Statement of Issue:
Transmitted for your consideration is the 9/11 Memorial Plaza Landscape Plan. City
Council referred the 9/11 Memorial Plaza landscape, plan to the Design Review Board
(DRB) for review prior to taking final action on the landscape plan. Staff recommends the
City Council approve the 9/11 Memorial Plaza Landscape Plan.

A. PROJECT PROPOSAL:

The 9/11 Memorial Plaza Landscape Plan (Design Review No. 12-010) represents a
request for the approval of the landscape plan for the 9/11 Memorial Plaza located at the
upper level of the Civic Center. The memorial plaza landscape plan incorporates the
approved 9/11 memorial sculpture, the Anjo lantern and Veteran's War memorial with the
proposed trees, ground cover, and seating walls.
B. BACKGROUND:
On March 18, 2013, City Council approved the location of the 9/11 Memorial sculpture at
the upper level (fountain) area of the Civic Center (Attachment No. 2) as part of its action
on the appeal of Design Review No. 12-010. At the meeting, the applicant introduced a
revised landscaping proposal creating a 9/11 Memorial Plaza. However, because neither
the DRB nor staff had the opportunity to review the proposal, City Council directed the
applicant to return to DRB for review and comment (Attachment No. 3).
City Council also directed staff to return with a cost estimate to relocate the Veteran's War
memorial to the 9/11 Memorial Plaza. The Public Works Department is still completing the
research for the relocation of the sculpture and will return to City Council in the future for
this item.
C. STAFF ANALYSIS AND RECOMMENDATION:
On November 14, 2013, the DRB considered the proposed 9/11 Memorial Plaza
Landscape Plan dated October 21, 2013, including elevations submitted on November 14,
2013, as directed by City Council. The DRB recommended approval of the landscape plan
with modifications (Attachment No. 4). There was a discussion regarding the species and
height of the proposed trees and how they will enhance or hinder the visibility of the 9/11
Memorial sculpture. Ultimately, DRB recommended that the four trees proposed at the
base of the entry staircase be replaced with low-level landscaping to retain maximum
visibility of the sculpture from a distance.
The landscaping plan provides seating for viewing the sculptures in the plaza, addresses
security, pedestrian safety, compatibility and scale in relationship of the sculptures to the
landscaping. The proposed landscape plan addresses the operational requirements of the
Civic Center, which are accessibility for the armored truck deliveries to the City Hall entry
point and daily employee cash deposits from off-site facilities to said entry point. The
proposed scale of trees and landscaping features of the walls and planting materials
complement the approved 9/11 Memorial sculpture. Code requirements address the
construction aspects of the proposed project and are included in this report as an
information item only (Attachment No.5).
Staff believes the conditions of approval and the code requirements adequately address
the construction of the 9/11 Memorial Plaza Landscape Plan within the Civic Center Plaza.
Therefore, staff recommends that City Council approve the 9/11 Memorial Plaza
Landscape Plan consistent with DRB's action.

The proposed project is categorically exempt pursuant to Sections 15301, California, Class
1, Existing Facilities, of the California Environmental Quality Act because the project
involves operation and minor alteration to an existing structure involving negligible or no
expansion of use.

SUGGESTED CONDITIONS OF APPROVAL
CONDITIONS OF APPROVAL — 9/11 MEMORIAL PLAZA LANDSCAPE PLAN
(DESIGN REVIEW NO. 12-010):
1. The 9/11 Memorial. Plan Landscape Plan received and dated October 21, 2013, shall be the
conceptually approved design with the following modifications:
a. A restricted vehicular access shall be provided from the western parking lot fronting
the Police Department Building along the west side of the Memorial Plaza and shall
be approved by both the Director of Planning and Building and Director of Public
Works.
b. The final plaza landscape plan shall incorporate the City water payment drop box and
the U.S. mailbox in a location approved by the Director of Public Works. The final
plaza plan shall also maintain access to City services subject to approval by the
Director of Public Works.
c. The applicant shall submit fully dimensioned plans that illustrate tree wells or grates,
wall heights and wall material details. The final landscape plan for the plaza design
shall be subject to approval by the Director of Planning and Building and Director of
Public Works.
d. The four trees proposed at the entrance of the stair case to the plaza shall be removed
and replaced with low-level landscaping.
e. The landscape plan shall incorporate Veteran's War Memorial flags and flag poles
with the relocation of the sculpture to the memorial plaza.
2. The applicant shall comply with all code requirements as submitted by the various
departments under separate cover.
INDEMNIFICATION AND HOLD HARMLESS CONDITION:
The owner of the property which is the subject of this project and the project applicant if
different from the property owner, and each of their heirs, successors and assigns, shall defend,
indemnify and hold harmless the City of Huntington Beach and its agents, officers, and
employees from any claim, action or proceedings, liability cost, including attorney's fees and
costs against the City or its agents, officers, or employees, to attack, set aside, void or annul any
approval of the City, including but not limited to any approval granted by the City Council,
Planning Commission, or Design Review Board concerning this project. The City shall.
promptly notify the applicant of any claim, action or proceeding and should cooperate fully in
defense thereof.

