Copley Drive,Diamond Bar,California 91765, is the local agency with primary responsibility for regulating stationary source air pollution in the South Coast Basin in the State of California; WHEREAS,the State of California is experiencing shortages of electricity that are anticipated to be particularly critical this summer,and which are expected to last for at least another two years until adequate conservation and increased supplies of electricity are attained; WHEREAS,as a result of the shortage of electricity and the potential for rolling blackouts, both public and private entities are seeking alternatives sources of electricity; WHEREAS, many of these alternative sources of electricity,such as emergency back-up diesel generators, are large sources of air pollution including toxic emissions of diesel particulate; WHEREAS, there exist cleaner alternative sources of electricity in the form of natural gas-fired microturbines; WHEREAS, the AQMD has created and funded an emergency microturbine program directed to help alleviate the critical electricity demands beginning this summer without resorting to more polluting sources of electricity; WHEREAS, under this microturbine program, a qualified public or private entity(SITE OWNER)«ill receive a microturbine system fully paid for by the AQMD so long as SITE OVL'NER agrees to certain conditions. Such a microturbine system includes: Quantity Description a) I 60-kW microturbine b) I External Fuel Kit c) 1 Fuel Gas Booster d) 1 Remote Monitoring System software e) 1 Exhaust Silencer; W WHEREAS, SITE OWNER, whose name is City of Huntington Beach, City IIall,and is located at 2000 Main Street, Huntington Beach,California,desires to participate in the microturbine program and therefore agrees to the follo ing conditions of the program: 1) SITE OWNER shall assume ownership of the microturbine system, including all attendant responsibilities and liabilities of owmership,upon delivery of the microturbine system to the SITE OW'NER's selected installation site. Hunt Bch Site Agreement-2 Microturbine Project Agreement 2 2) SITE OWNER shall be responsible for paying the cost of delivery and installation of the microturbine system.. SITE OWNER shall contract for the installation of the microturbine system with an installer that is authorized by Capstone Turbine Corporation. 3) SITE OWNER acknowledges that time is of the essence to ensure that the microturbine system is fully operational before the peak summer periods, and therefore, SITE OWNER shall take all necessary actions within SITE OWNER's control to ensure that the microturbine system is properly installed, operational,and connected to the electricity grid %within six weeks following execution of an agreement for installation of the microturbine system, including obtaining all necessary building permits. Unless SITE OWNER is otherwise notified,the AQMD does not require air permits for these microturbines. 4) Within three business days after the completion of system installation and startup,SITE OWNER shall provide AQMD with the follo Aing: a) Copies of all building permits required to install the microturbine system. b) A copy of the grid connection agreement with the local electric utility c) A«Titten confirmation,signed by SITE OWNER's authorized officer,that the microturbine system has been satisfactorily installed and is properly functioning. 5) SITE OWNER agrees to repair or replace the microturbine system or maintain property insurance on the microturbine system to cover repair or replacement costs incurred as a result of theft, vandalism,or Acts of God. b) SITE OWNER agrees to keep the microturbine system in good operating condition and to operate the microturbine system at the installation site, at a minimum,under the following circumstances,unless the SITE OWNER's cost of natural gas exceeds $1.50 per therm: a) during summer peak periods as defined by SITE OWNER's local electric utility; or b) i)whenever SITE OWNER is notified of an electricity interruption, if SITE OWNER is under an interruptible electric service contract,or ii)whenever the California Independent System Operator(ISO)declares a Stage 2 or Stage 3 electrical emergency,if SITE OWNER is not under an interruptible electric service contract. If SITE OWNER willfully does not comply%vith these minimum usage requirements, SITE OWNER agrees to relinquish ownership of the microturbine system and to pay up to V0,000 for removal and transfer of the microturbine system to another site designated by AQMD. AQMD shall excuse SITE OWNER from this clause if there is an equipment breakdown and the SITE OV+NER promptly takes steps to repair the condition causing the breakdown. Microturbine Project A�ment 3 7) SITE OWNER shall provide access to AQMD or AQMD's contractor personnel to make site inspections and cooperate with AQMD or AQMD's contractor personnel on phone inquiries and surveys regarding the microturbine system operation and on future remote monitoring of the microturbine system. 8) SITE OWNER agrees to provide other needed access to the microturbine system,as well as other assistance and information,to ensure the success of this program. 