The City Council , at its regular meeting of December 6, 1982, approved
the "Charter as voted by the electorate with Certificate by Council".
Pursuant to Section 34464 of the Government Code, I am forwarding for
Charter filing, two certified copies each of the required documents.
1 . Charter revision as voted by the electorate with Certificate of
Registrar of Voters to result of the canvass of the General Election
returns.

HUNTINGTON BEACH OF CERTAIN CHARTER AMENDMENTS

We, the undersigned, Robert P. Mandic, Jr. , Mayor of the City of
Huntington Beach, County of Orange, State of California, and Alicia M.
Wentworth, City Clerk of the City of Huntington Beach, do hereby certify
and declare as follows:
That the City of Huntington Beach, a municipal corporation of the
County of Orange, State of California, now is and at all times herein
mentioned was, a city having a population of more than fifty thousand
(50,000) inhabitants, and has been, since October 24, 1963, and is now
organized and acting under a Charter adopted under and by virtue of
Section 8, Article XI of the Constitution of the State of California,
which Charter was duly ratified by a majority of the qualified electors
of such City at a special election held for that purpose on the 6th day
of June, 1966.
That in accordance with the provisions of Article XI of the
Constitution and Title 4, Division 2, Chapter 3 of the Government Code
of the State of California on its own motion the Council of the City of
Huntington Beach, being the legislative body therof, duly and regularly
submitted to the qualified electors of said City of Huntington Beach
certain proposals for the amendment of the Charter of said City, to be
voted upon by said qualified electors at a Special Municipal Election
held as provided for by law, in said City on the 2nd day of November,
1982, which said proposals were designated as Proposed Charter Amend-
ments Measure "L" .

That said proposed amendments were published and advertised in
accordance with Title 4, Division 2, Chapter 3 of the Government.Code
of the State of California, on the 12th and 19th day of August, 1978,
in the "Huntington Beach -Ind-e'pendent:', .a bi-weekly newspaper of general
circulation published, printed and circulated in said City, and being
the official newspaper of said City for said purpose, and in each
edition thereof during the day of publication.
That said proposed charter amendments were submitted to the electors
of said City for adoption and ratification at a special municipal elec-
tion duly and regularly held in said City of Huntington Beach on the 2nd
day of November 1982, which said date was not less than forty, nor more
than sixty, days after the completion of the advertising in the above men-
tioned official paper of the proposed charter amendments aforesaid. That,
in accordance with the provisions of the Elections Code of the State of
California, the Council of the City of Huntington Beach had adopted, on
June 21, 1982, a Resolution No. 5133 wherein it requested the Board of
Supervisors of Orange County, California, to order the consolidation of
said special minicipal election with the state-wide general election
held in said county on November 2, 1982, that said consolidation had been
so ordered by said Board of Supervisors; and that said special municipal
election was so consolidated with said state-wide general election held
in said county on said date.
That at said special municipal election a majority of the qualified
electors voting upon proposed charter amendments "Measure L" voted in
favor of the amendments and adopted and ratified the same.
That we have compared the attached amendments with the original
proposals submitting the same to the electors of said City and find that
the foregoing is a full , true, correct and exact copy thereof; we further .
certify that the facts set forth in the preamble preceding such amendment
to said Charter are,

CITY ATTORNEY'S IMPARTIAL ANALYSIS OF
MEASURE TO AMEND CITY CHARTER TO CHANGE
DATE OF MUNICIPAL ELECTION TO NOVEMBER
The proposed revision of the City Charter would change the municipal
election date from April to November. ' The change would place municipal election
issues on the ballot for the statewide general election, held on the first Tuesday
after the first Monday in November in each even-numbered year.
The City Clerk projects both substantial cost savings and increased voter
turnout from consolidation with the general election. On the other hand,
municipal issues will be on the same ballot with state, federal , county and other
election choices.
Voter turnout for April and November elections for the last four years
compares as follows:

Costs of consolidating municipal elections with the November election are
20 cents per registered voter, compared with costs of approximately 54 cents
per registered voter for the April , 1982 municipal election (a .total of $52,132
for that election) .
Should the electorate vote to change the date from April to November, the
incumbents then in office will continue to serve until their successors are elected.
The amendment would also eliminate some unnecessary language from Charter
Section 300 relating to the 1966 election, when the Council was increased from
five to seven members.

Statement of Issue:
In order to file the new City Charter with the Secretary of State, require-
ments under Section 34464 of the Government Code must be met. I have
compiled and certified all required documents with the exception of Council
Certification of the Charter. The reason for the delay is that the Certif-
icate of Election by the County Registrar of Voters was not available until
November 17, 1982.
Recommended Action:
Approve attached Certificate of Ratification by Electors of the City .of
Huntington Beach of Certain Charter Amendments and authorize execution
by the Mayor and City Clerk .
Analysis:
The new City Charter will be effective upon receipt and filing of all
required documents by the Secretary of State.

