Funding Source: No cost Recommended Action: Adopt Resolution No. aoo`l--A2 , a Resolution of the City Council of Huntington Beach amending the Memorandum of Understanding between the City and the Surf City Lifeguard Employees' Association by adopting the side letter of agreement in regards to the 1,500 hours provision. Alternative Action(s): Reject the Resolution and maintain the current tracking method of a rolling twelve-months. Analysis: Representatives of the city and the Surf City Lifeguard Employees' Association (SCLEA) have completed the meet and confer process on a side letter agreement for changes to the 1,500-hour rule. The Memorandum of Understanding between the city and SCLEA contains a provision for a maximum number of hours (1,500) that part-time/recurrent employees (seasonal and may recur year after year, not regular full-time) can work within any twelve- j� H:\RCA's\1500 Hours.doc � 8/23/2004 9:04 AM / a REQUEST FOR ACTION MEETING DATE: SEPTEMBER 7, 2004 DEPARTMENT ID NUMBER: AS-04-032 month period, referred to as a rolling twelve months. The responsibility for tracking the 1,500 hours has been with the Community Services Department within the Marine Safety Division. In evaluating the rolling twelve-month tracking method, along with the impact on staffing needs during the critical months of April through September, it was found that tracking the hours on a calendar year would be more efficient. This calendar year tracking information is already generated by the city's payroll system. Most importantly, it provides reliance on the ability to schedule hours without exceeding the 1,500 hour maximum rather than reduce part- time/recurrent lifeguard hours during the peak summer months. Changing the 12-month tracking method is an administrative change and has no cost impact. Attachment(s) 40. Pad 1. Resolution, including Side Letter of Agreement as Exhibit A m V RCA Author: Irma Youssefieh H:\RCA's\1500 Hours.doc 8/23/2004 9:04 AM ATTACHMENT 1 RESOLUTION NO. 2 0 0 4-7 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE SURF CITY LIFEGUARD EMPLOYEES' ASSOCIATION, BY ADOPTING THE SIDE LETTER OF AGREEMENT (REGARDING NUMBER OF PERMITTED WORK HOURS WITHIN A TWELVE-MONTH PERIOD) WHEREAS,on February 18,2003, the City Council of Huntington Beach adopted Resolution No. 2003-17 for the purpose of adopting the 2000/02 Memorandum of Understanding (MOU)between the City and the Surf City Lifeguard Employees' Association(SCLEA); Subsequent to the adoption of the MOU,the City of Huntington Beach and SCLEA agreed to changes, corrections, and clarifications to the MOU that are reflected in a Side Letter of Agreement between the City of Huntington Beach and the SCLEA ("Side Letter of Agreement") attached hereto as Exhibit A and incorporated herein by this reference. The Side Letter of Agreement pertains to a change in the method by which the number of hours worked are tracked. NOW,THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Huntington Beach as follows: Section 1. The Side Letter of Agreement attached hereto as Exhibit A is approved and adopted. Section 2. The Side Letter of Agreement amends the MOU between the City of Huntington Beach and the SCLEA. This Side Letter of Agreement shall be incorporated into any future Memorandum of Understanding between the City of Huntington Beach and the Surf City Lifeguard Employees' Association to amend Article IX (C) — Work Day; Work Week as follows: C. 1.500 Hours "An employee represented by the SCLEA may work up to one thousand five hundred (1,500) hours in a twelve-month (12-month) period. Retroactive to pay period beginning December 20, 2003, the 12-month period shall be based on a City payroll calendar year. An employee shall not work more than 1,500 hours in this 12-month period."
