"Reusable bag" means a bag that can be used 125 times or more. Alternate motion made to table until the advocates return with an educational plan and funding streams. Throughout oceans of the world, plastic bags are the primary source of plastic pollution according to a 2009 publication by the United Nations Environmental Program. Plastic bags not only have a negative aesthetic impact in our ocean and on our beaches, these bags kill wildlife. As plastic bags degrade and break into smaller and smaller pieces, animals such as sea turtles and sea birds mistakenly consume them. Consumption of plastic can block the digestive system and cause animals to starve. Other local governments such as the County of Los Angeles, the City of Long Beach, (a copy of the ordinance from the City of Long Beach is provided as an example), the City of Calabasas, and the City of Manhattan Beach have enacted ordinances to reduce the use of single use plastic bags. On July 14 of this year, the California Supreme Court upheld the right of cities to pass ordinances to restrict the use of these bags. We realize for some in our community the purchase of reusable bags to replace the plastic bags might be a hardship. The Surfrider Foundation has committed to hosting monthly reusable bag give-a-ways. Rainbow Disposal has agreed to donate reusable bags for distribution from the Rogers Senior Center, Oakview Community Center, and other locations in the city. Our recommend action would not ban the use of plastic bags used for the collection of dog waste such as those distributed at dog beach. RECOMMENDED ACTION: Request that city staff develop an ordinance to require stores located in the City of Huntington Beach replace single use plastic shopping bags with reusable bags. "Reusable bag" means a bag that can be used 125 times or more. "Customer" means any person or persons, purchasing goods 19 from a store. 20 B. "Farmer's Market" has the meaning provided in Subsection 21 3.80.180.G of the Long Beach Municipal Code, 22 C. "Operator" means the person in control of, or having the 23 responsibility for, the operation of a store, which may include, but is not 24 limited to, the owner of the store. 25 D. "Person" means any natural person, firm, corporation, 26 partnership, or other organization or group however organized. 27 E. Plastic carryout bag includes compostable and biodegradable bags 3 but does not include reusable bags, produce bags or product bags. 4 F. "Postconsumer recycled material" means a material that 5 would otherwise be destined for solid waste disposal, having completed its 6 intended end use and product life cycle. Postconsumer recycled material 7 does not include materials and by-products generated from, and commonly 8 reused within, an original manufacturing and fabrication process. 9 G. "Produce bag" or "product bag" means any bag without 10 handles used exclusively to carry produce, meats, or other food items to the �o 11 point of sale inside a store or to prevent such food items from coming into Z o C 12 direct contact with other purchased items. "Recyclable" means material that can be sorted, cleansed, a coCO oo Q 14 and reconstituted using available recycling collection programs for the j WZmv _ M 0 15 purpose of using the altered form in the manufacture of a new product. "Recyclable paper carryout bag" means a paper bag that 19 meets all of the following requirements: (1) contains no old growth fiber; (2) 20 is one hundred percent (100%) recyclable overall and contains a minimum 21 of forty percent (40%) postconsumer recycled material; (3) is capable of 22 composting, consistent with the timeline and specifications of the American 23 society of Testing and Materials (ASTM) Standard D6400; (4) is accepted 24 for recycling in curbside programs in the City; (5) has printed on the bag the 25 name of the manufacturer, the location where the bag was manufactured, 26 and the percentage of postconsumer recycled material used; and (6) 27 displays the word "Recyclable" in a highly visible manner on the outside of 28 the bag, 2 ARB:bg A10-02640(3/3/11) L:\Ap ps\CtyLaw32\W PDocs\D009\P 013\00231307.DOC I J. "Reusable bag" means a bag with handles that is specifically 2 designed and manufactured for multiple reuse and meets all of the following 3 requirements: (1) has a minimum lifetime of one hundred twenty-five (125) 4 uses, which for purposes of this Section, means the capability of carrying a 5 minimum of twenty-two (22) pounds one hundred twenty-five (125) times 6 over a distance of at least one hundred seventy-five (175) feet; (2) has a i 7 minimum volume of fifteen (15) liters; (3) is machine washable or is made 8 from a material that can be cleaned or disinfected; (4) does not contain 9 lead, cadmium, or any other heavy metal in toxic amounts, as defined by 10 applicable state and federal standards and regulations for packaging or 11 reusable bags; (5) has printed on the bag, or on a tag that is permanently T p w U 12 affixed to the bag, the name of the manufacturer, the location where the o ¢ �`° do 