Subject: Farking Agreement with W & D Commercial
Properties, Inc.
Dear Council Members:
Transmitted herewith is a parking agreement between city
of Huntington Bea h and W & D Commercial Properties, Inc.
The developer wishes to use a portion of the storm channel
easement '.nat belongs to the City for parking and through
traffic of vehicles for a proposed commercial development on
the southwest corner of Edi.zger and Sher.
The area covered by the agreement calls for the developer
to construct and maintain the easterly 8.00 feet of the west
45.00 feet of said development tdi the specifications of the
Depzrtment of Public Works.
It is recomraanded that your Honorable Body approve and
execute the si.►bject agreement.

The City Council of. the City of Huntington Beach at its regular
meeting held Monday, November 3, 1975, approved a parking agreement
providing use by your company of a portion of a City storm channel
easement for parking and t%rough traffic of vehicles.
We are enclosing a duly executed copy of said agreement for your files.

AGRE,E1,IENT FOR USE OF PORTION OF DRAINAGE
EASEMENT FGR PARKING PURPOSES
THIS AGREEMENT is between the CITY OF HUNTINGTON BEACH,
a municipal corporation, hereinafter referred to as CITY,
and W & D COMMERCIAL PROPERTIES, INC. , a California corporation,
hereinafter referred to as COMMERCIAL.
R E C I T A L S
1. CITY has an easement for storm channel drainage
purposes over that portion of the Northeast quarter of Section 23,
Township 5 South, Range 11 We;:t, San Bernardino Base and
Meridian, Orange County, California, more specifically de-
scribed as the East thirty (30) feet of the West forty-fi,je (45)
feet of the Northwest quarter of the Northeast quarter of the
above mentioned Section 23, excepting therefrom the Northerly
thirty (30) feet.
2. COMMERCIAL desires to encroach on a portion of said
easement, specifically the Easterly eight (8) feet thereof, for
the purpose -„ accommodating parking and through traffic of
vehicles for a proposed commercial. development.
3. CITY has determined that such parking use will not
interfere with the present use of said drainage ease nt.
NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS:
A. COMMERCIAL may use the Easterly eight (8) feet of
said easement for parking and, through traffic purposes

B. Prior to commencing use of the property for parking
and through traffic purposes, COMMERC.IAL shall install a fence
of a type approved by, and at the location designated by, the
Public Works Director.
C. COMMERCIAL shall improve the property to be used for
parking and through traffic purposes Go the specifications of the
Public Works Director.
D. CITY retains the right 40 use the property for
maintenance or repair of drainage facilities.
E. CITY retains the right to terminate this agreement
upon ninety (90) days written notice to COMPMRCIAL.
The parties have executed this Agreement this ? day
