Statement of Issue:
On a regular basis the City of Huntington Beach receives correspondence from the
California League of Cities, and others, regarding pending legislation which comes before
the County, State and Federal levels of government which have an impact upon local
governments. The city is requested to write letters of support or opposition and
communicate its position to those legislative committees who are considering the legislative
proposals. This city action is important because it allows County, State and Federal elected
officials to hear directly from their local elected City Council regarding pending legislation. It
also provides the needed support to those individuals who represent local government
interest in Sacramento and Washington D.C. In order to insure the city responds in a timely
manner on issue that would have an effect upon local government it is necessary to have
the city council set policy that staff can follow to insure the city's voice is heard at the
County, State, and Federal levels of government.

Analysis:
During the course of the State and Federal Legislative sessions a number of issue are
presented that have a direct impact upon local governments including the city of Huntington
Beach. In order for our local representatives at the County, State and Federal levels to be
informed about proposed legislation that effects the city it is important for the City Council to
communicate these impacts to those legislators.
To help staff monitor the legislative proposals at County, State and Federal levels it is
necessary for the City Council to adopt a legislative policy that enables the city, through the
Mayor's Office, to quickly and effectively respond to pending legislation.

CITY COUNCIL METHOD OF COMMUNICATING WITH OTHER
LEGISLATIVE BODIES REGARDING PENDING LEGISLATION
The following is the City Council Policy regarding the manner in which the City will
communicate its positions on legislative matters pending before other legislative bodies.
(e.g. County Board of Supervisors, State and Federal Governments, etc.).
1. The City Clerk shall include an additional heading on the City Council Agenda entitled
Legislative Matters Pending Before a Federal, State, or Local Legislative Body.
Under this heading, the City Administrator through the City Clerk would include copies
of:
a.) Correspondence the city receives in which the city is requested to take
positions on State, Federal, or local government legislative matters.
b.) Copies of the California League of Cities weekly Legislative Bulletin
requesting the city to take positions on matters pending before a governmental
legislative body. These matters will be summarized by bill number or topic on
the agenda.
c.) Requests from the City Administrator and/or City Department Heads
requesting the City Council to take a position a pending legislative matter.
Under the new agenda heading an action can be taken by the City Council, to authorize
the Mayor, on behalf of the city, to transmit a letter of support or opposition on any of the
matters listed on the agenda. With the City Council authorization, the Mayor, could then
contact appropriate State Legislators, or their staff, and communicate the"city's" position
to them.
2. It shall be the policy of the Huntington Beach City Council that all written letters or
verbal communications regarding"city" support or opposition to pending legislation, to
be communicated to another legislative body or their staff, shall be derived by formal
action of the City Council. Individual City Council members, City Administrator and City
Department Heads may communicate on city letter head, their professional concerns
regarding pending legislation, as long as their position is, (1) not contrary or in conflict
with City Council Policy and (2) does not state a"city" position without a formal action
by the City Council.

SUBJECT: A Revised Method of Communicating City Council Positions on
Legislation Pending before Other Legislative Bodies
The City of Huntington Beach is a member of the California League of Cities. This
organization provides a number of educational and training opportunities for City Council
members as well as city government professionals. The League also provides lobbying
services for California Cities on issues which come before the California State Legislature,
that have a direct affect upon cities throughout the State of California. The League staff
prepares weekly Legislative League Bulletins, which provides an analysis of those bills
which would impact the cities either positively or negatively. In the Bulletin,the League
requests cities to either support, oppose, or take a neutral position on pending bills which
are before the State Legislature. Cities are asked to write or fax letters, or to make direct
contact with members of the State Legislature who are considering the pending legislation,
and share with them the city's position on pending bills.
PAST COMMUNICATION PRACTICES
The past practice of communicating the city's positions on pending legislation to the State
Legislature has been for the Mayor to write letters to the appropriate State Legislative
Committee stating the city's position. The city's positions have been derived from the
League of Cities Legislative Bulletin, in consultation with the City Administrator and city
staff.`The practice which was followed by previous City Councils was: if the League of
California Cities indicated a position to be followed on a particular bill and the City
Administrator and Mayor were in agreement and believed that the bill served the interest
of the city,-a letter would be drafted by staff and sent by the Mayor to the appropriate
Legislative Committee,with copies of the letter distributed to each City Council member,
as well as a copies to our local State Legislative Representative and the State League of
Cities' Offices in Sacramento.