13 bag was manufactured, a statement that the bag does not contain lead, �o oo Q 14 cadmium, or any other heavy metal in toxic amounts, and the percentage of WZM z 15 postconsumer recycled material used, if any; and (6) if made of plastic, is a owoo W L I : 16 minimum of at least 2.25 mils thick, it m 9J o°M 17 K. "Store" means any of the following retail establishments 18 located within the City of Long Beach: 19 1. A full-line, self-service retail store with gross annual 20 sales of two million dollars ($2,000,000), or more, that sells a line of dry 21 grocery, canned goods, or nonfood items and some perishable items; 22 2. A store of at least ten thousand (10,000) square feet of 23 retail space that generates sales or use tax pursuant to the Bradley-Burns 24 Uniform Local Sales and Use Tax Law (Part 1.5 (commencing with Section 25 7200) of Division 2 of the Business and Professions Code) and that has a 26 pharmacy licensed pursuant to Chapter 9 (commencing with Section 4000) 27 of Division 2 of the Business and Professions Code; or 28 3. No store shall provide to any customer a plastic carryout bag. 8 B. This prohibition applies to bags provided for the purpose of 9 carrying away goods from the point of sale and does not apply to produce 10 bags or product bags. 11 C. LL owom C a 16 All stores shall provide or make available to a customer only U- CO o 0 M 17 recyclable paper carryout bags or reusable bags for the purpose of carrying i 18 away goods or other materials from the point of sale, subject to the terms of 19 this Chapter. Nothing in this Chapter prohibits customers from using bags 20 of any type that they bring to the store themselves or from carrying away 21 goods that are not place in a bag, in lieu of using bags provided by the 22 store. 23 24 8,62.040 Regulation of recyclable paper carryout bags. 25 A. Any store that provides a recyclable paper carryout bag to a 26 customer must charge the customer ten cents ($0.10) for each bag 27 provided, except as otherwise provided in this Chapter. 28 B. All stores must indicate on the customer receipt the number of 4 recyclable paper carryout bags provided and the total amount charged for i i 5 the bags. 6 D. All monies collected by a store under this Chapter will be 7 retained by the store and may be used only for the following purposes: 8 1. Costs associated with complying with the requirements 9 of this Chapter; 10 2. Actual costs of providing recyclable paper carryout 11 bags; or T� Z 0 12 3. All stores shall keep complete and accurate records or WQmU 1, r 5 15 documents, for a minimum period of three years from the date of sale, of OWOm W a Z 16 the total number of recyclable paper carryout bags provided, the total U_ J o M 17 amount of monies collected for providing recyclable paper carryout bags, 18 which record shall be available for inspection at no cost to the City during 19 regular business hours by any City employee authorized to enforce this 20 Section, Unless an alternative location or method of review is mutually 21 agreed upon, the records or documents shall be available at the store's 22 address. A responsible agent or officer of the store shall confirm that the 23 information provided is accurate and complete. 24 F. The provision of false information, including incomplete 25 records or documents, to the City shall be a violation of this Section, and 26 such store shall be subject to the fines set forth in Section 8,62.080. 27 28 8.62,050 Use of reusable bags. 5 ARB:bg Al0.02640(3/3111) L:\Apps\CtyLaw32\W P Docs\D 0og\P 013\00231307.D OC 1 A. All stores must provide reusable bags to customers, either for 2 sale or at no charge. 3 B. Each store is strongly encouraged to educate its staff to 4 promote reusable bags and to post signs encouraging customers to use 5 reusable bags. 6 C. Each store is strongly encouraged to provide to the City and to the 7 public a summary of any efforts a store has undertaken to promote the use of 8 reusable bags by customers. 9 10 8.62,060 Exempt customers. ao 11 All stores must provide at the point of sale, free of charge, either a) o w E - 12 reusable bags or recyclable paper carryout bags or both, at the store's oQ � `° 0 13 option, to any customer participating either in the California Special a ,U oUJZm< 14 Supplemental Food Program for Women, Infants, and Children pursuant to U 15. Article 2 (commencing with Section 123275) of Chapter 1 of Part 2 of LL owom W V m 16 Division 106 of the Health and Safety Code or in the Supplemental Food w J LL CO o ° CO 17 Program pursuant to Chapter 10 (commencing with Section 15500) of Part 3 18 of Division 9 of the Welfare and Institutions Code. 19 20 8.62.070 Operative date. 21 This Chapter shall become operative on August 1, 2011, for stores 22 defined in Subsections K.1. and K.2. of Section 8.62.010. For stores 23 defined in Subsection K.3. of Section 8.62.010, this Chapter shall become 24 operative on January 1, 2012. The City Manager has primary responsibility for enforcement 3 of this Chapter. The City Manager or designee is authorized to promulgate 4 regulations and to take any and all other actions reasonable and necessary 5 to enforce this Chapter, including, but not limited to, investigating violations, 6 issuing fines and entering the premises of any store during business hours. 