TREASURER. TERMS. The elective officers of the city shall consist of a
City Council of seven members, a City Clerk, a City Treasurer and a City
Attorney, all to be elected from the city at large at the times and in the
manner provided in this Charter and who shall serve for terms of four years

The proposed revision of the City Charter would change the municipal
election date from April to November. The change would place municipal
election issues on the ballot for the statewide general election, held on the
first Tuesday after the first Monday in November in each even-numbered
year.
The City Clerk projects both substantial cost savings and increased �(
voter turnout from consolidatioNwith the general election. On the other /
hand,municipal issues will be on the same ballot with state,federal,county s
and other election choices.
Voter turnout for April and November elections for the last fou yer

The municipal election date needs to be changed to save tax money and
increase voter participation in city government.
The proposal to change the municipal election date from April to Novem-
ber in even-numbered years will consolidate municipal elections with the
statewide general election in November. Present costs of approximately 54
cents per registered voter will be reduced to 20 cents.In 1982 the municipal
election cost $52,132. The City Clerk estimates that consolidation would
have saved $19,370 in that election.
November elections also draw more voters to the polls.Voter participation
has been declining in city elections from 22% in 1976 to 12% in 1982. In
1982,only 12,510 persons voted and as few as 4,190 votes were required for
election to the City Council 1 contrast 70,570 voters cast ballots in the
most recent general election. General elections have attracted more than
66%of registered voters in the last few years.Consolidation will maintain a
democratic .government in our city and help prevent small groups with
vested interests from controlling city government. Municipal election in
November will help assure a more representative government by increas-
ing voter turnout.
To save dwindling tax revenues and encourage more voter participation in
city government,we urge you to support the charter amendment to change
the municipal election to coincide with the statewide general election in
November. Vote YES on Measure "L".

The voters must decide whether the benefits to be derived outweigh the
many negative factors which could result from changing the General Muni-
cipal Election now held in April to a consolidated election in November. -
I. Local candidates and local issues which affect the residents of Hunting-
ton Beach most directly could become obscured by the many State,
Federal, School, and special district candidates and measures appear-
ing on the same ballot.
2. In order to reach the voters,local candidates would need to solicit more
campaign funds and would be competing with the many other candi-
dates for funds and media coverage.
3. Holding the consolidated municipal election in November could throw
the non-partisan council offices into the arena of partisan politics.
4. Because of greater interest in the more visible State and Federal candi-
dates,some of the voters may be less informed on local candidates and
• issues, possibly giving the advantage to the incumbents.
5.-If the General Municipal Election were held in November,the county-
wide vote count could result in long delays of local election results since
a the State and Federal tabulations would take priority.
In conclusion,we believe that it is not in the best interests of the residents
aof Huntington Beach to move the City's election date from April to

PARA ENMENDAR LA CARTA CONSTITUCIONAL DE LA
CIUDAD DE HUNTINGTON BEACH PARA CAMBIAR LA
FECHA DE LA ELECCION MUNICIPAL DE ABRIL A
NOVIEMBRE EN AROS DE NUMERO PAR.
La fecha de .la elecci6n municipal necesita ser cambiada
para economizar dinero de impuestos y aumentar la participaci6n
de los votantes en el gobierno municipal .
La proposici6n para cambiar la fecha de la elecci6n muni-
cipal de abril a noviembre en anos de nGmero par consolidara'
elecciones municipales con la elecci6n general por todo el es -
tado en noviembre . Los costos presentes de aproximadamente
54 centavos por votante registrado serdn reducidos a 20 centavos .
En 1982 el costo de la elecci6n municipal fue $52 , 132 . La Secre-
taria Municipal calcula que la consolidaci6n hubiera economizado
$19,370 en esa elecci6n.
Las elecciones de noviembre tambien atraen mds votantes a
los lugares de votaci6n. La participaci6n de los votantes ha de- .
clinado en elecciones municipales del 22% en 1976 al 12% en 1982 .
En 1982 , s6lo 12 , 510 personas votaron y tan pocos como 4 ,190 votos
fueron requeridos para elecci6n al Concejo Municipal . En contraste
70 ,570 votantes votaron en la elecci6n general mds reciente . Elec-
ciones generales. han atraido ma's del 66% de votantes registrados
durante los filtimos anos . Consolidaci6n mantendra' un gobierno
dem6crata en nuestra, Ciudad y ayudard a prevenir que grupos nequehos
con intereses establecidos controlen el gobierno municipal . Elec-
ciones municipales en noviembre ayudardn a asegurar un gobierno
mds representante por medio del aumento de participaci6n de los
votantes .

