RESOLUTION NO. 2013-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING THE CITY'S INTENTION TO LEVY AN ANNUAL ASSESSMENT FOR FISCAL YEAR 2013-2014 WITHIN THE HUNTINGTON BEACH DOWNTOWN BUSINESS IMPROVEMENT DISTRICT WHEREAS, the California Legislature, in adopting the Parking and Business Improvement Area Law of 1989 (Streets and Highways Code §36500 et seq.) found that cities are authorized to levy assessments on businesses in order to promote economic revitalization and tourism, create jobs, attract new businesses and prevent erosion of business districts; and The California Legislature found that cities are authorized to levy assessments on businesses which benefit from those improvements and activities; and A sizeable majority of the downtown businesses within the City of Huntington Beach requested that the City Council commence proceedings under the Parking and Business Improvement Area Law of 1989 to establish a downtown business benefit area within the City of Huntington Beach and to levy a special assessment to promote tourism and tourist related events; and The City Council formed a business improvement area, known as the Huntington Beach Downtown Business Improvement District (the "District"), by the passage of Ordinance No. 3661 on September 7, 2004. The City is proposing to levy an assessment for fiscal year 2013-2014 pursuant to the process detailed in Streets and Highways Code §36500, et seq.; and The District's Advisory Board has prepared and filed with the City Clerk an "Annual Report/Operating Budget 2012-2013 Fiscal Year to Date" and "Proposed Budget for Fiscal Year 2013-2014" (collectively, "Annual Report"); and NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. The City Council hereby approves the Annual Report filed by the Advisory Board in the City Clerk's office attached hereto as Exhibit A and incorporated herein by this reference, which includes a proposed budget for Fiscal Year 2013-2014 and a description of the improvements and activities to be provided for Fiscal Year 2013-2014. SECTION 2. To levy and collect assessments within the District area for Fiscal Year 2013-2014 as per the assessment schedule listed in )Exhibit B attached hereto and incorporated herein by this reference. SECTION 3: The type or types of improvements and activities proposed to be funded by the levy of assessments on businesses within the business improvement area are specified in Exhibit C, attached hereto and incorporated herein by this reference. Further, 13-3833/99520 1 Resolution No. 2013-39 the improvements, if any, to be acquired for the proposed business improvement area are specified in Exhibit C. SECTION 4. A public hearing shall be held before the City Council on September 3 , 2013, at 6:00 p.m., or as soon thereafter as this matter may be heard, in the Council Chambers of the City Hall, 2000 Main Street, Huntington Beach, California, at which time the Council will hear all interested persons for or against levying of the assessment, and the furnishing of specified types of improvements or activities. Protests may be made orally or in writing; but, if written, shall be filed with the City Clerk at or before the time fixed for the hearing and contain sufficient documentation to verify business ownership and validate the particular protest. Any protest pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularity or defect to which the objection is made. The City Council may waive any irregularity in the form or content of any written protest, and at the public hearing, may correct minor defects in the proceedings. A written protest may be withdrawn in writing at any time before the conclusion of the public hearing set forth above. If written protests are received by the owners of businesses within the District, which will pay 50% or more of the total assessments to be levied, no further proceedings to levy the proposed assessment shall be taken for a period of one year from the date of the finding of a majority protest by the City Council. If the majority protest is only against the furnishing of a specified type or types of improvements or activity within the District, those types of improvements or activities shall be eliminated. SECTION 5. The City Clerk is hereby directed to provide notice of the public hearing by causing the this resolution of intention to be published once in a newspaper of general circulation at least seven days before the public hearing. SECTION 6. Further information regarding the proposed business improvement district may be obtained at the Huntington Beach City Hall, 2000 Main Street, Huntington Beach, California 92648; telephone (714) 536-5542; or from the Huntington Beach Downtown Business Improvement District, 315 3`d Street, Suite E, Huntington Beach, CA 92648, (714) 536-8300. SECTION 7. The City Clerk shall mail a complete copy of this resolution of intention by first-class mail to each business owner in this area within seven days after the Council's adoption of this resolution. SECTION 8. This resolution shall take effect immediately upon adoption. With over 250 restaurants, retail, hotels, salons, spas and service establishments, HB Downtown has the highest concentration of shopping, entertainment and dining in Huntington Beach. e r, •�' i` EL (AKIS - WOMB i . R In 2013 we welcomed a range of new dining options such as The Local Bench Grill, Super Hero Sandwiches, Avocado Cafe, The Funnel House and Bruxie. In addition, a new retail store, Unique Vintage, joined The Strand. Soon we will be welcoming two new dining options, Dos Toros & Ritter's Steam Kettle Cooking, to HB Downtown, giving visitors even more reason to enjoy our destination. a PROGRAMS & SERVICES The HBDBID continues to work to promote and enhance accessability and overall appeal of Downtown through its programs & services, including holiday beautification, street services, public safety and marketing programs. In conjunction with the City of HB I departments of Public Works, Economic Development, the Art Center, and the HB Marketing and Visitor Bureau, the HBDBID is proud of the role it plays in promoting HB Downtown as a premier destination for residents and visitors alike. I SEPTEMBE '\ - �• , � CEMBER 5 STREET SERVICES The street services program is administered by the BID staff and on-street services are performed by our contracted cleaning services provider, Malco Maintenance. Day porters maintain cleanliness in most 1 downtown areas except for buildings that provide their own cleaning service. Porters are ` responsible for litter, trash removal, spot mopping of sidewalks, minor graffiti removal, dusting storefront sills and gum removal. POWER WASHING 1 , The power washing program includes steam Icleaning of sidewalks on Main St. twice a week in peak periods and once