7 If the City Manager or designee determines that a violation of this Chapter 8 has occurred, he/she will issue a written warning notice to the operator of a 9 store that a violation has occurred and the potential penalties that will apply 10 for future violations. 11 B. Any store that violates or fails to comply with any of the T" z o 12 requirements of this Chapter after a written warning notice has been issued 0 c `0 13 for that violation shall be guilty of an infraction. o°CD Q 14 C. If a store has subsequent violations of this Chapter that are = Q : 0 0 15 similar in kind to the violation addressed in a written warning notice, the 0Wom uJ � v m 16 following penalties will be imposed and shall be payable by the operator of UJ U- CO ? -- o 17 the store: M 18 1. A fine not exceeding one hundred dollars ($100) for the 19 first violation after the written warning notice is given; 20 2. A fine not exceeding two hundred dollars ($200) for the 21 second violation after the written warning notice is given; or 22 3. A fine not exceeding five hundred dollars ($500) for the 23 third and any subsequent violations after the written warning notice is given. 24 D. A fine shall be imposed for each day a violation occurs or is 25 allowed to continue. 26 E. Any store operator who receives a written warning notice or 2 fine may request an administrative review of the accuracy of the 3 determination or the propriety of any fine issued, by filing a written notice of 4 appeal with the City Manager no later than thirty (30) days after receipt of a 5 written warning notice or fine, as applicable. The notice of appeal must.. 6 include all facts supporting the appeal and any statements and evidence, 7 including copies of all written documentation and a list of any witnesses that 8 the appellant wishes to be considered in connection with the appeal. The 9 appeal will be heard by a hearing officer designated by the City Manager. i 10 The hearing officer will conduct a hearing concerning the appeal within 11 forty-five (45) days from the date that the notice of appeal is filed, or on a w 12 later date if agreed upon by the appellant and the City, and will give the oo ZB :F�'0 0QZ a g3 a o 13 appellant ten (10) days prior written notice of the date of the hearing. The _ �CD co o2 Q 14 hearing officer may sustain, rescind, or modify the written warning notice or W Z m U f_� M v 15 fine, as applicable, by written decision. The hearing officer will have the owom W -V; m 16 power to waive any portion of the fine in a manner consistent with the U CO W � ° o M 17 decision. The decision of the hearing officer is final and effective on the 18 date of service of the written decision, is not subject to further administrative 19 review, and constitutes the final administrative decision. 20 21 8.62.090 Severability. 22 If any section, subsection, sentence, clause, or phrase of this 23 ordinance is for any reason held to be invalid by a decision of any court of 24 competent jurisdiction, that decision will not affect the validity of the 25 remaining portions of the ordinance. 26 27 8,62.100 No conflict with federal or state law. 28 Nothing in this ordinance is intended to create any requirement, 8 ARB:bg A10-02640(514/11) L:\Apps\C tyLaw32\W P Oocs\D009\P013\00231307.DOC 1 power or duty that is in conflict with any federal or state law. 2 3 Section 2. The facts surrounding plastic versus paper or recycle bags in terms of the amorphous "carbon footprint" is clear. Plastic bags are far less damaging across their entire lifetime compared to the other two options. This is much like the silly debate of years gone by where electricity guzzling hot air hand dryers were required to replace paper towels when the full energy use across the life of the drying event demonstrated lower power consumption for paper towels. Please do not pass this FEEL GOOD ordinance, it is "feel good law..........that does not feel so good." This is not the time for more government mandates, more government intervention in.our lives, more government regulations inhibiting responsible personal choice, more government telling everyone what they must do or must not do, more government turning something voluntary into something mandatory. And all without a vote of the people. This proposal will,hurt jobs, not help jobs; will hurt our economy, not help our economy. Our national unemployment rate is at 9.1%, and our credit rating has been reduced to AA+ from Triple A, for the first time in history. Alternatives to plastic grocery bags.require more energy to manufacture, produce more greenhouse gas emissions, and create more waste than plastic bags. And there is the legal issue of whether the City can effectively mandate that people buy "reusable bags" (defined in the proposal as those that can be used 125 