Accordingly, it is our desire to repeal Resolutions 2014-51 through 2014-54 to remove the Ballot Measure related to Huntington Beach Charter Section 803 [exemption for regulation of real property in mobile/manufactured home parks] and reaffirm Resolutions 2014-45 through 2014-48. RECOMMENDED ACTION: Approve a Resolution of the City of Huntington Beach to repeal Resolutions 2014-51 through 2014-54 to remove the Ballot Measure related to Huntington Beach Charter Section 803 [exemption for regulation of real property in mobile/manufactured home parks] and reaffirm Resolutions 2014-45 through 2014-48 calling for and consolidating the election, submitted measure related to Safe and Sane Fireworks, and set priorities. Resolution Number 2014-60 A RESOLUTION OF THE CITY OF HUNTINGTON BEACH TO REPEAL RESOLUTIONS 2014-51 THROUGH 2O14-54 TO REMOVE THE BALLOT MEASURE RELATED TO HUNTINGTON BEACH CHARTER SECTION 803 [EXEMPTION FOR REGULATION OF REAL PROPERTY IN MOBILE/MANUFACTURED HOME PARKS] AND REAFFIRM RESOLUTIONS 2014-45 THROUGH 2O14-48 CALLING FOR AND CONSOLIDATING THE ELECTION, SUBMITTED MEASURE RELATED TO SAFE AND SANE FIREWORKS AND SET PRIORITIES WHEREAS, on July 28, 2014, the City Council of the City of Huntington Beach enacted four (4) resolutions numbered 2014-51, 52, 53 and 54 that in part, called for and consolidated the election, submitted measures and set priorities for the election that will take place November 4, 2014; and The resolutions contain two (2) ballot measures with associated questions to be submitted to the voters of the City. These measures concern the amendment of City Charter Article VIII to add a Section 805 to permit the sale, possession, display, use and discharge of safe and sane fireworks; and amendment of City Charter Article VIII to amend Section 803 to provide an exemption for regulation of real property in mobile/manufactured home parks, retroactive to July 21, 2014; and Prior to the enactment of the above resolutions, City Council enacted four (4) resolutions number 2014-45, 46, 47 and 48 that added one (1) measure (in addition to associated election requirements) regarding amendment of City Charter Article VIII to add a Section 805 to permit the sale, possession, display, use and discharge of safe and sane fireworks. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. Resolutions 2014-51, 52, 53 and 54 are hereby repealed. SECTION 2. Resolutions number 2014-45, 46, 47 and 48 which adds one (1) ballot measure regarding amendment of City Charter Article VIII to add a Section 805 to permit the sale, possession, display, use and discharge of safe and sane fireworks as well as associated election requirements, are reaffirmed. SECTION 3. The owners of this park have offered long term leases to the residents of the park for the past several months and over 60%of the residents have signed the.leases. Tbese.leases limit annual rent increases to 5%to 6%. Both of the Parks as well as all of the other mobile home parks in the city offer rent assistance programs to their low-income residents. We respectfully submit that rent control is not the answer and that the o%mers of Huntington Beach mobile home parks and residents are working together on alternative solutions to address issues raised. We urge the City Council to approve the recommended action and remove the Ballot Measure related to Huntington Beach Charter.Section:803:from the November 2,014 ballot. Mobilehome homeowners in Huntington Beach need your support. They innocently purchased their homes in mobilehome communities where future rent raises were within their budgets, especially those Seniors and Veterans and others on fixed incomes. To allow any park owners to raise the rents on a piece of dirt beyond the cost to operate and a reasonable rate of return is not illegal, but is unethical. There are no protections without a Rent Stabilization Ordinance (RSO) from greedy park owners, or from the ""good" park owners selling their park to Investors who in turn raise the rents on purpose beyond the means of the low and very low income homeowners. The intent is obvious, and that is to 1 evict the homeowners and take over the homes so they can either rent or sell the home to a new homeowner with a higher income. These displaced citizens of Huntington Beach have been forced to abandon their homes and almost everything in them. Many were forced to move miles away from their medical facilities and families. Still others are on the streets or living in their cars. Huntington Beach should not have this legacy. Please have compassion for those less fortunate people. Retirement pays only a fixed amount, and there is no way to keep up with the exorbitant rent increases in some of the parks. The mobilehome homeowners are frightened. Please support them by giving them this chance. Hopefully, the citizens of Huntington Beach will also have compassion and vote to assist the mobilehome homeowners by changing the Charter, thereby paving the way for a RSO. If we do not get this passed by the Voters and a Rent Stabilization Ordinance in place, I fear we will see several of the "good" park owners becoming greedy too, and raising their rents up to this artificial "market rent being set by the more greedy park owners. Thank you for all you have done for Huntington Beach citizens. Your job is not an easy one, and we place our trust in you to do the right thing. I just learned today that the mobile home rent stabilization measure is essentially dead, and that one of the reasons it is being withdrawn is because residents should negotiate with park