a week in off-peak periods. Alleys are steam cleaned quarterly. COORDINATION WITH PUBLIC WORKS The BID staff interfaces with Public Works to insure a safer environment regarding tree trimming, sidewalk replacement and reporting of major graffiti clean up. This maintenance partnership with the city is credited for providing a cleaner, more beautiful downtown district. The BID is excited to renew the Memo of Understanding with the City of Huntington Beach to be adding services to include blocks of 5th street in Malco service. PUBLIC SAFETY ADVOCACY The BID continues to build strategic hUDT partnerships with law enforcement and � xTy, to advocate for appropriate police coverage for daily details and special events in the downtown area. We continue to be involved in the planning; stages of city and community events: such as, the Surf City Marathon, 4th o July and US Open of Surfing, to ensure' <. -- downtown business interests and;; , concerns are represented and addressed. In 2013, we joined the. HBMVB in the Save the Bonfires campaign. RESPONSIBILITY The BID is active in promoting and sharing information on responsible beverage service (RBS) and Training for Intervention Procedures (TIPS) classes to all our local restaurants and pubs. These programs are designed to prevent and recognize intoxication, underage drinking and drunk driving, by serving alcohol responsibly, thoroughly checking ID's, not over serving patrons and not serving minors. The BID has recently partnered with Harbor Distributing to prornote designated driver, safe driving and taxi voucher prograrns. MARKETING, EVENTS & COMMUNICATIONS 11 -l"I The HB Downtown BID showed continued e BID events and significant growth in social media programs in 2012. An essential part of the BID's goals is to support the downtown merchants by keeping the downtown district top of mind for local residents and visitors as a primary business and vacation destination. The BID will continue to grow these communication channels with Huntington Beach fans to connect and engage them about all that downtown has no offer. This year we have also made a concerted effort to become "Fans" of businesses downtown so we can share their pages and help spread news about their special offerings and events. In April, we presented a special Easter celebration with Easter Bunny pictures and petting zoo. In May, we hosted two special events: Police Appreciation and HB Downtown Fashion Show. In June, we brought back a favorite event. - The Princess Party, loved by youngsters who had photo ops with 6 fairytale princesses that also did a song and dance show each hour. A very important element of Surf City Nights is that we provide a number of booth spaces every week for the benefit of city services and local non-profit charity groups, all year round. Also, in 2013, for the first time, the BID was very excited to participate with a float in the 4th of Jul event. The BID information booth, with its bright yellow canopy, continues to be highly visible and attractive. Centrally located; it is an essential marketig n tool to reach the thousands that attend each week, Volunteers distribute promotional material for all BID members and their related events. 15 ART WALK - Third Thursday The HBDBID brought a renewed energy to the ART WALK this year, starting with new logos and creating special themed events each month. Responding to feedback from both visitors and artists HUNTINGTON BEACH alike, we moved the event night from DOWNTOWN Wednesday to the third Thursday of ART each month. The HB Artwalk brings art enthusiasts to the streets of downtown to over two dozen host locations, with between 35-50 artist exhibits. Also this year, we've partnered with the International Surfing Museum to create a center hub of activity in the parking lot, with entertainment, live art, and kids' art activiites. The free self-guided tour offers guests an entertaining evening of exploring art and ambiance in downtown. The Art Center continues to be an invaluable partner in hosting and promoting arts and culture while building community. 0 e . �, CHILI AT THE BEACH June 15, 2013 Some Iike it hot and that's just what they got at the 6th Annual Chili At The Beach where 21 Chili/Salsa teams cooked up some flavorful and spicy recipes while competing for awards in several categories. The crowd of nearly 20,000 was entertained by three stages of music, including a stage for young 111k performers. This family friendly event featured a kid's zone and a first-time-ever Ferris Wheel on the Strand. With over 60 vendors exhibiting products geared towards men's interests and hobbies, Chili at the Beach has become a favorite event for the local community. The event raised funds to support the Boys and Girls Club of Huntington.Valley. SURF CITY DAYS - September 15-16, 2012 q, This event was the end of summer beach bash that included a Beach Fun Run, Community Surf Championships, Stand Up I ~ Paddle Surf Race to Marine Safety Demonstration, Community Volleyball Tournament, Green Expo by the Chamber of Commerce, and a Board Demo Days on Main St. 2012 The BID is looking forward to exciting plans for growing SURF CITY DAYS with a fun new Jr. Lifeguard event & Safety Fair planned for 2013. HALLOWEEN FEST - October 31, 2012 On Halloween, Downtown HB was transformed into HBoo h Spooky Town where little super heroes and princesses enjoyed a safe and family-friendly festival. Tons of treats on the streets, a petting zoo, pony rides, games and DJ entertained nealry 12,000 guests. The Kid's Costume contest and Canine Howl-O-Ween contests were a big success on The Strand where prizes were awarded for most creative, scariest, cutest, funniest and best duo or group. 17 OUTREAC H The BID partnered with the Chamber of Commerce and the City of Huntington Beach to support the 2nd FACE2FACE Business PACE2FACE Expo located at Pier Plaza in May. Local HB downtown restaurants generously donated food and drinks for the Expo participants and VIPs. In 2013, the BID connected students from Ocean View HS Business Academy with downtown businesses, by coordinating field trips to local businesses where we engaged in mutually beneficial discussions regarding destination and business management. BID Staff, Directors and BID members attended many meetings of the City Council, Zoning Administrator Hearings, Downtown Economic Development Committee, Specific Event Hearings and numerous committee meetings to advocate for Huntington Beach Downtown and its interests and to insure continued economic vitality in the downtown district. Meetings Meeting schedules are published in the monthly newsletter and are posted on the website. Meeting agendas are posted in our office window, on the community bulletin board and at City Hall in accordance with the Ralph M.