times or more). Can the City Council impose these individual mandates on its citizens and on its visitors, often foreseeably from other states —which invites an examination of the "commerce clause" of the United States Constitution? Council members Boardman, Dwyer and Shaw make the bold assertion, "Plastic bags not only have a negative aesthetic impact in our ocean and on our beaches, these bags kill wildlife. As plastic bags degrade and break into smaller and smaller pieces, animals such as sea turtles and sea birds mistakenly consume them. Consumption of plastic can block the digestive system and cause animals to starve." However, they cite no scientific study to support those assertions. They cite no scientific study that indicates how many sea turtles and sea birds, if any, who ingest plastic bags suffer from a 1 blocked digestive system or starve . . . only the bold, unsubstantiated assertion do they offer. Where is the evidence that plastic bags "degrade and break into smaller and smaller pieces"? How many sea turtles and sea birds have, in fact, starved from consuming small pieces of plastic bags in Huntington Beach (or in Orange County) each year? Where is the backup? Where is the proof? Where is the evidence? These Council members-,also cit&,,as.``Iocal" governments that have enacted similar plastic-grocery- bag bans, the County of Los �neles,,,Calabasas and Manhattan Beach. None are "local," and none are here in Orange County.` Interestingly, these Council members,aiso apparently feel that plastic bags distributed at "doggy beach" would not "degrade and break into smaller and smaller pieces" and thus could not cause "animals to starve," since those plastic-.bags would be exempt from the operation of the otherwise universally applied ordinance. The clear effect of the proposal is to "mandate" that all residents and visitors to Huntington Beach (who I believed we court to visit our city and spend money) be required to buy a "reusable bag" (much like "ObamaCare" where citizens are required to buy health insurance). Would a bag that can only be reused 120 times violate the ordinance? Ninety times? Sixty times? Twenty times? A brown paper bag? Who certifies the re-usability index level of such bags? Who decides on who is authorized to certify the re-usability index level of such bags? How often should these "125-reuses" certifications be required? Who should review such periodic re-certifications of the re-usability index level? When word gets out of this new Huntington Beach regulation, will the number of shoppers here decline? Taxes and bans simply don't work. Banning recyclable plastic bags will not solve the litter problem or reduce the amount of waste in our ocean, sewers, landfills or on our beaches. Litter must be addressed directly by targeting behavior and increasing access to recycling bins and waste receptacles. Make more recycling bins available throughout the community, and I posit that far fewer plastic bags will find their way into our Pacific Ocean. According to the American Chemistry Council, the few communities that have chosen to tax or ban the use of plastic grocery bags found that their efforts to help the environment actually had the opposite effect. ® After a 2002 tax on grocery bags in Ireland, consumers actually use 10 percent more plastic bags than they did in Ireland's pre-tax days. ® San Francisco's ban on plastic grocery bags caused shoppers to switch to paper bags, which require 70 percent more energy to manufacture, produce 50 percent more greenhouse gas emissions and create five times more waste than plastic bags. ® Before-and-after litter audits in the City of San Francisco found that litter had not.decreased, which was one of the stated purposes of the city's ban. ® A Qualitative Study of Grocery Bags in San Francisco was conducted by the editor of the Use Less Stuff Report following the city's bag ban and found that the replacement of plastic with paper bags and the return of double-bagging may actually increase the environmental impact. 2 Promoting the recycling of plastic baps, rather than taxes or bans, is the best way to decrease litter and conserve valuable resources and energy. Fortunately, the vast majority of communities that have considered measures to address bag waste have opted for programs to increase recycling of this valuable material. Our three Council members fail to mention this fact. Banning recyclable plastic bags will not reduce society's dependence on oil, either. In the United States, plastic bags are made primarily (80%) from domestic natural gas, and when recycled, that material is made available for new products. Banning recyclable plastic bags or mandating their replacement with compostable bags will diminish efforts to recycle these products. Banning plastic bags, and mandating that our citizens purchase "reusable bags," is a lose-lose situation. In logic, I urge you not to go forward with the proposal. Gino J. This will hurt the young and elderly unfairly because they have weaker immune systems. It will increase Doctor