Los votantes tienen que decidir si los beneficios cuales
seran derivados p-esan ma's que los muchos factores negativos
cuales pueden resultar del cambio de la eleccion municipal ge-
neral ahora conducida en abril a una eleccion consolidada en
noviembre.
1 . Candidatos y asuntos locales cuales afectan a los
residentes de Huntington Beach mas directamente
pueden obscureserce por los muchos candidatos esta-
tales ,. federales , escolares y de distritos especia-
les y las medidas apareciendo en la misma balota .
2 . Para poder alcanzar a los votantes , los candidatos
locales necesitarian solicitar mas fondos de campana
y competirian con muchos otros candidatos para fondos
y publicidad.
3 . E1 conducimiento de una eleccion municipal consolidada
en noviembre podria poner los puestos del concejo no
partidiarios en la arena de politica partidiaria .
4. A causa de ma's interes en candidatos estatales y federa-
les mas visibles , ciertos votantes pueden estar menos
informados sobre candidatos y asuntos locales , posible-
mente dandole la ventaja a los incumbentes .
5 . Si la eleccion municipal general fuera conducida en
noviembre , la computacion de votos por todo el condado
podria resultar en tardanzas largas de los resultados
de elecciones locales desde que las tabulaciones esta-
tales y federales tomarian priorid,ad.
Si el electorado vota pars cambiar la fecha de abril. a noviem-
bre, los incumbentes entonces en el puesto continuaran sirviendo
hasta que sus sucesores sean elegidos .
En conclusion, creemos, que no seraa de provecho para los re-
sidentes de Huntington Beach que cambien la fecha de la eleccion
de la ciudad de abril a noviembre . Si Ud . quiere la oportunidad
de mantenerse un votante informado y que su voto informado afecte
el liderato en Huntington Beach, vote NO sobre la Medida "L" .

The voters must decide whether the benefits to be derived outweigh
the many negative factors which could result from changing the
General Municipal Election now held in April to a consolidated
election in November.
1. Local candidates and local issues which affect the
residents of Huntington Beach most directly could become
obscured by the many State, Federal , School , and special
district candidates and measures appearing on the same
ballot.
2. In order to reach the voters, local candidates would need
to solicit more campaign funds and would be competing
with the many other candidates for funds and media coverage.
3. Holding the consolidated municipal election in November could
throw the non-partisan council offices into the arena of partisan
politics.
4. Because of greater interest in the more visible State and
Federal candidates, some of the voters may be less
informed on local candidates and issues, possibly giving
the advantage to the incumbents.
5. If the General Municipal Election were held in November, the
county-wide vote count could result in long delays of local
election results since the State and Federal tabulations would
take priority.
Should the electorate vote to change the date from April to
November, the terms of three Councilpersons, the City Treasurer
and .the City Clerk would be extended 7 months beyond their elected
4 year term.
In conclusion, we believe that it is not in the best interests of the
residents of Huntington Beach to move the City's election date from
April to November. If you want the opportunity to remain an informed
voter and have your informed vote affect the leadership in Huntington
Beach, vote NO 'on Measure "L".

The proposed revision of the city Charter would change

would place municipal election issues on the ballot for the

The City Clerk projects both substantial cost savings and
increased voter turnout from consolidation with the general
election. On the other hand, municipal issues will be on the same
ballot with state, federal, county and other election choices .
Voter turnout for April and November elections for the last
four years compares as follows :

STATEWIDE GENERAL ELECTION
NOVEMBER 2, 1982
Section 300 . CITY COUNCIL, ATTORNEY , CLERK AND TREASURER.
TERMS. The elective officers of the city shall consist of a
City Council of seven members , a City Clerk, a City Treasurer
and a City Attorney, all to be elected from the city at large at
the times and in the manner provided in this Charter and who
shall serve for terms of four years and until their respective
successors qualify.
Subject to the provisions of this Charter, the members of
the City Council in office at the time this Charter takes effect
shall continue in office until the expiration of their respec-
tive terms and until their successors are elected and quali-
fied. Four members of the City Council shall be elected at the
general municipal election held in 1966, and each fourth year
thereafter. Three members of the City Council shall be elected
at the general municipal election held in 1968 , and each fourth
year thereafter. No person shall be elected as a member of the
City Council for more than two consecutive terms and no person
who has been a member for more than two years of a term to which
some other person was elected a member shall he elected to the
City Council more than one further consecutive term.
Subject to the provisions of this Charter , the City Clerk,
City Treasurer and City Attorney in office at the time this
Charter takes effect shall continue in office until the expira-
tion of their respective terms and the qualification of their
successors. A City Clerk and City Treasurer shall be elected
at the general municipal election held in 1968 , and each fourth
year thereafter: A City Attorney shall be elected in 1966, and
each fourth year thereafter.
The term of each member of the City Council , the City Clerk,
the City Treasurer and the City Attorney shall commence on the
first Monday following his election. Ties in voting among candi-
dates for office shall be settled by the casting of lots .