These letters are placed in the pending bills file and the staff of the various State
Committee's would note at the end of their staff reports, for the legislator who serve on
the State legislative committees, those organizations who support and those organizations
who oppose the proposed legislation.

BENEFITS OF THE REVISED METHOD OF COMMUNICATING
The city would benefit greatly by instituting a revised method for responding to requests
for positions on bills pending before other governmental bodies. Currently, the requests
which come from other agencies are usually copied and placed in individual City Council
member's mail boxes, along with large amounts of other correspondence the City Council
receives on a regular basis. In the past,the City Council has not had an organized
platform to bring up these important matters. It has been left to the Mayor, City
Administrator, and city staff to review these matters and draft letters for the Mayor's
signature. The revised method will allow the matters to be brought before the entire City
Council on a regular basis and provide a platform in which the residents, through
television and the newspapers, will be made more fully aware of the City Council efforts to
protect the interest of the city in the area of Intergovernmental Relations. Secondly, the
burden of developing the city's position is more evenly distributed among the City Council
and will provide both the Mayor and city staff a clear understanding of the City Council's
position on legislative matters which have an impact upon our city or that is pending
before another legislative body. Compliance with the Brown Act would be met.
NEGATIVE TO THE PROPOSED METHOD
The biggest negative that the revised method of communicating the city's position to other
governmental agencies poses is that it will require the City Council to spend additional
time at City Council meetings to discuss legislative issues which are before other
legislative bodies. Realizing that City Council meeting time is limited, the City Council
will need to determine how much time should be spent addressing these intergovernmental
issues.
CONCLUDING REMARKS
I believe that the revised method of communicating with other legislative bodies will
enhance both the City Council and city's position in the eyes of the public and provide the
missing platform for the residents and the press to become better informed about those
issues which are being considered that will have a direct effect upon the city and its
residents.

I recommend that the revised method of communication be seriously considered by the
City Council. The City Council can adopt the new method of communicating or modify
this proposal. In any event,there does appear to be a need to improve upon our current
practices and I believe this proposal is worth a try..

RECOMMENDED ACTION:
1. Authorizes the Mayor to send letters of support or opposition on the
following pending issues which are before the State Legislature:
AB 37 (Pringle) Support- Designates the County of Orange as the
state recognized reuse authority of the purposes of
planning the conversion of MCAS, El Toro.
AB 201 (Allen) Support- Would allocate $76,160,000 from a
Special Account for Capital Outlay to the
Department of Water Resources for allocation to the
Orange County Flood Control District.
SIB 623 (Peace) Support or Neutral -Adds to existing law a felony
wobbler so that those individuals who sell illegal
converter boxes for personal profit can be charged
with either a misdemeanor or a felony depending on
the circumstances involved.
SB 872 (O'Connell)Support- In regard to an Oil Spill requires the
administrator for oil spill response to establish a
united incident command team which includes one
local jurisdiction representative.
AND
2. Adopt Resolution No. 6686 - "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF HUNTINGTON BEACH TO INTERVENE IN THE
LITIGATION CHALLENGING MEASURE A."

(City Council) Request that Council Petition the County of Orange to Extend
Hours of Operation at their Hazardous Waste Material Station in Huntington
Beach
Communication from Councilmember Bauer requesting that Council petition the
County to extend the hours of operation of the Hazardous Waste Material
Station. Current hours of operation are Saturday 2 p.m. to 9 p.m. or 100 cars
whichever is least. The consequences of this practice is that hazardous waste is
being dumped randomly throughout the city or being dumped at Rainbow
Disposal Pickup Service.