visits, hospital visits and possibly cause deaths. Preventing the use of plastic bags will cost jobs putting people out of work and into poverty in this no jobs economic era. It will force the poorest among us to spend more when shopping to buy bags and may force them to have less to eat. It will not reduce plastic usage as the reusable bags will be composed of vinyl. The reusable bags when thrown away will take much longer to deteriorate because to be reused it must last longer so it will be a heavier gauge vinyl. It will cost markets money to retrain their own employees who will then spend time working with the public forcing a rise in prices to cover the costs. I grew up with paper bags and they are weaken, tear and items fall out especially when cold items release moisture and items are heavy requiring double bagging so doubling the cost. Forcing a fee for paper bags will hurt the poor and elderly most even having them run out of money for food to pay for bags over time. It may also have unintended consequence. People instead of driving to the Wal-Mart in Huntington Beach which will not have plastic bags will drive to Beach&the 22 Freeway Wal-Mart where plastic bags are available. They will go to the Home Depot in Costa Mesa or Santa Ana instead of Huntington Beach for the same reason. The same goes for super markets. These actions will reduce sales and taxes in Huntington Beach. I would suggest you not put this into effect or spend money to research further. Hi, I saw this posting in the Orange County Register and strongly agree with its sentiments. I've added some comments to clarify. The plastic bag ban proposed for Huntington Beach may have the best intentions but it's incredibly short-sighted. First, it's very anti-tourist. Since the city spends so much on drawing tourists to the area, why would it make it more difficult to carry your purchases? If I'm on vacation, I can't also fit reusable bags in my suitcase. I would just stop in Costa Mesa or Fountain Valley to make my purchases easier. Thinking Huntington Beach is so special that tourists would tolerate the extra inconvenience is naive. Perhaps if the law was adopted county-wide, that might make a difference. Second, this law does nothing to stop tourists from bringing plastic bags into the area. If tourists create much of the trash on the beaches, this law does little to resolve it. Third, it appears this law is very pro-Costco, but anti-mom and pop stores. With the new Costco opening up near Bella Terra and their use of boxes instead of plastic bags, they would be one of the very few businesses not to be affected by the law. Most other businesses do not have the economies-of-scale to offer boxes instead. In a slow economy, this additional law (with very little benefit) would be the death knell for mom and pop businesses. Finally, it will kill Surf City Nights along Main Street. My family likes to go out on Tuesday nights to one of the restaurants along Main Street. Afterwards we visit the Farmer's Market and usually buy 10 bags of fruit and vegetables. I'll be darned if I'm hauling 10 recyclable bags into a restaurant. One of the two would have to go. By way of background, the American Chemistry Council (ACC) is a national trade association of manufacturing companies, including those domestic producers of fully recyclable retail plastic bags. ACC members support efforts to reduce bag litter and disposal and it is for that reason we have been working to promote and enhance the recycling of not only plastic bags but other plastic packaging as well. ACC is in full agreement with the intent of this discussion but feel an outright prohibition on these recyclable products is unnecessary. In many cases, suggestions to ban recyclable plastic bags often overlook important, yet unintended environmental impacts. Furthermore, these ordinances have the potential to impact consumers economically, especially for those employees who work at bag manufacturing facilities in California. As you and your colleagues discuss this issue, ACC respectfully requests that you consider several policy issues and potential alternative approaches. A common misconception is that plastic bags are not recyclable. California law requires all large grocery stores and pharmacies to provide a recycling bin for plastic bags. These bins provide a local consumer infrastructure that can capture not only recyclable plastic grocery bags but newspaper, dry cleaning, toiletry, and other bags and film as well (e.g., product wraps for cases of soda, paper towels, etc.). Nationally, plastic bag and film recovery has increased by 31 percent since 2005. This recovery growth is more than nine times greater than the 3.4 percent increase in recovery of all municipal solid waste from 2005 to 2009 according to EPA data. Recovery of postconsumer film (which includes plastic bags and product wraps)grew to an estimated 854,377,000 pounds in 2009. In many communities around the country, ACC has worked in partnership with retailers, public agencies and other stakeholders to