NOTICE IS HEREBY GIVEN pursuant to Sections 22830 and 22835 of the Elections Code
of the State of California, that a Special Municipal Election will be held on
Tuesday, November 2, 1982, for the purpose of submitting to the voters proposed
amendments to the Charter of the City of Huntington Beach.
Said changes will move the General Municipal Election from the second Tuesday in

RECOMMENDATION:
Adopt Resolution No., 10 officially calling the election on November 2, 1982.
ANALYSIS:
The Resolution Calling the Election sets out the purpose of said election and specifies
the date. The Resolution must be adopted by August 6, 1982.

polls shall be closed, except as provided in section 14301 of
the Elections Code of the State of California.
SECTION 5• That in all particulars not recited in this
resolution, said election shall be held and conducted as provided
by law for. holding municipal elections in said city.
SECTION 6. That notice of the time and place of holding
said election is hereby given and the City Clerk is hereby au-
thorized, instructed and directed to give such further or addi-
tional notice of said election in time, form and manner as re-
quired by law.
SECTION 7. ' That the City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the book
of original resolutions of said city; and shall make a minute of
the passage and adoption thereof in the records of the proceedings
of the City Council of said city in the minutes of the meeting at
which the same is passed and adopted.

STATEMENT OF ISSUE:
It is Council 's intention to .call an election on November 2, 1982 for the purpose of
proposing an amendment to the Charter to consolidate the General Municipal Election
with the General Election in November. If an Impartial Analysis is to be prepared ,
and printed in the voter pamphlet, Council must give such direction.
RECOMMENDATION:
Direct the City Attorney's Office to prepare an Impartial Analysis for publication
in the voter pamphlet.
ANALYSIS: C
Council has requested by Resolution the Consolidation of the Charter Amendment
with the County of Orange. The Mayor has appointed Councilmen MacAllister and
Pattinson to prepare arguments.

At the Council meeting of June 7, 1982, Council directed that a ballot
measure changing a municipal election date to the date of the November
General Election be presented to the public.
RECOMMENDATION:
Adopt the attached resolution.
ANALYSIS:
The resolution requests the Board of Supervisors at the County of Orange
to consolidate a special municipal election to be held on November 2, 1982
with the state-wide General Election in order to determine whether our
municipal election should be changed to November. The resolution also
states the wording that will appear on the ballot measure.
FUNDING SOURCE:
Funds are included in the 1982/83 budget request for the City Clerk' s

Until the passage of SB 230 (Schmitz), Chapter 1013, 1981 Statutes, general law cities
were required to hold their general municipal election on the second Tuesday in April of
each even-numbered year, while charter cities have the freedom to set their own election
dates.
SB 230 permits general law cities to consolidate the general municipal election with the
State primary (June of even-numbered years), the State general election (November of
even-numbered years) or the uniform district election day (November of odd-numbered
years).
Under the provisions of SB 230, the city council if it wishes to change its election date
must adopt an ordinance which then must be approved by the board of supervisors. Within
30 days after the ordinance becomes operative, the city clerk shall mail a notice to all
registered voters informing them of the change of election date.
For a number of years, many general law cities have wished to consolidate their elections
for the primary purposes of increasing voter turnout and reducing, the costs for conducting
the election. The experience of the 18 charter cities that have consolidated their
elections does suggest that cost savings can be realized and that voter participation in the
city election is higher than before the consolidation.
Advantages and Disadvantages of Consolidation. Presented below are some of the
advantages and disadvantages of a city consolidating its election. Obviously these
advantages and disadvantages will vary in importance from city to city. It is important,
however, that the city weigh carefully these points before changing the election date.

