HomeMy WebLinkAboutRequest Staff to Repeal Municipal Code Chapter 9.60 RelatedTo: Honorable Mayor and City Council Members From: Matthew Harper, Mayor Pro Tem s* Jill Hardy, City Council Member Date: April 29, 2013 Subject: CITY COUNCIL ITEM FOR TIME MAY 6, 2013, CITY COUNCIL MEETING — REPEAL OF MUNICIPAL CODE CHAPTER 9.60 - HYPNOTISM STATEMENT OF ISSUE: It is unclear as to what circumstances led to the adoption of this ordinance in 1979, but today it appears to lack relevance to the city of Huntington Beach. RECOMMENDED ACTION: Motion to ask the City Council to repeal Chapter 9.60, Section 9.60.030 — Hypnotism -- Practice Prohibited-- of the Huntington Beach Municipal Code. xc: Fred Wilson, City Manager Bob Hall, Deputy City Manager Jennifer McGrath, City Attorney Joan Flynn, City Clerk ,pP/oc- 4 —D Item 18. - 1 Hs -508- Esparza, Patty From: Flynn, Joan Sent: Tuesday, April 30, 2013 2:07 PM To: Harper, Matthew; Hardy, Jill Cc: Fikes, Cathy; Esparza, Patty Subject: Just a heads up On your item for the next council meeting, we will be revising the recommended action slightly. It will read on the agenda, what you wrote, "Motion to ask the city Council to repeal chapter 9.60.030 — Hypnotism — Practice Prohibited — of the Huntington Beach Municipal Code" with the added language — by directing the city attorney to return with the appropriate ordinance for repeal. The motion will look like: "Motion to ask the city Council to repeal chapter 9.60.030 — Hypnotism — Practice Prohibited — of the Huntington Beach Municipal Code by directing the city attorney to return with the appropriate ordinance to effect the repeal." This will direct Jennifer to bring back the strike through ordinance for first and second reading. Would you read the complete sentence into the record when you make your motion, because Jennifer has told me the agenda language does not replace the language on the packet submitted by the originator. If ther3e is a discrepancy, the original language takes precedence. By reading the motion, it will put it into the record. Thanks.