Request: Design Review No; 12-010 represents a request to review the design, colors,
and materials for the construction of a 9/11 Memorial to replace the fountain at
the Civic Center. The sculpture incorporates two small I-beam sections (approx-
imately 4 feet in length)from the World Trade Center recovered by the New York
City Fire Department. The sculpture design symbolizes the New York City Twin
Towers. The sculpture is designed to appear to have two`separate 19 foot high
towers when viewed from the front but are connected at the back of the sculpture
to accommodate a recessed waterfall feature located between the two towers. A
19 foot wide round base serves to anchor the sculpture and also serves to ac-
commodate lighting which will illuminate the sculpture.
At a public hearing held on Monday, March 18, 2013, the Huntington Beach City Council heard
and approved as amended Design Review No. 12-010 with findings and conditions of approval
(attached). The City Council requested that the landscape plan presented by the applicant dur-
ing the meeting be referred back to the Design Review Board, and directed staff to return to
Council with costs and recommendation related to moving the War Memorial to the same plaza
location.

FINDINGS AND CONDITIONS OF APPROVAL

FINDINGS FOR PROJECTS EXEMPT FROM CEQA:
The City Council finds that the project will not have any significant effect on the environment and
is Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA)
pursuant to Section 15301, Class 1—Existing Facilities, because the project involves a minor
modification to the operation of the existing development involving negligible expansion of an
existing use.
FINDINGS FOR APPROVAL— DESIGN REVIEW Nb. 12-010:
1. Design Review No. 12-010 to permit the installation of a 9/11 memorial sculpture replacing
the existing fountain. The sculpture installation at the Civic Center is designed at a height of
19 ft and a circumference of 19 ft with a water feature and illuminated base will not be detri-
mental to the general welfare of persons working or residing in the vicinity or detrimental to
the value of the property and improvements in the neighborhood and will not result in noise,
safety, or compatibility issues as the Civic Center is identified as an internal node in the
General Plan and design to accommodate visitors. The installation of the memorial will not
generate detrimental impacts onto surrounding properties as the sculpture will be placed
within the security surveillance of the Civic Center facility.
2. The installation of a 9/11 memorial at the Civic Center, which is surrounded by commercial,
public, and office uses, will be consistent with the existing land use pattern and compatible
to its surroundings. The use will be required to comply with conditions of approval regarding
installation and operation to ensure that any potential impacts to the surrounding properties
are minimized.
3. The installation. of the 9111 memorial is in conformance with the General Plan land use de-
signation of public uses. The proposed 9/11 memorial will comply with all building code in-
stallation requirements. The installation of public art benefits both the citizens and visitors to
Huntington Beach by creating a destination place to view the 9111 memorial sculpture. Ad-
ditionally, the sculpture was designed by an award winning artist.
4. The granting of the design review application for the installation of the 9111 memorial is con-
sistent with the General Plan because the General Plan Urban Design Guidelines designa-
tion for the Civic-Center identifies City Hall as one of ten Internal Nodes. A node acts as a
significant focal point and as a center of movement and activity. The proposed project to
add public art in the form of a memorial sculpture contributes to this standard and is there-
fore consistent with this designation and the goals and objectives of the City's General Plan
based on the following:

Objective 1.4: Intensify the use and strengthen the role of public art to enhance the visual
image of-Huntington Beach Civic Center by:

a. Establishing incentives for incorporating art in private development; and
b. Require that persons proficient in the visual arts be included on the design of public
entry identification,. public signage and graphics design.
Policy UD 1.4.2: Coordinate the involvement of artists and the role of art in the image of the.
City with the provisions of the Historic and Cultural Resources Element.