owners. As you must know, residents of Rancho Huntington Mobile Home Park have been trying to negotiate with Kort& Scott/Sierra Management for the past year, to no avail. I attended the last special city council meeting in July and personally witnessed Abe Vigotti state to you that rent increases in Rancho Huntington are between $50 to $149 per month. Two weeks later, my 87 year old mother received a letter signed by Vigotti that increases her rent by $199 per month. This is a 26%rent increase in one year. Her entire monthly social security income now barely covers her payments to the park for space rent and utilities. This leaves nothing for food, prescriptions not covered by insurance, supplemental medical insurance payments, home taxes, home insurance, home maintenance costs, etc. My mother invested nearly her entire retirement savings of$200,000 to buy and make necessary repairs to her home in 2004. If it sold today the home is expected to bring only about $50,000, if the owners even agree to a sale. I have been assisting my mom financially as much as I can but I am in my 50's, am about to lose my profession of 20 years to outsourcing, and two years ago I developed a severe form of autoimmune arthritis that has already required several surgeries and that- is is going to make finding another job more difficult combined with my age. I am also a renter and do not have a home that I can move my mom into. i Recently dozens of photos of my mom and dad and other relatives of mine that were taken in Huntington Beach from the 1920's-1960's were added to an online photo archive called OC Stories that is maintained by the County of Orange. There is also a photo that was added of my mom's high school friend Billie Kennedy, a 90 year old resident of Pacific Mobile Home Park. I think about my mom and Billie when I hear about the city wanting to preserve historic resources. There are people who are living historic resources with priceless historic memories who are being driven out of the city by corporate owners who do not even live here or care anything about this city. Why are people who previously supported placing this on the ballot withdrawing that support? My first confusion stemmed from an open letter in the OC Register from Mayor Harper and Councilman Carchio to you and the remaining council members denouncing the notion of making this a ballot measure. I don't know why a full page "ad" was necessary?Then the majority of the council supported the placement on the ballot. Then it became a ballot measure with no teeth and now there is a special meeting to take it off the ballot. If council members were not in agreement with placing this on the ballot for the people to decide, why did they vote in favor of placing it on the ballot in the first place? We could vote in our HOA to establish a cut-off date to pay only our current rent amount, and not pay a penny more. Or we could agree to a fair annual increase based on national cost of living figures. If we were to stand united,the park owners would have a huge challenge attempting to evict ALL of us from our tiny patch of land. Perhaps park owners could file liens against our mobile homes, but to what end ... our homes depreciate faster than automobiles. They could cut off our gas,water and electricity ... but it would be difficult to justify such draconian tactics since we would still be paying our original rent amounts. We could join together and march (or roll in our wheel chairs and scooters) en mass on city hall. Attending Council meetings has been a waste of time. What other recourse is there for us? I have firsthand knowledge of how it can cause a city to diminish with my experience in Venice Beach. As a homeowner in the city we pay high property taxes and plan to invest money to purchase another home as a rental. The rent we will charge needs to cover our costs and should not be regulated by the tenant/city or we will not continue to invest our money in homes within the city limits. 1 A friend of mine had to pay his tenants almost $30K so their family could sell a home they had owned for 40 years. The tenants had lived there about 10 years, paid less than 1,200 a month in rent, the owners never raised their rent, the home (Duplex) was located two blocks from the beach, 1500 sq ft upstairs unit and if you stood on the balcony you could see the ocean. These tenants were their cousins and the cousins went to the City of Venice who informed them of the rent control proceedings who then demanded $30K and got it. They were family and demanded money to move. What would happen if they were complete strangers? No one should be entitled to have control over a property they are renting. Again, I OPPOSE the rent control in the City of Huntington Beach. We are alarmed to hear of the sudden reversal of fortunes for mobile home residents in Huntington Beach. You see,this is not a local problem, but a problem that is occurring in multiple counties, states, the nation. Aggressive "roll-up" corporations using an "asset-stripping" type of business model have found "asymmetries" in some mobile home parks and are rapidly displacing the earlier "mom-and-pop" style business models. The traditional mom-and-pop park owners were typically better corporate citizens that balanced their decisions with concerns for the community, the city and the residents. Again this is an issue of business models and business practices - what benefits your community and city the most. If this were just about expensive beach land,that would be one thing. But the same issues are occurring