Public Facilities & Resources Department req-jests acceptance of the project as complete and
authorization to file a Notice of Completion for the seismic retrofit of Trinidad Lane
Bridae over Inland Waterway in the Huntington Harbor area of the City of Huntington Beach.
ADDITIONAL DATA
The work consisted primarily of construction of seismic retrofit improvements to the road
approaches and abutment portion of the Trinidad Lane Bridge (Bridge No. 55C-0260) . Beador
Construction, Inc. was given 130 working days, or until February 11, 2000, to complete the
$182, 499 project. Work was actually completed on October 26, 1999.
The estimated total construction cost amount included in this AIT is based upon quantity
calculations prepared by inspection staff and extra work claims submitted by the
contractor. Staff is still reviewing extra -work claims submitted by the Contractor and may

return to the Board for approval of Contract Change Orders to compensate the
Contractor for those extra costs that are substantiated. Meanwhile, the
filing of the Notice of Completion for the project is necessary to effect
the release of retention funds being withheld to which the Contractor is
enti_led. Subsequent to resolution of final costs for the project, final
payment_ amount may be subject to correction in the event that errors in
calculations are found, as provided by the clerical errors section of the
project special provisions.
Trinidad Lane Bridge and its approach roadway lies within the City of
Huntington Beach and, in accordance with Section 1700 of the Streets and
Highways Code, was declared to be a County highway during the construction
period. Now that the project is completed, it is necessary to relinquish
the County's Jurisdiction over that area. A sample resolution to effect
this change is submitted.

6 On motion of Supervisor Wilson, duly seconded and carried, the following Resolution was
adopted:

WHEREAS, on March 30, 1999, this Board, in accordance with Section 1700, Article 3,
8 Chapter 9, Division 2 of the Streets and Highways Code passed a resolution designating Trinidad
Lane Bridge and its approach roadway which lies within the city limits of the City of Huntington
9 Beach to be a County highway for the purposes of improving said bridge: and
10 WHEREAS, the improvements to said bridge have now been completed by the County of
Orange, and

WHEREAS, it is the intention of the Board of Supervisors to relinquish jurisdiction of said
12 bridge to the City of Huntington Beach within whose city limits said bridge is located,
13 NOW, -THEREFORE, BE IT RESOLVED that pursuant to Section 1704, Article 3, Chapter
9. Division 2 of the Streets and Highways Code, this Board does hereby declare that Trinidad Lane
14 Bridge and its approach roadway in the City of Huntington Beach is no longer a County highway,
and

BE IT FURTHER RESOLVED that the Clerk of this Board is hereby instructed to transmit
16 to the City Clerk of the City of Huntington Beach a certified copy of this resolution.

Statement of Issue : The City Huntington Beach and the County of Orange need to Amend
Agreement No. D97-112 (formerly D97-004).
Funding Source :
Gas Tax Funds have been budgeted for this work.
Recommended Action : Motion to:
Approve Amendment No. 1 to City/County Agreement D97-112 allowing a time extension for
the Trinidad Island Bridge Retrofit Project.
Alternative Action(s) :
Deny approval and forego the project.
Analysis :
On June 16, 1997, the City and County entered into agreement D97-112. This agreement
designates the County as the project contracting authority and authorizes the County to
provide contract administration for the Trinidad Island Bridge Retrofit Project during the
course of construction.
The original Agreement expired on June 30, 1998 and requires an amendment allowing a
time extension to December 21, 1999.
This project has been delayed due to Caltrans finalizing the project plans and specifications.

THIS AMENDMENT TO AGREEMENT, made and entered into this 5th day of April , 1999,

The CITY OF HUNTINGTON BEACH, a municipal
cotporation, hereinafter designated as "CITY"
AND
The COUNTY OF ORANGE, a political subdivision
of the State of California, hereinafter designated as
"COUNTY"
WITNESSETH
WHEREAS, CITY AND COUNTY entered into Agreement No. D97-112 (originally identified as
Agreement No. D97-004)on August 19, 1997, said agreement defines the terms and conditions of'a cooperative
project for the seismic retrofit of Trinidad Island Way Bridge in the City of Huntington Beach, referred to herein
as "PROJECT", and
WHEREAS, the date for the award of a construction contract for PROJECT needs to be amended.
NOW.THEREFORE, IT IS AGREED by the parties that the date for award of a construction contract
as shown in Section IV. A. of AGREEMENT shall be amended from "June 30, 1998"to"December 21, 1999".

