JJ es ew o Icy or ExceptionGib Statement of Issue, Recommendation,Analysis, Fundinq Source,Alternative Actions,Attachments: STATEMENT OF ISSUE: The City of Huntington Beach has been requested to continue its membership in the Orange County Joint Powers Authority of the Southern California Hazardous Waste Management Authority {SCHNVMA}. BECOMMENDATION: Approve continued membership in the Orange County Joint Powers Authority of the SCHWMA and authorize a total payment of $I,8I8 membership dues for FY 89-90 and FY 90-91. ANALYST Eleven orange County cities joined together in 1986 to form the Orange County Joint Powers Authority of the SCHIYMA. The purpose of the Joint Power Authority is to insure that orange County has equal representation on the Southern California Hazardous Waste Management Authority. Prior to the Joint Powers Authority being formed, Los Angeles and San Diego each had three voting members while Orange County only had two. The formation of the Orange County Joint Powers Authority gave Orange County the opportunity to add one voting member on the SCMVMA thus provide for equal representation. The SCHWMA has the responsibility to oversee the development of Regional Hazardous Waste Management plans and have those plans approved by the State. Iry Pickier, Mayor Pro Tern of Anaheim, has been serving as the Joint Powers Authority representative and will continue in that capacity. Call to Order and Introductions The meeting was called to order at approximately 10:10 a.m. by City of Anaheim representative, Kristine Thalman (representing Mayor Pro Tem, Iry Pickler) with roundtable Introductions. 2. Background/Purpose of Joint Powers Authority Kristine Thalman gave a brief overview of the JPA purpose and background with the fcrmation intent being the advantage of having a third vote on the Southern California Hazardous Waste Management Authority (SCHWMA). Orange County presently is represented by three votes; the County of Orange, the Orange County Division League of Cities, and the Orange County Joint Powers Authority (JPA). Although the JPA had decided to continue membership for one more year in 1988, the series of events that have taken place relative to the implementation of a hazardous waste management plan have impacted this earlier decision. The State Department of Health Services (DHS) has rejected Orange County's Hazardous Waste Management plan due to the language surrounding the fair share concept. Further, an Actuarial Study is currently being conducted by the Authority (SCHWMA) to assess how an Insurance Pool for member agencies would be developed. Finally, a "united front" is ftrportart at thss critical stage, 3. Orange County Hazardous waste Management Plan--- Status Update A listing of those County and Regional Hazardous Waste Management Plans approved and disapproved by the State Department of Health Services was distributed (Attachment A). However, Assembly Member Sally Hansen has introduced A8 2595 which, if enacted, will allow the resubmittal of plans previously disapproved if done so within 180 days. Ms. Peters advised at the April 26 SCHWA meeting that the previously submitted language regarding Fair Share would be amended and resubmitted to the State. 4. Orange County's Future Role in the JPA Discussions with Karen Peters and Phillip Fernando (SCAG) have indicated that it would be to Orange bounty's benefit to continue the JPA membership. Moreover, the Authority will be completing the Actuarial Study for the Insurance Pool which may prove to be beneficial , in reference to Hazardous Waste Facility liability issues, to the JPA member cities. The Insurance Pool may provide a cost effective risk management program as well as the Unity aspect (rather than having one city shoulder the liability burden.) With the 1990's being the Environmental decade, the shortfall in hazardous waste facilities, and the AS 939 (Integrated Waste Management) Implications, it may be beneficial to keep the JPA in tact. 5. Actuarial Study-- -Insurance Pcol SCHWA is in the process of setting up presentations to Board of Supervisors, Waste Ccmmissions, and City Councils on the Insurance Pool requirements. JPA meeting representatives suggested that a presentation be given to city staff risk managers of the eleven JPA member cities prior to presentation, to elected officials. This meeting will be coordinated through the City of Anaheim and is anticipated to take place in late May. 6. Joint Powers Authority - Continuation Each of the representatives present indicated that the JPA should remain in existence for the remaining 1989/90 fiscal year in addition to 1990/91. It was further suggested that a revised invoice be submitted to each of the member cities by the coordinating city (Anaheim). The SCHWA $10,000 annual membership fee (a total of $20,000 for FY 1989/90 and 1990/91) will require a revised invoice reflecting the two year participation individual city share of $1,818.20. Each city will receive a revised invoice within two weeks. Since representatives of elected officials were present, a new delegate and alternate was not determined. Currently, Mayor Pro Tem, Iry Pickler (Anaheim) and alternate Councilwoman Joanne Coontz (Orange) represent the Orange County JPA. A new delegate and alternate have yet to be determined. 7. The time and place of the next meeting shall be 19 determined by the members. Such meeting may be held prior to 20 Orange County League of Cities Meetings. 21 4. TERM OF REPRESENTATIVE. 22 a. The selected representative and alternate shall 23 continue to represent the interests of the COMMITTEE for two 24 years; provided, however, that the term may end earlier if the 2.5 selected representative loses his or her elected status or as 26 provided in the following subparagraph. 27 b. The representative may be removed by a two-thirds 28 majority vote of those CITIES present at the meeting. 092485 -2- 1 5. DUTIES OF REPRESENTATIVE. 2 The representative shall regularly attend the meetings of 3 the AUTHORITY. The representative shall make quarterly reports to 4 the COMMITTEE at the time of Its meetings as to the AUTHORITY's 5 actions and other matters concerning the representation of the COMMITTEE on the AUTHORITY. In representing the COn11ITTEE, the representative may act independently, with the assistance of 8 policy direction provided by the COMMITTEE. 