everywhere, inland, and in our own park, which is owned by a large "roll-up" corporation-Kort and Scott/ Sierra. Our park is not near the beach, we are in a residential area and are yet seeing rent raises comparable to those experienced in Huntington Beach. Again, this about business models, and not particular to any areas of Huntington Beach. What models do you support? There are numerous and innovative efforts currently being made at local and state levels to bring back the resemblance of fairness to mobile home park residents that are besieged by some aggressive owners. You have the opportunity to help this effort and be among the leaders that show that good capitalism and good community business practices are supported, but not rampant capitalism that strips assets and removes exorbitant amounts revenue and living standards from the residents and the local community. I urge you to reconsider your decision and work further with residents and good corporate citizens to promote healthy business practices and work to heal the damage done to community members. Please Urge mom-and-pop park owners to disassociate themselves from the businesses that are causing them their current duress and urge those better-citizen park owners to speak out against those that sully their reputation by association. Please Urge MHET to purge its ranks of large aggressive corporate park owners and return to being an advocate for the better-citizen park owners as was their original founding charter. i The mis-focus seems to be that park owners are synonymous with mobile home parks. It's being bandied about that the park owners "make the parks" -that the park owners are "owners of the park". This is no more true than to say that a landlord that rents a studio to an artists then "makes the artist" or is the "owner of the art". The overall greatest investment in most mobile home parks is the buildings in the park - 95% of which are owned and paid for by the residents. It is typically the residents that make the vast majority of investment in parks. Too often these residents pay the taxes (via pass-throughs in their bills), too often they pay for the upkeep of the common interests (via pass-thoroughs in their bills) and additionally they must maintain their house per rules and regulations, pay insurance AND space rent for the hook-ups and land. This is a far cry from any traditional type of relationship that an apartment renter has with his landlord. We are deeply concerned that park owners are allowed to refer to themselves as landlords as if they resemble apartment owners, which they do not - because the park residents typically fund the majority of the value of the park. Because it is the residents that fund the park, and are the major investors in the park, let me leave you with some thoughts about the value of preserving this form of habitation- and it is preserved by supporting the residents and good-citizen park owners. MOBILE HOME PROUD NON-SUBSIDIZED Mobile homes are one of the few, if not the only,NON-SUBSIDIZED affordable housing solutions. That means that all mobile home residents BOUGHT their homes and are PAYING for them themselves. Some choose mobile homes for affordability reasons. Others choose mobiles homes for convenience. Many have chosen them for downsizing in retirement. What ever the reason - each and every resident is fully bearing the financial responsibility for home ownership on their own, without charitable or otherwise financial assistance. You should be proud. THE PRIMARY MEDIUM-DENSITY HOUSING Looking at the State of California's reporting requirements for cities,we see in each city's General Plan, the designation of Medium-Density Housing almost exclusively applied to mobile home parks. Without the residents investment in mobile home parks cities would see the elemination of Medium-Density Housing in cities and the split of cities into the two extremes of High-Density apartments and Low-Density traditional stick-built housing. Only two extremes cannot be good for the health of the community. Medium-Density housing allows apartment owners a chance to participate in the MOBILE HOMES ARE GREEN - AMONG THE GREENEST We hear in the news, almost daily, about "going green", saving energy, reducing our "footprint" on the environment. Well, mobile home owners are already there. When a mobile home is constructed, it uses less energy than a conventional home of the same size. There is efficiency in the manufacture that reduces waste and once in place on a lot,the WHOLE PARK consumes less energy than comparable stick-built homes. Mobile homes leave less of an environmental footprint. Whether you are an advocate of"green" or not. Just by living in a mobile home you have done tremendous good in energy consumption and for the environment. You are probably well ahead of most residential, detached homes. You should be proud. MOBILE HOME COMMUNITIES HAVE STANDARDS There are practically no mobile home communities that do not have rules and regulations that the residents sign when they move into the park. Enforcement of the park rules and regulations varies in parks and is a continual issue that residents bring up in all parks. But if you step back, and look at it from a distance, most parks actually have a level of appearance and safety that they do not fall below. Be glad that your park tells residents when they need to clean up, do repairs, etc. Drive around some stick-built home areas and see look for that home with the weedy lawn, chipping paint, greasy driveway - the eyesores of the neighborhood. With rules and regulations 