Dear Mr. Eichblatt:
Attached is the cooperative agreement between the City and County for the
Trinidad Island Bridge Seismic Retrofit (Agreement No. D97-004) . we have
modified the agreement slightly since your last review (a marked up copy of
changes is attached) . If the agreement still meets with your approval
please have your City Council execute this agreement. After the City
Council has executed the agreement we will take it to the County Board of
Supervisors for execution. You will then be sent an original fully
executed agreement for your files.

the construction contract for this bridge, hereinafter referred to

WHEREAS, COUNTY is willing to prepare the bid package and administer the
bridge seismic retrofit construction contract for the CITY; and
WHEREAS, CALTRANS will fund loot of all eligible PROJECT costs; and
WHEREAS, CITY has an agreement with CALTRANS for reimbursement of
eligible PROJECT costs; and
WHEREAS, CITY will fund all PROJECT costs not funded by CALTRANS.
NOW, THEREFORE, IT IS AGREED by the parties hereto as follows:
I. CITY SHALL:
A. Prepare and process all necessary environmental documents required by
the California Environmental Quality Act of 1970 (CEQA) , as amended.
B. Prepare, or cause to be prepared, construction plans, specifications &
cost estimate for the PROJECT, and transfer said items to the COUNTY.
C. Identify utility locations on plans and be responsible for utility
relocation costs which are not covered by CALTRANS.
D. Review and approve the final plans, specifications and estimate (PS&E)
for PROJECT.
E. Pass a resolution declaring the bridge to be a COUNTY bridge during
the construction period.
F. Review and approve contract change orders (CCO) for PROJECT.
G. Visit PROJECT site as necessary during construction period.
H. Participate in a final walk through upon completion of PROJECT and
provide written acceptance of the PROJECT.
I. Fund any portion of the PROJECT bid package preparation, construction
and construction administration costs not covered by CALTRANS (both CITY and
COUNTY costs not covered by CALTRANS) .

Statement of Issue: The City has a bridge which must be designated as a County Bridge
during construction
Funding Source: None required_
Recommended Action: Approve the attached Resolution allowing Trinidad Island Bridge
to be designated a County bridge for the period of construction.
Alternative Action(s):
Deny approval and direct staff to administer the construction activities. This will require
additional staff time and reduce staffs ability to administer ongoing construction projects_
Analysis: The State Seismic Safety Retrofit Program provides for the upgrading of the
Trinidad Island Bridge within Huntington Beach to meet current seismic codes and improve a
bridge identified as being vulnerable to earthquakes_
The City and the County have entered into an agreement for the County to provide contract
administration during the course of construction.

The City/County Administration Agreement has designated the County as the project
contracting authority; therefore, pursuant to the Streets and Highway Code, the Board of
Supervisors and the City must adopt resolutions designating the Trinidad Island Bridge as a
County Bridge during construction. Both agencies must adopt their resolutions prior to award
of a construction contract. Upon completion of the project the County will relinquish the
bridge back to the City.
Environmental Status: To be review after completion of the preliminary design phase.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
CONSENTING TO THE DESIGNATION OF THE TRINIDAD ISLAND BRIDGE IN THE CITY
OF HUNTINGTON BEACH AS A COUNTY BRIDGE FOR THE PURPOSES OF
CONSTRUCTION , MAINTENANCE, IMPROVEMENT AND/OR REPAIR
WHEREAS, the State of California is improving various bridges within the County of
Orange to provide seismic protection: and
As a part of the project, the County of Orange intends to designate the Trinidad Island
Bridge within the City of Huntington Beach as a county bridge for purposes of construction,
maintenance, improvement and/or repair; and
Pursuant to Streets and Highways Code section 1701, the City Council intends to give
its consent to such designation,
NOW, THEREFORE, the City Council of the City of Huntington Beach hereby resolves
as follows:
1. The City Council hereby consents to the designation of Bridge No_ 55C-0260
(Trinidad Island Bridge, crossing the Long Channel), as a county bridge for the purposes of
construction, maintenance, improvement and/or repair during the period of the aforementioned
seismic retrofitting project -,
2. Pursuant to Government Code Section 65402, the City Council finds that the
proposed project is in conformance with the City's General Plan;
3. Pursuant to Orange County Flood Control Act, the City Council approves the
proposed project's plans and special provisions.