ADVANTAGES:
1. Increase Voter Turnout. City elections can attract higher voter turnout through
consolidation. Historically, turnout for municipal elections has been below that of
the state primary election and of the state general election. By consolidating with
one of these elections, a city would gain the benefit of the higher voter turnout
attracted by these elections. Of the charter cities contacted which have
consolidated with the state primary or general election, all achieved higher voter
turnouts through consolidation. Such increases are not as apparent when elections
are consolidated with local elections in November of odd-numbered years; however,
this varies from city to city.
2. Potential Cost Savings. Cities may realize dollar savings through consolidation.
Consolidation with an election that is already taking place allows costs to be cut,
since the expense of hiring poll workers and renting polling places for a separate
municipal election can be eliminated, and such functions as printing ballots and
publishing polling places can be consolidated and performed more efficiently.
County charges to a city for its share of the expenses of a consolidated election
would therefore likely be less than city costs for a separate municipal election.
However, it is important that the city carefully compare its own cost for conducting
the election with a specific cost quotation received from the county.
3. Voter Convenience. Consolidation of elections may be more convenient to the
voter. Elimination of a separate municipal election would mean less trips that a
voter would have to take to the polls. Consolidation would also allow voters to
concentrate on all of the issues at once, rather than having to take the time to
investigate political issues on separate occasions. If voting is made more
convenient, then perhaps more citizens will go to the trouble of voting.
4. Creates a Better Connection Between Local Issues and Higher Elected Officials'
Involvement. Since under consolidation citizens would be voting on local issues at
the same time they would be voting for higher elected officials, voters might make a
better connection between the local issues and the involvement of higher officials in
those issues. This could force county, state, and federal representatives to be more
responsive to city needs.
5. Relieves City Clerks from Sometimes Burdensome Work. Consolidation would shift
some of the election work to the county, thereby relieving city clerks from part of
the sometimes burdensome administrative work involved in running an election. This
work is primarily routine, and is often a problem for clerks in small cities whose
offices are not set up to handle the flood of work involve J in the administration of
an election. It is important before adopting the ordinance to clarify which tasks the
county will undertake and which responsibilities the city clerk will retain.
6. More Appropriate Timing. Budgeting follows closely behind the April election date,
and newly elected council members may be unfamiliar with the city government to
make significant contributions to the budgeting process. With this in mind, a
November election date may be more appropriate.
DISADVANTAGES:
I. Decreases Media Coverage of City Issues. With consolidated elections, city issues
and candidates might take a back seat to other election campaign coverage in the
local media. Media coverage might tend to focus on more glamorous state and
national issues rather than city issues.
2. Decreases Availability of Campaign Resources. Consolidation might force city
candidates to compete with higher office candidates for resources, decreasing their
ability to attract campaign volunteers and money donations.
3. Decreases Familiarity With City Issues. With consolidated elections, other issues
and candidates might attract attention of the voter at the expense of city issues,
resulting in less familiarity with city issues among citizens.
4. Injects Partisan Politics. If municipal elections were consolidated with partisan
elections, it might have the effect of injecting partisan politics into municipal non-
partisan elections.
5. Interferes With City Candidates' Involvement in Higner Office Candidates'
Campaigns. With consolidated elections, city candidates might not wish to work in
or endorse campaigns of higher office candidates who were running at the same
time. This could have the effect of making such higher elected officials less
responsive to local concerns, since in some instances they would be less indebted to
city officials for their election.
6. Creates Longer Ballots. The state general election and in particular the state
primary election already require lengthy ballots. Consolidation would make these
ballots even longer. City issues council elections will be placed at the end of the
ballot, which might have a detrimental effect, and could outweigh any advantage
resulting from higher voter turnout.
Questions and Answers
The following are the most often asked questions regarding the intent and implementation
of SB 230. The League staff has reviewed these questions with the staff of the Secretary
of State's office. However, it is important that the city consult with its own city attorney
for his/her opinion regarding this legislation.
1. What are the deadlines for city council and board of supervisors action if the city
wishes to change the April 1982 election date?
It appears that board of supervisors' approval should formally begin before January
14, which is the first day the city clerk can issue nominating papers. The integrity
of the elections process must be kept in mind. The city should not begin the
elections process for the April election and then change election dates to avoid
holding the April 182 election.
The city should be mindful of the fact that if qualified initiative or referendum
measures are pending the council must take action between December 31 and
January 15. (See Elections Code Sections 4010-4011.) If such measures are pending
or if any others have been scheduled or set to be submitted to the electorate in
April, this may affect the moving of the election date and/or the holding of a special
election.
The city should determine from the board of supervisors how soon the board needs to
receive the city ordinance before taking action.

