HomeMy WebLinkAboutConsideration to form Charter Amendment Committee - SPECIAL As each applicant is interviewed each Council Member will be scoring their responses. At the
end of the interview the Council Member may tally their scores for their own personal
information and analysis.
After all of the 24 applicants have been interviewed, the Council Members will be asked to
select their top eight applicants by checking the box to the right of the applicant's name. No
order of preference needed.
Staff will tally the votes received for each applicant. If there are eight clearly receiving a majority
of the straw votes the voting will end. (e.g. eight had 4 or more votes each). If there are fewer
than eight, those who have a clear majority of the votes will be considered as selected for formal
appointment at the Council Meeting of July 6. Those with no votes will be eliminated. The
Council will then be asked to select candidates commensurate with the number of seats that are
remaining. (e.g. six received majority votes) Those selections must be from among those who
received two or more votes in the first round.
If a sufficient number of candidates receive a clear majority of the straw votes to fill the
remaining seats the voting will end. If a third round is required, again candidates with only one
or no votes in the second round will be eliminated and the Council Members will be asked to
select candidates commensurate with the number of seats that remain from among those that
received two or more votes in the second round. This process will continue until eight
candidates remain, plus two alternates.

The method of scoring is up to the individual Council Member. It might be easiest to
score each question on a scale of 1-10 or 1-5. At the end of the interviews, we will be
taking straw votes, and you will be asked to select your top eight candidates from
among those interviewed.

Charter reform is incredibly important and will color everything the city does for the next few decades. We have much
to learn from other CA charter cities, and we also have opportunities to lead with innovations of our own. I would be

Fossil Fuel Technologies, and Nuclear power plants. Direct involvement with the both UWUA and IBE, Union
interactions that range from actual steward to handling company representation on labor relations to first hand
involvement with Collective Bargaining Agreement negotiations for both IBEW and UWUA. Mobilization Lead for
SCE's Peaker projects in which the team established goals, conducted benchmarking throughout the Western US,

Why Do You Wish to Serve on a Volunteer Citizen's Body?
My father moved to HB in 1943. Attended the Country Day School when it was a public school, as well as the original
Oceanview Elementary School. Both Mother and Father graduated from HBHS. My wife and I both grew up in HB and
graduated from MHS. My 2 boys attended school at Moffett, Sowers and Edison HS, and my wife's 2 children
attended Smith, Dwyer, and HBHS Growing up, working, and owning homes in North HB, South HB, Downtown, and
now Central HB, I believe I have a good down-to-earth grasp on what the city has gone through, areas in need of
improvement, and areas to continue to support. I have some ideas that I believe will better the community, but also
understand this is my first venture into local city government. I believe my heart and desire is to continue to better the
community for those of us that live here now and for those that will live her in the future. I also believe I have a wider
perspective of all activities within the community, through my experience as a youth sports volunteer, charitable
activities, and my work experience.

Civic Interests
Local government, both city and county, are the cornerstone of our democratic system. From these entities, and the
various bodies that comprise them, rises both the structure and the ideological vision that supports and maintains our
economic, social, and material well being. The people, themselves, must be the seed that brings forth more fair and
more responsible government. Now that I have some of the wisdom and a lot of the humility that comes with age, I
offer my city whatever benefit those qualities can generate.

In the face of the advancing years, I find that the incessant shrillness of my youthful idealism has mellowed into a

anything, I think that listening to and comprehending the ideas and input of others would be the most important quality
I could bring to this body.

It was not until I was reviewing the actions of the City Charter Review Committee, did I
realize the timeline of expected meetings (from your email on 5/12) anticipating the meetings
to start in July or August (it appears the timing of the formation of the committee has slip
by a few weeks). But I will be having knee replacement surgery the first week of August, so
I think I would not be able to be an active participant (if selected) for all of August. or
possibly longer.
Therefore, please accept my withdrawal for consideration to the committee.
As well, if you could pass on my appreciation to the Mayor and the City Council, it would be
greatly appreciated.

