SUBJECT: Approval to purchase a new Code Enforcement vehicle using funds
from the Statewide Abandoned Vehicle Abatement Program.

Statement of Issue: After several years of use, the current Code Enforcement vehicle
used for the Vehicle Abatement Program is in desperate need of replacement. The staff
requested and received $17,100 from the Orange County Transportation Authority for the
purchase of one vehicle to be used for the vehicle abatement program. The $17,100 has
been received and deposited in the General Fund.
Funding Source: General Fund, Unappropriated Fund Balance with 100% reimbursement
provided by the Statewide Abandoned Vehicle Abatement Program. This is unanticipated
revenue.
Recommended Action: Motion to appropriate $17,100 from the unappropriated general
fund reserve and authorize expenditures to purchase a new Code Enforcement vehicle
which will enhance and support our abandoned vehicle enforcment efforts.
Alternative Action(s): Do not approve using these excess SAAV funds to purchase the
new vehicle and return the $17,100 already received from this program for this purpose.

Analysis: The Code Enforcement Division currently participates in the Statewide
Abandoned Vehicle Abatement (SAAV) Program, which is administered by the Orange
County Transportation Authority. Through this program the City is reimbursed for
abandoned vehicles that we investigate by complaint or officer observation (Code
Enforcement is responsible for private sector enforcement, while the Police Department is
responsible for public sector enforcment). On a quarterly basis, the SAAV Program
distributes these reimbursements to the participating agencies submitting reimbursement
requests to the Transportation Authority for their enforcement efforts.
At the end of the fiscal year there is occasionally an excess of funds distributed by the
OCTA-SAAV Program. OCTA may, at their discretion, distribute these excess funds to
participating agencies or return the funds to the State of California. The excess funds
distributed to the participating agencies must be used to enhance and support their
abandoned vehicle abatement program. These funds are in excess of the regular quarterly
distribution funds received and does not impact any future quarterly funds requested.
The Code Enforcement Division currently uses a Dodge Aries for enforcement of abandoned
vehicles, however, after many years of use the vehicle is in desperate need of replacement.
The Division was informed by Administration that the City currently purchases Chevy
Lumina's for City use. The Purchasing Department received a bid of $17,100 to purchase a
new Lumina should excess OCTA-SAAV funds be obtained.
On September 10, 1997, Code Enforcement personnel submitted a request to the OCTA-
SAAV Program to obtain the excess funds necessary to purchase the new Lumina. This
request was granted and a check for $17,100 was received. At the time the check was
received, Code Enforcement personnel was informed that the funds must be used for the
purchase of a new vehicle to be used by the Code Enforcement Division for enforcement of
abandoned vehicles. We would like to purchase the new Lumina with the funds provided.

As required by Resolution 4832, A Fiscal Impact Statement has been prepared for
"Approval to Purchase One Code Enforcement Vehicle Using Excess Funds from the
Statewide Abandoned Vehicle Abatement Program."
If the City Council approves this action (total appropriation $17,100), there will be
no effect on the estimated unappropriated, undesignated General fund Balance at
September 30, 1998 because the amount is offset from increased revenue already
received from the State of California.