9) AQMD will be applying for self-generation incentive monies authorized by the California Public Utilities Code 399.15(b). SITE OWNER agrees to assist AQMD in this process and take all reasonable steps necessary to qualify for the self-generation incentive monies. Such steps may include the purchase of an 3-year service contract with the manufacturer of the microturbine or other vendor that still enables qualification for the incentive,at a cost not-to- exceed Three Thousand Five Hundred Dollars($3,500)per microturbine per year. 10)SITE OWNER shall hold harmless, indemnify,and defend AQMD, its officers, employees, agents,representatives and successors in interest against any and all loss, damage, cost, or expenses which AQMD, its officers,employees,agents,representatives,and successors in interest may incur or he required to pay by reason of any injury,or property damage caused by the installation or operation of the microturbine system or by SITE OWNER,its employees,subcontractors,or agents in the performance of this Agreement. I I)This Agreement shall run from the date of execution by SITE OWNER or delivery and acceptance of the microturbine system,whichever is sooner,to October 31,2002,except that the provisions of clause 10 shall survive the expiration of the Agreement. 12)SITE OWNER may not assign, sell,or license any of the rights granted under this Agreement without the prior written consent of AQMD. 13)SITE OWNER may arrange with the microturbine manufacturer to exchange the 60-kW microturbine and associated equipment for two 30-kW microturbincs and associated equipment.Any additional cost involved in such an exchange shall be borne by SITE OWNER. If such an exchange takes place,SITE OWNER shall provide AQMD with a copy of the purchase order documenting the exchange. T - li REQUEST FOR COUNCIL ACSON MEETING DATE: June 4, 2001 DEPARTMENT ID NUMBER: BD 2001-2 Analysis: Since June 2000, the City has experienced several Stage III energy alerts. Earlier this year, staff investigated the use of an emergency generator, which was later abandoned due to the City being relieved of the Interruptible Rate. However, the State of California continues to be in an "Energy Crisis,' with recent electric rate increases and the prospect of substantial rate increases over the next few years. During the past two months, staff began exploring alternative sources of electricity to help defray future Edison rate impacts. Dialogues began with the University of California, Irvine's National Fuel Cell Research Center and Advanced Power and Energy Programs, to determine the viability of utilizing new technology. Through this association, South Coast Air Quality Management District (SCAQMD), through its Microturbine Site Agreement, has offered the City of Huntington Beach two (2) 30-kw Microturbines and related equipment to modify existing flare gas to power said Microturbines. This program was developed and funded by SCAQMD to help alleviate the critical electricity demands beginning this summer without resorting to more polluting sources of electricity. SCAQMD is particularly interested in the City of Huntington Beach because the project would reduce air pollutants by eliminating our current practice of burning the excess flare-gas from three oil wells located in the City Hall parking lot, and utilize that same gas to power the proposed Microturbines. SCAQMD is hoping that the City would also become a 'prime showcase" for this type of technology, and thus provide an accessible site to be viewed by the community and businesses. This project would help community development staff understand the technology, its benefits, and then be able to encourage and assist new development to incorporate this technology into new developments which would create more electrical self-reliance within the City of Huntington Beach. The City is particularly interested in this technology because it provides an alternative source of electrical power to City Hall without natural gas fuel costs. Attachment 2 shows the City's estimated out-of-pocket costs for installation, maintenance, avoided costs for electrical energy, and a conservative estimated payback. The payback begins In the 3rd Year and by the end of 10 years, the City will have saved over 600 000 in avoided electrical costs. In order to comply with the terms of the proposed Agreement (City must have the Microturbines installed within six weeks of executing an agreement to install), the City of Huntington Beach will be required to "fast-track" this project. In order to accomplish this, staff needs to be authorized to pursue a sole-source contract with Capstone California to complete the actual installation of the equipment, at a cost not to exceed $150,000. This contract is scheduled to be presented at the June 18, 2001 Council meeting. Said installation would be located adjacent to the existing flare station in the east parking lot. If the City Council approves this request (total appropriation $150,000), the estimated General Fund Balance at September 30, 2001 will be reduced to $9,597,188.