CONDITIONS OF APPROVAL --DESIGN REVIEW NO. 12-010:
1. The elevation received and dated July 3, 2012 shall be the conceptually approved design
with the following modifications.
a. Sculpture shall be installed to replace the existing fountain-'located at the Civic
.Center upper level.
b. Final landscape plans for the Memorial Plaza shall be reviewed by the Design
Review Board and approved,by the Director of Planning and Building prior to plan
check submittal.
c. Water feature and Light components shall be energy efficient.
2. Applicant is responsible for the maintenance of the sculpture and all utility costs unless the
applicant enters into an agreement with the City for the maintenance of the sculpture
including the utility costs prior to the issuance of building permits.
3. Bollards or barrier approved by the Design Review Board and the Director-of Planning and
Building shall be installed along the driveway frontage directly fronting the sculpture in order
to block vehicular entry and protect pedestrians viewing the sculpture.

REQUEST: Review the design, colors, and materials for the construction of a
9/11 memorial plaza at City Hall by removing the existing water
fountain fronting Main Street. The primary sculpture incorporates
two I-beam sections of the World Trade Center recovered by the
New York Fire Department. The sculpture design symbolizes the
Twin Towers and is proposed at a height of 19 feet with a 9 feet
wide base. The sculpture incorporates a water feature which will
be illuminated from the base. This item was referred by the City
Council back to DRB for further review. The project has expanded
to now incorporate an extensive memorial plaza with landscaping,
seating walls, and includes the existing War Memorial currently
located at the east civic center entrance.

The Design Review Board of the City of Huntington Beach took action on your application on
November 14, 2013, and your application was recommended for approval with modifications
to the City Council. Attached to this letter are the recommended conditions of approval of your
application.
Please be advised that the Design Review Board reviews the conceptual plan as a basic
request for entitlement and forwards any recommendations to the City Council. The conceptual
plan should not be construed as a precise plan, reflecting conformance to all Zoning and

Subdivision Ordinance requirements. Please note that there may be additional requirements
prior to the commencement of the project.

consideration and final action. You will be notified of the pending hearing date.

RECOMMENDED CONDITIONS OF APPROVAL - DESIGN REVIEW NO. 12-010:
1. The landscape plan received and dated October 21, 2013, shall be the conceptually
approved design with the following modifications:
a. A restricted vehicular access shall be provided from the'western parking lot fronting
the Police Department Building along the west side of the-Memorial Plaza and shall
be approved by both the Director of Planning and Building and Director of Public
Works.
b. The final plaza plan shall incorporate the City water payment drop box and the U.S.
mailbox in a location approved by the Director of Public Works. The final plaza plan
shall also maintain access to City services subject to approval by the Director of
Public Works.
c. The applicant shall submit fully dimensioned plans that illustrate tree wells or grates,
wall heights and wall material details. The final plaza design shall be subject to
approval by the Director of Planning and Building and Director of Public Works.
d. The four trees proposed at the entrance of the stair case to the plaza shall be
removed and replaced with low-level landscaping.
e. The Veteran's Memorial shall incorporate related flags and flag poles with the
relocation of the sculpture to the memorial plaza.
2. The applicant shall comply with all code requirements as submitted by the various
departments under separate cover.
INDEMNIFICATION AND HOLD HARMLESS CONDITION:
The owner of the property which is the subject of this project and the project applicant if different
from the property owner, and each of their heirs, successors and assigns, shall defend,
indemnify and hold harmless the City of Huntington Beach and its agents, officers, and
employees from any claim, action or proceedings, liability cost, including attorney's fees and
costs against the City or its agents, officers, or employees, to attack, set aside, void or annul
any approval of the City, including but not limited to any approval granted by the City Council,
Planning Commission, or Design Review Board concerning this project. The City shall promptly
notify the applicant of any claim, action or proceeding and should cooperate fully in defense
thereof.

PROJECT DESCRIPTION: City Council considered this project on March 27, 2013. Upon discussion, Council
referred the project as amended to include landscaping and seating to the Design Review Board. The project will
return to the City Council with costs and recommendation related to moving the War Memorial to the same plaza
location. The potential location is not depicted on this plan.As staff we will need to prose the location and provide
the related costs. I have attached the City Council NOA.

various stages of project permitting and implementation. A list of conditions of approval adopted by the Planning
Commission in conjunction with the requested entitlement(s), if any, will also be provided upon final project

