RESOLUTION NO. 2018-55
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH AMENDING THE FEES AND CHARGES FOR
ENTRANCE TO OR USE OF CITY PROPERTY, FEES AND CHARGES COLLECTED BY
THE COMMUNITY SERVICES, FINANCE, FIRE, INFORMATION SERVICES, AND
PUBLIC WORKS DEPARTMENTS, AND THE FEES FOR ENVIRONMENTAL REVIEW,
ALL AS ESTABLISHED PURSUANT TO RESOLUTION NOS. 2016-59, 2017-46, 2018-01,
2018-29, and 2018-48, WHICH ESTABLISHED A CONSOLIDATED COMPREHENSIVE
CITYWIDE MASTER FEE AND CHARGES SCHEDULE
(SUPPLEMENTAL FEE RESOLUTION NO. 7)
WHEREAS, the City Council adopted Resolution 2016-59 establishing the Consolidated
Comprehensive Citywide Master Fee and Charges Schedule(the"Fee and Charges Schedule");
and
The City Council temporarily amended the Fee and Charges Schedule pursuant to
Resolution No. 2017-46, and further amended the Schedule pursuant to Resolution Nos. 2018-
01, 2018-29, and 2018-48; and
The City Council desires to update the Fee and Charges Schedule; and
The City Council had reviewed the Citywide User Fee and Rate Study conducted by NBS
(the "Fee Study") in support of Resolution No. 2016-59. In the case of various Community
Services, Finance, Fire, Information Services, and Public Works Department Fees identified in
Exhibit A to this Resolution, the City Council established the fees at less than the 100% cost
recovery the Fee Study recommended. The City Council desires to increase said fees to no more
than full cost recovery as established in the Fee Study; and
The City Council further desires to increase the Community Services Department charges
for entrance to or use of City property identified in Exhibit A to this Resolution; and
The City Council further desires to update the Fee and Charges Schedule to modify the
fees the Community Development Department collects for environmental review to full cost
recovery on a time and materials basis. At the time of project application, the applicant shall pay
an initial deposit representing a portion of the estimated cost of time and materials. In all cases,
the project applicant shall pay the full cost of City Staff's time and materials, and/or the invoices
of the consultant the City retains to complete the environmental review of the project. To the
extent the City's time and materials and/or the consultant's total invoices exceed or are less than
the deposit, the applicant shall pay the additional cost, or the City shall refund the unused portion
of the deposit. The Director of Community Development, or his or her designee, shall determine
the amount of the deposit as well as the final cost of environmental review; and
Pursuant to Resolution No. 2012-23, the City Council adopted Traffic, Library, Fire,
Police, and Parkland Development Impact Fees pursuant to Chapters 17.65, 17.67, 17.73, 17.74,
and 17.75 of the Huntington Beach Municipal Code (collectively, the"Impact Fees"). The City

included the Impact Fees as part of the Fee and Charges Schedule when it adopted Resolution
No. 2016-59. Pursuant to this Resolution, the City Council desires to delete pages 27, 66, and 67
from Exhibit A, the Fee and Charges Schedule of Resolution No. 2016-59. Concurrently with
adopting this Resolution, the City is making clear the Impact Fees remain in Resolution No.
2012-23.
NOW, the City Council of the City of Huntington Beach does hereby resolve as follows:
Section 1. Resolution No. 2016-59, as amended pursuant to Resolution Nos. 2018-01,
2018-29, and 2018-48, is further amended by adopting the Recommended Fee Level column
attached in Exhibit A, which shall become effective upon adoption of this Resolution, and
continue thereafter.
Section 2. When collecting the environmental review deposits to the Department of
Community Development, as described at Exhibit A, the applicant shall pay an initial deposit

Section 3. Resolution No. 2016-59, as amended pursuant to Resolution Nos. 2018-01,
2018-29, and 2018-48, is further amended by deleting pages 27, 66 and 67 from Exhibit A to
Resolution No. 2016-59. All other charges or fees set forth in Resolution No. 2016-59, as
amended pursuant to Resolution Nos. 2018-01, 2018-29, and 2018-48, shall remain in effect.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on 17 th day of December , 2018.
