Administration of our city business must be consistently watched and guided to ensure efficient, economic
and open operation. I will insist that Council decisions be made only at well publicized open meetings, not in
. study or executive session.
For fifteen years I have watched haphazard planning turn Huntington Beach into a poorly developed,traffic
congested city. In I Y2 years as Public Facilities Corporation Director,I've found evidence of wasteful decisions and ` ;!
poor city accounting procedures.
Appointed to a special investigative committee I participated in recommendations to improve management
methods. The important council directed,changes remain uncorrected.
My first priorities are: lowering taxes, evaluation of the Utility Tax,questioning high salaries,large reserve
funds, frills and departmental inefficiencies.
Affordable housing and needs of our youth, senior citizens and handicapped will have my immediate
attention.
I favor working effectively with private organizations and County Government to solve our cultural and social
concerns efficiently and economically.

balance to the deliberations of the City Council. He,has been the Council's bridge between the past and the
dynamic present in Huntington Beach. f

As you know, the Home Counc�l.l lira.:, am amendment; to
Section 2. . 011 .050 of L-fie Buac fi Conti.) . That
section concerns itself with campaign contribution limitations .
In my opinion, the amendments proposed by Home Council would
be superfluous to the existing section .
First, the Home Council proposes to add a definition to the
word "person. " This is unnecessary in that "person" is already
defined in Section 1 .04 . 010(e) of the Huntington Beach Municipal
Code . A comparison of the latter existing definition and the
one propased by Home Council shows them to be substantially
similar, except for the fact that the final sentence of the ;
proposed section discusses activities of the campaign committee .
It is unnecessary for the City to adopt said sentence in that
Section 82013 of the Government Code defines committees and
Sections 811100 et seq . of the Government Code describes the
organization, powers and duties of committees .
Secondly , the other subsections proposed by the Home Council
would seek to prohibit any person from concealing the true.
origin of any campaign contribution or circumventing the con-
tribution limitations . In my opinion it is unnecessary to add
these subsections because the campaign contribution limitation
is sufficient in and of itself. It is an infraction for anyone
to violate existing Section 2. 04 .050 , that is , contribute more
more $200 to any individual candidate . If it can be proved that
a person contributed more than $200 through another person, he

STATEMENT OF PROBLEM:
The ordinance limiting campaign contributions to $200 per donor does
not specifically define "person" in sufficient detail to insure that
the intent of the ordinance cannot be circumvented.
RECOMMENDATION:
After reading by title , waive further reading of Ordinance No. a 71 ,
attached.
ANALYSIS :
The recommended ordinance defines "person" to include "individual
proprietorship, firm, partnership, joint venture , syndicate , business ,
trust , company, corporation, association, committee , or any other group
of persons acting in concert . "

The City Council of the City of Huntington Beach does ordain
as follows :
SECTION 1. The Huntington Beach Municipal Code is hereby
amended by amending Section 2. 04. 050 to read as follows :
2. 04. 050 Contributions--Limitation.
(a) No person other than a candidate shall make, solicit or
accept any contribution, gift , subscription, loan, advance, de-
posit , pledge or promise of money or anything of value in aid of
the nomination or election of a candidate which will cause the
total amount contributed by such person with respect to a single
election in support of such candidate to exceed two hundred
dollars ($200) .
(b) No person shaZZ make use of another person in an at-
tempt to conceaZ the true origin of any campaign " contribution.
(c) No person shaZZ make use of another person in an at-
tempt to circumvent the campaign contribution Zimitation pro-
vided for in subsection (a) .
SECTION 2. The Huntington Beach Municipal Code is hereby
amended by adding thereto Section 2 . 04. 015 to read as follows :
2. 04. OZ5 Definition of person. For the purposes of this
chapter onZy, "person" means an individuaZ proprietorship, firm,
partnership, joint venture, syndicate, business, trust, company,
corporation, association, committee, or any other organization
or group of persons acting in concert. Provided further that
nothing contained in this chapter shaZZ prohibit a campaign com-
mittee from acting mereZy as a conduit for making, soZiciting or
accepting contributions from or to other persons.
SECTION 3. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the pas-
sage of this ordinance and cause same to be published within