2. Why is the city ordinance effective upon approval of the board of supervisors?
Consolidation with one of the three (3) election dates m!ntioned above places an
additional burden/responsibility on county elections procedures and computer
capabilities. In some instances counties cannot physi:ally take on additional
elections, particularly during the June primary. For this r!ason it was necessary to
amend SB 230 prior to its passage to provide a procedure for counties to approve the
consolidation. Unfortunately, the legislation provides .10 guidelines for county
approval/disapproval, although the intent was that the capacity of the county's
election system be the sole criteria.
3. Is the ordinance changing the election date subject to refer!ndum?
Under both Government Code Section 36937 and Electio.is Code Section 4050 an
ordinance "relating to an election" is not subject to referendum. Therefore, it
appears that an ordinance adopted pursuant to SB 230 would not be subject to the
referendum. Also, the language in SB 230 that the ordinance is operative upon
approval of the board of supervisors suggests the action is not subject to the 30-day
referendum period.
It is interesting to note that a few cities are considerin,,; putting the question of
moving the election date on the April ballot as an advisory measure to determine
whether in fact the electorate prefers an election date ch-inge.
4. Can the City Council adopt an ordinance under SB 230 delaying the operative date,
thus not affecting the terms of the current city council?
Yes, just as with any other ordinance a delayed operative d ite can be provided for in
the ordinance. It should be remembered that a future city council (and/or board of
supervisors) could at any time between adoption of the ordinance and the operative
date change the election date (or in the case of the Board of Supervisors recind their
approval).
Again, it is important to consult your city attorney, but it appears the current city
council could change the April 1986 election date without decreasing the terms of
the existing city council as is prohibited under SB 230.
5. Can the election date by changed back to the original April date?
Yes, by simply repealing the ordinance establishing the new election date. The city
can also in the future move the election date to another time specified in the
legislation by adopting a new ordinance.
It should be noted also that if the Legislature changes the date for the statewide
primary or other statewide election date and the city general election is
consolidated with that election, the city election would also automatically be
changed to the same date unless the council repeals the ordinance.
Finally, remembering that changing the election date cannot reduce the terms of
those on the council, any change back to the April date would require extending
terms 22 to 27 months.
6. How does SB 230 apply to a city with a directly elected mayor who serves a two-
year term?
Due to a drafting error, it would appear that the provisions of SB 230 cannot be used
by a city which has a directly elected mayor with a two-year term because the term
referred to is four years. Legislation correcting this oversight will be introduced in
January.

Since we issued advisory memos on December 10 , 1979 and June 23 , 1981 ,
regarding signature verification , we have received new inquiries and
of course Chapter 589 (AB 2150) was chaptered this year . While Chap-
ter 589 is not effective until January 1 , 1982 , it is our opinion that
the statute codifies existing case law. In order to provide uniformity
among the counties in verifying signatures , we have updated the guide-
lines . This memo therefore replaces the ones dated December 10 , 1979
and June 23, 1981.
FILING PETITION SECTIONS
Clerks and registrars should accept for filing all petition sections
which conform to the provisions of the Elections Code . In making a
determination as to whether there is conformance , the clerk or regis-
trar need only review the petition section to make sure that the
tendered document contains the appropriate caption , title and summary ,
introductory language , text , signature spaces , and declaration of
circulator in the proper format . No examination of the contents of
the portions to be completed by signers and circulators is required at
this stage .
RAW COUNT
Those counties conducting a random sampling of signatures must initially
determine the "raw count" . The standard for counting a particular
signature as sufficient for purposes of the "raw count" is different
than the standard for actually verifying the sufficiency at the samp-
ling stage . Generally , all signatures on filed petition sections will
be included in the "raw count" notwithstanding irregularities which
may eventually result in their exclusion at the verification stage .
As noted below , the primary exception to this rule involves the absence
of portions of the petition section as discussed in paragraph 3 , and
signer ' s identification information that is crossed out , as discussed
in paragraph 17 .

SIGNATURE VERIFICATION
Actual verification of signatures requires the clerk or registrar to
mark as insufficient those signatures which do not conform to the
Elections Code requirements for any of several reasons . Various
reasons for marking signatures as insufficient at this stage are set
forth below.
PARTICULAR SITUATIONS
1 . Signatures appear in signers' spaces but circulator ' s affidavit
is left blank or unsigned : Include in the raw count.. Mark these
signatures "not sufficient" .
2 . No signatures appear in the signers ' space , but one or more sig-
natures appear in the completed circulator ' s affidavit : None of
these signatures are counted in the raw count , or examined during
verification.
3 . Text of measure , circulator ' s affidavit or title and summary , have
been cut off the petition section : No signatures on these petitions
shall be included in the raw count or counted as "sufficient"
during verification .
4 . Photocopies of petition sections , which are completed with original
signatures : Count signatures on these petitions when all prerequi-
site elements of the original petition have been included.
5 . Handwritten petition sections : Generally, signatures on documents
that contain all the prerequisite statutory elements for an initia-
tive petition section (proper title and summary, text of the petition ,
etc . ) should not be invalidated solely by reason of appearing on
a handwritten section . However , signatures on any page not contain-
ing complete title and summary shall be disregarded . These kinds
of sections have been found with several variations :
(a) Entire petition reproduced in handwriting : Such a
petition section will not invalidate signatures ap-
pearing on it if all statutory elements are present ,
including the correct title and summary and text .
(b) Signatures appended to a paper that is so attached
to the bottom of a regular petition section that
the petition becomes an extended or lengthened page :
In effect , this is similar to a signer placing his
signature on the front of a normal petition as the
eleventh signer on a page with printed spaces for ten
signatures . These signatures should be counted if
otherwise valid .