Statement of Issue: The City has a bridge which is eligible for participation in the State
Seismic Safety Retrofit Program The City is interested in having the County of Orange
designated as the contracting authority during construction_

Funding Source: Gas Tax Funds will be budgeted in the upcoming 1997/98 Budget to
have the County perform the administrative function_ The construction portion of the project
will not begin until after the the City's budget is approved. State and Federal funds will be
used for the construction portion of the project and no City funds will be needed.
The current Engineer's estimate for the construction portion of the project is approximately
$200,000. The Estimate for the County to perform the administrative function is $10,000_
Recommended Action: Approve the attached Agreement No. D 97-004 allowing the
County to administer the seismic retrofitting of the Trinidad Island Bridge during the period of
construction
Alternative Action(s): Deny approval of the attached agreement and direct staff to
administer the construction portion of the program. This would require additional staff time
and reduce staff's ability to administer ongoing construction projects.

Analysis: The State Seismic Safety Retrofit Program provides for upgrading the Trinidad
Island Bridge within Huntington Beach to meet current seismic codes and improve the bridge
identified as being vulnerable to earthquakes_
The City/County Administration Agreement will designate the County as the project
contracting authority and authorize the County to provide contract administration during the
course of construction.
The Construction will not begin until October or November of this year. The Consultant, hired
by the State on behalf of the City, will not have the plans and specifications available until
late June of this year The project must be awarded by December 31, 1997.
Environmental Status: To be reviewed after the preliminary design phase is completed.

On Tuesday, August 19, 1997, the Board of Supervisors approved Cooperative Agreement No. D97-
004 with the City of Huntington Beach for County administration of the construction contract for
seismic retrofit of Trinidad Island Way Bridge. Enclosed is your copy of this approved agreement. It
has come to our attention, however, that the agreement number, D97-004, is the duplicate number for a
similar seismic retrofit agreement approved by the Board in May, 1997.
A new number, unique to this agreement, has been assigned to this document. This change does not
affect the legality of the approved agreement, only the file referencing, contract administration, and
accounting of the project. Please change your files and existing documents to reflect this correct
number, D97-112, as it will be used in the future for all references to this agreement, and file a copy of"
this letter as cross-reference should any confusion arise from this renumbering.
We apologize for this small oversight, and sincerely hope that any inconvenience to you and your staff
is minimal.

THIS AGREEMENT, made and entered into this /?tkday of C 1997,

The CITY OF HUNTINGTON BEACH,
a municipal corporation
hereinafter designated as
"CITY"
AND
The COUNTY OF ORANGE,
a political subdivision of
the State of California,
hereinafter designated as
"COUNTY"
W I T N B S S E T H
WHEREAS, the California State Legislature has established a seismic
retrofit program to provide a means of funding seismically deficient bridges
in California; and
WHEREAS, the California Department of Transportation, hereinafter
referred to as "CALTRANS", has concluded a screening of the State's 12, 000
locally-owned or private bridges, as part of the local Seismic Retrofit
Program, to determine which bridges may be seismically deficient; and
WHEREAS, One bridge declared Category I seismically deficient is the
Trinidad Island Bridge in the Huntington Harbor area of CITY; and
WHEREAS, Caltrans is preparing the design for the seismic retrofit for
this bridge; and
WHEREAS, the CITY desires to have the COUNTY prepare the bid package and

administer the construction contract for this bridge, hereinafter referred to
as PROJECT; and
WHEREAS, COUNTY is willing to prepare the bid package and administer the
bridge seismic retrofit construction contract for the CITY; and
WHEREAS, CALTRANS will fund 100% of all eligible PROJECT costs; and
WHEREAS, CITY has an agreement with CALTRANS for reimbursement of
eligible PROJECT costs; and
WHEREAS, CITY will fund all PROJECT costs not funded by CALTRANS.
NOW, THEREFORE, IT IS AGREED by the parties hereto as follows:
I. CITY SHALL:
A. Prepare and process all necessary environmental documents required by
the California Environmental Quality Act of 1970 (CEQA) , as amended.
S. Prepare, or cause to be prepared, construction plans, specifications &
cost estimate for the PROJECT, and transfer said items to the COUNTY.
C. Identify utility locations on plans and be responsible for utility
relocation costs which are not covered by CALTRANS.
D. Review and approve the final plans, specifications and estimate (PS&E)
for PROJECT.
E. Pass a resolution declaring the bridge to be a COUNTY bridge during
the construction period.
F. Review and approve contract change orders (CCO) for PROJECT.
G. Visit PROJECT site as necessary during construction period.
H. Participate in a final walk through upon completion of PROJECT and
provide written acceptance of the PROJECT.
I. Fund any portion of the PROJECT bid package preparation, construction
and construction administration costs not covered by CALTRANS (both CITY and
COUNTY costs not covered by CALTRANS) .