6. LEAD CITY. )� The city whose elected official is selected to serve as the COMMITTEE's representative shall be designated "Lead City" for �0 12 purposes of this Agreement. p �- 13 7. Each city shall pay 19 an equal share to the Lead City within twenty (20) days after the 20 date of this Agreement. Failure to pay such share shall 21 disenfranchise the non-paying city. 22 S. REIMBURSEMENT OF COSTS. 23 Each city shall reimburse the Lead City an equal share 24 for its operating expenses as is approved by the committee and 25 which is attributable to the services provided by the 26 representative to the COMMITTEE. 28 101M -3- 1 9. ADDITIONAL CITIES. 2 Other cities of Orange County may join the COMMITTEE with 3 the approval of a majority of the members of the COMMITTEE at the 4 time of application. After the approval of a majority of the 5 existing members has been obtained, the new member city shall 6 execute a counterpart of this Agreement. Each new city joining the COMMITTEE shall be required within twenty (20) days after 8 executing such counterpart to reimburse the existing members for 9 its equal share of the $10,000 payment originally required to 10 participate in the AUTHORITY (see Para. 7 PAYMENT) . 10. INDEMNIFICATION. SOU�if l CAI.I C�F� �jay�tl% HORITY Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: Statement of Issue: Eleven Orange County cities who have been working together to improve the representation for Orange County on the Southern California Hazardous Waste Management Authority, have been invited to seat one representative on the Authority. In order to provide this additional representation, it is necessary for the City of Huntington Beach, to join with the ten other Orange County cities to enter into an agreement to formalize the Orange County Cities "Committee" and provide an equal portion of funds to support the Committees activities. Recommendations: 1. Approve a !Memorandum of Agreement to represent Orange County Cities on the Southern California Regional Hazardous Waste Joint Powers Authority 2. Authorize $910 for the City of Huntington Beach's share of the initiation fee for joining the Authority and $300 for miscellaneous administrative expenses for the Orange County Committee's activities for fiscal year 86/87. Analysis: The Southern California Hazardous Waste Authority originally called for only two representatives from Orange County, while three each were provided to Los Angeles and San Diego. The City of Huntington Beach expressed a concern about the unequal representation and set about to join with other concerned Orange County cities to petition the Authority to seat one additional representative. On August 8, 1985, eleven Orange County cities met and decided to each request their respective City Councils to approve a formal agreement between themselves for the purpose of gaining an additional representative to the Southern California Hazardous Waste Authority and contribute an equal share towards the $10,000 payment for initial membership into the Southern California Hazardous Waste (Management Authority. 6 PI O 4/84 r The Orange County Cities Committee selected Councilman Iry Pickier of Anaheim to be Chairman of the Orange County Cities Committee and represent them on the Authority. The City of Anaheim will provide staff support to the Orange County Cities committee. With the approval of the recommended agreement by the eleven Orange County cities, Orange County will have equal representation with both San Diego and Los Angeles on the Southern California Hazardous Waste Management Authority. Orange County will be represented on the Authority by Supervisor Harriett Wieder, representing the County of Orange, Mayor Pro Temp Bill Ackerman of Fullerton, representing the Orange County Division of the League of California Cities, and Councilman Iry Pickler representing the Orange County Cities Committee. Funding Source: Miscellaneous contingency account #101593. Cities in attendance were Fullerton, Orange. Fountain Valley, Irvine. Santa Ana, Garden Grove, San Juan Capistrano. Brea, Anaheim, Newport Beach, and Huntington Beach. Charles Thompson had indicated that SCAG was forming a Southern California Hazardous Waste Management Authority which would develop guidelines and policies regarding hazardous waste for the whole region. He also indicated that each county would have a county representative and a city representative (selected by the Orange County Division of the League of California Cities) . However. the City of Los Angeles and City of San Diego were given authority for a third representative on this Southern California Hazardous Waste Management Authority. Representatives from the cities in attendance voiced a concern over the fact that Los Angeles and San Diego could potentially have a larger voice on Hazardous Waste Management than Orange . County. It was decided that those cities with mutual concern would form a Joint Powers Authority and seek its own representative on the Southern California Hazardous Waste Management Authority. On August 8, 1985, the interested cities met and decided that they would each contribute an equal share toward the $10,000 payment required for initial membership into the Southern California Hazardous Waste Management Authority. In addition, they would request assistance from Harriett Weider to receive an invitation to join the Hazardous Waste Management Authority. At that meeting, Iry Pickler was selected Chairman for the initial term, with Anaheim City staff providing the necessary support to the JPA. 200 South Anaheim Boulevard,P.0.Box 3222,(714)999.5166 2 The Southern California Hazardous Waste Management Authority at their meeting of April 24, 1986, extended an invitation to our JPA to become a full member of the Board. As such, they have now requested the $10.000 initiation fee from our JPA along with an executed copy of our agreement. This agreement still requires each of the 11 cities to execute the agreement and pay their equal share of the $10.000. A copy of the agreement has been enclosed so that you may take it to your respective councils for approval. In addition, a check for $909. 10 should be made payable to the City of Anaheim. Attention William Sell, City Manager 's Office, P.O. Box 3222, Anaheim, CA 92803. Anaheim will then send a check for $10,000 to the Management Authority on behalf of the SPA. Each council is also requested to set aside up to $300 for miscellaneous administrative expenses that may arise during the year. These expenses would range from office supplies to specific staff time required of the lead city as approved by the members of the JPA for special work required on behalf of the JPA.