promote the recycling of plastic bags and wraps. The City of Huntington Beach is under no imminent or future threat of citizen safety and health from the use of plastic bags. You are opening the City up to un-necessary lawsuits, and this City is already reeling from the effects of the Public employee giveaways to which the City Council has succumbed. If you truly believe that plastic bags are a danger to Americans, animals and the environment, then why be hypocritical? You will eventually have to ban the following; Pens, which you throw away when used. If you are going to ban everything that may now, or in the future be bad for us or the environment will you plan to; Dictate to restaurants what they will serve for meals? Tell Huntington Beach stores what they may sell? Regulate all beach, park, public space, and city services to fit the narrow vision of a handful of people on the City Council? Please reject these socialistic trends in our society. Your proposed ban on plastic bags is unreasonable. The closed stores and businesses, the financial strain with which you have burdened the citizens, and the crumbling infrastructure should be of paramount concern and not all this enviro-hysteria. I'm a student at Huntington Beach High School. This year at school i learned about the awful side effects of the use of plastic bags. First off it takes non renewable fossil fuels, petroleum and natural gas, to create plastic. It is harmful to ecosystems in obtaining these two non-renewable energy sources and in manufacturing plastic because it puts toxic chemicals into the atmosphere. Next, it takes 1,000 years for plastic to break down. Therefore it puts toxic chemicals into our water sources which later on leads to contamination. Meantime, more than 100,000 marine animals die each year from chocking on plastic. We are Huntington Beach. The only city I know that holds annual Duckathons, gives Kelly Slater a key to our city, holds the U.S. Open of Surfing every year that draws crowds in the tens of thousands. We are Surf City. Since our city revolves around the health of our beaches, it is our duty as citizens to keep our ecosystems clean and uncontaminated. Banning plastic bags is vital to preserving our city and the health of the many people that come to visit us each year. Gordon Brown announced last month that he would force supermarkets to charge for the bags, saying that they were "one of the most visible symbols of environmental waste". Retailers and some pressure groups, including the Campaign to Protect Rural England, threw their support behind him. But scientists, politicians and marine experts attacked the Government for joining a "bandwagon" based on poor science. Lord Taverne, the chairman of Sense about Science, said: "The Government is irresponsible to jump on a bandwagon that has no base in scientific evidence. This is one of many examples where you get bad science leading to bad decisions which are counter-productive. Attacking plastic bags makes people feel good but it doesn't achieve anything." Campaigners say that plastic bags pollute coastlines and waterways, killing or injuring birds and livestock on land and, in the oceans, destroying vast numbers of seabirds, seals, turtles and whales. However, The Times has established that there is no scientific evidence to show that the bags pose any direct threat to marine mammals. They "don't figure" in the majority of cases where animals die from marine debris, said David Laist, the author of a seminal 1997 study on the subject. Most deaths were caused when creatures became i caught up in waste produce. "Plastic bags don't figure in entanglement," he said. "The main culprits are fishing gear, ropes, lines and strapping bands. Most mammals are too big to get caught up in a plastic bag." He added: "The impact of bags on whales, dolphins, porpoises and seals ranges from nil for most species to very minor for perhaps a few species. For birds, plastic bags are not a problem either." The central claim of campaigners is that the bags kill more than 100,000 marine mammals and one million seabirds every year. However, this figure is based on a misinterpretation of a 1987 Canadian study in Newfoundland, which found that, between 1981 and 1984, more than 100,000 marine mammals, including birds, were killed by discarded nets. The Canadian study did not mention plastic bags. Fifteen years later in 2002, when the Australian Government commissioned a report into the effects of plastic bags, its authors misquoted the Newfoundland study, mistakenly attributing the deaths to "plastic bags". The figure was latched on to by conservationists as proof that the bags were killers. For four years the "typo" remained uncorrected. It was only in 2006 that the authors altered the report, replacing "plastic bags" with "plastic debris". But they admitted: "The actual numbers of animals killed annually by plastic bag litter is nearly impossible to determine." In a postscript to the correction they admitted that the original Canadian study had referred to fishing