(c) Signatures appearing on the back of a printed peti-
tion section or on an attached additional page of a
regular petition section on loose-leaf or other
paper : Signatures on these pages should be counted
if otherwise valid where each page bearing signatures
is headed by the proper title and summary.
(d) Signatures on loose-leaf or other paper informally
identified as part of a particular initiative peti-
tion , but bearing no proper caption , official title
and summary , or text : None of these signatures
should be included in the raw count , or counted as
"sufficient" during verification .
(e) Hand-drawn petition sections fail to include one-inch
column after name of signer : Lack of column does not
invalidate petition signatures .
( f) One page of a multi-page section fails to include the
title and summary while remaining pages of the same
section are properly identified : The signatures on
the particular page in question should not be counted
in the raw count or declared "sufficient" during
verification . However , failure to include the title
and summary on one page of a section does not invali-
date other pages of the same section that are other-
wise in proper form.
6 . Petition sections in which the face of the section indicates
that the petition sections were circulated among voters of other
counties than the county where actually filed : Any such sections
that are detected prior to or during the process of filing the
petition should be returned to the filer . If such sections are
discovered after filing , count signatures on these sections in
the raw count , then declare "not sufficient" any signatures of
voters not registered in the county of filing .
7 . Petition sections labeled as being circulated in counties other
than the county of filing , but containing one or more signatures
of voters registered in the county of filing : Count these sig-
natures in the raw count, and during verification , count as
"sufficient" those signatures of voters registered in the county
of filing .
8 . Circulator ' s affidavit lists no address or only a post office
box address : Signers signatures should not be disqualified in
the raw count or verification because of the absence of the
residence address of a circulator .

9 . Circulator ' s affidavit has no date of execution and no date of
circulation : Signatures on these petition sections shall be
included in the raw count , but shall be invalidated as "not
sufficient" when considered for verification .
If either a date of circulation or date of execution , but not
both , is included in the petition section , the signers ' signa-
tures shall be counted as "sufficient" if otherwise valid .
If the circulator ' s affidavit in a petition contains space
for the beginning date of circulation and a separate space for
the ending date of circulation , and only one of the spaces is
. completed , the signatures should be counted as "sufficient" if
otherwise valid .
10 . Conflicting dates between dates supplied voluntarily by signers
and dates in circulator ' s affidavit : Ignore the signers ' dates
and rely on the date in the circulator ' s affidavit .
11 . Address of signer typed or written in by someone other than the
signer : Count these signatures as "sufficient" if otherwise
qualified.
12 . Signers ' identification information , such as name and address ,
apparently printed on the petition prior to circulation : Count
these signatures as part of the raw count , and mark them "insuffi-
cient" during examination .
13 . Signer includes a post office address without a residence address ,
or lists no address : These signatures shall be included in the
raw count , but shall be declared "insufficient" during examination .
14 . All or a portion of the address on petition is different from
address on latest voter registration affidavit : Signature should
be included in the raw count , and be marked "insufficient" during
examination except in cases where a valid registration card show-
ing the address on the petition was on file in the clerk ' s office
at any date during the circulation period of the particular
petition section that is shown on the circulator ' s affidavit .
15 . Signer includes an abbreviated name or nickname on the petition :
Count the signature as valid if the name is complete enough to
locate the voter registration card , the signatures although not
necessarily an exact match , appears to have been made by the same
person , and the voter registration card indicates the voter is
qualified .
16 . Dates of circulation in circulator ' s affidavit are either printed
as part of the petition , or they are written in handwriting

First, I would like to list the Orange County Cities who have either already
consolidated with the County or are in the process.
June Primary November General
Anaheim Newport Beach
Irvine Costa Mesa
La Palma Brea
Garden Grove
The County is discouraging consolidations with the June Primary, but not refusing
any city willing to pay the price.
Primary Election Consolidation is 35It per registered voter. In 1980, Huntington
Beach had 93,691 registered. (That would have cost $32,791 .85) a saving of
$11 ,173.16, excluding the City Clerk 's Office paper work. Presently, registration
is 93,779.
General Election Consolidation costs 20� per registered voter. With the same 1980
figures, that would constitute a saving of $18,738.20.
If Council chooses to make the change, it can 'be done by Ordinance, after the Charter
is amended to eliminate reference to the April election date.
As you can see by the attached, the manpower hours by the City Clerk 's Office are
many, excluding the paper work - Nomination Papers, Statements of Qualifications,
Conflict of Interest, etc.
The County will handle everything, including the paper work for a minimal extra charge,
but most cities prefer to maintain control of that portion of the election.
Arguments for and against, in my opinion, are as follows:
April . - FOR: (a) Ballot devoted entirely to City issues and .candidates
AGAINST: (a) Historically low voter turnout.
(b) Higher costs than June or November consolidation.
June - FOR: (a) Higher voter turnout
(b) Cost savings to the City.
(c) Using state precincts make it far more convenient to the electors .
(d) Use of County precincts workers a saving of great effort on
City Clerk 's Office.
(e) Need for DPW delivery and pickup of booths and ballot boxes
and police extra services eliminated.

