Our estimated cost for relocating this line, as shown on the sketch, is $1800; however, we would expect reimbursement for the actual cost of such work, %tatever it might be. Licensee and the agents and employees of Licen- see shall have the privilege of entry on said premises for the pur- pose of making necessary repairs to or changes in said: stru.otuxe, and licensee agrees to at all times keepsaid premises in good re- pair, and in the event of the improvement of said street, to improve that portion of said highway upon which said structure is cox struoted, in the same nanmr and to as good condition as said street or highway; and further agrees that it will keep said structure in such condition that the top of the rails thereof, wD,1 be flush .with the surface of said highway, and that it will not permit or allaff any cars, motors, engines, or other railroad cars or vehicles to stand or remain standing upon any portion of said structure. bi Upon revocation of the privilege contained here- in, or upon termination of this agreement, as hereinafter pro7ided, licensee shad, at Licensee's own cost and expense, immediately re,. move sa,i.d structure and restore said premises, as nearly as possible to the same condition in which the adjoining portions of said Ocean Avenue are at that time, failing in which Licensor may perform such work at cost of Licensee, which cost, Licensee agrees to pay to Licensor upon demand. 5. Licensee agrees that all work upon, or in con- nection with said structure shall be done at such time and in such manner as not to interfere in any way with the use of said Ocean Avenue as a public highway, and that the location of said structure and all work in connection therewith shall be done and made under the supervision and to the satisfaction of Licensor. 7. Should Licensor at any time require the removal, reconstruction, alteration, or changes in the location, of said, structure, Licensee shall, at License0 s own expense and cost, immo-- diately remove, reconstruct, alter, or make changes in the :location of said structure upon: receiving written notice from: Licensor. 8. This license is personal to Licensee, an& in caso l icenuee shall attempt to assign or transfer the same in Yhole or in part, without the previous written consent of the Licensor, this license may, by notice from Licensor to Licensee be revoked. 9. In the event Licensee shall discontinue the use of said structure or shall abandon the same, or shall fail to keep, ob- serve and perform any covenant on Licensee's part herein contained; all rights hereby given shall forthwith cease and determine and TA.cen- see shall thereupon remove said structure and restore said premises as hereinbefore provided. Should Licensee in such event, fail, ne- glect or refuse to so remove said structure and so restore said premm ises, such removal, and restoration may be performed by Licensor at the expense of Licensee, which expense Licensee agrees to pay to Licensor upon demand. 10. if at any time or times, any work of any kind or character is to be performed or done by a contractor for Licensee, Licensor hereby reserves the right to require any such contractor to enter into a vrritten Agreezment with Licensor satisfactory to it and to also xequire any such contractor to give an indemnity bond in favor of Licensor in such amount as licensor shell specify before permitting, any such o mtractor to perform or do any of said work upon the premr ises hereinbefois specified. 11. Licensee will ftilly pay for all materials joined or affixed to said premises, and pay in Tull all persons that perf.o= labor upon said. premises, and will .not permit or suffer any mechani.cis or other liens of any kind or nature to be enforced against said prem- ises for any work done or materials furnished thereon at Licensee's instance and request. 1'2o 1n case Licensor shall bring suit to compel per-. formance of or to recover for any breach of any covenants, agreement, or condition herein written, 'Ucensee shall and will 'pay to Licensor reasonable attorney- fees in addition to the amount of judgment and costs 13. This agreement may be terminated by either party hereto by giving thirty (301 days' notice in writing to that effect. 14.
