HomeMy WebLinkAboutCity Council Item - 4-21-14 - City Council Places Ballot Ini e Tc��s, ---- ` CITY OF HUNTINGTON BEACH City Council Interoffice Communication To: Honorable Mayor and City Council Members From: Dave Sullivan, City Council Member ] Date: April 14, 2014 Subject: City Council Member Item for the April 21, 2014, City Council Meeting— Pertaining to a City Council-Placed Ballot Initiative to Repeal the Plastic Bag Ban STATEMENT OF ISSUE: My observation, and that of many others, indicates that the Plastic Bag Ban Ordinance is extremely disliked and disapproved of by a significant majority of Huntington Beach citizens. In the majority view, any benefits are significantly outweighed by the many problems the ordinance creates. For example, studies indicate that only a tiny minority wash the suggested reusable bags thus creating a significant risk to health. There is a loss of revenue to the city because many disgruntled HB citizens shop at markets in adjacent cities. Many business owners complain about the impact on their business. The biggest complaint is that people reused the plastic bags for numerous things such as garbage, lining receptacles, picking up dog droppings, etc. Now those multi-reuse plastic bags are not available because of this short-sighted ordinance. The voters of HB should make the decision on such a significant change, not just four members of the City Council. RECOMMENDED ACTION: 1. Approve the placement of a ballot measure which repeals Chapter 5.95 USE OF PLASTIC CARRYOUT BAGS AND RECYCLABLE PAPER of the Huntington Beach Municipal Code on the November 4, 2014, General Municipal Election ballot to be submitted to'the qualified electors of the City of Huntington Beach. 2. Direct the City Attorney to bring back at the May 5 City Council meeting a resolution that includes all the necessary materials and language to place a measure on the November 4, 2014, General Municipal Election ballot which repeals Chapter 5.95 USE OF PLASTIC CARRYOUT BAGS AND RECYCLABLE PAPER of the Huntington Beach Municipal Code. 3. Direct the City Attorney to prepare the ballot initiative and impartial analysis. 4. Direct the City Attorney to return to Council at the May 5 meeting with a resolution for setting priorities for filing a written argument for the above-mentioned ballot measure. As an organization that frequently hosts cleanup events at Huntington State Beach, Coastkeeper has a unique perspective on the plastic bag issue and appreciates the opportunity to comment on the City of Huntington Beach's bag ban.We hope that the City Council will take our comments into consideration and oppose placing a repeal measure on the November ballot. In March 2013, the City Council voted to approve the Reusable Bag Ordinance, found at Chapter 5.95 of the Huntington Beach Municipal Code. The Reusable Bag Ordinance took effect on November 1, 2013. After the ordinance took effect,a group of City residents began collecting signatures for a measure on the November 2014 ballot that would repeal the bag ban. In order to put the measure on the ballot, the group must collect the signature of 10,940 registered voters. This effort has fallen well short of gathering the required number of signatures.With the apparent failure of this grass roots effort City Councilmember Sullivan,who was one of the dissenting voters when the ordinance was adopted,has now decided to sponsor a City Council proposal to put the repeal measure on the ballot. He states that reusable bags pose health risks because people do not wash them before reusing them,Huntington Beach residents do not like reusable bags, and it hurts the affected stores'business. Coastkeeper has seen no evidence that there is widespread opposition to the bag ban in Huntington Beach or that the opposition is significant enough to hurt businesses. Further, Coastkeeper feels that the health risks of reusable bags are minimal and avoidable. The studies that Councilmember Sullivan is citing are likely the ones conducted in Toronto,Canada and by Loma Linda University and University of Arizona,which showed that reusable bags tested positive for E. coli, salmonella and coliform bacteria. The accuracy of these studies have been questioned. They were funded by the plastics industry and are thus likely biased. Further,most strains of E. coli are harmless, according to Dr. Susan Fernyak, director of San Francisco's Communicable Disease and April 17, 2014 Page 2 of 2 Control Prevention division.' The average,healthy person would not get sick from most strains of E. coli, and the studies do not state which strains of E. coli were found in the tested reusable bags. Even if the health concerns are valid,it is not difficult to overcome the minimal health risks that those studies found reusable bags may pose. The California Department of Public Health released a publication'with health tips to ensure the safe use of reusable bags, such as: frequently washing and drying the bags,washing the countertop where the bags were placed while unbagging groceries, using plastic produce bags, carrying the bags at checkout instead of placing them on the conveyor, and placing meat,poultry and fish in separate bags from produce. These are simple,common-sense suggestions that should not be difficult for residents to follow. Coastkeeper hosts monthly beach cleanups on the second Saturday of each month at Huntington State Beach. Hundreds of volunteers attend each of beach cleanups. In March 2014, 250 volunteers picked up 285 pounds of trash,and in April 150 volunteers picked up136 pounds of trash. Plastic products make up the majority of trash picked up from Huntington State Beach. The consistent high turnout at our beach cleanup events demonstrates that Huntington Beach residents have seen that plastics pose a huge threat to marine life and impair their enjoyment of the beaches. It also demonstrates that residents feel passionate about keeping the beach clean. Because marine animals eat plastic bags and plastic products and become sick or die,plastics impair water quality,and plastic litter makes Huntington Beach aesthetically unappealing, Coastkeeper supports government incentives to reduce the use of plastic bags. Coastkeeper feels that,while plastic bag bans do not completely solve the plastic problem,requiring businesses to offer reusable bags and to stop carrying plastic bags helps raise awareness and helps to reduce the environmental impacts of plastic by reducing the use of plastic bags. Coastkeeper strongly urges the City Council to consider the issues that we have identified in this letter and oppose a ballot measure to repeal the bag ban. We believe that the current bag ban is beneficial, that the health risks posed by reusable bags are minimal and avoidable,and that Huntington Beach residents support the ban. I am writing in support of Councilmember Sullivan's submitted agenda item to place a ballot initiative on November 4, 1024 ballot to repeal the plastic Bag Ban. As a resident and business owner in Huntington Beach, I have not seen an issue that has polarized so many in our community.This ordinance has affected practically every citizen in the City along with almost every visitor to our city. I feel an issue with such a large impact on the community should be voted on by the citizens of the community.Though I agree that the pollution caused by the bags needs to be addressed, I believe in educating the public, not impeding choice and imposing fees and taxes to change behavior.