2 and diligent park management, many mobile home parks have cleaner and fresher looking parks overall. You should be proud. ITS THE MANAGEMENT OF THE PARK THAT ALSO MAKES THE DIFFERENCE When mobile home residents begin to see that the actual park owner is falling below standards, they often begin to do something about it. Yes, park owners,themselves,too often let their standards slip - and residents don't just sit and take it! Mobile home park residents DO CARE about their community and what is happening. You should be proud. There are mobile home parks that were purchased from the owner by the residents and are now resident-owned parks (ROPs). It is a worthy goal of residents to prevent abuse by attempting to purchase their own park and take control of it themselves. Aggressive park owners have a history of refusing to sell the park to the residents. MOBILE HOME RESIDENTS WORK TOGETHER TO MAKE A BETTER COMMUNITY It was California mobile home residents,themselves, that created GSMOL (Golden State Manufactured Home Owners League) and got the BEST mobile home residency laws (MRLs) in the USA written and passed into law! However, the enforcement of those laws are too often up the the residents, requiring that they organize and advocate for themselves. But residents did organize and are working to bring more residents into the group. In two years, the number of GSMOL Chapters has gone from 5 to 35 in the three-county region of Zone C (Los Angeles, Orange, and San Bernardino counties). That's progress! Some park owners have found that residents don't understand the leases they are asked to sign. Park owners have used these lease-contracts to get out of rent control and lawsuits. They have learned they can use the lease to pass-through park maintenance costs to residents. The lease often gives them the ability to increase rent annually, often in large amounts. But mobile home residents CAN and DO organize in sophisticated ways and affect their community and local and state governments. DO NOT LOSE THESE IMPORTANT ASPECTS TO YOUR CITY. That Councilmembers Katapodis and Carchio feel that fireworks, a one-time-a-year issue, warrants being on the ballot yet they fail to see where a vote of the people is needed for the protection of the homes and well-being of so many Huntington residents affected by this mobilehome issue, is curious and disconcerting.. Councilmembers Katapodis and Carchio(along with Harper and Sullivan), you pulled the rug out from under us. Our desiring rent stabilization for mobilehome parks is strictly a mobilehome issue. It is not a veteran, senior, or impoverished issue. All mobile homeowners will be impoverished once the corporate owners own all of the Huntington Beach mobilehome parks if no protections are put into place. Our plight does not affect regular homes, townhomes, condos, nor apartment dwellers. Those homeowners also own the land where their property sets, or they rent a specific dwelling. Presumably, you know how our situation is different from any other homeowners': The mobilehome park is one where one entity owns the home and another owns the land upon which the home sets. Mobilehomes, or manufactured homes, are not like apartments, condos, townhomes, or regular stick-and-brick homes. We have mortgages, pay our taxes, make repairs, and, in addition, pay the corporate owner of the park a hefty rent for the piece of ground under our homes. The owner is supposed to keep the park grounds and facilities in good condition. Councilmembers Katapodis and Carchio,you pulled this measure from the ballot in a year when you are not running for City Council re-election. This action conveys that you wish to slip this measure by the populace that you are supposed.to serve. Rather than empowering your constituents, you are avoiding putting real issues before them. You appear to be afraid your constituents would see the truth of this issue: Greedy corporations are being allowed to unjustly strong-arm individual citizens out of their homes. Sadly, you have ignored the plea of a large and politically active constituency who will remember your callousness in every future election. I have been a lifelong voting, conservative Republican for over 30 years. That is, I was a lifelong, voting, conservative Republican through the 2012 election. Once I began paying attention to local City Council positions and votes regarding manufactured homeowners in mobilehome parks, I was taken aback by the Republicans' stance on "property rights." I have Huntington Beach City Council August 11, 2014 Page 2 changed my party affiliation as a result of watching the Republicans on the Huntington Beach City Council. I have changed my party affiliation;due in large part because of the voting records of Matthew Harper,Joe Carchio, Don Hansen,`Devin Dwyer, and recently, due to Dave Sullivan's suspicious change in the ballot wording on this issue. During the last six or more years, as more corporate owners entice family park owners to sell their parks to negligent and gouging:corporate owners (such as Kort & Scott) for exorbitant profits (even though homeowners through their HOAs have expressed their desire to the park owners to purchase the parks where their homes set), homeowners in Huntington Beach mobilehome park owners are being picked off with these unscrupulous dealings. Shorecliffs and Pacific Mobile Home Parks are prime examples. Republicans Matthew Harper, Joe Carchio, Don Hansen, Devin'Dwyer, and now Dave Sullivan and Jim Katapodis, it is shameful that you are letting this happen in our "Compassionate" City. Your