Flynn, City Clerk SUBJECT: Designate the Huntington Beach Independent as the Primary Newspaper for Publication of the City's Legal Notices �� EmeEssue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: The city's legal advertising needs include publishing legal notices for the City Council and other agencies, authorities, boards, and commissions of the city. It is necessary for the City Council to designate a newspaper for publication of such notices. Fundinq Source: Each department budgets annually for the cost of legal notices that are the responsibility of their department. Recommended Action: MOTION: Approve Resolution No.aW�-S\ `A Resolution of the City Council of the City of Huntington Beach Designating Certain Newspapers for the Publishing of Legal Notices of the City." 1. Designating the Huntington Beach Independent as the primary newspaper for legal notices of the City pursuant to City Charter Sections 500 and 503, and 2. Approving continuance of the current practice of placing legal notices in the Orange County Register (daily publication) if there is insufficient time to place the notice in the Huntington Beach Independent provided the initiating department indicates there is an urgent need to do so and with authorization from the Office of the City Administrator. Alternative Action(s): Select the Huntington Beach Wave as the primary newspaper for legal notices of the city pursuant to City Charter Sections 500 and 503. KEQUEST FOR COUNCIL ACTION MEETING DATE: July 6, 2004 DEPARTMENT ID NUMBER: CK-2004-7 Analysis: Pursuant to the City Charter, Sections 500 and 503, legal notices of the City must be published in a daily, semiweekly or weekly newspaper published in the County or the City and circulated in the City, which is selected by the City Council for that purpose. There are two weekly newspapers that meet this requirement, the Huntington Beach Independent and the Huntington Beach Wave. Of these, the Huntington Beach Independent has a publication date and a deadline schedule for publication that best meets the needs of the city. The deadline for publication is 4:30 PM on the Monday immediately prior to the Thursday publication of the newspaper. The Huntington Beach Wave's deadline is 12:00 PM on the Wednesday of the week prior to their Thursday publication. Both of these newspapers are adjudicated newspapers. The Huntington Beach Independent is more widely circulated and a subscription is not required to receive the newspaper. During the last 18 years, the Huntington Beach Independent has consistently provided the city with excellent and dependable service. The City Clerk is, therefore, recommending that the City Council designate the Huntington Beach Independent as its primary newspaper for all city legal notices pursuant to City Charter Sections 500 and 503.
