Hi Jill—per our discussion last night, here is the justification (cut and paste directly from the FPPC Campaign Manual#2)
for your funds becoming surplus once you left office in 2010. Your use of them in 2012 for that election were not legal.
In order to have saved those funds,your treasurer and you must have filed a 501 for the 2012 election and also
amended your 410 to carry over the funds to the 2012 election. Please call the FPPC and find out what you need to do.
Erik Peterson had the same conditions. He chose to refund or donate the surplus funds.

use left over campaign funds for officeholder
expenses or for a future election.Campaigns

Use of Surplus Funds _
There are restrictions on how campai_gn
funds held by an elected officeholder or;
candidate may be spent once the funds
become "sur lus "'Surplus funds ma/ not;.-
bur election. See Chapter 1 for
information about using campaign funds for a
future election before they become_surplus.
Campaign funds held by an officeholders
become surplus when the officeholder leaves
the office for which the funds were raised, or
at the end of the semi-annual reporting
period following his or her defeat, whichever
occurs last. Campaign funds held by a
nonincumbent defeated candidate or a
candidate who withdraws from an election
become surplus at the end of the semiannual
reporting period following the
election. (The end of the semi-annual
reporting period is June 30 for elections held
during the first six months of the calendar
year, and December 31 for elections held
during the last six months of the calendar
year.) If a candidate or officeholder dies,
campaign funds held by the candidate or
officeholder become surplus on the earlier of
either June 30 or December 31 following his
or her death.
Surplus funds may only be spent in the
following manner:
• Payment of outstanding campaign debts
or officeholder expenses;
• Refunds to contributors;
• Donation to a bona fide charitable,
educational, civic, religious, or similar taxexempt,
non-profit organization, provided
no substantial part of the proceeds will
have a material financial effect on the
candidate, on any member of the
candidate's immediate family (spouse or
registered domestic partner and children),
or the campaign treasurer;
• Contributions to a political party or
committee, so long as the funds are not
used to make contributions in support of
or opposition to a candidate for elective
office. (The funds must be used for the
party's or committee's overhead
expenses.)
• Contributions to support or oppose any
candidate for federal office, any candidate
for elective office in a state other than
California, or any ballot measure;
Payment for professional services or
attorneys' fees for litigation which arises
out of campaign or election activities; or
• Payment for an electronic security system.

This letter serves to notify you that the October 6, 2014 deadline to file a Pre-Election Campaign Statement for the
period of July 1, 2014 through September 30, 2014 has passed.
NetFile, the City of Huntington Beach's free web-based data entry e-filing system, allows users to electronically submit
disclosure reports as mandated by the California Political Reform Act. Users are able to access the system on any
computer with internet access, 24 hour a day, 7 days a week.
Access the system by going to the NetFile User Log-In page located at https://netfile.com/Filer.
The individual who will be entering transactions into your committee's account and e-filing statements needs to create
a NetFile User by clicking the "Create a New NetFile User" link. This opens the Create a New NetFile User page.
Follow the on-screen instructions. There is a short video that explains this entire process located in the How-To Videos
section on the log-in page.
Once the individual has created their NetFile User, they must then link their NetFile User Account to the committee
account. Log in and then click the "Link Local Campaign Filer Account" link. Enter the Committee Name as found on
your FPPC Form 410. Select the Committee Type and then enter the Filer ID: and Filer
Password:

your August visit to deliver Council candidate forms for the November election, Robin
and I shared our concerns about your campaign funds being categorized by the Fair
Political Practices Commission (FPPC) as "surplus," based on FPPC guidelines and
failure to re-designate their use to the current election period. We advised you to
contact the FPPC directly for a definitive answer on this matter.
OnAugust 29 we received a copy of the 410 amendment you filed with the California
Secretary of State's Office to rename your committee. i am contacting you to confirm
that the FPPC advised you that re-designating your existing campaign funds was
allowable, and that you would not be required to open a new committee. Please advise.