decision in this vote is hurting the people who have made an honest investment in their manufactured home. Many of them are Republicans who share what they believed to be your values. I regret having voted for you in past elections, and in the future you can rely on me to inform those you reach out to of your true "values." I will also expose your suspicious connections to your lobbying groups, MHET (Manufactured :Housing Education Trust/Vickie Talley), WMA (Western. Manufactured Housing Association/Julie Pauliej, or CAR (California Association of Realtors- Barbara Delgleize-2014 City Council Candidate). Rent stabilization is necessary for every single manufactured homeowner in the City of Huntington Beach. Maybe not all of the parks require it.now, while they are` still owned;by family units. However, every one .of`them will surely one day be purchased by unscrupulous corporate owners unless they are purchased'instead by their residents. have begun to lose faith that true "values" are behind your:actions. Then it was " we'll they are sending them out". She said Everyone is getting the $149.00. I got a phone call a week later and said my increase would be $195.00. Since we are on a limited social security income, I asked if that would matter. I was told income has nothing to do with what the increase is. This increase I am receiving is a big hardship. It just doesn't seem right that they can increase our rent by anything they want. I live in Rancho Huntington and my rent will increase by $200 November first. The first two years my rent went up by $40, Last year under Sierra Management it went up$50. This increase represents four years of usual and customary increases. There is no way I can pay a mortgage and this rent with more increases like this, I budgeted for$40-50 per year as customary. As of November it will be 50% of my net income, and a 20% raise. I face the possibility of having to sell within a year having been here only four years; when thought this was my last home. One of my neighbors who called Sierra about her$150 increase was told "We can raise your rent every 90 days" and "its going to get worse hen she complained about the amount. This is the future of all mobile home parks once they are sold to large corporations, please keep rent stabilization on the Ballot as we have had no success in trying to deal with these despicable business practices on our own as an HOA. City officials had approved the measure July 28, but since then, two council members said they talked with one of the mobile home park owners who agreed to work out leases with tenants. Councilman Jim Katapodis, who brought forward the proposal to kill the measure, thanked John Saunders, owner of Pacific Mobile Home Park and Huntington Shorecliffs Mobile Home Park, for "stepping up to the plate" and working with his residents at both parks on a five-year lease. Councilman Joe Carchio, who co-authored the resolution to pull the measure off the ballot, highlighted some components of the lease deal. He said rent increases would not exceed 4% annually for residents paying at least 40% of their income toward rent. Many residents from both parks have told council members about rent increases they have faced this year, some as high as 62% in a month. Katapodis said he believes Saunders will follow through with the agreements he has proposed to his residents. Saunders could not be reached for comment. "I have also come to realize at this point that other mobile home park owners have been 3 fair on their dealings with their resident owners, raising space rental rates [that are] acceptable to their residents, and I highly commend them for that," Katapodis said. "I think they really hammered out a good deal," Carchio said. "If Mr. [Randy] Wells, the president of the [Pacific Mobile Home Park] HOA [who] represents both of those [parks] agreed to it with Mr. Saunders, then they are working in the right direction." Carchio said rent control doesn't work, citing Detroit and Camden, N.J., as examples. While Saunders has agreed to work with residents at his two parks, council members are still concerned about the owner of Rancho Huntington Mobile Park, a senior-only park where residents fear rents may increase if they do not sign a long-term lease. Amber Monte, who represents Rancho Huntington owner Sierra Management, said 60% of the residents have signed a lease. However, resident Patricia Taylor, 76, said Rancho Huntington's homeowners association has tried to work out a better deal with management and has yet to settle on an agreement. "If we can come to some kind of a compromise as a result of having[the ballot measure pulled], it would serve a good purpose," Taylor said. The proposal by Katapodis and Carchio passed on a 4-3 vote, with Mayor Pro Tem Joe Shaw and council members Connie Boardman and Dave Sullivan dissenting. Councilwoman Jill Hardy surprised many people in the council chambers by voting in favor. She had supported stabilizing rents at mobile-home parks since Sullivan brought the issue forward at the council's July 21 meeting. However, she voted to pull the ballot measure because she was concerned about making the situation worse between residents and park owners. Hardy vowed to bring the issue back during the 2016 elections, should it be needed. "I can guarantee that if this isn't on the ballot this time and some of the bad practices that have been going on continue or become worse, that there will be a strong organization, a lot of time to prepare and a lot of money raised to do it right in 2016," Hardy said.
