CITY COUNCIL MEMBER ITEM FOR THE MAY 18, 2015, CITY COUNCIL MEETING - RESCIND PREVIOUS CITY COUNCIL ACTIONS ON NICHOLS/WARNER SITE STATEMENT OF ISSUE: On November 4, 2013, the City Council approved several legislative items related to the property generally located south of Warner Avenue and east of Nichols Street (the "Nichols/Warner Site"), which had been acquired previously by Rainbow ES. These legislative items of November 4, 2013, modified and designated the Residential Medium Density to Industrial Zoning. Since that date, Rainbow ES, the owner of the Nichols/Warner Site, was acquired by Republic. Republic/Rainbow has recently requested that zoning designation for this Nichols/Warner Site be reverted back to its pre -November 4, 2013, "Residential Medium Density" designation, thereby repealing the November 4, 2013 actions by the City. RECOMMENDED ACTION: Direct the City Manager to initiate General Plan and Zoning Map Amendments to remove the current General Plan and Zoning designations on the Nichols/Warner Site, and change the "Industrial' designations back (repeal) to "Residential Medium Density." cc: Fred Wilson, City Manager Ken Domer, Assistant City Manager Joan Flynn, City Clerk Michael E. We do not foresee any need for the property based on our revised business plans and projections. Therefore, we would like to request the City rescind the commercial/'industrial rezoning of our property so that it will revert back to medium density residential. We appreciate your cooperation in this matter. Cc.