(b) Delay in obtaining election results. Not critical
with new county tabulating machines.
November - FOR & AGAINST: (a) Greatest cost savings to City.
(b) Same arguments as the June Primary.

If the State Legislature reinstates the purge of voters who do not vote in the
November election, our registration figure would. be greatly reduced, thus reducing
the cost of the elections no matter who conducts the election.

Attached hereto is a preliminary analysis of various charter revision
proposals prepared principally by former local politicians, Jerry Matney,
Ron Shenkmen, Jack Green, Don Shipley and Ted Bartlett .
I would principally like to call your attention to item seven of the
Proposed Charter Revisions, inasmuch as they will directly affect future
department heads and other employees of .the city .
In addition, total projected elimination of the city attorney ' s office
will result in extensive bumping rights for all city attorney employees .
The Charter is half the length it was in 1966 . Now they are eliminating
another one half. This desire to continually shrink the City Charter,
removing from it the protections that one would expect to find in the
city ' s legal " constitutio.n" is frightening to me and it should be to you.
I would like to urge you to make your employee organization aware of this
threat to good government in the city. Council will consider Charter
Revision December 14, 1981 at 7 : 00 p .m. in the Council Chamber.

Power to tyre Council.
A chaster revisinn committee , composed exclusively ar
present and past members of the City Council , has proposed
amending the charter to vastly increase the powers of the
City Council .
The present charter contains a. system of checks and
balances in the distribution of city governiental powers.
This revision would eliminate that separation of powers
and effectively vest those powers in the City Council .
At; the same time , the proposed changes would remove
significant powers from the electorate' s control over city
government . The amendments reflect a major shift away
from democratic government.
Simply stated , the, proposals' would :
1 . Remove the .right of the people to elect their
City Treasurer.
2. Remove the right of the people to elect their
City Clerk.
3. Remove the right of the people to elect their
City Attorney.
4 . Remove the requirement that the city have a City
Attorney at all . The City Council would not he required to
have any legal review on proposed contracts , ordinances and
other decisions. The City Council would be able to act with-
out any legal input to. protect the people . No longer would
the charter establish the duties and powers of the City
Attorney.
5. I?limi.nate the requirement that the city have a
City Treasurer to protect and collect its funds.
6. Allow the City Council members to dramatically
increase their own salary and benefits. The charter now
provides a maximum of $175 per month. The changes would
allow `400 per month , plus expenses and hencrits applicable
to city employees , plus twice that; salary .for the mayor.
7. Remove department heads Cron the .civil service
system , making their appointment and removal largely poli-
tical . Although the revisions purport to delete council
power to approve appointment or removal of department heads ,
the City Administrator would Have the. appo:i_ntment and .removal
power over these key positions , and the administrator is
subject to direct council control . The effect is to make
all department heads and the City Administrator subject to
removal by four members of the City Council .

Remove provisions .from the charter empowering it
to levy taxes to pay its bonded obligations and judgments.
9. Provide for an elected mayor with a two- ,ear term ,
but preclude the people from electing any person as mayor for
more than two consecutive terms. Also , the revisions would
prohibit a person from being a candidate for both City Council
and mayor at the same election , thus precluding the electorate
from deciding whether a candidate should be mayor or a council
member.
10. If the City Attorney , City Clerk and City Treasurer
positions are retained as elective officers , the revisions would
remove the' electorate ' s right to re-elect these professional
employees for more than two consecutive terms. It would .be
difficult to attract qualified professionals to seek these
offices when their total service would be as little as six
years. There is little just:ifickion for a term limitation
on professional officials ; such a limitation shows a substan-
tial distrust of the voters. In a democratic government , the
voters should be able to decide which officials to elect to
protect the city.
The proposes] charter revisions are undemocratic in removing;
power from the voters and vesting it :in the council , and they
remarkably alter the structure of city government by destroyipq
the separation of powers that operates to check and balance the
city government . The voters should consider carefully whether
they wish to abdicate these powers and controls to a transitory
four-vote majority of subsequent City Councils.
