sue implementation expeditiously. It is our recommendation, however, that the Planning Ccmission - as developer of the City' s Implementation Plan - be named to coordinate implementation activities. An important function of the implementing a'9enny is to review proposed development projects within the Greenbelt Corridor for consistency with the `Greenbelt Plan. The Planning Commission already performs this review function and can continue to do so. While :specifl.c construction and design acti7ities can be carried out. thro'ugh responsible departments - such as Parks and Public Works . - the Planning Comaission should continue its supervisory role as it does now with parks and trails programs . PARTICIPATION IN THE GREENBELT COMMISSION In June, 1976 , the City Council voted to discontinue funding for the Green- belt Commission for the 1976-77 fiscal year. The Council was prevented from discontinuing fuhding, however, by the Joint Powers Agreement entered into by the City of Huntington Beach upon joining the Greenbelt Commission . The agreement specifies that a jurisdiction is obligated to fund the Greenbelt Commission for an entire decal year unless a resolution to with- draw passed by the governing body is submitted to the Commission by May 1 prior to the upcoming fiscal year. Because this Aay 1 deadline ura- iot met,, the City was committed to extend funding through July 1 , 1977 . A Zormal decision remains to be made as to whether the Council still wiuhes to dis- continue funding thin Greenbelt Commission after fiscal year 1977 . Orange County has wa'.thdrawn from the Greenbelt Commission already. The cities of Fountain Valley and Costa Mesa participated in the planning program but. never I-ecame official members of the Commission. The City of Newport Beach is currently a member, RECOMMENDATIONS : 1. Adopt the Santa Ana River/Santiago Creek Greenbelt Implementation Plan as propose-d by the Greenbelt Commission. 2 . DesignaLA; 41-.ba Planning Commission to assume the function of coordinating execution of the Implementation Plan. 3 . CORRIDOR � IMPLEMENTATION PLAN HUNTINGTON BEACH AREA The Implementation Plan for the Santa Ana River Greenbelt in Huntington Beach is broken down into four phases : PHASE I Phase I defines the physical limits of the desired greenbelt corri- dor and related impact area. (See Figure 1.. ) The impact area, defined as a transition area to serve as an intrciuction to the � R greenbelt, includes the property all around the revised corridor, i .reads approaching the greenbelt, and some vacant property. With this new definition in mind, a revised greenbelt corridor was delineated encompassing somewhat less area than the alternative selected in January, 1975 by involved citizens as the most preferred readjustment of the greenbelt corridor. Acting as an extension of the greenbelt corridor in Huntington Beach is the impact area, defined as a transition area to serve as an introduction to the greenbelt. It includes the property all around the revised corridor, roads approaching the greenbelt, and some vacant property. Also shown on the enclosed map are features related to the green- belt corridor but not within the physical Imits. These are: 1 . Tourist facilities, existing and proposed Pier Specialty Commercial r Hotels/Motels , ( Mini-Theme Park 2. Beach 3 . Parks and Schools (within a mile and a half of the. river) 4 . Bike Trails (between Beach Boulevard and the river) 5. Proposed Scenic Highways and Landscape Corridors. f• As part of the Phase I? Implementation Plan, the Staff has indi- cated where landscaping should be installed and assigned numbers to the projects to be implemented within the revised corridor and a impact area. Landscaping along the whole length of the river in Huntington Beach is desired, except where planting already exists r along the boundary of the Sanitation District Plant. Project f numbers have been assigned as follows : 1. LHB-001: Huntington State Beach Development 2 . LHB-G02 : Santa Ana River Nouth, planned for open space development as yet undefined. 3. LHB-003 : Landscaping along the river within Huntington Peach. 4 . LHB-004 : Indianapolis bicycle trail, providing bicycle access ` to the river. Ownership is divided between private interests, Huntirigton Beach, Orange County Flood Control District, and the Orange County Sanitation Dis•" trict. At its 5/29/73 meeting, the' Board of Supervisors considered a °r request by developers to purchase the bCFCD parcels presum- { ably for residential development. The Board rejected the re- , _....__... quest. On 7/6/73, the Santa Ana River/Santiago Creek Greenbelt: Com- mission passed a resolution supporting the Board's action. More recently, a letter to the developer from the Huntington Beach Planning Departm*'nt indicated that approval would be granted for a coimnercial center at the northeast corner of Brookhurst and Hamilton. ' The attorneys for the developer then renewed their request for purchase of the OCFCD prop- erty. The Chief Engineer of OCFCD countered by 'auggesting ;. public purchase of the developers land for future flocid con- trol use.