➢ CODE ISSUES BASED ON PLANS &DRAWINGS SUBMITTED:
➢ Project shall comply with the current state building codes adopted by the city at the time of permit
application submittal. Currently they are 2010 California Building Code (CBC), 2010 California
Plumbing Code, 2010 California Electrical Code, 2010 California Energy Code, 2010 California
Green Building Standards Code, and the Huntington Beach Municipal Code (HBMC). Compliance
to all applicable state and local codes is required prior to issuance of building permit.
➢ Provide construction details and calculations for the monuments including the "Peace Pale," flag
pole, and other structures exceeding 42" in height.
➢ Provide compliance to disabled accessibility requirements of Chapter 11 B of the 2010 or 2013
CBC.
■ Provide details and dimensions for steps shown on plans. Handrails will be required for
these steps.
• Provide detectable warnings at blended transition between walk and Union Avenue, and
between plaza and pedestrian drop-off.

■ Show vehicular entrance and.vehicular route on plaza.
• Provide removable barriers to prevent unauthorized vehicles from driving onto the
plaza.
• Show pedestrian protection provisions that will be in place when vehicles enter the

■ Show sloped walk as an accessible route:
• Show width of walk.
• Provide running slope and cross slope of walk.
• Provide details for the handrails along the walk. If slope is greater than 1:20,
handrails will be required on both sides. Wheel guides or curbs will also be
required.
• Show slope of the accessible route to the memorial.
• Show the slopes of the plaza surrounding the memorial.
• Show the slope of the walk adjacent to the Civic Center Building.
➢ Review and provide compliance with Title 17 of the City of Huntington Beach Municipal Code,
Building and Construction. This document can be found online on the citys website.
➢ Recommendation: Please contact me or our office for a preliminary review of code analysis to
examine any possible building code issues that may arise.
➢ For projects that will include multiple licensed professions in multiple disciplines, i.e. Architect and
professional engineers for specific disciplines, a Design Professional in Responsible Charge will be
requested per the 2010 CBC, Section 107.3.4.
➢ I n addition to.all of the code requirements of the 2010 California Green Building Standards Code,
specifically provide a Construction Waste Management Plan per Sections 4.408, 5.408, and
Building Maintenance and Operation, Section 5.410. Prior to the issuance of a building permit, a
construction waste management plan will be required.
➢ COMMENTS:
➢ Planning and Building Department encourage the use of pre submittal zoning applications and
building plan check meetings.
➢ A separate electrical permit will be required for any lighting or power associated with the project.
The design professional in charge will be responsible to coordinate and submit the documents for

The following is a list of code requirements deemed applicable to the proposed project based on plans as
stated above. The items below are to meet the City of Huntington Beach's Municipal Code (HBMC),
Zoning and Subdivision Ordinance (ZSO), Department of Public Works Standard Plans (Civil,Water and
Landscaping) and the American Public Works Association (APWA) Standards Specifications for Public
Works Construction (Green Book), the Orange County Drainage Area management Plan (DAMP), and
the City Arboricultural and Landscape Standards and Specifications. The list is intended to assist the
applicant by identifying requirements which shall be satisfied during the various stages of project
permitting, implementation and construction. If you have any questions regarding these requirements,
please contact the Plan Reviewer or Project Planner.
THE FOLLOWING DEVELOPMENT REQUIREMENTS SHALL BE COMPLETED PRIOR TO
ISSUANCE OF A BUILDING PERMIT:
1. ADA compliant path of travel shall be maintained along the northwest comer of the Development
Building. (ADA)
2. An analysis of the existing plaza concrete along the new armored truck route shall be provided to
show structural support for the proposed vehicle loading.
S. The applicant's grading/erosion control plan shall abide by the provisions of AQMD's Rule 403 as
related to fugitive dust control. (AQMD Rule 403)

4. The name and.phone number of an on-site field supervisor hired by the developer shall be
submitted to the Planning and Public Works Departments. In addition, clearly visible signs shall be
posted on the perimeter of the site every 250 feet indicating who shall be contacted for information
regarding this development and any construction/grading-related concerns. This contact person
shall be available immediately to address any concerns or issues raised by adjacent property
owners during the construction activity. He/She will be responsible for ensuring compliance with
the conditions herein, specifically, grading activities, truck routes, construction hours, noise, etc.
Signs shall include the applicant's contact number, regarding grading and construction activities,
and "1-800-CUTSMOG" in the event there are concerns regarding fugitive dust and compliance with
AQMD Rule No. 403.
5. The applicant shall notify all property owners and tenants within 300 feet of the perimeter of the
property of a tentative grading schedule at least 30 days prior to such grading.
THE FOLLOWING DEVELOPMENT REQUIREMENTS SHALL BE COMPLIED WITH DURING
CONSTRUCTION:
6. An Encroachment Permit is required for all work within the City's right-of-way. (MC 12.38.0101MC
14.36.030)
7. The developer shall coordinate the development of a truck haul route with the Department of Public
Works if the import or export of material in excess of 5000 cubic yards is required. This plan shall
include the approximate number of truck trips and the proposed truck haul routes. It shall specify
the hours in which transport activities can occur and methods to mitigate construction-related
impacts to adjacent residents. These plans must be submitted for approval to the Department of
Public Works. (MC 17,05.210)
8. Water trucks will be utilized on the site and shall be available to be used throughout the day during
site grading to keep the soil damp enough to prevent dust being raised by the operations:

