Wilson, City Manager SUBJECT: Authorize City Manager to execute all documents on behalf of the Fourth of July Executive Board in furtherance of the sale of Safe and Sane Fireworks Statement of Issue: The City Council has authorized the sale of Safe and Sane Fireworks through Ordinance No. 3932 Municipal Code Chapter 5.90. In order to facilitate the contractual agreements with the fireworks vendor, non-profit groups, and the city's preferred vendor, contracts will need to be completed. This action will authorize the City Manager to sign said agreements. Financial Impact: None Recommended Action: Motion to: Authorize the City Manager to sign contracts with fireworks vendors and/or non-profit groups to sell fireworks. Alternative Action(s): Do not approve the City Manager's authority to sign agreements with the fireworks vendor(s) and non-profit groups. HB -81- Item 11. - 1 REQUEST FOR COUNCIL ACTION MEETING DATE: 2/21/2012 DEPARTMENT ID NUMBER: AD12-004 Analysis: The City Council adopted Ordinance No. 3932 adding Municipal Code Chapter 5.90 which allows the sale of Safe and Sane Fireworks in the City. The City Council named the Fourth of July Executive Board as the preferred vendor to utilize the booths to sell the fireworks. The Fourth of July Executive Board does not have the authority to sign and enter into contracts on behalf of the City since they are not a registered 501(c)3 organization. In order to sell fireworks, the Executive Board will need to enter into contract(s) with the fireworks vendor(s). In the event that the Executive Board negotiates with other non-profit groups to operate the fireworks booths to earn money for their organizations, an agreement will need to be signed with those non-profit groups. This action will allow the City Manager to sign said agreements on behalf of the Fourth of July Executive Board.
