The Youth Employment Service Coordinator will prepare a bi-monthly
v report showing the number of job applicants from each of the tlizoe
cities and the number of applicants placed for each cf the cities-.

After Decembi;,- 31, 1973; each city has mutually agreed to operate
its ovm Eaq-11"sty within its incorporated boundaries and assume its

in the following areas
1. Meet on a regular basis to discuss sharedgoals and
' p;roklems and determine ways to work in a complementary
fashion.
2. Work together in publicity and ,other s_.ccial programs.

During the month of July the Manpower YouthEmployment
Service increased its job placement t',tal by 141 hires over
the month of June. The goal of 300 hires I set for the month
of July was exceeded by 66 hires. Altogether 366 hires were
recorded compared with 226 for last month.
Applicant registration also increased during the month
of July, with 1,402 applicants registered compared with
1,168 for last month.

If Mrs. Koch is not an independent contractor, there she is
an employee or agent. if she is an employee, then our
existing liability policy will corer her and Y.E.S. But

SUBJECT: Youth Employment Service (Y.E.S.);
City Council Resolution No. 364
Pursuant to your instructions, I have investigated and found that
Y.E.S. does not carry liability insurance, in fact Y.E.S. has no
insurance at all.
Mr. Hal Brick of Jones Gillespie and Goppert informs me that the
ci.ty's existing liability insurance policy does not cover Y.E.S.,
and that they should have their own liability insurance policy.
Also, each city contributing funds to Y.E.S. should be named as
an additional insured on Y.E.S's iiability insurance policy.
The minutes of the Insurance Meeting of February 28, 1973 (attend-
ees: Rowlands, Belsito3 Arguello, Bonfa, Georges, Gillespie,
Brick, Williams of Chubb/Pacific) indicate that it was agreed that
Y.E.S.is to be encouraged to secure liability insurance
I have also found that Y.E.S. is not a corporation nor a partner-
nersh p, nor is It a separate public entity. There is not in
existence a „oint powers agreement creating a separate public
entity. There is merely a simple agreement among, foLir cities to
provide funds for Y.E.S. The cities of Fountain Valley, Garden
Grove, Westminster and Huntington Beach each pay a Pro rata share
of Y.E.S's costs. Therefore, Y.E.S's relationship to the City of
Huntington Bead, is either an agency or an :�ndependent contractor.
I contacted Mrs. Janey Koch, who Informed me that she operates
Y.E.S.., and that the operation is located in the Huntington
Center Mall,

Mrs. Koch informed me that she is paid for Y.E.S's services out
of our city's general fund twice a month with no deductions on
the paycheck which makes her an independent contractor according

or not she is an independent contractor because our city is,

as set forth in the annexed budget. Each city agrees to pay a pro
rata share of this amount on a per capita basis as follows:

Huntington Center Mall. The City of huntington Beach will be
the fiscal agent for the service,
The Youth Employment Service Coordinator will prepare a bi-monthly
�c report showing the number of job applicants from each of the four
cities and the numberof applicants placed for each of the four
cities. Each city agrees' to pay one-half of the above annual
share of costs not later than .October 1, 1972. The 'balance is
due and payable on March 1, 1973.