Subject: Council Request e Charter Amendment Committee
With the advent of the city's 100 anniversary, it seems an appropriate time to consider
undertaking a formal review of the City Charter. The City Charter was originally adopted in
1937. There have been two minor amendments in the last 24 years: The addition of Measure
C (Section 612) in 1992 and Infrastructure Funding (Section 617) in 2002.
For discussion purposes below I have outlined just a few of the potential amendments that
might be considered. City Council, staff and the community as a whole of course may have
other worthy considerations to add to the mix:
Section 600: provides old fiscal year (July 1-June 30)which has been subsequently
changed by ordinance
Section 609: prohibits imposition of real estate transfer tax, which most cities utilize as
a positive generator of revenue that only takes place upon transfer of property and
therefore does not impose an annual burden upon any business or person's budget.
Section 612: this is the "Measure C" section, which ought to at least be amended to
exclude public infrastructure items like water pumps or sewer lift stations, and park or
beach related amenities like parking lots, bathrooms, pedestrian walkways and/or
required storage facilities etc. Further, the $100,000 cost limit, should be increased to
say $250,000 with an added annual increase indexed to the CPI. I would recommend
sitting down with the original authors of Measure C to establish what updates they
could support.
Section 614: Twenty-five thousand dollar limit was probably adopted by last Charter
revision in 1966 and should be similarly increased.
Staff has sought information from other cities that have recently undergone a charter review.
The approach varies, but most often there is a reviewing body made up of citizens who are
assisted through the process by a facilitator.
Based on these models, it is suggested that the Charter Amendment Committee be made up of
eleven (11) members, one each appointed by the seven City Council members, one appointed
by the Chamber of Commerce, and three appointed at-large by an application and interview
process.

In the responses received, both Burbank and Culver City noted that they had utilizied the
services of a professor from Cal State Fullerton, Dr. Raphe Sonenshein, to facilitate the
process. Culver City said they, "will honestly attest that we could not have completed this task
without the expertise and leadership of Dr. Sonenshein."
With these thoughts in mind, I would like to make the following recommendation:
1. That staff prepare a presentation of aforementioned Charter Amendment Process for the
City Council to consider at a Study Session. The recommendation for consideration
being to consider establishing a Charter Amendment Committee to make
recommendations to the City Council to be placed on the ballot in November of 2010.
Please note that the committee makes recommendations to the City Council on what
proposed amendments might be put on the ballot, but then the City Council ultimately
decides which amendments actually will be on the ballot, with the Huntington Beach
voters ultimately deciding which amendments are adopted if any.
I cannot support this formation of a Charter Amendment Committee at
the present time because I believe that it is an unnecessary expenditure of
resources during a time of crises in government.
Last week the LA Times and OC Register reported that this State will
have a projected budget deficit of$41.813illion by 2010. Note that this is
almost half of the revenue ($86billion) the State expects generate in the next
fiscal year. Note also that last September the projected deficit was one
billion dollars, last month that had ballooned to $27.8 billion. Who can say
that the $41.8 billion of last week is the final figure covering the State
Budget for July 1, 2008 to June 30, 2010. These estimates are from the
Department of Finances, Legislative Analyst's Office.
Can anyone doubt that the State will have Counties, School Districts
and Cities share their pain, rather than take a knife to their bloated budgets?
OC is laying off 210 Staff members in Social Services and asked 4200
Social Service employees to take up to 80 hours unpaid leave before June
3 0, 2009. They are also considering additional layoff in other departments
after disclosing the County is forecasting $84 million budget gap. Is more to
follow?
As for the City of HB all indications are that we are sailing into a
"perfect storm" in the coming year, comparable to a Category 5 Hurricane.
This is the time for the Mayor and Council to provide leadership as we
outline contingency programs. Should we have a hiring freeze? Should we
propose early retirement incentives? Where can we introduce cost savings?
Our City Administrator has already asked every Department to reduce their
budgets. If we work together I have no doubt that we will emerge from this
storm event. But we cannot divert our attention from this formidable task by
proposing such frivolous activities as this Charter Amendment at the
expense of Staff s time while cutting their budgets. I am voting
emphatically NO, and question why anyone would support it. Furthermore,
I recommend a Study Session to discuss contingency plans for a time of
possible economic downturn.

the minutes of this Council meeting.