9. All haul trucks shall arrive at the site no earlier than 8:00 a.m. or leave the site no later than 5:00
p.m., and shall be limited to Monday through Friday only. (MC 17.05)
10. Wet down the areas that are to be graded or that is being graded, in the late morning and after work
is completed for the day. (WE-1/MC 17.05)
11. The construction disturbance area shall be kept as small as possible. (California Stormwater BMP
Handbook, Construction Erosion Control EC-1) (DAMP)
12. All haul trucks shall be covered or have water applied to the exposed surface prior to leaving the
site to prevent dust from impacting the surrounding areas. (DAMP)
13. Prior to leaving the site, all haul trucks shall be washed off on-site on a gravel surface to prevent dirt
and dust from leaving the site and impacting public streets. (DAMP)
14. Comply with appropriate sections of AQMD Rule 403, particularly to minimize fugitive dust and
noise to surrounding areas. (AQMD Rule 403)
15. Wind barriers shall be installed along the perimeter of the site. (DAMP)
16. All construction materials, wastes, grading or demolition debris and stockpiles of soils, aggregates,
soil amendments, etc. shall be properly covered, stored and secured to prevent transport into
surface or ground waters by wind, rain, tracking,tidal erosion or dispersion. (DAMP)

1. During demolition, grading, site development, and/or construction, the following shall be adhered to:

including the Noise Ordinance. All activities including truck deliveries associated with
construction, grading, remodeling, or repair shall be limited to Monday - Saturday 7:00 AM to 8:00
PM. Such activities are prohibited Sundays and Federal holidays. (HBMC 8.40.090)
2. Prior to issuance of demolition permits, the following shall be completed:
a. The applicant shall follow all procedural requirements and regulations of the South Coast Air
Quality Management District (SCAQMD) and any other local, state, or federal law regarding the
removal and disposal of any hazardous material including asbestos, lead, and PCB's. These
requirements include but are not limited to: survey, identification of removal methods,

containment measures, use and treatment of water, proper truck hauling, disposal procedures,
and proper notification to any and all involved agencies. (AQMD Rule 1403)
b. The City of Huntington Beach Building Division shall receive written verification from the South
Coast Air Quality Management District that the Notification procedures have been completed.

3. Prior to issuance of grading permits, the following shall be completed:
a. A Landscape and Irrigation Plan, prepared by a Licensed Landscape Architect shall be submitted
to the Planning and Building Department for review and approval. (HBZSO Section 232.04)
b. "Smart irrigation controllers" and/or other innovative means to reduce the quantity of runoff shall
be installed. (HBZSO Section 232.04.13)
c. Standard landscape code requirements apply. (HBZSO Chapter 232)
d. All landscape planting, irrigation and maintenance shall comply with the City Arboricultural and
Landscape Standards and Specifications. (HBZSO Section 232.04.113)
e. Landscaping plans should utilize native, drought-tolerant landscape materials where appropriate
and feasible. (HBZSO Section 232.06.A)
4. During demolition, grading, site development, and/or construction, the following shall be adhered to:
a. The provisions of the Water Efficient Landscape Requirements shall be implemented. (HBMC
14.52)
5. The project shall comply with all applicable requirements of the Municipal Code, Building & Safety
Division and Fire Department, as well as applicable local, State and Federal Fire Codes, Ordinances,

6. Construction shall be limited to Monday — Saturday 7:00 AM to 8:00 PM. Construction shall be

7. All landscaping shall be maintained in a neat and clean manner, and in conformance with the
HBZSO. Prior to removing or replacing any landscaped areas, check with the Departments of
Planning and Building, and Public Works for Code requirements. Substantial changes may require
approval by the City Council.
