At that time, staff indicated to Council that if this revenue did, indeed, become a reality, the city would schedule a public hearing to set the fee should it be a revenue producing activity. The anticipated revenue has fallen considerably short of the cost to pur- chase, maintain, and install the pennant banners and the program is not anticipated to generate enough revenue to cover the cost for at least two more years. It is also quite possible that, at this time, the city will have to replace hardware and the fee will still not be a revenue generator. Staff will continue to track the annual income from the specific event pennant banner program and at such time as revenue exceeds costs, we will prepare a public hearing notice as required by law. The Community Development Director reported that the fee resolution was written to recuperate the full cost of the brackets within a one year period. A motion was made by Garofalo, seconded by Green, to appropriate $9,500 from the unencumbered General Fund balance into Account No. E-AA-PW-417-221-00 for the purchase and installation of permanent mounting brackets for pennant banners on street light poles; and authorize the Director of Public Works to proceed with the solicitation of bids for the purchase and mounting of permanent mounting brackets; and adopted Resolution No. 6672 as amended for a two year amortizing period. Funding Source: Unappropriated General Fund Balance. Recommended Action: 1. Appropriate $9,500 from the unencumbered General Fund balance into Account No. E-AA-PW-417-221-00 for the purchase and installation of permanent mounting brackets for pennant banners on street light poles-, 2. Authorize the Director of Public Works to proceed with the solicitation of bids for the purchase and mounting of permanent mounting brackets; and 3. Approve attached resolution amending the city fee resolution by adding fees for the installation and retrieval of pennant banners during specific events. Alternative Action(s): 1. Do not purchase or install permanent, standardized hardware, nor allow pennant banners to be hung for specific events. 2. Purchase and install the recommended hardware but do not pass the cost for such hardware onto specific event applicants. Charge only for the installation and retrieval of pennant banners. Analysis: Each year, the city approves a number of specific event permits that include a request for authorization to locate and install pennant banners on city and SEC light poles. Currently, there is no standard for the hardware used in mounting such banners or for0e locations where banners may be installed. This results in the city being unaware of where banners will be installed or what type of hardware is used, presenting a liability to the city. REQUEST FOR COUNCIL ACTION MEETING DATE: 4/3/95 DEPARTMENT ID NUMBER:PW 95-014 Banners have been installed on poles that have blocked vehicular views, presented a hazard to pedestrians, or damaged the poles because the banners were too large or heavy or the brackets were faulty. Public Works crews have had to remove, at city expense, brackets and banners left on poles after events. While staff recognizes the need and encourages the use of pennant banners for promoting specific events and for informing the public of activities, the location of such banners and the method of installing them need to be standardized and controlled by the city. On March 16, 1995, staff made a presentation to the Specific Events Committee that would provide for the purchase and installation of quality mounting hardware for pennant banners. Staff also presented a standardized program for the size of banners, locations, and installation and retrieval. The committee supported the program unanimously. The program is as follows: The city would purchase aluminum mounting brackets and mount them permanently on 118 city and SCE light poles throughout the city and on the city pier. The city would charge a fee, approved by Council, that would include a payback of the initial capital costs and the direct costs of labor to install and retrieve the banners. Each specific event applicant would pay this fee in addition to purchasing their own banners per the standards established by the city. The staff recommended fee would be $97.50 per pole or $2,500 for the entire 118 sites throughout the city. This cost would recover the city's capital outlay for the hardware and the installation/retrieval costs. Once the city recoups the $9,500 capital cost, the fee would be changed to cover the cost of installation/retrieval and a sinking fund to replace the hardware in five to ten years (the estimated life of hardware). After the capital payback estimated to be one year, the fee would drop to $15 per pole for installation/retrieval. Staff has reviewed the above proposal with promoters of several of the large specific events that utilize pennant banners in promotions. The professional sporting events such as surfing and beach volleyball, and Pierfest are in support of the proposed program and fees. Nonprofit community groups such as Fourth of July Executive Board, Art Center Foundation, and the International Surfing Museum feel that the city should pay for the initial hardware and that they should only be charged for installation/retrieval. Because of the city's current fiscal position, staff.has prepared the program to be completely self-supporting by the users of pennant banners. Summary: The city cannot continue to allow inferior hardware that damages light poles for installation of pennant banners. The city can also not allow banners to be installed in certain locations that obstruct views or cause liability. The proposed program would have the city control the locations, installation and retrieval of pennant banners. Specific event applicants would be required to purchase banners according to city standards, and pay the city for their installation and retrieval. A- I= OIL March 30, 1995 :;. r -� Mayor and City Council City of Huntington Beach 2000 Main Street Huntington Beach, CA 92648 Subject: Event Banners on Street Light Poles Dear Mayor and City Council, I understand that you will be considering an item on your April 3, 1995 agenda which recommends that City staff be authorized to purchase and install permanent mounting brackets for pennant banners on street light poles. The recommendation includes an amendment to the city fee resolution to allow charging a fee to event organizers to cover the costs of installing pennant banners on the mounting brackets and removing them after the event. As you know, the Surf City Foundation holds Pierfest on the third weekend of August each year. In conjunction with Pierfest, we purchase and have installed pennant banners throughout the City and on the municipal pier. Although the Surf City Foundation is a non-profit charitable corporation, we support the recommended action. The action is necessary in order to preclude inferior hardware which could cause liability problems [for the City and the event orgaruzer. It is also desirable that that the hardware and the banner sizes be uniform for aesthetic reasons. We do not object to a one time charge to all event organizers, whether they be for-profit or charitable, of a fee to amortize the City's costs for these banners because we feel it is not an expenditure that the general taxpayer should absorb.
