At that time, various funding sources such as the State Gas Tax had not been received or confirmed and the necessary expenditure appropriations were unable to be adopted. Therefore, it is necessary to establish appropriations in order to move forward on CIP projects and the Gas Tax Exchange Program in FY 2009/10. Funding Source: State of California gas tax revenue, Federal, State and County transportation grants, and existing fund balance. Recommended Action: Motion to: Approve additional appropriations for FY 2009/10 as detailed in the Capital Improvement Program New Appropriations FY 2009/10 Budget Addendum (Attachment 1.) Alternative Action(s): Do not approve the appropriations in the Capital Improvement Program New Appropriations FY 2009/10 Budget Addendum (Attachment 1) and require separate City Council approval for each CIP project in FY 2009/10. �/i REQUEST FOR CITY COUNCIL COUNCIL ACTION MEETING DATE: 12/21/2009 DEPARTMENT ID NUMBER: FN 10-003 Analysis: Every year, there are some capital projects whose funding source has not been confirmed at the time of budget adoption. Given the State of California's budget issues and threats to withhold Highway Users Tax (e.g., gas tax) revenue, FY 2009/10 was a particularly difficult year to plan the Capital Improvement Program (CIP). In addition, the Gas Tax Exchange Program with the Orange County Transportation Authority (OCTA) was not fully funded given the possibility of the State withholding gas tax. Therefore, it is necessary to present a Capital Improvement Program New Appropriations FY 2009/10 Budget Addendum for City Council approval (Attachment 1.) The appropriations detailed in Attachment 1 establish new spending authority for various CIP projects as well as for the Gas Tax Exchange Program with the OCTA. There are now confirmed funding sources for FY 2009/10 capital projects using gas tax, as well as new Federal, State and County grant revenue. The Orange County Transportation Authority (OCTA) informed the City last month that the Gas Tax Exchange Program will continue on a modified schedule. Now in its thirteenth year, the program redistributes State Gas Tax funds from OCTA to local cities. For FY 2009/10, the annual exchange amount is $1,945,999. Monthly payments of approximately $216,000 are made to the city, which earns interest on the funds and returns the principal to OCTA each quarter. This program was established to repay OCTA funds loaned to the county during the 1994 bankruptcy. Attachment 1 includes new appropriations totaling $4,908,082. This is the amount necessary to continue work in FY 2009/10 on various capital projects as well as to participate in the OCTA Gas Tax Exchange Program. These expenditure appropriations will be offset by gas tax and grant revenue of $5,177,982. Strategic Plan Goal: Maintain, improve and obtain funding for public improvements. Environmental Status: Projects are reviewed on an individual basis prior to award.