II. COUNTY SHALL:
A. Be and is hereby designated the Lead Agency for PROJECT.
B. Be and is hereby designated as Project Engineer, Contracting and
Construction Agent for the parties to do and perform all things necessary in
order to prepare bid package, construct PROJECT in accordance with the
approved plans and specifications and to execute and deliver all documents
required in connection with the construction and completion of PROJECT,
including its Notice of Completion and final accounting report.
C. Prepare the final PS&E and compile in a form acceptable for
advertising PROJECT for bids.
D. Process 2nd and 3rd Utility notices.
E. Obtain all necessary regulatory permits.
F. Obtain PS&E approval from CALTRANS and CITY prior to advertising
PROJECT for bids.
G. Pass a resolution declaring the bridge a COUNTY bridge during the
construction period.
H. Process CCO that are necessary for the completion of the PROJECT as
shown on the plans and specifications and as approved by the CITY, CALTRANS,
and the COUNTY, and note any changes on record drawings.
I. Prepare and submit monthly invoices to CALTRANS for PROJECT costs
incurred; depending on how the agreement between CALTRANS and the CITY is
structured the COUNTY may have to invoice the CITY for PROJECT costs incurred.
J. File "Notice of Completion" and return ownership and maintenance of
the bridge to CITY.
K. Prepare record drawings depicting changes made during construction and
provide CITY with one set of original reproducible as-built mylars.

III. PAYMENTS AND FINAL ACCOUNTING:
A. COUNTY shall invoice CALTRANS (or CITY - see II.I above) on a monthly
basis for PROJECT costs based on COUNTY labor reports and progress pay
statements.
B. within ONE HUNDRED TWENTY (120) days after filing of the notice of
completion of the contract by COUNTY, COUNTY shall submit a Final Accounting
Report for PROJECT, for review and approval of CITY. COUNTY shall provide
with the Final Accounting Report a certification signed by COUNTY Director of
Public works and its Director of Finance that all expenditures applicable to
PROJECT have been made and that all copies of invoices and warrants are on
file with COUNTY.
C. Within 60 days after receipt of Final Report from COUNTY, CITY shall
review the Final Accounting Report for approval by CITY ENGINEER; upon
approval, CITY shall transfer to COUNTY any necessary funds, if any, to
balance PROJECT expenditures made or incurred by COUNTY.
IV. IT IS MUTUALLY UNDERSTOOD AND AGREED:
A. If COUNTY fails to award the PROJECT construction contract
by June 30, 1998, this agreement shall automatically become null and void
unless the parties mutually agree to extend the termination date.
.B. Pursuant to and in accordance with Section 10532 of the California
Government Code, in the event that this Contract involves expenditures of
State funds aggregating in excess of ten thousand dollars ($10,000) , the
parties shall be subject to the examination and audit of the Auditor General
of the State of California for a period of three (3) years after final payment
under this Contract.
C. That neither COUNTY nor any officer or employee thereof shall be
responsible for any damage or liability occurring by reason of anything done

or omitted to be done by CITY under or in connection with any work, authority
or jurisdiction delegated to CITY under this agreement. It is also understood
and agreed that, pursuant to Government Code Section 895.4, CITY shall fully
indemnify, defend and hold COUNTY harmless from any liability imposed for
injury (as defined by Government Code Section 810 .8) , occurring by reason of
anything done by CITY under or in connection with any work, authority or
jurisdiction delegated to CITY under this agreement.
D. That neither CITY nor any officer or employee thereof shall be
responsible for any damage or liability occurring by reason of anything done
or omitted to be done by COUNTY under or in connection with any work,
authority or jurisdiction delegated to COUNTY under this agreement. It is
also understood and agreed that, pursuant to Government Code Section 895.4,
COUNTY shall fully indemnify, defend and hold CITY harmless from any liability
imposed for injury (as defined by Government Code Section 810.8) , occurring by
reason of anything done or omitted to be done by COUNTY under or in connection
with any work, authority or jurisdiction not delegated to COUNTY under this
agreement.