tackle, not plastic debris, as the threat to the marine environment. Regardless, the erroneous claim has become the keystone of a widening campaign to demonise plastic bags. David Santillo, a marine biologist at Greenpeace, told The Times that bad science was undermining the Government's case for banning the bags. "It's very unlikely that many animals are killed by plastic bags," he said. "The evidence shows just the opposite. We are not going to solve the problem of waste by focusing on plastic bags. "It doesn't do the Government's case any favours if you've got statements being made that aren't supported by the scientific literature that's out there. With larger mammals it's fishing gear that's the big problem. On a global basis plastic bags aren't an issue. It would be great if statements like these weren't made." Geoffrey Cox, a Tory member of the Commons Environment Select Committee, said: "I don't like plastic bags and I certainly support restricting their use, but plainly it's extremely important that before we take any steps we should rely on accurate information. It is bizarre that any campaign should be endorsed on the basis of a mistranslation. Gordon Brown should get his facts right." A 1968 study of albatross carcasses found that 90 per cent contained some form of plastic but only two birds had ingested part of a plastic bag. Professor Geoff Boxshall, a marine biologist at the Natural History Museum, said: "I've never seen a bird killed by a plastic bag. Other forms of plastic in the ocean are much more damaging. The statistics are there and they are staggering! Our wildlife consumes way more plastic than we I'm sure anybody ever though possible when we starting using plastic to make everything from water bottles to car parts. It really is a no-brainer for a city like "Surf City". Our ocean defines us here in HB and it certainly is represented by our name. Everyone who runs for City Council says they believe in clean water, clean beaches and a high quality of life for the residents of HB. Cutting the wasteful plastic bags will bring us closer to each of those goals. Paper bags can be a viable alternative to plastic and do not create near the harm of the plastic in the ocean. I was discussing this issue with a friend the other day and reminded her that it has been less in my lifetime that stores transitioned from paper to plastic. In the days of paper bags, the clerks would take an extra moment or two to carefully pack the bags and make sure that I walked out with as few bags as possible. Today at many stores I get plastic bags packed with only a few items and end up with lots of extra bags. In 2008 Whole Foods ditched plastic bags. They seem to be doing just fine business without them. In 2009 they updated their paper bags to the highest level of environmental sensitivity (http://wholefoodsmarket.com/pressroom/blog/2009/04/20/whole-foods-market@-paper-baps-at-checkouts-receive- forest-stewardship-council-fsc-certifications. All this to say... it can be done. It just takes a forward looking group of people to recognize that this is about right and wrong and not about politics or ideology. The reasons for such a ban are legitimate, and by and large I support a plastic bag ban. However, I wish to express to you my strenuous objection to surcharging consumers for the use of biodegradable paper bags. These do not create a pollution problem or a wildlife problem as the plastic bags do, and to mandate the idea of effectively taxing the consumer for the use of these bags is horribly offensive, and to disguise such a charge as a necessary part of a plastic bag ban is misleading and inappropriate. I strongly encourage you to REFUSE to mandate charging the consumers of Huntington Beach for paper bags. As a Huntington Beach resident I would like to voice my opposition to such an ordinance. I grocery shop often and do not always have reusable bags in my car. There have been several studies that show that after a few usages reusable bags become full of dangerous bacteria from uncooked meets etc. This bacteria can then go onto other foods that are placed in those bags. Also, most people reuse plastic bags. We use ours to pick up after our dog. Those of us who chose not to use reusable bags will be punished by being charged for plastic bags. Why don't we allow people to have a choice in such a simple issue? Honestly, do you lay awake at night thinking of ways to make life more difficult for your constituents? Besides, pollution resulting on our beaches is not only from HB; some of it is effluent from cities far north to us. Could you tell me the proper method of opposing this and encouraging others to do so, beyond writing letters and e- mails? Most people in HB are unaware of this potential bag tax/ban; at the very least it would be more fair to vote on it at a later date and let the public choose, rather than certain other council members making a decision affecting nearly 200,00 people when more likely it's the 16,000,000 beach visitors who are vastly contributing to this pollution.
