SUBJECT: Adopt Resolution No. 2014-68 to designate the Huntington Beach Wave (Orange
County Register) as the Primary Newspaper for Publication of the City's Legal
Notices
Statement of Issue:
The City's agreement with Los Angeles Times Communications, LLC, dba Huntington Beach
Independent, for legal advertising services has expired. Recent challenges related to billing and
publication of legal notices experienced with the Tribune Company, former parent company of the
Los Angeles Times and based in Chicago, Illinois, support consideration of designating another
locally operated, adjudicated newspaper as the primary newspaper for publication of the City's legal
notices.
Financial Impact:
Financial impacts are minimal, as each department budgets annually for the cost of legal notices it
is responsible for.
Recommended Action:
A) Adopt Resolution No. 2014-68, "A Resolution of the City Council of the City of Huntington
Beach Designating Certain newspapers for the Publishing of Legal Notices of the City;" and,
B) Approve continuance of the current practice of placing legal notices in the Orange County
Register daily publication if there is insufficient time to place the notice in the Huntington
Beach Wave provided the initiating department indicates there is an urgent need to do so
and with authorization from the Office of the City Manager.
Alternative Action(s):
Do not approve, and direct staff to draft an agreement for legal advertising services with the
Huntington Beach Independent.
Analysis:
City Charter Sections 500 and 503 direct that legal notices of the City must be published in a daily,
semi-weekly or weekly newspaper published in the County or the City and circulated in the City,
which is selected by the City Council for that purpose. In 2004 the City designated the Huntington
Beach Independent, a Los Angeles Times publication, as the primary newspaper for publication of
the City's legal notices.
In August 2014, Tribune Media Company, home to a diverse portfolio of television and digital
properties, announced a separation (spin-off) of its publishing entity, Tribune Publishing Company,

which includes the Los Angeles Times. Operational changes occurring prior to and following the
spin-off of Tribune Publishing Company have caused the City to experience billing problems and
missed deadlines for legal publications in the Huntington Beach Independent.
A Request for Quotation for legal advertising services was advertised by the City in late May. Two
newspapers, the Huntington Beach Independent and Huntington Beach Wave, responded (see
attached). The quotes were competitively priced, with slightly reduced rates offered by the
Huntington Beach Wave, an Orange County Register publication. Billing and publication operations
for legal advertising in the Huntington Beach Wave are similar to the Huntington Beach
Independent, and legal advertising offices are located in Santa Ana, California.
The Orange County Register currently publishes 25 community papers within the County of
Orange. The Huntington Beach Wave was adjudicated in 1998, and is circulated to 16,122 paid
subscribers annually. In addition, approximately 3,800 complimentary copies of the community
paper are distributed via racks on Thursdays to over 90 locations accessed by the public within the
City and portions of Fountain Valley and Sunset Beach.
The Los Angeles Times currently publishes three community papers within the County of Orange.
The Huntington Beach Independent was adjudicated in 1994 and reports a circulation figure of
15,356. In addition, 7,700 complimentary copies are distributed on Thursdays to racks at
approximately 121 locations throughout the City and portions of Fountain Valley and Sunset Beach.
The City currently allows departments to seek permission from the City Manager to place a legal
advertisement in the Orange County Register when time is insufficient to meet the weekly
community newspaper's publication deadline. If the City designates the Huntington Beach Wave as
its newspaper for publishing legal notices, staff will be able to conduct business and receive billing
from only one vendor.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH DESIGNATING CERTAIN
NEWSPAPERS FOR THE PUBLISHING OF
LEGAL NOTICES OF THE CITY
WHEREAS, pursuant to Section 503 of the City Charter, legal,notices of the City must
be published in a daily, semiweekly or weekly newspaper published in the County or the City,
and circulated in the City which is selected by the City Council for that purpose,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. That the Huntington Beach Wave, a community newspaper published weekly by
the Orange County Register, is hereby designated as the primary newspaper for legal notices of
the City pursuant to City Charter Sections 500 and 503.
2. That the City Council approves continuance of the current practice of placing
legal notices in the Orange County Register(daily publication) if there is insufficient time to
place the notice in the Huntington Beach Wave, providing the initiating department indicates
there is an urgent need to do so and with authorization from the Office of the City Manager.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 6th day of October , 2014.
